They hope to weed out ileelg rentals. The two sides we s went headtohead in a federal court today. This is video of airbnb attorneys leaving the hearing moments ago. He joins us now to explain why some believe this lawsuit could impact a lot of people in San Francisco. And guys that includes people who dont use airbnb because at the heart of the issue is the housing crisis in San Francisco. What is available is just too expensiv expensive. Airbnb believes its platform gives them way to make money but they think too many people are turning shortterm rentals into year round. Now a judge will weigh in on the legal battle. Instead of working with the city, they simply went ahead and sued. Reporter how would you describe how airbnb has handled the situation . Very arrogant. Reporter he says airbnb and other websites like it should be forced to take responsibility for the thousands who rent out their homes online without first registering with the city. And thats why San Francisco is not going to be intimidated by what is a bully tactic on a the part of this company. Reporter anyone in San Francisco wanting to rent out short term has been required to get a 50 permit. In may we revealed at least 82 of hosts are breaking the law. Since they failed to register with the city. Folks have been robbing residents of that housing and airbnb has been driving the get away car. Reporter compos and other members of the bord of supervisors allowed the city to charge up to 1,000 per day. If they allow unregistered users to continue to post their rentals online. Airbnb fought back, slapping the city with an 18page lawsuit that accused San Francisco of violating the commercial rights of speech. And it would be a significant burden to see if all their users were register would the city. San francisco put that on hold after the lawsuit was filed. This is the first time we have ever taken a step like this. Reporter david owens says the citys registration process for hosts is too complicated. But when users fail to register, San Francisco wants Companies Including airbnb to be stuck with financial penalties. Its really just not that simple. This is a new activity, a new economy and the city can and should be able to develop a simpler, much more innovative process to enable folks to rent out their home for a few nights out of the year without going through a process that takes six eight weeks. They say it takes half as long. If people get to ignore city laws they dont like, snt that a recipe for disaster . Weve spent a significant amount of time working on solutions and being part of the dialogue and in fact are committed to continuing that process. The current rules simply dont work. Reporter our Investigative Unit went undercover this past summer to show you how easy it to find and rent homes on airbnb not registered with the city. Nearly 2,000 homes were taken off the market permanently in order to be advertised as shortterm rentals on airbnb. A aif theyre able to get part of this ordinance thrown out at the crux of the housing crisis is this question of will San Francisco continue to have a middle class . Reporter you think this one lawsuit can carry that larng large of an impact. Especially around the sharing economy that would allow other industries to say we have no responsibility when it comes to the impact that our business has on society. Reporter its unclear just when the judge will issue a decision in this case, but if you plan on renting out your home, that 50 Registration Fee will spike to 250 in november. Thats because San Francisco just realized its Enforcement Program is costing more than its bringing in. They had to shell out over 400,000 to keep things egoing.
