Hello and welcome to this class action special. We begin tonight with growing concern over the privacy of your childs personal data at school. Now, parents have been hammering for technology in the classroom things like computers, apps, hightech learning software, but did you know that many Bay Area School districts sign contracts with Third Party Companies for that Educational Technology . Information about your child in the hands of someone else. So, is that safe . One bay area dad is at the forefront of a movement to keep students private information private. My first reaction was, like, wow, i cant believe theyre not protecting this. Tony porterfield is a concerned dad but hes also a software engineer. He took a good look at Educational TechnologyCompanies Used by schools and was alarmed at the amount of unsecured information collected about kids. His, yours, mine. Names, email addresses, photos. One of the sites i looked at doesnt strip the geo at least when i looked doesnt strip that information from the profile photo. So, if that happens to be on the picture, and someone gets ahold of it, they might know where the kid lives. Porterfield took his concerns public and wound up in the new york times. He says he wants Better Privacy protection for students. And a guarantee that data is used for academics not advertising. As a parent i dont want my 6yearold to have a marketing profile. Right now the issue about privacy in schools is sort of like the wild, wild west. Commonsense media in San Francisco has studied the proliferation of Educational Technology companies in schools and sees a troubling trend. The real problem is lack of knowledge and expertise and the fact that theres no uniform standards and theres no clear and simple way that School Districts are protecting student privacy. Theyve sort of been left on their own. Even so a recent study finds 95 of School Districts turned to thirdparty companies to store data in the cloud. Lets start with the cyber. Chief Technology Officer ann duncan works with lots of outside companies. She says Big Companies do the best job. Its the small startups that can pose problems. And thats when we get into real challenges is the agreements are written by a lawyer and very one sided and we have to go back and try and make it equitable and protect student data and not leave loopholes for things to get lost. Outside contracts are vetted by district lawyers but duncan points out not all districts have that luxury. We spend a nontrivial amount of money working with our attorneys making sure the agreements meet our needs and not every district can afford that. As for this dad who original i had brought his security concerns to light, he wants ground rules. Pure and simple. Personal information is a valuable business commodity, right . And if youre going to collect it, you know, im saying protect it. Now we reached out to one of the most successful Ed Tech Companies in the bay areas and they have a chief privacy officer, he told us empowering teachers and providing them the tools to create and innovate is critical to helping student achieve their full potentially and theres no reason student privacy cant be protected at the same time. It can. Meanwhile an Industry Group that represents Ed Tech Companies recently came out with a list of five best practices on how to handle sensitive student information and the u. S. Department of education issued guidelines, too. So, lets hope those are being shared liberally. Well, a high profile lawsuit is under way that could radically alter Public Education in california, and at its heart is a longstanding debate over job protections for teachers. The question for the judge do laws meant to protect teachers sometimes hurt students. One San Carlos High School student at the center of the lawsuit says, yes, she thinks they do. High School Senior kate elliott is looking forward to college. But its middle school thats on her mind these days. In its grade kate says she had a teacher who wasnt doing her job. We were coming to class watching youtube videos or coloring. And it felt like the teacher didnt really care about our education. Kates big brother had had the same Science Teacher so she knew what to expect. Coloring in eighth grade. It was ridiculous. Kate says her fellow students, parents and even other teachers knew this one bad teacher was hurting the school. It stinks to go to class every day when you have a teacher that doesnt care and youre not doing anything. Its been four years now but kate is getting her day in court. Shes one of nine students suing the state. Saying teacher statutes violate their rights to equal education. Teachers are really unique among Public Employees in that they have what we sometimes call super duper rights. Its those job protections that are at the center of a major lawsuit filed by a nonprofit called students matter founded by wealthy Silicon Valley entrepreneur david welch. I am a target of public schools. They are targeting teacher tenure, last in, first off rules which are the layoffs the last teachers hired are the first fired and a dismissal process that they say is overly complex and too expensive for any one district. It would cost the district hundreds of thousands of dollars and take two, three, four years or even longer. The issue is not how do we get rid of bad teachers. The issue is how do we get more funding. This teacher says the lawsuit is a high profile diversion from the real issue, years and years of budget cuts that she says hobble california schools. It has to do with the lack of resources and lack of suppois s for new teachers. And shes also skeptical of the source of the lawsuit. I