Reporter raj, it was a year ago all most to the day that the 14yearold girl reported being Sexual Assaulted by a senior here at the high school. Not going to describe details of the assault, they are too graphic. The girl and her parents did agree to talk with us if we protected their identity. I was walking to the bathroom and the boy came up behind me and started choking me and dragging me. Reporter the young freshman described the sixth period attack. It was middle of the afternoon at the high school. She says she fought him. But when i would do that, hed choke me harder and drag me faster. Reporter he would not let her up. Longer than five minutes. It felt like forever. Reporter the girls mother says she got a call that afternoon from the schools vice principal and remembers screaming. Because reporter because of all the times that i would call and report about my daughter being sexually harassed and they did nothing about it and it led to my baby to be assaulted. And all he could say is im sorry. Reporter according to the familys lawsuit, the mother and daughter had both complained to School Officials about the young girl being sexually harassed at school. We would tell them multiple times what was happening. And all they would say is okay, well deal with it. But they just brush it off like it was nothing. She says daddy, i just wish you were there and i wasnt able to be there. Reporter the lawsuit claims the boy had previously been arrested for Sexual Assault at another high school. If santa rosa officials did not know about the boys history, they should have. We believe they did but should have and this should have been in his school records. Reporter district officials here in santa rosa declined to talk with us saying they knew nothing about the lawsuit and siting student confidentiality laws. The attorney representing the family says the case was filed two weeks ago. Hes expecting an award in the millions, if a jury does not if they do not settle first, however. Police are investigating a shooting involving one of their own officers, but the shooting also has the attention of police in concord. The man that police shot, the man on the screen on the left is responsible for shooting an 8yearold boy last friday. Nbc kim joins us live from fairfield and this particular suspect, kim . Reporter jess, it is an active crime scene as Police Gather evidence. This began from a tip from a concerned citizen who recognized 32yearold james from media reports and contacted police. Now this happened at around 12 30 this afternoon in the parking lot of a Lowes Home Improvement store on the 3400 block of north texas street in fairfield. Investigators say the caller followed the car into the lot. He did not approach the suspect, but waited for police to arrive. Officers arrived, contacted the suspect who ran away on foot. Officers pursued the suspect where an officerinvolved shooting occurred. He is suspected in the shooting of an 8yearold concord boy last friday. The little boy was playing in front of his home when he was hit by a bullet in his neck. Hes still recovering. Concord police do not believe he was the intended target. They released gerauds name and picture warning everyone he was on the run and to consider him armed and dangerous. Fairfield police would not say if gerard was armed and would not tell us how many times he was shot. There were three officers that initially responded to this scene. He says there were no other injuries reported. Now gerard was taken to a local trama unit where he remains listed in critical condition. Thank you, kim. Marianne favro has more. Reporter the allegations center around a private meeting lorrie smith called with retired judge cordell who heads up the commission looking into jail operations. That commission was formed after three guards allegedly beat inmate Michael Tyree to death last year. The Commission Wants the county to investigate what it calls misconduct during the private meeting in palo alto earlier this month. The Association Says according to cordell, the sheriff shared documents associated with investigation and warned if the commission called for a change in leadership, it would hurt smiles e election battle. The sheriff showed Text Messages from deputies and talked about e reelection. In a statement roger wins low Vice President of the sheriffs Association Says clearly the sheriff is more concerned about advancing her own political career than addressing the real issues in our county jails. These new accusations come just two days after the Commission Recommended a change of leadership at the county jails. Rick calendar sits on that commission. What i believe right now is we need federal oversight to come in like they did in l. A. To take over the jails and basically have oversight so if they need to be over lorrie smith to do so but right now i do not believe we should have the sheriff in charge of the jail. The Commission Voted to set 120 recommendations to the santa collar ray county supervisors including increase Mental Health services and training for guards. We reached out to lorrie smith who issued this response. I remain focused on keeping Santa Clara County safe. We are making needed reforms in the jail to make sure those who deserve to be behind bars are receiving Mental Health and Reentry Services so they dont come back. Sheriff lorrie smith just issued another statement saying that the unions acquisitions are untrue and also said shes focused on implementing real change to improve our jails. One year earthquake prediction maps, the first of their kind show ground shaking risks nationwide. Usgs arthur mcgar says oil and Gas Production is making the earth move. Induced earthquakes mostly from oil and gas east of the Rocky Mountains have contributed to the total seismic hazard. Berkeley but even with her credentials as a faculty member for two decades and as the current dean of social sciences, that cant save her from the criticism shes expected to get in her new role. The interim lead hasnt had a history of working on the cases and the students in general have very little faith. Reporter the chancellor announced hess will serve as the interim lead at the university with critics accusing uc berkeley of slow responses to cases involving high profile professors, an assistant basketball coach and campus fraternitie fraternities.
