Tracking it all hour long. From renting a bmw for two weeks to lavish meals and hundreds of dollars spent on wine. The city audit in san jose shows that some employees are using city credit cards for questionable purchases. So exactly which employees are living the high life on your dime . Damian trujillo is live at city hall where he went looking for some of those names. Reporter what we found is there are some people noted inside this audit who work here and city hall, including the mayor. There are firefighters and other employees whose expenditures are being questioned. These are some of the thousands of documents nbc bay area got from the city auditor today. This one, Sharon Erickson said in her report, violated prudent use of city funds. Its a charge for more than 2,300, including 700 in alcohol, to entertain a delegation from ireland. At the dinner table that night, the mayor. And several council members. The city manager and City Attorney were also there. There was approval for Alcohol Purchase as part of that meal. We questioned whether it was a prudent expenditure of taxpayer dollars to spend that much money on alcohol. Reporter in a statement, the Mayors Office wrote city policy allows limited expenditures of this type for Economic Development purposes. A spokeswoman said the mayor didnt have wine at the dinner and that the mayor has been briefed by the city auditor and is exploring ways to increase transparency around pcard transactions. We do question in this report the use of procurement cards for business meals, for highly compensated or highlevel employees. Reporter also mentioned in the audit, a 2250 expense for tickets to an awards dinner, a dinner City Employees did not attend. We found in the new documents it was charged by the airport director. And this one. Four top drain leather rocker recliners bought by a firefighter in charge of facilities for almost 3,500. If they did knowingly use the credit card in violation of city policy or procedures, then there are some steps to take some corrective action for that. Reporter union leader Jose Guerrero says all employees go through annual training on how to properly use their cityissued pcards. All of us as City Employees, whether City Employees or any politician, must adhere to honesty, integrity, and transparency in the use of the city credit cards. Reporter guerrero says that goal is for all employees, whether elected or not. Another expense mentioned in this audit, the firefighter who leased a bmw for two weeks. In the audit, he says that he did not have his personal car with him but he intended to switch the charge later on. Apparently that did not happen. The Fire Department tells me they take this matter very seriously and there is now an Ongoing Investigation already you can find all these documents online at nbcbayarea. Com. The city auditor did make several recommendations on individual cases and on policy as well. She said the majority of the employees are following the rules, but recommends that all employee expenditures be posted online to promote transparency. And she says she will check back in six months to see if the city has acted on recommendations. New details tonight in the case of uber driver accused of beating a passenger with a hammer in San Francisco. This happened early tuesday at elsworth and alamany boulevard in bernal heights. The driver hit one of three passenger in the head after an argument about what route to take. The San Francisco District Attorney George Gascon says the suspect has pled not guilty and uber may be liable. If an employee is in the course and scope of their employment, injures others, you have certainly civil liability, depending on the extent of it, it could be criminal liability. Im not saying theres either at this point but certainly thats the normal lens that you use to look at these cases. Uber tonight has issued a response that reads in part, it is our policy to immediately suspend a drivers account following any serious allegations, which we have done. We stand ready to assist authorities in any investigation. Happening now, another major water main break in Southern California. This one started just before 3 00 on sunset boulevard. But this time in west hollywood. 2 1 2 hours later, still gushing water. No word on how many gallons have spilled. The break happened about seven miles from that massive water main break in july that flooded ucla and the campus. In that case, 20 million gallons spilled. Both breaks happened along sunset boulevard. Its too early to know at this point if the break happened along the same water main. For most of the afternoon this is what it looked like in downtown san mateo, one of the busiest streets in that corridor, after a van smashed head0 into a Public Transit bus, killing two and injuring five on El Camino Real near 10th avenue just before 1 00. Nannette miranda is live with traffic now flowing normally. Do we know any more about what actually happened . Reporter the man and woman from the van died. And their names still have not been released. All of the passengers on the bus survived. And one may have escaped injury after something told her to leave the bus immediately. Nobody saw the woman because we didnt get on the other side of the car. Everyone was screaming. Reporter investigators dont know why yet, why the green van traveling southbound on south El Camino Real near downtown san mateo crossed the center divider, crashed headon into a