Officials say about 33 calls came in during a twohour period but point out no highpriority calls were put off, no calls were ignored. But they acknowledge it did put a strain on the force. There was 20 officers go ahead dated to this incident. Thats a significant amount of officers for one situation. Again, it leaves certain parts of the city without police services. Reporter the mayoral candidates say they know situations like that put staffing right at the top of the debate. When you have a Major Incident in this city now, the real question is whether or not theres enough Police Officers to cover the neighborhoods and the immediate crisis incident. And we think not. I think we all recognize theres a lot of fear in this city. And residents want solutions. Thats why ive been focused on solutions that can really keep us safer. But its important that we focus on the solutions and not on the fearmongering. People here in the neighborhood are already well aware of the problem. We have new information tonight surrounding the first case of ebola diagnosed in the u. S. Were learning a possible mistake when the man first went to the hospital in dallas, he was sent home with a prescription for antibiotics. He told the nurse he had just been to liberia in west africa. Now hes back at the hospital in isolation. Health officials have identified more than a dozen people who came in contact with the man and may now be at risk. Today we learned that some schoolaged children have been identified as having had contact with the patient. And are now being monitored at home for any signs of the disease. An Elementary School one of those children attended told parents to pick up their kids today. The ebola patients condition has been upgraded to serious but stable. Ebola has been partly blamed for a big drop in the Dow Jones Industrial average today. Airline stocks took a hit. The dow fell 238 points. You hear it, cal trans crews preparing for the worst. An october heat wave means fire danger is high tonight in many parts of the east bay. Humidity is lower, temperatures are up, which is a dangerous mix. We have Team Coverage this evening. Jeff ranieri is tracking the latest weather patterns. We begin with Jody Hernandez in oakland where certain trees are adding to the fire danger. Reporter raj, highly flammable eucalyptus trees cover the east bay hills. You can see some of them behind me. Their high oil content make them fire torches just waiting to light up. But so far, efforts to clear them out have not been fruitful. People who live in the east bay hills are growing more worried every day. Its worrying. Overalls was all i had after the fire. I lost everything. Reporter firestorm victim gordon piper doesnt want anything else to experience his loss. Ever since the 1991 firestorm, piper spearheaded efforts to clear out dry and dangerous vegetation. Namely french broom and leaves and debris from the areas highly flammable eucalyptus trees. In the firestorm, the eucalyptus trees were sending their flaming seed pods over the top of my car as i was trying to evacuate. Those were all eucalyptus. There may be pine interspersed. Reporter thousands of nonnative, oilladen eucalyptus trees blanket the east bay hills and could act like fire torches if ignited. Its a very dry condition like we have now, and wind. Those things together with just an errant cigarette butt could cause this thing to go like a tinder box. Reporter the university owns about 1,000 acres in the hills. They and others have been waiting for years for fema to release funds to remove the invas invasive trees but the money hasnt materialized. Common sense, given the conditions, they ought to allocate the monsooner than later. Reporter the university is doing what it can, putting up no smoking signs and clearing brush. The cost of removing thousands of trees is something it cant shoulder alone. With an october heat wave heading in, everyones holding their breath disaster doesnt strike. Fire danger remains high in the east bay hills tonight. Fire crews are out on patrol and they are urging everybody to be on alert. And its only going to get hotter. The fire danger even greater. This heat can be dangerous. Yeah, it most certainly can be, catch you off guard. The thing thats going to be different about the heat event were seeing, its going to be hot inland and up against the coastli coastline. When we get fire winds developing, its coming from a drier direction. Winds out of the north and east. Its getting fueled by that clockwise motion around High Pressure and going to help propel some of this heat to the immediate coastline. Its going to completely cut off any kind of cool pacific breeze. Largest danger back here across those east bay hills with the low humidity and again wind thats going to be with us. We definitely want to point out we are not looking at winds of 40 to 60 miles per hour. Tonight through fridays forecast, 10 to 20 miles per hour. But again, its the direction of the wind that is key. Its already beginning to build out of the north here and slightly out of the east. This intersection did receive an e on a county rating scale, one step above failure, which means total grid lock. A study is trying to figure out how to improve slow commutes. Traffic jams and congestion headaches are easy to find along page mill road in palo alto. According to a city report, the page mill and 280 interchange is one of the worst spots for backups. You remember last week, big news when every working group in the department signed a letter of no confidence. While today with this letter the battalion chiefs have joined the insurrection, calling on the mayor to replace the citys firstever female fire chief, whos been on the job for more than a decade. By thursday a line of Department Heads and Community Leaders had