As soon as she gets that stamp in her passport that shes admitted on the immigrant visa she has, she will automatically become a u. S. Citizen. The president S Immigration ban is still on hold because the ninth Circuit Court of appeals in San Francisco declined to immediately reinstate it. Nbc bay areas Marianne Favro has a closer look at the complicated court case. It started of course in Washington State and here we are in San Francisco. Yes, and now the ninth Circuit Court of appeals has asked for both sides to file legal briefs before the court makes its final decision. This after a federal judge halted the program friday. Legal analysts say the ninth Circuit Court is considered the most liberal court in the u. S. The u. S. Justice department is asking to pause the decision by u. S. District court judge james robart who suspended trumps executive order. As you know, that order barred citizens of seven muslim majority countries from entering the u. S. For 90 days. Legal experts we talked to today say the burden of proof is now with the Justice Department. Theres no question that the Justice Department has an uphill battle here. The state of washington has already shown to a trial judge and at least implicitly to the ninth circuit that they have a probable a chance of probable success on the merits of the case. Attorney dean johnson says a threejudge panel from the ninth circuit will be selected randomly to make the decision. He says if that panel ends up being comprised of liberal judges, and the uphold the District Court judges decision, then the travel ban would be over. The governments brief repeatedly asserts that president ial authority cannot be questioned by judges once the nations security is invoked. Back to you. It is complicated indeed. Take a look at the scene in chicago today as a father was reunited with his wife and daughter. They too were coming to the u. S. From yemen. And in new york, iranian researcher nima enyadi boarded a flight to new york today. He received a visa to conduct research at stanford university. Enyadi says he started calling airlines as soon as the court blocked the ban, looking for the quickest, most direct flight. He said he would go anywhere, as long as the plane landed in the u. S. Meteorologist rob mayeda is tracking the storm. When will that bridge get wet . Starting to see rain bands approaching San Francisco. Doppler radar is beginning to see moderate rain into the north bay. San jose starting to see showers and heavier rain around the Santa Cruz Mountains. Clearly on the wide angle view on our storm ranger radar, thats where the rain is located, an hour to an hour and a half away from cross to go the central bay, bringing gusty winds. You can see the back edge of the system right there followed up by more showers and rain at times as we get into the monday morning commute. We do think briefly we could get gusts up to 40 Miles Per Hour. Gusty winds at times, mainly for the first half of the night. Roadway flooding that could fall from the downpours we see late this evening and tonight, which could have an impact on the morning commute. Slight chance of isolated thunder in the mix too. Two more storms ahead beyond the storm were seeing now, which will bring healthy rain totals to the mountains. Second storms, slower moving. That could double rainfall totals and increase Flooding Risk for creatieks and streams especially in the north bay. Here at home, one person is dead after being shot in vallejo this afternoon. Vallejo police got a call of shots fired shortly before 1 00 p. M. When they arrived on scene, they did find a person who had been shot. The victim was pronounced dead at the scene. This happened near an apartment on hilborn street in vallejo. Investigators are looking for a suspect or suspects. No word on what led to the shooting. A dance competition afterparty in vacaville descended into violence early this morning. Hundreds of College Students from several universities were at this event on orange drive. Calls started coming in about fights breaking out and spilling outside. Then just as officers arrived, someone pulled out a gun in the parking lot and started shooting. Police contained the area and did an extensive search but could not find any victims or the gunman. We share the roads with these trucks every day. Now drivers tell us there is a hidden danger on their trucks that could spark a fire on a highway you drive. It tells you regen required. Ive got over 5 million miles. Reporter he hauls everything from solid waste to soda pop. Its a good occupation. Got my kids through college, paid for my house and my toys. Reporter last february, he could only watch as his beloved truck burned. I timed it. Eight minutes, that truck was burned to the frame. Thats all it took. Reporter you could have been inside that truck. Could have been sitting in there when it caught on fire. I feel fortunate that i was out of it, didnt get burned trying to save the truck. You know, its your truck. Something to me that can be completely preventible. Youre