Police have surrounded a home where an armed man is accused of threatening a pregnant woman. Police also evacuated the neighborhood. This is near the East Ridge Mall in san jose. Marianne favro was on scene and eight hours and counting. Whats the strategy . Reporter well, officers have tried everything from k9 officers to robots here to try to get the suspect to come out, and in the last hour, the situation has intensified with officers using flash grenades to try to get that suspect to come out. Despite the flashbangs, the suspect is still barricaded in a home on claire ease drive. He is a suspect in a morning robbery of an auto parts store. The man jumped the fence and ran into this enabled. Police say he forced his way into a home where he held a woman against her will at knifepoint, and told her he had a gun. The womans relatives say she was pregnant. She was not injured. The man then forced his way into a second home and then a third house, where a family lives. The family escaped unharmed, and thats where Police Believe the suspect is barricaded right now. Police evacuated the neighborhood and set up a perimeter. They brought in the s. W. A. T. Team, dogs, and armored vehicles, and even a robot to help determine the suspects location. Neighbors who have not been able to return to their homes for more than eight hours are rattled. Youre in your home, you think youre safe and it ends up someone goes inside your home and you think youre safe and really youre not. Reporter police used a bull horn and spoke in both english and spanish, urging the suspect to come out with his hands up, but so far, that has not happened. Now, a block and a half away from this barricaded suspect is an elementary school, Kathryn Smith elementary psychological. It was not placed on lockdown. But i talked to the principal, and he told me they kept the students inside during recess, just as a precaution. Concord police dog is back home tonight recovering from stab wounds. Yesterday police shot and killed a man who attacked that dog. That man is identified as dominic musilman of antioch. Before he attacked the dog, he attacked another man with a hatchet. That victim will recover. Detectives say the k9, gelee, tracked him to a backyard shed where he emerged with garden shears. He used them to beat and cut the dog. Jelle is under heavy medication and may be off duty for a while. The feds have spoken. The question now, will sfpd listen. Department of justice says the sfpd needs to make major changes, the results of the review released today. Stephanie chuang joins us in San Francisco. You know, the big question here with answering questions from the community here about trust, and the mayor and interim police chief says, look, we didnt wait for this report to come out, including outfitting the department with body cameras. This is abbreviated report n. It, questions including the power that the Police Officers union has here in the city. And late this afternoon, that union fired back. Two months after San Francisco police shot and killed mario woods, mayor ed lee asked the department of justice to conduct an investigation into the entire Police Department. The doj focused on five areas. Use of force, bias, community policing, recruitment and hiring. There are significant efficiencies we identified. Reporter the sfpd does not adequately investigate use of force or keep complete data on the incident. The doj also found police disproportionately pulled over africanamericans and searched both africanamerican and hispanic drivers compared to white drivers. Not only were africanamericans and hispanic drivers disproportionately searched, but less likely to have contraband on them. Reporter the Police OfficersAssociation Says it has been fully cooperative with the doj investigation, pointing to this line on page 72 of the report. Quote, it is important to note that the findings do not prove racial bias by officers of the sfpd or by the agency as a whole. Mayor ed lee says the city has thrown open the door to change and plans to implement the recommendations. Our Investigative Unit reviewed five years of reports, and found 13 Police Departments, including San Francisco, have undergone this same type of review. Now only one Police Department finished the process. That is las vegas. That department was also reviewed after a rash of police shootings, and one year after the review, the doj said Las Vegas Police had adopted 95 of the recommendations. Now the doj says other departments, and they include philadelphia and spokane, washington, also showed positive results. Six months after their reviews. However, the baltimore Police Department which began its review in 2011 failed to implement any reforms. Now, as a result, that department is now under a civil rights investigation by the doj. Raj . Students at san jose state are calling for justice, following reports of two sexual assaults involving students at an offcampus party. The University Says the suspects, a member of the Water Polo Team, may have left the country. Michelle roberts joins us from campus with the latest details. Michelle. I stuff like this goes on around campus. Reporter students are upset to learn a water polo player has now been accused of sexually assaulting two women. The two victims did not know each other, and they came to us independently. Reporter chief diversity officer, says the assaults happened on labor day weekend. Following the assault, University Officials say the suspect was immediately moved into staffonly housing. And 24 hours into the investigation, he was banned from campus, pemdi pending the investigation. Because he hasnt been arrested, and charges have not been filed against him, officials are not releasing his name. Now the nocontact order, the noretaliation order, moving the student, and then doing an interim suspension. Reporter today many students we spoke with say theyre frustrated the university didnt send out a campuswide alert, notifying them of the alleged assaults. We should have been alerted maybe sooner. But im glad to be finding out now. Reporter today a spokesperson with the University Says the alert wasnt sent because the incident wasnt deemed an immediate threat. Many students we spoke to disagree. I believe it is a threat, because it is someone thats in our campus and we might, like, be, like, encounter them. Reporter michelle roberts, nbc bay area news. University Officials Say the entire Water Polo Team received training following the incident. The District Attorneys Office is reviewing the case, but no charges have been filed. The university is also conducting its own separate investigation. They didnt think it was an immediate threat, but did sjsu break the rules by not alerting the community right away . Our Investigative Unit looked at the details of the clery act, the federal law that requires colleges to tell the public about crimes that happen on or near campus. It says schools have to let people know about crimes in had a timely manner. Thats only if it the crime is an ongoing threat to students or employees. The law leaves it up to Campus Police to make that determination. We also want to pass along a correction. Information we reported during our morning newscasts. So speaking of rainfall, the time line, of course, of utmost importance. So as youre going to be able to see in the futurecast, by thursday at 11 30, rainfall lines up here across santa rosa, middletown and calistoga. We expect still the heaviest rainfall to arrive as we head throughout 7 00 a. M. On friday. Winds, 15 to 30 miles per hour. Possibly some embedded thunderstorms, and not only for the east bay, peninsula and the north bay, but it does look like this wet weather will also move down to the south bay, maybe by 10 00 and also 11 00 in the morning. Pretty locked in for a quarter to a half inch in the south bay. And from San Francisco northward, a half inch to 1 inch the way we see it right now. Well spend some time on your extended forecast.