formed at the fire commissions meeting in support of chief hayes white and it appeared she had weathered the worst. Until today. Describing a crisis of confidence and echoing the rank and files complaint that the current state of the Fire Department has become untenable and immediate action is necessary. The police car had people on all sides of it. 50 years ago tonight, thousands of students on the cal campus surrounded a lone police car. What happened next sparked a movement that changed the country. Taking control. A south bay mans tactic to try and fight his burglars by using his computer. His home was ransacked and he reported it to police. A south bay man decided that was not enough. As nbc bay areas Marianne Favro shows us hes using social media to track down the suspects and get his belongings back. They took my deceased mothers jewelry. My camera equipment, my gear, my imacs. Reporter september 22nd, ben came home to find his condo in this North San Jose neighborhood had been burglarized. Im furious, enraged. You know, people need to make a stand against people like this. Reporter he reported the climb to police but felt that wasnt enough. I just felt that, unfortunately, due to the understaffing with the police department, you know, they couldnt do so. They stacked the case files on case files upon another one. I had to act myself. Reporter thats exactly what he did, using his stolen computer to track down the suspects in santa clara. He posted this message directly to the burglars on facebook, asking them to turn themselves in and return his belongings. Let me tell you what ive done the past three days. Ive tracked down where they live. Ive seen them. I know what type of car they drive. I know the hackers home as well as buyers home. If i could do that in three days imagine what i could do in a week. Reporter the burglars didnt give themselves up but the message got 400 likes. San jose police admit they are shortstaffed, one burglary detective handling more than 3,000 cases this year alone. We understand the frustration. Were doing the best that we can. We just ask that people not put themselves in harms bay. Reporter ben says he will continue to search for the suspects. In the meantime, hes given police the new information he learned during his own investigation. I put it all on a silver plat tore the police. Hopefully they do their part. Theres been a shakeup at the secret service. This afternoon the director stepped down. Julia pearson resigned. Shes been under pressure for various security lapses. Just yesterday, lawmakers grilled pearson about a man armed with a knife who was able to charge into the white house after jumping the white house fence. Several other Security Breaches have also come to light recently. Pearson lasted a little more than a year at the position. She was the first female director in the history of the secret service. It was much more than a protest, it was a spirit that captured the countrys attention. It happened 50 years ago today on the cal campus. A student set up a table at sprout plaza in support of racial equality. What happened next no one could have predicted but it changed this country. Diane dwyer has more on our series the Free Speech Movement. And so at noon, several of our groups, including our core group, set up tables with information, literature. I had the good fortune of being the person they came to first. Jack was sitting at the core table. And he refused to identify himself when the deans asked for his registration. And they made the incredible decision to bring a cop car onto the center of the plaza at the noon hour. And i mean, how anybody could be that stupid, i dont know. I was right in front of the car. I was by the right fender on the drivers side. And i heard somebody shout sit down. By the time i got put in the police car, it had people sitting down on all sides of it. And there i sat for the next 32 hours. By most accounts, it was 21yearold mario savio who, in his sports jack, collared shirt and slacks, first found his place in history by taking off his shoes and climbing on top of that police car. The symbolism, striking. Protests overpower. Protest over power. The symbol of authority, the police car, became a symbol of a protest. Because it was surrounded by protesters. The authority was emasculated. We took our shoes off. We had all taken our shoes off because we didnt want to damage the car. And we stood on top of it. Pretty soon, within an hour, there was a sound, there was a microphone on top of the police car. And a big sound system. And there was and anybody who wanted to speak could sign up. And i was right in the middle of it. I mean, it was just it was just thrilling. And then that night was the first time id ever made a speech. It was from on top of the police car. I remember quoting frederick douglass, the great abolitionist, who said that power concedes nothing without a demand. I remember that i quoted that and the crowd roared back. Its affirmation. By friday night, october 2nd, some 30 hours after the sitin had started, the pressure was mounting. The next day was parents day. It could not have been worse timing for the university and better timing for the protesters. When night drew and people were negotiating, and we were scared. I mean, there was they had assembled all these police from all around. And wed been told to take off wristwatches and earrings and stuff so that they couldnt pull on those. It was very scary. Most of the people involved were not hard enened, political sophisticates. Many people, it was the first demonstration theyd ever been involved in. I remember mario racing towards the car. We could all see him coming, waving a piece of paper. And getting up on top of the car. Taking his shoes off, getting up on top of the car, and saying that we