The north bay into San Francisco, san petaluma. Thats when the heavy band will move through. By 4 00 well see the band of rain. Overall its going to be one of those days you want to stay inside. Its going to be rainy and gray and really soggy. So if you have the kids, you want to take one of snow days take it easy get out there and ajoy. Theres a Flash Flood Watch for the north bay. Keep in mind. Flooded roads, creeks, and streams continue to rise throughout the day. On the bright side a chance to put on the boots and splash in puddles. My kids lo to do that. Thats true. Maybe stay off the roads. Right. More evidence let me get that straight of the power of the storms here. This mud slide closure in marin county. Its between fairfax. The road is expected to be closed until monday for repairs. Sach rated ground continues to uproot trees. This downed tree is on the marin coast. The roadblocked on highway 1 at fair valley road because a tree fell on a power line there. In the middle of the storm, the demolition of a pacifica Apartment Building is underway to keep it from crashing down a cliff side on to the beach belo below. The work should be done by wednesday. The city has been fighting the owner of the building for almost six years now. Its right next to another Apartment Building that was torn down last month. High surf and strong storms are causing the cliff underneath the building to give away. The foundation will remain as a way of stabilizing the cliff top until this summer and it will be removed. Ultimately they never found anything, but we did ventilate the structure with our own fans and watched the hvac system in the structure to bring in a lot of fresh air into the building. Police are investigating their own officerinvolved shooting on friday night after an armed man robbed a kfc. A Woman Working inside called 911 to report a man with a gun. And a lot of watching. Were inducing spawning. The subject at the center of the attention critically endangered White Alabama abalone. Its estimated there are only around 5,000 white abalone left in the ocean in southern california. So researchers here are now taking matters into their own hands. Were breeding them to make more of them so we can put them out in the wild. In a special oneday event the Lab Scientists collected all their white abalone separating the females from the male. They are called broadcast spawners. They send their eggs and sperm into water columns and they collect in tiny pillars of water. We put them in pockets with special chemicals that make them think that other animals are spawning. Reporter it artificially sets the mood. We get excited every time. Reporter even in a sterile scientific setting, each release abalone egg release ensues a cheering section. We combine the eggs and sperm to optimize for thelization. Hunters point in San Francisco is one of the largest redevelopment projects in the nation. The Investigative Unit revealed the contractor cleaning up the site admitted to mishandling radiation tests and falsifying data. A former worker explains how it happened in an exclusive interview. Over here and in here pretty much anywhere you see here it was done illegally. When Anthony Smith left Hunters Point four years ago, he carried a secret with him. A secret involving radiation, deception, and a government contractor. A hes kept until now. Are you relieved to speak out now . Yes. It still bothers me. I dont like being here. Reporter what he witnessed and what he didded into questions that the former site is clean and safe. For decades the navy ran radiation experiments on hunter point. Then the government decided to repropose the land for homes, shops, and parks. It awarded 300 million in clean up contracts to tetra tech. Smith tested soil for radio active contamination. He left his georgia home in 2002 and worked on and off at Hunters Point for a decade. At first, he took pride in his work. He said that changed in 2009. Thats when things got out of hand. Reporter when you say out of hand. What do you mean . A lot of sample being switched. Reporter he collected soil samples from areas that may have been contaminated. He said supervisors began instructing him to get rid of hundreds of those samples and replace them with soil from areas that had already been cleaned. I didnt like it. It was not. Thats not the way its supposed to be done. Reporter how serious of a problem is this . Very serious. Because the dirt and air is dirty. Reporter by dirty . Contaminated. Reporter with radiation . Yes. Reporter smith collected samples under that building. He recalls one sample tested positive for radium. An element linked to bone cancer. They made me get rid of the sample. When it comes back hot, what does it mean . It means it needs more remediation going on and they didnt do so. Reporter smith isnt the only one questioning the clean up. We learned the state Health Department to be retested in december. The state said no contamination was found. Who did the testing . Tera tech. They ought to have legal action against them. Reporter smith said it was faster and cheaper to pass the soil off as clean when it may not have been. His bosses directed him to dump contaminated soil into trenches now covered or paved. Is there any way of knowing what the contamination level is in those areas . No, madam. Theres no way. Reporter smith said tetra tech fabricated documents including chain of custody forms. Theyre supposed to certify soil samples under his control but he said sometimes his bosses filled them out. I never got to see them until the end of the day and all i did was sign my name and put the date. Reporter watched the supervisors tamper with Computer Data that analyzed radiation levels. They can change the numbers. Like, say, it was reading high 10,000. Youre back around 6,000. They would take the 10,000 and knock it down to 5500. Reporter would you consider that fraud . Yeah. Reporter what was the response when you raised your concerns . If you dont like what were doing, you can go home. Reporter smith needed the job so he stuck it out until 2012. He put Hunters Point behind him until the Investigative Unit contacted him this. An interreport. In it the Company Admits to the mishandling of soil samples and submitting falsified data to the navy. Tetra tech blamed four sample collectors including smith. Reporter you were skate goat. Yeah. Theyre blaming me for something