san trans bus, in front of the funeral home where Susie Wiggins was headed. I saw the van coming from the south. And traveled across the lane. I went around the bus to park my own car. I realized that he had hit the bus headon. Reporter annabel diaz was one of 15 to 20 passengers on the bus, but instinct told her to get off the bus early at the stop just before the crash site. The san mateo resident thanks god for telling her to get off. It was really scary and she cant imagine it could have happened to her. In all, sam trans says five needed to be taken to the hospital. Drivers are pulled from service pending the outcome of drug and alcohol testing. Reporter passenger diaz says theres nothing to indicate the bus driver did anything wrong. A oneday strike by golden gate ferry captains is leaving thousands of commuters looking for another way to get home tonight. Its also forcing hundreds of giants fans to find a way to get to the game. Mark matthews is live at at t park with more. Reporter on average, 700 people ride the ferry to the ballpark on any given game night. Tonight those 700 are joining the clogged streets and the parking lots around this ballpark, because as you can see, the ferries are not running tonight. They havent run all day. At the Ferry Landing picketers walked the line in support of 16 ferry cap tanz out on strike. Were behind the cost of living, have been over ten years. Reporter robert barley makes a little over 80,000 a year. A spokeswoman for the district says thats competitive. Ferryboat captains and deck hands are the highest paid on the bay. Reporter the skippers say thats not true. According to the districts own wage survey, were behind the scale. Reporter we checked. The districts wage survey shows the golden gate cap tanz are the highest paid, compared with red and white and blue and gold fleet, but paid significantly less than ferry captains in the districts other area, washington state. Reporter the board of directors of the golden gate transportation district met today to hear a report on the negotiations. The board authorized a generous wage increase of 3 per year for each of the three years of the proposed contract. Reporter and there was no talk of budging in negotiations. You may remember that the First Court Hearing was canceled earlier this month as well. San jose Police Arrested mcdonald at his home back in august. On suspicion of felony domestic violence. Prosecutors say he has yet to be charged and say there will be a new court date will not be a new court date unless they decide to file those criminal charges. Well tell you exactly where that is and how long these storms last in just a few minutes. San jose is now in the process of deciding which pot clubs will be able to stay open for business after the city ordered all clubs to shut down in july. The citys decision on applicants so far shows a huge change in its vision for the medical marijuana landscape. Robert honda joins us live at San Jose City hall with more. Reporter janelle, if you remember, at one time there were more than 100 pot clubs in san jose, about 90 by the time the city set up its permit process. But very few are going to get approved. Pretty tasty, just got it in today. Reporter officials said pot clubs were operating like the wild, wild west with no regard for city restrictions. The number of applicants for city permit indicates many simply closed doors and of the 30 or so on the list it appears only six were approved for this first phase about half a dozen are under review, 16 were denied. Its not completely barren. But once the ordinance fully goes into effect and were down to the six to ten clubs that might still be open, many of them will be limited in what they can provide. Reporter the number could end up even lower since this first phase just means the clubs approved are in compliance with city restrictions such as not being too close to a school. They still have to apply for a permit to open and clubs that cant get a permit will have to close by october 18th. So if you have a location that fits, regardless of how you run your operation, you can stay open. Theres a lot of people that work in the industry that are no longer going to have their jobs. And the biggest and most important thing is now youre going to push people to be selling these things on the streets. Reporter city officials acknowledge a handful of clubs are still ignoring the process. Next week the city council is expected to boost fines significantly for noncompliance. Now were learning a father and son hospitalized after rescue crews pulled them from San Francisco surf on wednesday died. The accident happened at ocean beach. Medical examiners have identified the victims as 47yearold jose garcia and 24yearold jose garcia jr. Both are from stanislaus county. A total of three had to be rescued that day. Crews pulled one person to safety. New accusations are flying in one of the most highprofile congressional races in the country. Californias 17th district in the south bay. Kevin durant candidate rokhanna is demanding the office of congressional ethics investigate congressman honda for misuse of house resources. Rokhanna held a News Conference revealing allegations, the most damning saying honda enticed donations with perks like attending a state department event. If youre headed out livermore down toward i5 to los angeles, watch out for those thunderstorms, they could be impacting the next hour and possibly