here as we head throughout the next couple days. in nearby lexington reservoir. we're getting all this rain, it's coming so quick, producing dangers now, on the other side, is this going to be enough rain to solve our problems right now? >> reporter: not nearly enough. we're here at the lake at the base of the santa cruz mountains. the reservoir looks healthy and full of life right now, the valley water district ward, it's been such a dry year, 23 we don't get any more storms, it may hurt the wildlife upstream. >> the break in the rain seemed like a perfect day for dick williams to pull out his binoculars. >> williams is a bird watch er. >> do we know that that is? >> a beautiful bird. looks like a robin. >> the birds might be okay with the amount of rain we've had this season. not all wildlife is out of the woods. >> we're mostly concerned that some of our small reservoirs are so low that they won't have any water left in the summer. and so creeks will go dry, we won't have any water. >> the creek may be okay, since water is regularly released into it. rivers like the guadeloupe may go dry this summer. endangering the wildlife that lives in it. >> we would like to see more than the storms that we're looking for, but maybe next week even more storms that would help. >> the valley water district says the last two days have helped. the rains have also brought out the greenery around the area. and they've made it easier for the kids to get down on the shore line. >> it's the first time -- >> the water district says it needs to explore how to happened el the danger to wildlife if the rain stops. >> one of the problem spots is the guadeloupe reservoir. that's at 10% of capacity right now, if that goes dry. then that means that the guadeloupe river through downtown san jose might also go dry during the summer months, that's bad news for that wildlife. live at the base of the santa cruz mountains, damian trujillo. >> the saturated growned is causing trees to topple over. sometimes with deadly results. a uc berkeley student was killed this morning in oakland after a tree collapsed on highway 13. 19-year-old kevin lockinlauni from san leandro hit the tree. he and his passengers got out of the car and moved to the shoulder, but then a truck came by hitting the tree and killing lockinlauni. another storm is on its way in. we're tracking that reporter: police tell me that she did not own a car. and they're wondering how she may have gotten away from this area without a vehicle. especially if she's wounded. now, police say they have canvassed the entire neighborhood. they've also checked with local hospitals, still, they cannot find the mother. >> i heard a scuffle upstairs and i paid no attention to it. >> reporter: mario was in the unit below when he heard a commotion upstairs. he was shocked when police later revealed what had happened. >> as a result of the preliminary investigation, right now we have determined that ava gutierrez did shoot his 11-year-old sister. and his mother, martha, she's 52 years old, and she's missing. >> reporter: police are now asking for your help to find martha gutierrez, who they believe may be critically injured. neighbors are stunned to learn 11-year-old lucy was killed by her own brother. they describe her as a friendly girl who loved to ride her bike. >> she was three years older than my daughter, she was real sweet with her. takinging her under her wing and being a big sister. >> sadly, mario and other neighbors are working on collecting donations to help pay for lucy's funeral. neighbors have created these boxes, the children have been working on them all afternoon, they've been handing them out. they're trying to collect donations in order to collect some money to pay for lucy's funeral expenses. at 7:00 tonight the neighbors also plan to hold a candlelight vigil here as well. as for lucy's 27-year-old brother, neighbors say he had been diagnosed with both major depression and posttraumatic stress disorder. he served as a veteran in the iraqi war and only returned home to this apartment complex for about two months. reporting live in gilroy, mary ann favreau, nbc bay area news. >> sad story, mary ann thanks so much. pictures from a fire in san jose where a firefighter had to be pulled out of the burping building to safety. he's recovering from second and third degree burns tonight after falling through the roof and catching on fire. the fire broke out just before 3:00 this morning at a four plex in williams road. 17 people lived in those units. officials say the fire was likely sparked by a candle in a downstairs unit. new at 6:00. the iraq war veteran who was injured at an occupy oakland protest, claims he was targeted. >> he was hit with a bean bag. jodi hernandez has more. >> reporter: this is where it all happened near the corner of 14th and broadway street in downtown oakland. scott olson says he was only here about 30 minutes when with he was struck in the head by an object. tonight he says he has new information about exactly what that object was, and he says it proves he was targeted. >> i was hit on the left side of my head right about here. >> reporter: scott olson says he's never been more certain what happened to him last october was no accident. olson was hit in the head by what he thought was a teer gas canister. turns out it may have been a bean bag. >> it just makes it that much more clear that somebody did intentionally shoot me. it's just -- it makes it that much more clear cut in my eyes. >> for a police officer to shoot at close range at someone with a projectile like that. it shows a disregard for people's safety in their life, really. >> he recently got an e-mail from an oakland police investigator informing him that residue and markings found on olson's hat revealed the type of object that struck him. he read a portion of that e-mail to us. >> the residue tested positive for lead. additionally, they examined the pattern and it is consistent with that of a stabilized bean bag rounds. >> reporter: the man heading up the investigation of what happened that night, said the source of injuries hasn't yet been pin pointed. he says they're still reviewing videos and reports. >> as far as determination, no. there's more investigation to be done. if he was, in fact hit by a bean bag, you would want to know who fired it and why? and did it meet the standards in the use of force agreement. >> olson says he was demonstrating peacefully, standing just 15 feet from officers when he was struck. the force of the object fractured his skull causing traumatic brain injuries. olson wants those responsible to pay. >> i think we should all get justice. i would like to see somebody in handcuffs over this. because i think a crime has been committed. >> now, the oakland police chief reilt rated today that their investigation is ongoing and he cannot release details, but the department is pledging to release details of the investigation as soon as it's complete. that's expected to