do believe that theres some really big moneyed interests that want to kind of coopt this issue, call it a civil rights issue, when, in fact, getting rid of these statutes is not going to improve the teaching force. Providing protections will. Obviously strong feelings on both sides of the issue. The judge is expected to issue a ruling in this case in the next few weeks, but whatever that decision experts say we can expect it to be appealed to the state supreme court. Janet napolitano is five months in to her job as the president of the university of california system, she was a high profile and really an unexpected choice for uc, politician, not an academic and a former governor and she faces a big job to revive and reinvest the states highly regarded but battered uc system. A towering building in downtown oakland is Janet Napolitanos new address these days. Western art lines her walls and her treasured cowboy saddle sits across from the desk where shes now orchestrating the rebound of one of the wests great institutions. The university of california. This is a university thats taken some hits during the recession. We want to rectify some of those, thats why were holding tuition flat this year. Because you really are at a crossroads right now, you mentioned yourself the tuition doubled, you know, in the last five years weve seen massive cuts but now after prop 30 and the investment from the governor again, do you see it as a turnaround time . I see it as an inflection time. Napolitano traded Government Employees for more than 230,000 uc students at a critical moment for higher ed in california. The state budget is looking better, but president napolitano is asking for more. She wants an additional 120 million above and beyond the funds Governor Brown allocated this year. Money she says she needs, not just to restore uc but to grow the university as well. Enrollment growth i think we need to be talking about enrollment growth and you just cant add students without having faculty and classrooms and laboratories. So, that needs to be taken into account. Governor brown has taken a big interest in the uc system and really kind of been stepping in and giving his opinion a lot. Your predecessor said Governor Brown, quote, is an extraordinarily intelligent, is extraordinarily passionate but it does take some energy to respond to his ideas. That was udall. What is your impression of the governor so far in your working with him . Ive enjoyed it. I think he is very involved. He comes to the regents meetings. He pays attention. Is that a plus . I think so. As napolitano settles in as state leader this was in the oval office. It is her former job in the federal government thats posing problems. Education not deportation. No on napolitano pro testers have zeroed in on her role in deportations while secretary of homeland security. The fundamental problem is not me. I think i become the personification of a greater frustration so i will take the hit of being the personification of that frustration but the frustration is that the congress hasnt fixed the underlying law. But here how do you as uc president ease their concerns . Well, i think by actions. Part of that action . Setting aside 5 million to help ucs estimated 1,000 undocumented students. Also on the agenda, tackling the diversity issue the university is often criticized for. I know that youve said that you really want to bring more smart lowincome students into the university system. What is your plan for doing that . Well, one is to make sure that students from low or lower middle income families know the Financial Aid resources at the university. Thats a tough thing for a lot of parents that are sometimes, you know, not from this country. I know i went through that with my parents. I had to do my own Financial Aid because they couldnt figure out how to do it. Absolutely. Getting that information early a lot of students are selfselecting out before applying thinking its unaffordable to go to the university. The plain matter of the fact is if your family makes less than 80,000, you dont pay any tuition. Another key issue for napolitano restoring the universitys cachet especially with californians. I want to have a larger conversation with the people of california about why this university is so special and so important. Why the work that it does here touches every aspect of california lives. Why the Educational Opportunity here is so open. Why it matters that we have the worlds leading Public Research university in this state. You have a lot of firsts going into this job, first woman president here, first nonacademic. How do you think those are a plus for you or are they . Or do they even have a bearing to this job . Well, i do enjoy the fact that im the first woman president. I think thats a good thing. In terms of being a nonacademic, you know, the president of the system really operates as a chief executive officer of the system. The chance hors run and the provosts run the Academic Mission of the university. So, in terms of relevant experience for running a system as big and complex as the university of california, thats the kind of experience they were looking for and that i bring. While budgets and regents meetings may keep napolitano plenty busy, shes happy to be back in the bay area where her own higher ed journey began. So, you went to santa clara university. Did you ever think when you were there you were going to come back, visit the university at one point as the head of the uc system . No. But i never thought i would live in arizona. I moved there after law school. I never thought i would be a governor. I never thought i would be a member of the