New tonight at 5 00, some bay area Trump Supporters are suing the city of san jose, the mayor, the police chief and 38 others tonight. 14 supporters filed the suit because of what happened while they were leaving a trump rally in downtown san jose last month had. The supporters say they were assaulted, intimidated and threatened by protesters and claim that San Jose Police failed to protect them. San joses mayor just released this statement within the past 90 minutes saying the ludicrous accusation that i somehow directed the Police Department to stand down at the rally is utterly false. In fact, i have no authority to issue such an order. Sam liccardo goes on to say 20 protesters were arrested and will be prosecuted. We also have some breaking news to bring to you right now. In Sonoma County, evacuations are under way in a windsor neighborhood after firefighters saw what might be an explosive device at an rv park. The device was found in the wine country rv park right next to highway 101. Now, the rv park, the nearby mobile country club, and Windsor Elementary School are being evacuated. Two men accused of a violent and brazen daylight attack appeared in Sonoma County court. Investigators say the men are responsible for gunning down and robbing an armored car guard in front of a windsor bank on tuesday afternoon. Nbcs bay area Jodi Hernandez was in the courtroom as the men were formally charged today. Jodi . Reporter prosecutors say they are charging this case very aggressively. The two men appeared here in court today for the first time where they were formally charged with attempted murder and armed robbery, but thats not all they are accused of. Sporting a black eye and shackled to a wheelchair, sergei gutsu and his alleged accomplice ivan morales appeared in court where they were charged with attempted murder and armed robbery. Investigators say morales used  rifle to shoot and rob an armored car guard outside windsors chase bank on tuesday afternoon. Right now ivan morales is charged as the shooter of the guard and sergei guptu is charged as the one who also possessed a firearm during the robbery. Reporter Sonoma County Sheriffs Department confirms tonight the two aid allegedly carjacked a man playing pokemon go at a sacramentoarea park sunday night and then used the car to commit the robbery and shooting in windsor. They are responsible to do such a crime, you know, and its its pretty, you know, its just awful, you know, to think about. The double shooting happened just before 11 00 this morning on tierra buena drive not far from the Elementary School. Police say two men were shot and one victim was hospitalized in serious condition. The other, a gunshot wound that wasnt lifethreatening. Hours ago the state board of education unanimously approved new rules including lbgt accomplishments in history classes, and that will start in the second grade. Reporter i have to tell you, you know, big changes are coming to californias schools, but they have been under way here in San Francisco. Were standing at one of two high schools that will be getting a new lbgt studies program, and this has been under way for a while. In fact, for years here the plan was just to make sure all students felt included. Reporter San Francisco Public Schools already have a department focused on lbgt support and a district that tries to stay progressive. We started a class at one of our high schools that is actually the first first lbgt studies class in history and thats here in San Francisco at the school of arts. Reporter program will expand to two other high schools and in other subjects the push is for lbgt contributions to be recognized, too. Its about accepting everyone. Its about making sure that everyone feels included. Reporter this comes acts state board of education approved Ground Breaking new social studies framework to approve lbgt history and contributions today. Under the new rules the lessons will start with younger grades with a focus on including diverse families and later moving on to the lbgt fight for equali equality. The plan which has been formally submitted to kranz calls for a third lane to be opened on the bridge during heavy commute time. Construction could start as soon as october with an estimated opening of december 2017. Projects leaders are also planning on adding a bicycle and pedestrian lane to the upper deck of the bridge.
