Youre wading through discovery documents. You get an email from his dad saying aaron had passed away. I spent the afternoon reading discovery material, getting very excited about significance of it in the case and how we could use it in an upcoming suppression hearing. Im driving home, having printed out a lot of stuff. And i get an email saying aaron committed suicide. I pulled over and called his dad. Were you shocked to hear this . I was shocked and sad. Im not sure i have words to describe how i felt. The case a lot of people have talked to prosecutorial overreach. They were asking seven years in prison for hacking into a school something and do something that was really a victimless crime. The question i have had the whole time, why did the government go after him so vehemently. In some ways they associated him with the wikileaks and the type of hackers involved there and they wanted to set a precedent. What is your take on why they went after him . I dont know the answer to that, but i fear that the it is mundane. You had a prosecutor in boston, ahead of the computer crimes unit in boston and ahead of the computer crimes unit isnt worth much unless you have a computer crime to prosecute. It didnt involve hacking really. He was an authorizationed user of the m. I. T. Computer system. They blew it way out of proportion and made it into a much bigger deal than it was. Have you had an opportunity to speak with them, the prosecutor in this instance . I have chosen not to. I got a phone call and email the day after he died and said please call me. He will say my deepest apologies, and i was going to feel gross about that. Or he was or i was going to Say Something to him that i was later going to regret. So i havent spoken to him. Im worried about the wider implications of this. You said it was just the one prosecutor. Is there some lesson to be learned around hacking crimes and how they should be handled by the government. Well, i think personally the lesson to be learned is that prosecutors really can overreach. They can inflate cases. Theres very little constituency for criminal defendants out there or for people in prison. Everyone wants to be tough on crime. And theres plenty of situations where youve got to say lets be reasonable here. There has been a precedent, though. You look at gambling online. There was a crackdown on that. There was a crackdown through these phases. If im a nontechnical person, and our audience tends to be i think what do you want them to know . Whats the significance of what aaron did . Whats his legacy . Well, you know, i think theres two pieces of aarons legacy. One is what he stood for in the internet community, free access to information that knowledge and the access to information and the revolutionary power of the internet should be available as widely and freely as possible. Thats really what he stood for. The other part of his legacy is that he was a good person who was engaged in a political act and prosecutors dramatically overreached. There have been petitions at the white house the white house will have to respond to given the rules they have set up as to firing those prosecutors. Whats your position on what should happen from here . I think the process will run its course. You know what, i think theres something for the press to consider too. I appeared in that courtroom when that case was going on. There was one reporter present. A scraggly guy from the m. I. T. Newspaper. There are more cases as well we will get to as well. Lets talk about the prosecutorial overreach. Thats their job. Devils advocate. There is no such thing as defensive overreach. I want you to make the jury find me not guilty and let me walk. Thats not overreaching. Do you follow what im saying . Sure. Its just not true for a prosecutor. Prosecutors are supposed to do justice. Youre not supposed to win at all costs. Win fairly. But is there your guy did a crime. Im going to prosecute that crime. First of all, i believe aaron did not commit a crime. I believe we would have won the case. And i felt very strongly about that. That is one of the things that was so disappointing. He could have been vindicated in the case. But where they went off rails was the sentencing. Jail time. He would have to plead guilty to 13 felonies. Guaranteed to go to federal prison. And if you go to trial and get convicted we think it is going to be in the neighborhood of seven years. Why something worth six months on a plea and seven years after trial . Thats not right either. Because he had a right to go to trial. He had a right to proclaim his innocence and ask for a trial. He would have gotten one. In the process they created this martyrdom. I think he wrote he wanted to see everything online free with nothing held back by big money and nothing sensored. And i think that will be, again, i hate to use the word legacy, but that may be. May live longer than you ever could have hoped and may reach more people. Sadly, the legacy and the impact of his suicide is much, much greater than he could have imagined. It is a barometer of the true conduct that was being prosecuted. As stewart took the position that once he gave everything back they didnt believe he should be prosecuted. And they didnt want to stand did not want . The victim didnt want him prosecuted and didnt want to stand in the way of this principal of making things publicly available. The