they told me to do every day. Reporter in a series of investigations starting in 2013, nbc bay area revealed how former employees and the state Health Department raised concerns about the companys work. But tetra tech ignored multiple interviews requests. We went to the companys trailer on site. Hi. My name is vicky im a reporter with nbc bay area. Im liking fur the supervisor. Thats me. Im not allowed to talk to anybody. Reporter is there anybody here to talk about the radiation clean up and to reassure the public that this clean up is safe . I am not allowed to talk to the press. It could be a lot less convenient to be a smoker. Last week the California Legislature said to governor jerry brown proposed legislation to raise the smoking age from 18 to 21. The package of six bills represents californias most comprehensive antismoking effort in nearly two decades, according to the american cancer society. The governor has 12 days to decide whether to sign the bills into law. If approved, california would become the second state after hawaii to raise the tobacco purchase age to 21. Nbc bay area analyst joins us now. Larry, this is six bills. They cover more than just the age limit. Give a run down of what would change if the governor signs. Yeah. Comprehensive. Thats a good way to start out. A comprehensive package. The bills would address several issues. It bans smoking in all schools. Period. Smokefree areas in all bars, place rooms, warehouse, hotel lobbies. The ability of cities, various ordinances, to raise tobacco taxes on their own without state permission. And the age to purchase the products. Including e cigarettes for anyone under 21 years comprehensive. Those are major changes. Some are saying the bills dont go far enough. They dont address the cost issues. Yeah. These bills, of course, attempt to increase the difficulty of purchases and smoking, of course. They leave out the important lever for change the four letter wo word cost. California is 87 cent tax ranks 34th among the nation. Take a look at the spread between the top state and the bottom state. What do you see in vast differences you see california far from the top and close to the bottom. Thats why the American Lung association gives california a big fat f rating on tobacco taxes. New york is 4. 87. Its 4 more than california. Why doesnt the a legislature add a tax component to the package. It seems like a no brainer given the other elements were seeing. Now we get to the wonky stuff. The question of rules and political values. Look, according to the california constitution tax changes by the California Legislature require an absolute keyword. Absolute twothirds vote before 54 of the 80 votes. That tax issue in california usually breaks down by Political Party lines. As i understand now, the democrats are three precious votes shy of the twothirds vote in the assembly. One vote away from the state senate. That was enough. That was enough to prevent consideration. So the numbers werent their side. What about a statewide initiative. There was one on the ballot. One of the 80 plus ballots people are attempting to put on the november ballot. What does it mean it be left up to the people of california to decide . Cant wait for november. Look, the sponsors are currently circulating an initiative that would add, yes, 2 per pack to cigarettes. Its expensive. The sponsor didnt succeed in the getting the required signatures. If passed, the total tax behind new york. Passage is hardly certain. Why well in 2012 the ballot proposition to increase tobacco taxes for 1 was narrowly defeated thanks, in part, to 47 million spent against the measure by the tobacco industry. So the rest of the tobacco story, well, you know, yeah, one shoe dropped but the yet has other. Once again we can expect tobacco to come out and spend probably 60 or 70 million to defeat that important issue. If theyre going to spend 60 to 70 million it lets you know how much money they would stand to lose. Okay. Yeah. Lets turn our attention to what is happening this week in politics as far as the National Scene and the race for the white house. What is going on with the protests and demonstrations at trump rallies map do you think is behind the escalation what seems to be more violation. Its an accustmulation of al kind of reactions to many things that the donald trump said about mexicans being rapists and murders and kicking them out. Keeping muslim poups the antifemale remarks. You add them up over time and finally people are saying enough. We cant take it. So his enemies, if you will, have come out. Not just because of chicago the other day but because of all these things. And, by the way, this has had a twoway response because Trump Supporters are more supportive than other. What were going to see now is a situation as we roll toward that domination where the Republican Party is going to be so fractured. Its going to be very, very hard to put it all together again. The es are high. Really, on all sides. Its not even two sides. There are so many components to this. The establishment, Trump Supporters, the protesters. Were watching another band of heavy rain starting to make the way on to the peninsula. In the north bay there will be another round of rain that will move through later on this afternoon. This is 2 00. Youll notice that will slide through the north bay eventually making the way into San Francisco, east bay, and south bay as we move toward the evening hours. Once we get to 7 00 this evening showers will tamper off and subside. Were expecting to see things dry off toward monday. Today will be rainy. Temperatures will stay cool today. Looking at upper 50s to low 60s. Now we have long stream of moisture heading into the bay area. We have got several hours of rainfall expected between now and this afternoon. About 12 hours of rain and thats why we have that Flash Flood Watch in effect for the north bay. This is how much rain were expecting by the end day today. Youll notice about more than an inch of rain more halfmoon bay. Same for the east bay. You get toward north bay and youll get close to an inch. As we start the day tomorrow well have a few lingering showers but not going to be much as far as adding to what weve already seen today. Now the winds are expected to later this afternoon as the rain comes through. The heaviest of the winds will be around 1 00 this afternoon. Theyll start to subside.
