Kris, this little girl is fighting more life this morning. Shes in Critical Condition. Reporter she is. She has 14 different fractures in her little body including a Skull Fracture that doctors told investigators could not have happened by accident. We expect well learn more about that later today but the babys father 32yearold Matthew Zabala, was arrested at the family home in san joses burbank neighborhood. He is now here at the main jail and will appear before a judge today. The charges are related to a savage assault on the infant baby girl who arrived at Valley Medical Center by ambulance on tuesday afternoon. At that point she was already in cardiac arrest. Doctors examined her the reason became apparent. Doctors conducted xrays. They learned that there was over 14 different fractures throughout her body, including her skull. In this young 6weekold infant, shes at a point in her life, the most vulnerable point of her life. She cant even feed herself. Its a horrible crime. Reporter again, the baby is in Critical Condition at Valley Medical Center. Zabala was arrested on felony child abuse and felony Domestic Abuse charges. Nbc bay area sources say he spent time in prison after he was convicted of abusing one of his other children as well. Garlts interviewed the babys mother but have not named her so far. In san jose, kris sanchez, today in the bay. The heated debate continues after a peninsula judge is reassigned. But as critics say that is still not enough. The Santa Clara County judge who presided over the stanford Sexual Assault trial will no longer hear criminal cases. Its a voluntary move by judge aaron persky following his sixmonth sentencing of former stanford swimmer brock turner in june. Since then persky has faced global criticism by a number of recall groups who are still moving to try to oust the judge all together. They want him off government payrolls immediately. These crimes against women and sex crimes are not treated by this judge like theyre felonies. He treats them like their minor dis misdemeanors. Groups are now working to collect enough signature ur choose to get a recall measure on the ballot. The request denied. The long awaited trial of Garcia Torres will not be moved from the current venue. Yesterday a superior court judge ruled the man akilling sierra lamar can get a fair trial in Santa Clara County. The judge also ruled the attorneys can refile to move that case in the future. Se air la a lamar was 15 years old. To this day, her body has not been found. Jury selection in this case starts in september. To a story we first brought you today in the bay. Police made an arrest in connection to a shooting wednesday morning in daly city. This morning 20yearold jordan perez is behind bars accused of shooting a man near the b. A. R. T. Station. The victim remains in stable condition. So far, no motive has been revealed. This is dash cam footage taken from inside a San Francisco cab. Police say that four men were inside thatuujt when they suddenly tazed and robbed the driver. This happened earlier this month in the citys neighborhood and so far no arrests. We also reported this week that another cab driver was attacked by a passenger in San Francisco. From what San Jose Police have told us they have not yet made any arrests. Investigators are still trying to identify the suspect in this murder that took place last night at around 8 30. This is near will intersection of bonita and herald. This is a neighborhood that almost sits underneath the 280 101 flyover. Police received the 911 call that came in as possible dead body. When the officers arrived they found a man suffering from what Police Describe as visible injuries. He died soon after at the scene. It appears he was located behind a chain linked fence in a grassy area underneath the interstate. Police are still trying to figure out what led up to this killing. As you mentioned, this is the 34th om side of the year for the city of san jose. You compare that to last year. 34th. That is four more than total for 2015. This morning a father is expected to make his First Court Appearance on charges that he severely beat his infant daughter. Investigators say that 32yearold Matthew Zabala violent by beat his 6weekold daughter. Family members brought her there on sunday after the baby had suffered cardiac arrest. Doctors found 14 different fractures on her body. After interviewing the family sheriffs investigators determined that her own father was responsible. Its extremely difficult. Its horrific crime. Zabala has prior convictions for child abuse as well, even serving time in prison for those crimes. Moving on now. Robbing banks without a disguise. Actually the last week. Most recent one yesterday at a wells fargo in west san jose. Investigators say that man simply hands a note to the teller saying that hes armed and demanding cash. Hes just a plain guy walking in and it will be hard for any witnesses to recognize that bank robbery is going on. As you can tell from these series of surveillance videos, hes wearing a hat but his face is entirely uncovered. Police are asking you to call if you have any information in this case. A rash of burglaries in an upscale east bay neighborhood. Residents say Police Response is not enough so theyre trying to do something about it themselves. There have been teb breakins in livermore including four in one day and four attempted breakins. Locals we talk to say police have been responsive but they want more. Close to 200 people attended a community competing at Independence Park all concerned about home burglaries. They say they want more officers on the streets. Theres communities that are third of our size and they have more officers per capita. We want to make sure that the Police Department is staffed according to the city plan. Livermore police say they have 91 sworn officers on staff with only 2 vacancies. New this morning. Two men are in custody after police say they were found with explosives last night in fairfield. It happened when Police Stopped a suspicious car on Central Place right near the scandia family center. One of the men were a wanted felon. Uncovered burglary tools and stole listen property along with whats described as improvised explosive devices, or ieds. Explosives team was called to help dispose of those devices. Mountain view man in jail for recording people in a rest room, including a toddler. Hes facing multiple charges. The crime happened at a home on middle field road where he was renting a room. Officers say last week a woman came forward saying she received online photos of herself in the rest room. Mountain view Police Tracked him down with the help of their cyber crime unit. Not guilty plea by a man charged with beating a homeless man to death three months ago in golden gate park. 26yearold michael grass dl so was arrested on tuesday and charged with murder, torture, and conspiracy. Heres that stanford law professor weighing in. These crimes against women and sex crimes are not treated by this judge like theyre felonies. He treats them like their minor misdemeanors. Reporter the official recall effort can begin as early as april of 2017. The group will have to get 80,000 signatures from folks in Santa Clara County in order to get it on the november ballot.