be done at the end of april. meanwhile, olson and his attorney are preparing to file a federal civil rights lawsuit against the city of oak land and the oakland police department in the next couple weeks. tomorrow olson says he will file an official complaint with the city. in oakland, jodi hernandez, nbc bay area news. the oakland police department's crowd control policy states that less lethal weapons including bean bags should not be used for crowd management or disbursal during demonstrations. bean bags can be used when someone is engaging in destructive behavior, but only if the person can be targeted without endangering other crowd members or bystanders. sfpd is asking for your help in a brutal assault case. look closely at the photograph we're showing you. the man in the middle of the photo is considered a person of interest in the case. the two suspects are on either side of him both described as being asian males. anti-domestic violence advocates want san francisco's sheriff removed from office in the wake his domestic violence trial. earlier this week the sheriff meeted guilty to a misdemeanor charge of false imprisonment. the charge stemmed from a new year's day incident in which he was charged with bruising the arm of his wife. he said he will not leave office. an anti-domestic violence coalition called on mayor ed lee to begin proceeding to remove the sheriff because he had lost their trust. >> isn't that really what it's about, trust? it's new law givers airports the authority to do so. kimberly terry has details. >> reporter: a lot of people don't know that sfo uses a private company when it comes to security screening. it just works better for them. and other airports want to do the same. right now san francisco international is one of 16 airports in the nation allowed to opt out of using tsa screeners. others have tried to get the same allowance to no avail. it gives more power to airports looking to switch to private security screeners. >> from the airport's perspective there's a lot of customer service, flexibility in scheduling. we also have eight checkpoints in four different buildings. >> reporter: a spokesperson for sfo says it works for them when it comes to meeting their demands. part time work hes can be brought in during peak times. >> they go through the same training, back roupd checks. the screeners wear the same uniforms, most people don't even know we don't have tsa screeners. >> the tsa manages the contract with the private security firm. travelers receive the same level of screening they would with federal workers. some house leaders disagree, claiming the private sector performs better. they accuse tsa attempting to shut down of what they call a cost effective and more efficient screening model for airports. in a statement, they wrote it just approved a private screening contract for another airport and is developing procedures to implement the provisions for the opt out program under the new law. we contacted both the oakland airport and the san jose airport. only san jose got back to us. the airport is very happy using tsa, they have no plans to opt out. it works for them, and they don't see any benefits to changing anything. live at sfo. kimberly terry, nbc bay area news. thousands of teachers about to get an unwelcomed message. today is the deadline for schools to send out thousands of pink slips for positions that may not be funded next year. nearly 20,000 layoff notices went out statewide. the largest number of pink slips issue issued to l.a. unified. san francisco unified led the pack with 210 notices. not all of the teach hes will be laid off eventually, but it will be a waiting game until school starts. fallout from a ballot deal governor brown made. the howard jarvis taxpayer association made a devil's bargain. the governor announced he's joining forces with the powerful teacher's union, to create a hybrid proposal that combines aspects of the millionaire's tax with his own tax initiative. both will back efforts to raise the tax rate for an additional two years. the governor has agreed to reduce the four-year sales tax increase from a half cent to a quarter of a percent. a state lawmaker wants to extinguish the controversial fire fee for rural property owners, because of it, they have to pay as much as $150 a year. a bill was announced today that would put an end to the burdensome policy. school lunch with or without pink slime? the usda announced it will give public schools a choice on using meat with or without the controversial filler. pink slime is an additive often found in ground beef in school lunches. it's made of beef storm system lining up offshore. some of the more consistent returns still about 150 to 200 miles away, eventually that's going to be moving in. not only producing rainfall for us, more additional snowfall for this year. heading this way tonight. mainly rainfall, too warm to get any major snow at the lower levels. we're expecting much higher numbers here coming up. right now we have 66 in sunnyvale, 68 in san mateo. and 67 in san francisco. on your weather headlines, you'll find showers returning for tomorrow morning. by the evening hours, that's when a secondary round of rain will be hitting us. it's going to bring a chance of thunderstorms into our weekend forecast. we're looking at showers moving in for that friday morning commute. maybe a tenth an earth to three quarters of an inch varying widely here in the bay area. the second and stronger round on the heels that morning system friday night and saturday morning. we'll find the chance here, thunderstorms and hail with that area of low pressure as that starts to kick on down. here's your time line. a few spotty showers developing into the north bay, nothing major. root ways expected to be wet in the north bay, east bay, south bay and the peninsula. the second round of rain is going to start to line up in the evening hours by friday. we're looking at pockets of heavier rainfall, that will likely continue into the early morning hours for saturday. here's the change in the forecast. everything kind of speeding up. we may have a short break around 8:00 a.m. saturday, there's going to be instability by the afternoon on saturday. i think the biggest concern is going to be across the santa cruz mountains with 2 to 4 inches of rain, more mudslides are likely, and also more urban flooding. snow totals could go as high as 40 inches in kingville as the snow level starts to lower to 5,000 feet. as for tonight, 53 in los gatos, 51 in santa cruz. 51 in napa. your numbers will start to cool off as we head throughout friday. low 60s in the south bay, 61 in sunnyvale. expecting 62 in the castro valley for the peninsula. 60s in san mateo and 59 in santa rosa. three-day forecast, we have rape for tomorrow morpg, the second stronger round as we head into early saturday morning, we're going to keep the chance of thunderstorms into sunday at this point. then we'll get some drying as we head into tuesday,