brentwood as well. Again, 95 of the bay area remains dry right now. But youve seen those towering cumulus clouds in the distance. The areas we talked about are the areas being impacted by those storms. If you had plans to pass through fairfield, thats where were looking at flooding conditions in place. They had about 1 to 2 inches of rainfall this afternoon in just about a twohour time. That is a classic scenario to set up flash flooding. You can see on radar at least a bit of good news for some of you out there. The rainfall is not as heavy. Were not tracking any hail at the moment. Theres no lightning showing up on the radar. But any rain is exacerbated things right now. I80 basically from cordelia right to downtown fairfield, that is the zone that you need to be aware of. If you have any creeks behind your house, watch those closely. Even though the rain may not be coming down heavy, lets say at your house, you get some downstream flooding from some of these smaller creeks, rivers and streams and that water can still rise even if we get drying conditions. And a Flash Flood Warning, were not familiar with it across the bay area, it means just that. In a flash, in a split second, you can get water rising up. Dont test and it see if your car can make it through it. Some of the roads under the Flash Flood Warning, green valley road, Solano College road, back here towards rockville road as well. In the north side of the Flash Flood Warning, it includes st. Andrews road and also Rancho Solano parkway. Hundreds of Flights Canceled across the nation after police say a contract worker set a fire at an air Traffic Control center near chicago. Tonight, passengers in the bay area are left stranded and questions about a system where a Single Person could cause such a widespread problem. Reporter one expert says that air Traffic Control is so busy around the chicago area that a backup system would probably have a tough time keeping up with the load at the same capacity right away. The passengers impacted here in San Francisco think the system should have been up and running much faster. Canceled. Reporter the nationwide trouble started after investigators say a contract worker set afire to an air Traffic Control center near chicago. Officials say its not linked to terrorism but the incident brought two of the nations busiest airports to a halt for hours and set off a Chain Reaction from coast to coast. It sounds like its one guy and he was able to start a small fire which kind of cascaded and shut down or delayed traffic across the united states. Thats pretty imcredible, really. Reporter flights did resume at a reduced rate, but the damage had been done. Many are asking how one person could impact flights nationwide. Aviation expert Mike Mccarron said the weakest link in any Security System is people. Investigators will have much to examine, but he believes the overall system is keeping people safe. Two highprofile Security Breaches at bay area airports have forced airport officials to rethink security protocols. San jose director of aviation briefed city council on security changes coming to san jose airport. The first breach happened in april when a teen stowed away in the wheel well of a flight from san jose to hawaii in april. Four months later, stowaway Marilyn Hartman boarded a flight without a boarding pass or ticket. The airport is considering significant changes including testing infrared imagery around the perimeter of the airport, increased patrols, and reviewing fencing standards and signage. A new resource is now available for a growing segment of the bay area lgbt community. Officials in San Mateo County say that community is growing but they feel its often invisible in the shadow of San Franciscos larger community. To address local issues, San Mateo County formed a lgbtq commission and held its first meeting today. The volunteer group will address issues like bullying in 62s, bathrooms for transgendered people, and isolation later in life. Foster farms recalling nearly 40,000 pounds of frozen chicken after a contamination scare. There have been no reports of anyone getting sick so far but the company is moving forward with caution since specific strain of bacteria involved could cause a potentially fatal disease. Back here on planet earth, the rain is helping firefighters make significant progress on the king fire burning in El Dorado County east of sacramento. The latest storm dumped up to an inch of rain, enough to last some firefighters who have been on the front lines for weeks get a break. The fire is 68 contained. Evacuation orders in two communities have been downgraded from mandatory to voluntary. And according to the u. S. Forest service, most of the fire is now burning in unpopulated, remote areas. Almost everyone is welcoming our rain across the droughtstricken state. There is one group that wants it to stay away these awhile. Grape growers in lodi. Rain could cause drapes to rot and decay. For a lot of us that arent familiar with flash floods, we talked about this earlier, it is just that, it can happen in a flash. Youre driving down the road, a river or creek goes over its banks, you get a lot of water in the roadway. So just keep your eyes open and keep a close eye out and around your house. Doppler radar, the good news for those of you near fairfield down here towards cordelia is this thunderstorm activity is beginning to calm down. Still some pockets of heavier to moderate rain.