story that is adorable. Jobs built hardware to rip off the phone company. Built an object to rip off the phone company. Its an adorable story. And it could have been an adorable story. They were building something tangible. Where was m. I. T. On this . They wanted to from, right . M. I. T. s position was never very clear. Aaron and his dad, who works at m. I. T. In the computer lab, believed m. I. T. Would come around and get off the idea of supporting the prosecution. They never did. They were never very much help to us. Theres an internal investigation going on now about that at m. I. T. And m. I. T. Was only cooperative with us once i served them with a subpoena and they had to be. Can you tell me or maybe youre resistant to what your defense would have been if things had been . Im not resistant. Its so straightforward. The basis of the crime under the cfa is unauthorized computer access. Aaron was an authorized user at m. I. T. As a guest. He was able to long on. As an authorized user at m. I. T. He was authorized to logon to j store. There was no unauthorized access. Once he got on he was downloading more than they would like. But this is a crime akin to checking out too many books at the library. Thats exactly what it was. So our defense was very straightforward. And i was really i was looking forward to trying this case. I was looking forward to vindicating aaron when i spoke at his funeral. I talked to him. And i said the summation i planned will never be given. And the hug that i was going to get after we won this case will never be felt. And i really felt sad about not having had that opportunity. But even this series has to compete with all the different devices in our lives. Whats become known as the Second Screen phenomenon. People text or tweet during the super bowl. It is no longer interactive enough to hold our attention. With that in found, fx has issued this, the sons of anarchy app, which allows viewers to interact with the show. A hidden audio signal from the television syncs it with the show. The back story, even information about what theyre wearing. The link to buy the clothing. It probably wouldnt be tom, a senior entrepreneur. Magic ruby, this is the company that makes the sons of anarchy app. Thank you for being with us. Thank you for the Television Show. The killer motorcycle show would not be my very first one. I understand your the creator. The folks at fox and xfx saw the opportunity to merchandise product. Its very amazing. And i have to say now that i know about the app, oh, where can i get one of those jackets . I love the motorcycle jackets. I love gemma, the one with the gun. Yes, i can actually see that. Is this the first app to sell something and merchandise . There are others, arent there . The nfl does. It is immersion. More just advertising. It allows you to learn more, get more information about the show that youre watching, dig in to the characters and actually find more about the background, previous shows and different elements of what the series is all about. As somebody who watches it and i watch it without a Second Screen because i really get into it. The other thing that surprises me is i understand when people are watching the voice and they text. Social show. This is a drama. Im amazing people are taking the time to be on a Second Screen. Well, people are on a Second Screen anyway. They are tweeting, they are on facebook, looking things up, going to imdb. What we find is theres a third wave of second streams coming along. The first one you check in and tell people what shows youre watching. The second one is a discovery application where you go and find out whats on, whats going to be on now. Those are still around. And the third wave is the immersive experience. You get to know more about the show, the characters. Youre allowed to see four or five. Trivia comes up. Like katie seagal was one of bob dylans background singers at one time. What about music . I was looking at the app. When its playing am i able to purchase any songs . Another one of the applications were doing now for a different show allows you to go and purchase a song as its playing. Are there certain characteristics certain shows have . I think of sporting events. This i never would have guessed. Any show thats in rerun . Actually there are. You have to have a certain audience. But shows that more importantly dont support a Second Screen. Is there a third screen phenomenon . He has a big screen tv, smartphone. It says more about our society probably. There is, actually. What were finding right now for another one of the shows that were doing, they want four different camera views of whats going on behind the scenes. Its a talent show kind of program. And we can go and you can switch on the application from each one of those four cameras and see. People are wanting more and more information. We have about a minute left. I have to go back. Why cant you buy the music directly . Are there rights issues . It seems to me it would be a natural. We can. Theres a limit to the amount of product that we sell. It was a compliment. You played a clip. They were making fun of the iphone. And there were several people who said i wonder where think got that. Yeah. Actual people gathering who created a computergenerated paper and got it submitted. But it was all nonsense. There was a point in which we nothing makes sense.
