protest outside wheeler auditorium tomorrow morning by passing out their petitions, their signed petitions. so far nay hathey have gathered than 300 signatures in the past 48 hours. nbc pay area news. he enforced the flaw el dorado county for years. now he's accused of breaking several laws. retired deputy sheriff donald attkisson is facing charges of embezzlement, grand theft, forgery, and perjury. some of the $20,000 in donations were supposed to go to the families of four police officers shot and killed in 2009. none of the families received any donation was another atkinson or the deputy sheriffs association. atkinson is also accused of taking $100,000 from an elderly victim. new, cutting deals. two former richmond police officers made plea deals in a federal case alleging they illegally purchased guns for minors. danny harris and raymond thomas employed underage security guards they recruited from the department's explorers scouting program. they wanted to give the guns to the kids in 2009. harris admitted that he lied to a gun dealer and conspired to slow down a criminal investigation. thomas accepted the plea to conspiracy. the fight keep a controversial videotape from being used as evidence in the domestic violence trial against san francisco sheriff ross mirkarimi is still not over. the court deciding that the appeal brought by the lawyer representing ileana lopez, mirkarimi's wife, was un. is now the defense team is challenging the videotape again. his attorneys want the tape excluded because prosecutors are attempting to use less than a minute of video to make up for the fact that lopez is refusing to testify. the team's last try at barring the video was shot down by the judge who ruled that a u.c. berkeley professor will be allowed to testify for the prosecution. that professor was the first person to ever write a textbook on the topic of domestic violence and has served as a consultant in 55 other domestic abuse trials. the painful process is another step closer to completion. for the first of the families whose homes were destroyed in the san bruno pipeline explosion, they're moving back to the very place where the disaster leveled their neighborhood a year and a half ago, killing eight people. nbc bay area's monty francis has more live on when that will happen and how they feel about it. >> reporter: well, pg&e has promised to never again rebuild a gas pipeline through this neighborhood. and that promise was a condition for many of these neighbors to return. now a lot of these homes are still under construction. as you see behind me. a few actually complete. so some families are moving in and moving on. there are sthiens san bruno neighborhood is slowly coming back to life. but there are also reminders of what happened here just 18 months ago. >> opened the door, and man, what a blast. it was just -- super hot. >> reporter: 74-year-old bob hensel survived the blast, but his home was one of 38 destroyed by the massive ball of fire. hensel and his wife, nancy, have rebuilt in the same spot. after almost 40 years, they say it's still home even though right now it might not feel that way. >> i guess in touch with some of the other neighbors, and they're going through the same thing. we didn't lose family. that's the best part. >> we try to control the things that you can. there are some things you have no control over. we're both getting older. maybe we take a different look on life because of that. >> reporter: they say at their age filling a new house with new things isn't an easy task. but they decided to stay because their children and grandchildren live close by. while the memory of the blast is still vivid, the hensels say they're looking forward to making new memories in a new home. >> my son had -- son-in-law and a grandson all have birthdays in march. so we're going to have dinner up here on the 17th on the floor. >> reporter: talks are still underway between pg&e and the city of san bruno to provide restitution for the victims. the hensels are expected to move into their new home sometime next week. live tonight, monty francis, nbc bay area news. san jose police are asking for your help in finding three men who assaulted and robbed a man in front of a san jose bar on 13th street south of 101 last september. they punched the victim in the head and threw them to the ground. these images are from surveillance video and show the man who police say threw the punch. the victim was nearly knocked out and said when he was -- said he was on the ground when he was robbed. investigators say the three men were seen leaving in a white minivan which could be a toyota cienna. a former assistant professor at cal state east bay will serve the next 38 years in prison after pleading guilty to sexually abusing a 5-month-old child. kenneth kyle worked as an assistant professor of justice studies prior to his arrest in 2010. the sentencing comes after he entered a guilty plea in san francisco. he must also pay $50,000 to the victim. kyle admitted he traveled to st. louis in 2009 to abuse the infant. authorities began their investigation after he allegedly discovered sharing child pornography on line. san ramon police are on the lookout for a man they say attacked a 15-year-old girl todayment it happened on the -- today. it happened on the trail near the gateway shopping center at brewin lane. investigators say the bhoon had a gun push -- the man who had a gun pushed the woman to the ground. he allegedly tried to sexually assault her. a passing car scared the have thousands of fewer children living in the city. 5,000 than just ten years ago. kids 5 to 17 has been on a downward trend the last two decades. there were more than 11% of the population in 1990. by 2010, they made up just 9% of city residents. the economy obviously one of the biggest factors in prompting middle class and low-income parents to move out of the city which has typically had fewer kids than other big cities. a popular dog rescue group in san francisco is closing its storefront. wonderdog rescue in hayes valley will be leaving its location. the founder says donations have declined and rent is too high. it had become a gathering place for people interested in adopting dogs at risk of youth indonesia. it may be harder to find -- euthanasia. it may be harder to find homes for the dogs, but the rescue will continue its work. >> we're still here. we'll continue doing rescue. you know, like every rescue in san francisco and