president s cabinet. I mean, windows of opportunity open. I think one of the purposes of a good education is, you know, when those windows open, you are prepared to go through them. Good advice. Napolitano may not be a regular in the white house anymore but she has responded to the president s call to make higher ed more accessible. She also wants to make it easier for Community College students to transfer to uc. On a personal note, president napolitano told us when shes not at her office in downtown oakland, she likes to visit with family members who happen to live in the east bay. Stay with us. Shes doing it as juggling her life as the wife to gavin newsom and her busy life as a mom of three. We watch dora and montana loves my little ponies now. Shes as comfortable chitchatting about her 4yearold son watching pink animated ponies. As she is pushing back against the image of american masculinity and its impact on boys. Our boys are sort of fed this sort of narrative about what it is to become a man. And so much of that leads to loneliness, despair, isolation, and you see it. And she wants to make sure you also feel it. Man up. Man up. Man up. [ bleep ] [ bleep ] act like a man. Be a man. Be a man. For my kids i was going to end this hyper masculine narrative here. Not due out until september the trailer for it already has over 2 million views on youtube. I have to say when i first saw it, i was stunned. Because its very raw. It hits you. Thats what our boys are being told. Our kids are consuming media 24 7, right . The whole thing. You know, rap music violent video games and all of those mediums are inflicting our boys with this horrible notion of what it is to be a man, and its to cut off your heart from your head, to not feel, to not to be in touch with what they are as human beings. Shes a powerful voice against gender stereotyping and her company set in a bucolic corner of marin county is now the birthplace of her provocative media message. Youve talked about misrepresentation project the movie, this movie, being a movement, not so much a movie. What do you mean by that . Were in the cultural change business. Were a movement. Where literally people individually opting in to be the change they wish to see in the world. That Movement Means taking it into schools just as she did with her female focused movie miss representation. There is no appreciation for the women intellectual. And talking about the connection she sees between hypermasculinity and Mass Shootings like newtown. The violence, the domination, thats all encouraged, fed, socialized to the point where it becomes normalized. Its that kind of unapologetic frank talk that has made Seibel Newsom a hot commodity on the lecture circuit, branding her an advocate for women and children, her not buying it hash tag her calling card and her new found clout, political power. Hillary, youve come out vocally saying you are endorsing a run for her for 2016. Why is having a female president so important and such a powerful game changer for your daughter, for my daughter . Can you imagine what it will be like when we have i say when we have a mother as our commander in chief . I mean, just the concept of a mother. I feel like all of a sudden, oh, mothers can be leaders. Mothers are powerful. Mothers should be respected. Mothers command authority. I mean, i just i have tremendous admiration for her. Shes so brilliant. I think that shes a formidable candidate. And i, you know, i want to see her as our first female president. What do you think about the word feminist . Because ive seen a couple of articles that they call you a feminist. Its funny, i so what do you think of that word . Im a humanist. And a realist. One that doesnt shy away from turning to husband governor gavin newsom for support. He really cares about, you know, women and making sure that we fulfill our potential. But its his potential to move up the state political ladder that may have this filmmaker taking on a new role. When newsom makes a bid for governor in 2018. I definitely know that, you know, that thats next. I mean, i think hes running for reelection and then thats next. And i think he would be a fantastic governor. And he has a lot of credentials. A and, yeah. Hed be great. While a run for the governorship is on the horizon, it is motherhood that defines her days. Ive had three kids in four years. Im tired. You know, i increasingly sort of crave that downtime and that privacy and that solitude. Mostly just because im so in love with our families. But not too tired to keep unmasking the fears that can keep us apart. Its all about our kids. I mean, at the end of the day, you know, what are we here for . Im, like, what are we here for if were not going to leave the world in a better place . And now that shes tackled films about boys and girl, Seibel Newsom tells us shes actually considering doing a film about grownups. This one would be on ageism. Certainly a lot on her plate. The College Board announced a sweeping redesign of the exam this week to make it more reflective of the actual work the students have been doing in the classroom. The s. A. T. Will return to the 1600 scale. The essay will be optional and students wont be penalized for incorrect answers. Students will be able to take it on paper or a computer. The new exam will be introduced in the spring of 2016. Bilingual education is back in the news. California restricted it with prop 227 but a new bill wants to repeal the requirements of the englishonly instruction. The state senator who authored the bill said english will always be the official language of california but the Global Economy requires a multilingual workforce.
