close guantanamo and so anything we can do to help give these people some sort of humanity they deserve i think is good. >> people let out of guantanamo, quite a few of them, have rejoined terrorist activities. those who have been cleared. i don't think i would like them to be here. >> reporter: marin says they would be carefully screened before being invited. she said many have remarkable backgrounds and have a lot to offer berkeley. >> you would love to have one as a neighbor or i would love to have one as the boyfriend of my granddaughter or something like that. >> reporter: now, the peace and justice commission says that they have already identified a number of organizations that are willing to offer housing and support to the detainees. the city council is set to take up the matter and vote on the resolution at its meeting next tuesday. reporting live in berkeley, i'm jody hernandez, nbc bay area news. we're learning more about a mysterious death in the east bay tonight. police investigating a possible homicide near the oracle arena. someone reported seeing smoke around 1:00 this afternoon from 880. when firefighters arrived, they found a charred body. they're not sure if the victim was a man or a woman. police da say it happened near a homeless encampment. officers are still on the scene near the oakland arena and bringing you information and the latest as we learn more. this is the story getting international attention. and it's happening here in the bay area. a local man said he was sexually abused years ago by the catholic church and now charged with attacking that priest. there he is in court today for a hearing to determine if he should stand trial. police say lynch attacked father lindner last fall. lynch says lindner sexually abused him and his brother decades ago in church camping trips in the santa cruz mountains. the attorney had strong words for the retired priest just minutes ago. >> i find it fascinating that the man kept repeatedly saying to police officers and to everyone that will listen he's not guilty of anyone and hasn't got the courage to show up in the courtroom when he's subpoenaed. >> they accuse the church of covering the crimes and say victims of crimes of decades ago have no way to seek justice since the statute of limb takeses has expired. the widow of a firefighter who died in the line of duty will receive more than $4.5 million. the 2007 house fire killed the firefighter scott desmond of brentwood and matt burton of concord. they sued the firm that called non-emergency lines to report a smoke alarm going off despite the fact they knew there was a fire. they waited ten minutes and sent a truck to the home in flames when the firefighters arrived. two people lived in the home that died in the house and burton and desmond are the first firefighters to die in the line of duty in the county. a teenager has taken the first step to filing a lawsuit against the government agency that's supposed to protect children from exactly that type of abuse. nbc reports the tortured teen wants money and also changes. >> reporter: at a news conference in sacramento, sydney and paul perry said they were filing the lawsuit on behalf of their nephew named adds kyle doe. >> it is a struggle for him because of what happened to him. >> reporter: kyle was repeatedly burned, beaten and chained in this home until two years ago. prior to moving to tracy, kyle lived in sacramento with karen ramirez, a woman to whom kyle's mother signed over custody. >> you can't take children in this country with the handwritten document. >> reporter: the lawsuit claims sacramento child protective services allowed kyle and his half-brother austin to stay with ramirez even after cps received allegations the boys were thin and jaundiced, losing patches of hair and stealing food. >> we were very disappointed in the fact that the very agency that was there to protect kyle failed him. >> reporter: the aunt and uncle say they, too, warned cps but were ignored. his lawyer says this lawsuit will bring to light ongoing problems at cps. kyle's lawsuit seeks damages for among thiother things emotional stress but doesn't specify an amount. >> the city of san francisco and the san francisco archdiocese are locked in a legal battle over more than $20 million. the city says the church owes $20 million in taxes after a transfer of more than 200 properties including mission delo res to different corporate owned. they say it's tax xemplt. a san francisco supreme court judge will decide if the archdiocese has to pay up. would you consider giving back part of your salary? the oakland mayor is doing that and reversing a -- returning 20% of the salary. the newly-elected mayor says times are touch and wants to lead the way and when ron dellums was mayor rerequested and received a pay increase. quan is following the example of jerry brown and declined any pay raises as mayor. let's look outside right now. many of us enjoying the weather for weeks now it seems but that may soon change. we need the rain. clouds coming in, jeff? >> jeff tracking the rain details. >> the clouds coming in and a lack of rain we are seeing is larger issue here than we're just not getting storms developing. it is happening on the pacific and just not seeing it over the bay area. look at this. in december in san jose, over three inches of rainfall. since january 1st, over 35 days, all we have had is less than an inch of rain in the south bay. that's where we need it the most right now. why is it so dry here? not only in california but for a good part of the southwest, it all has to do with the larger pattern of la nino. cooler pacific waters equalling less storm development out here and then combine in the storm track. it's continuing to shift to the north producing dry weather in the west. that's also coincidentally why the storms in the east coast so strong because the storm pattern has to flip at some point and it has been across the southeast, even today with heavy snow and the east coast with the major storms. so, since july 1st of 2010, we have had anywhere from five to 11 inches of rainfall and right now the south bay and san jose needs rain the most. they're only at 69% of normal. coming up, we'll tell you when this latest storm we're tracking out in the pacific right there you can see it when that's going to arrive in my forecast. >> see you in a few minutes. oakland residents outraged by the gang injunction will band tomorrow together in court set to appear as a case management hearing to discuss the injunction naming 15 gang members and covering nearly 100 blocks of north oakland. critics contend the year-old injunction is too costly and didn't reduce crime in the area. a gang injunction is a court-ordered restraining order preventing known gang members from gathering in certain areas and taking part in certain activities. some employees at bart are going back to school this week. the agency says it's trying to train its police force and other employees to become more community oriented and responsive to the people they serve. bart faced strong criticism after a bart officer shot and killed a passenger oscar grant in 2009. the agency said it's trying to recommends reorganize the force. administrators say the classes of this beak will help them learn problem-solving skills to make bart safer. >> we take a step back and really assess what's going on and reach out to other resources. we have a better chance of making a problem go away. >> what we're trying to do is engage everybody at bart, the administrative staff, the operation staff, everybody has a stake in making bart safe. >> more than 300 officers will go through the training. along with some administrators. the transit agency serves some 350,000 riders a day. there's a remarkable story out of san jose with a 2-year-old boy stuck in his father's truck. >> it's good at the end here. the 2-year-old got the finger stuck inside the wall of a dad's truck. today, daniel showing us where the boy put the arm playing yesterday. he got it stuck up to the elbow. dad tried everything from butter to vaseline and mom called 911. >> poor little guy. >> and then the firefighters responded. they cut out part of the truck and took the boy to the e.r. with the metal still stuck around his finger. take a listen. >> something like this before so somebody in the hospital mentioned, well, i don't know what to do. but firefighters -- i thought they were going to try to cut his finger or something to get the swelling down. but the firefighters were able to get it. >> wow. well, the boy's smiling as you can see. thumb's up for everyone. fingers up there. surgeons used a special saw to first place, huh? thanks. nearly 400 unemployed flight attendants will be back in the sky this summer. they'll be rehired for air traffic. the airline said the recall notices could go out next monday to 147 senior attendants. spokesman said the company was able to rehire the attendants because of an increased demand for international routes. retired pilot and danville residents is known as the hero of the hudson but now he's getting a new title. plaintiff they're suing a bank and a realtor alleging fraud and civil conspiracy. the couple claims they overpaid buying a retail building in paradise for $935,000. six years later, their own appraiser concluded the property overpriced by some $200,000. the broker tells the santa rosa press democrat the original valuation was accurate but