san francisco's very pro-dog, we'll work from home. >> so they'll do fostering the dogs at their homes, and people can still adopt them through mobile adoption centers. a coast guard crew is back home in alameda today after seizing cocaine and marijuana from the coast of central and south america. the u.s. coast guard cutter morganthau intercepted nine vessels carrying drugs and trafficking money. they seized more than a ton of cocaine, 1,-300 pounds of marijuana, and detained 15 suspected smugglers. the mission lasted 72 days. >> today's always an exciting day. we've been married for four years. whenever they come back, it feels >> all right. thank you very much. after a heated battle, an upscale retailer opened its doors in walnut creek today. a big crowd turning out for the opening of the 85,000 square-foot neiman marcus. shoppers lined up 90 minutes before the doors opened and were greeted by employees with pom poms. the sprrs were decorated with pieces by 30 local artists. it ends a two-year development battle that had to be settled. >> i think the negativity's gone, and the people that supported it are excited about it. this is a good day for walnut creek and for the central area. proponents of the store -- opponents of the store were concerned it might mar the small town charm of walnut creek. tonight, oakland police are searching for a masked man who walked into a cvs store at the rock ridge center. here's a picture. the s.w.a.t. team responded and thought they had the suspect trapped inside. after checking the tape, they found the suspect had gotten out before they even arrived. he's still on the loose, and police think he was armed but he didn't steal anything. a 27-year-old former marine is missing. possibly in pacifica after he went rock climbing. joseph mchenry was last seen a week ago. before he disappeared, he told his friends he was going rock climbing. police found his car on wednesday near the sharp part golf course off highway 1 in a residential area. mchenry had planned to rock climb and camp at a secluded beach in pacifica. the coast guard and police searched the shoreline. so far, no sign of him. how do you feel about a t-rated animated film? the "t" stands for tobacco. if a local nonprofit has its way, that rating could become reality. it wants to increase the number of january -- to decrease the number of animated characters it shows smoking on the big screen. marianne favro says the scenes are k really hurt kids, especially teenagers. >> reporter: the surge's aren't shows there's a -- surgeon general's report shows there's a big link between characters who light occupy screen and kids who try smoking for the first time. a reason movies marketed to kids are feeling pressure to end cigarette smoking. one bay area group want to go smoking scenes in movies extinguished. breathe california says there's new evidence when kids see characters lighting up on the big screen, they're more likely to start smoking themselves. >> we now have the u.s. surgeon general's report from 2012 that did a mega analysis of all of those pieces of research and has determined there is a causal relationship between seeing smoking in films and starting to smoke. >> reporter: reed gave a thumbs down to "hugo" for smoking scenes. but the worst offender was -- >> what are you saying? ketd around the area. 70s before the see breeze picked up. we are cooling off big time around the bay area. before the sea breeze kicked in, 70 in san francisco, warmest day of the week as we've been talking about, close to 81 in santa cruz. gorgeous there. and mid to upper 70s. 75 in livermore and 74 around nap amp look what's happening now. we are in the mid 50s already. san francisco and oakland, the sea breeze has reached the inner part of the east bay here around the water. and eventually that cooler air will spill up into the higher elevation, east pay valleys, too. the seabreeze is cranking up. pushing in low clouds for tomorrow morning. we may see some mist or drizzle along the coastline as we get into the start of the weekend. saturday, we'll see cooling. clouds coming, not too much in the way of rain showers other than the mist we could see on the coast. looks like now around midday sunday we'll see our best chance in the first -- and the first chance of many to see rain and moving through the bay area. the radar, looking pretty dry. and today and maybe into tomorrow, it will continue that way. on the way we've got a series of systems here. this first one is kind of scooting high pressure out of the way. not bringing rain. it's bringing high clouds and pumping up the sawbreeze. the systems -- the seabreeze. the systems behind it, a large-scale pattern change. moving from the west coast, no rain in sight, to one that will have a trough of low pressure parked offshore. it will pump in systems almost every day and a half or so for the next seven to ten days. end their weekend we'll see cooling. a chance of lighter rain. tuesday, wednesday, another for thursday and friday, periods of rain. the heaviest generally north of the golden gate bridge. the entire area getting much-needed lane in what will be the final week of winter. hour by hour for your weekend, you see on saturday, lots of clouds. not much showing up in the rain futurecast. into sunday, here around midday, that's lunchtime bond is sunday evening, light rain. the rain totals not much. toward the north bay, close to a quarter inch of rain. enough to wet the ground and hopefully knock down all the tree pollen that's been outside. allergies is been horrible with the dry conditions and the warmer than average winter we've seen. so traveling from the high country this weekend we will see snow flying as early as sunday afternoon. a dry commute heading to the high country. by sunday evening, we will see snow flying in the sierra. around the bay area, should be mostly in the 40s as that onshore breeze picks up. it's going to add moisture to the skies and keepur o temperatures up at least for the morning. for the afternoon look what it's doing to daytime highs. down from the upper 70s to low to mid 60s for most of the bay area. for inland valleys and on the coast and inland, 50s most places. for the weekend, cooling sunday, cooler than saturday. chance of lighter rain sunday. monday through thursday, rain. rain friday, too. i don't recall a seven-day forecast where we've had that much rain. but we need it. we need it this time of year. i think the gentleman in
