Recapping our top story President Trump tonight revealed hes nomiting appeals urt judge neil and retopping our top story tonight, President Trump revealing his nominating Appeals Court judge neil gorsuch to fill a vacancy on the Supreme Court. 49 years old, gorsuch would be the youngest justice since Clarence Thomas joined the court. He was 43 when he was nominated. Gorsuch served on the Appeals Court in denver. Mr. Trump said it himself tonight. This is one of the most important decisions a president can make so will he be confirmed by a divided congress. Larry, not much of a surprise here but why judge gorsuch. He was on the list of 21 judges three or four months ago. He picked this justice for a couple of reasons. He appears to be conservative. Number two, hes very young. This man if confirmed will be on the court 25, 30 years. He has the potential of setting the courts agenda as time goes on. Well he said he wanted a conservative judge, right . Could things change though . Can judge gorsuch stay conservative because things do change when you get on the Supreme Court. Its fascinating when you watch these justices. Weve seen anytiit in the past, coming in as a liberal and becoming more and more right. Anthony kennedy came on as conservative and drifted toward the center. This judge has clerked for two justices. You kind of wonder whether something will happen with this appointee. Theres no guarantee. So the current balance, how could he affect it as we know it. We expect him to be a conservative justice. So in that sense the balance of the court will remain 44 with Anthony Kennedy often finding himself in the middle. When democrats look at this, they may make a fuss. But the fact of the matter is the likelihood is that the court stays the same. Within the last hour weve also seen leader pelosi and senator harris tweet theyre opposed to the pick. Could we see a firl bust erfili . You could. But i dont think you will. The likelihood that the next justice to retire will be a liberal, perhaps ginsburg, someone like that. Thats when youre see the fire woks if he wants to replace a liberal with a conservativconse. Two justices are in their 80s. Whats the time line here . We could see as many as three more justices appointed by President Trump. Thats one of the reasons why this election was so important. Youre looking at the likelihood, at least the possibility of this court swinging to the right in a rather firm way 63, 72 for perhaps the next 25, 30 years. Its going to be a changing time for american society. It could be a big swing, two justices, possibly three leaving and President Trump could be in office for up to the next eight years. It was all of the talk today, sin city in doubt. The new information were learning about the raiders and why a move to las vegas is in serious jeopardy tonight. California could make history on a controversial immigration policy. The po polroposal to make us a sanctuary state and why some lawmakers say that could make a lot of sense. A sanctuary for undocumented immigra right now at 6 cl6 30, california may soon declare the entire state a sanctuary for undocumented immigrants. Today lawmakers in sacramento advanced a law. Nbc bay areas Michelle Roberts with a closer look at what could be a controversial measure. Absolutely. The measure was pabszedssed out committee this morning. The full legislature could become the full socalled sanctuary state in the country. If the federal government wants to enforce its immigration laws, it can do so. If it wants to enforce its criminal laws, it can and should do so. It is not our job to do that work for the federal government. State senator scott weiner backed a bill in San Francisco that would prohibit state and local Law Enforcement agent sigs from spending money to assist federal authorities with the aris or deportation of any nonviolent undocumented immigrants. They argued that the measure wont get in the way of the federal enforcement. It restricts the commandeering of our resources to do the job of the federal government. Violent criminals will be allowed to slip through the system if cooperation between local and federal Law Enforcement is restricted. The federal government might be able to discipline sanctuary states or cities if they think and if they can show that a city is violating some law. A santa clara law professor says if california becomes a socalled sanctuary state, legally the feds may only be able to pull money allocated for state and local Law Enforcement agencies. Last week David Livingston had this to say when asked about declaring sanctuary city policies in his jurisdiction. It could be devastating for our county and would be a bad policy. Currently california gets 100 billion from the feds every year. The legal expert we spoke with called the federal threat to pull those funds a scare tactic saying it would be unconstitutional. An interesting verbal scuffle today. Sean spicer insisted to the pre press that they were wrong to call it a ban. Kristen welker pointed out thats what the president himself called it. Hes using the words that the media is using. At the end of the day hold on. Jonathan, thanks. Ill let kristen talk. It cant be a ban if youre letting 1 Million People in. Now spicer says instead of using the word ban the process should be considered quote extreme vetting. And what youre seeing here is the senate you dish rare committee adjourning their hearing today which is newsworthy because members did not vote on attorney general nominee jeff sessions. Democrats used an on secure senate rule to delay the vote. Sessions is expected to be approved by the panel tomorrow. And a Senate Committee has approved betsy devos to be the nations next education secretary in a 1211 vote, the committee did agree to send the nomination to the full senate for a vote. News about the future of the oakland raiders. The road to las vegas got a lot bumpier for the silver and black. This is life look at the coliseum in oakland. The raiders might not be going anywhere. This evening a lot of big money being moved around. Scott budman joins us to break down the latest moves. So much to wrap or heads around but this is big news. Its true. And break down is the right term here is as the chances of the raiders moving to las vegas have broken down a bit. But not everyone is assured that the raiders will stay in oakland. The raiders are, at least for now, a little closer to staying home. Sheldoned a lson and his 650 million have reportedly stepped away from the table taking away some of las vegass momentum. But dont count them out yet. Im not ready to say that because 750 million on the table from the state is the largest amount of money that any Public Entity has put forward to a single use stadium naps significant. And while others, like hall of famer ronnie lot say theyre still ready to do what they can to keep the raiders here, one long time insider says the thorn in all of this is the raiders themselves. What percentage of the team is mark davis willing to give up to have a partner with billions of dollars to help him build . And build is a key point here. The oakland as for instance say theyll choose a site for a new ballpark by the end of the year. Will things change at all if the raiders decide to stay long term.