had reached an agreement. And then enumerating what it was and urging us to accept the agreement by acclamation and to quietly disperse. And we did. After that, savio became the prominent leader of the united front of groups movement that was soon to have a new name. Over that weekend, the united front of groups met and realized that we had a struggle ahead of us. And started developing more formal organizational structure and came up with a name. And that was the Free Speech Movement. The Free Speech Movement was formed that weekend. It captured something that appeals to every american. Free speech. There was the sense of a new day dawning. Mauve i dont said on that day, although the war is far from over we have won the biggest battle, the battle to gain recognition from the university. But that sense of a new day faded as the agreement with the university quickly fell apart. In berkeley, diane dwyer, nbc bay area news. Facebook is apologizing to drag queens. At issue, facebooks real name policy. It led to an outcry from activists when facebook forced users to update their profiles to their legal names. Performers like drag queens who use stage names were locked out from the site if they didnt comply. Transgender and Abuse Victims were also impacted. Today, facebook employees met face to face with activists and apologized. The company promised to find a solution, however, they did not reverse the new policy. A pay raise if you work in berkeley. Minimum wage is now 10 an hour. Todays increase was the first in a gradual rise in the minimum wage. Next year it will go up to 11. In october of 2016, 12. 53. Oaklands minimum wage could match that amount. Theres a measure on the November Ballot that would increase oaklands minimum wage to 12. 53 by 2016. Governor brown made waves rejecting a bill that would have created strict guidelines for Police Surveillance drones. Tonights reality check focuses on the governors decision to allow more lenient use of drones. Reporter this is a huge gray area right now in the arena of personal liberties. Can Law Enforcement agencies use drones basically at their own discretion to gather information . Governor brown said the Fourth Amendment to the constitution already protects privacy concerns so theres no need to require warrants for drone use. Are you really protected by the constitution . We take a look. For many americans, drones popped onto the public radar as a military device used to address highlevel targets or a general tool of destruction. But now zones are part of the hohum of everyday life. Delivering packages for mainstream retailers. Just approved by the faa for filmmaking. Deployed by Police Departments for surveillance. Its a practice suspect that has many civil liberty proponents unnerved. Efforts by californias General Assembly to push back on Law Enforcement and require a warrant for such drone use just got stymied by Governor Brown with a veto. The reason, he says the california constitution and Fourth Amendment to the federal constitution, which protects the right of the people against unreasonable searches and seizures, is a sufficient safeguard against intrusion. But whats the reality . It would depend on the particular circumstances of the case. What the Fourth Amendment essentially protects is persons reasonable expectation of privacy. Reporter a santa clara constitutional law professor points out, reasonable comes back to a legal interpretation. The Supreme Court ruled that a lowflying aircraft doesnt violate a reasonable expectation of privacy but the court has not weighed in on drones. Without this precedent we asked, can a drone reasonably, legally, swoop into your backyard . It depends on where exactly in the backyard you are. If youre within the curtilago of the home, under the front awning or near the front door, arguably you do have a reasonable expectation. Reporter the truth is much like the nsa data breach or controversy swirling around access to your cell phone data, the understanding of a reasonable expectation of privacy in 2014 is untested and still evolving. That makes browns claim of protection from drones through the Fourth Amendment very much unproven on a casebycase basis. This bill passed the California Legislature with overwhelming support. So youd figure the legislature is probably going to override the veto, right . Not very likely. Californias override rules are the toughest in the country. The last time any gubernatorial veto was overturned in california, the 1970s, under the last brown administration. Looks like the governors word here is the final one. Im sam brock. Thats tonights reality check. Dead fish are turning up along the Guadalupe River in downtown san jose. Nbc bay area alerted the valley Water District about the fish, take a look. The Water District sent out a biologist with a hazmat team. The biologist says the fish appear to be carp, largemouth bass, and a fish called sacramento suckers. He believes the drought that is everything to do with the deaths. Last weeks storm made matters even worse by creating small, temporary pools in the riverbed. Last week, there was a little bit of a rain event that probably generated a runoff off of the hard surface of the urbanized area. And that can stir fish up to move around and then they just got stuck. As the creek went back down to its intermittent condition. He adds, with more dry weather, area creeks and rivers will likely sha ring even more so it might not be a good idea to try to relocate the fish which are still alive. The closer that area of High Pressure gets the more heat comes our way. Tomorrow downsloping winds will get temperatures into the 90s. By friday, the hottest day of the week, thats going to drive these offshore winds and help bring us 90s even at some of our beaches. Take a look at the trend.