talking about a crime scene. Reporter jason, like many other truckers we spoke with, believes the fire was caused by a diesel particulate filter or dpf. California started requiring the device for all Diesel Engine vehicles in 2007. Roughly a million trucks in this state are equipped with one, and those trucks travel the country. The filter traps 99 of the soot produced by diesel trucks, cutting air pollution by capturing small particles from a trucks exhaust before they get into the air. Keith says his truck fire ignited while the filter was undergoing a cleaning process called regeneration, burning all that captured soot into a fine ash. The cause of the fire is undetermined. But insurance investigators suspect it started somewhere in the exhaust treatment system. Their report notes the Company Investigated several similar fires but pen pointiinpointing is difficult because, quote, the exhaust gets so hot that evidence is consumed. The filters are expensive. They are dangerous. And they dont work. Reporter bud caldwell owns a petroleum and trucking company. He formed an alliance to challenge the states rules requiring filters. The group points to a series of filter failures including two recalls for filters, including a fire in washington that destroyed 25 homes. These were not ready for prime time when they were put forward. Reporter theyre suing the state, asking for restitution for drivers with damaged trucks. These filters do not cause fires. Reporter hes the chief of enforcement at the California Air resources board. You say theres no link between the filters and fires. In your report, you investigated 13 fires, you found three fires were linked to the filters and you issued two recalls. That is true, that we issued two recalls. Reporter he acknowledges some of the initial filters put on the market were linked to fires. But hes confident newer trucks with filters work safely. He says c. A. R. B. Investigated roughly three dozen fires since 2009. We have looked at the the fire issue extensively and we dont see evidence linking filters on the road today and fires. Reporter while they havent found a connection between newer filters and fighters, there is a high failure rate. Those faulty parts are still used on trucks today. Why havent you come down stronger and addressed these issues sooner . These parts are failing at a high rate. There are a number of hoops we have to jump look at and prove in order to force the manufacturers to take action. In this case were essentially not able to do so. Reporter and what happens to the truckers and the businesses and these folks in between while all thats happening . Well, like i said, these instruction are safe to drive. If they have problems with the trucks, theyre going to need to repair them. Reporter as for keith daniels, the lifelong trucker says he hopes this issue will be resolved and soon so other drivers wont have the same close call he did. You think you can go out and do your job and come home safely, you know. The alliance for california business first sued the state unsuccessfully in 2015. But they say the new lawsuit contains new fires, including keiths. Meanwhile, c. A. R. B. Is working to false manufacturers to fix faulty parts. Are you right behind her . Reporter right now im literally right behind her. How do you feel . No questions. Reporter shes ready to go into a press conference right now, well try to get her to say hello, but i can tell by looking at her face, her emotions are definitely there, she was happy to embrace her family and people she hadnt seen for literally years. Her first steps on american soil. This is a young lady who has been through a lot, as we know she was a part of that travel ban. And then as she was just about to step on a plane to come to sfo, thats when it all happened. She and her father were stuck in a hotel, an African Hotel in djibouti. And then of course she had some luck on friday, when a court order allowed the ban to be temporarily lifted. Thats when she took her opportunity to come to america. As soon as she arrived, she immediately got that passport stamped. When that passport was stamped, she immediately became an american citizen. Right now she is feeling relieved but most importantly, her family are happy she can now be in the house with her two siblings, her mom and dad, her entire family. What a journey for this young lady. Its taken her six years to get to this point. Were going to try to get a little bit more information from her, maybe, ill get her to talk, in the next few moments. Wind gusts 20 to 30 right now. Those could accelerate up to 40 Miles Per Hour briefly around 9 00. Then wind speeds starting to throttle down as the cold front passes us between 6 and 10 00 tonight. You see the heaviest rain widespread from 6 to about 11 00 p. M. , followed up by scattered showers as we head into the morning commute tomorrow. Tomorrow, mild, low 50s to start the day. Some rain at times. Likely ponding on the roads courtesy of all the heavy rain well see over the next four hours.
