The five men arrested are between the ages of 17 and 20. One is from stockton and the rest from san jose. Even though they didnt kill their friend, they are charged with his murder under the socalled provocative act doctrine. A 24yearold homeless man admits he stabbed to death a 16yearold, ivan diaz, but Police Released him supporting his claim that he acted in selfdefense saying the young men attacked him last month at campbell park. Because of the actions caused causing diazs death they could be charged with his murderer. We believe that the five subjects who were with the deceased 16yearold were the ones who initiated the attack. If convicted the five suspect face sentences of 15 years to life in prison. And take a look at this. A golfer spotted this car in a canal this morning, and when rescuers arrived, they found a man inside. Nbc bay areas Jodi Hernandez is in pittsburgh with more and why rescuers say this death could be linked to this weeks spring storm. Reporter drivers distraught mother came to the accident scene to see for herself where 56yearold Dennis Sandoval lost his life. Sandovals family says the pittsburgh electrician was driving home from the b. A. R. T. Station after a day at work last night when he crashed his car into the contra costa canal. We dont know exactly when this collision occurred it. Aperiod that the driver drifted off of the roadway. Rescue crews spent the morning in the chilly waters of the canal pulling sandoval and his car out of water. Police say yesterdays Stormy Weather seen on this corel phone video taken by a neighbor very well may have played a role in the accident. Hail covered the roadway with a sheet of white. Last night this was the scene in oakland on el dorado avenue in the Piedmont District this. 50foot tall oak tree crashed to the ground moments after a man was walking by with his dog. The tree smashed three parked cars and snapped a power line. I heard the crackling, and i thought it was thunder so i turned around to see the lightning and everything and saw the transformer blow and saw the tree come down and just got inside as quick as i could. Thank goodness the rain saturated the ground and weakened the root system. Now on monday this 80foot redwood tree in berkeley shattered into pieces when lightning struck. The coast guard and Fire Fighters quickly contained the spill, but they say they still have no idea where it came from. State Officials Say the spill did not impact any wildlife. Well, san jose is trying to build up its police force, but its having problems filling the spots. Only half the spots available are filled for the next police academy. Nbc bay areas Damien Tarullo joins us at city hall this evening. Whats the problem here, and why the low numbers . Reporter well, raj, two City Council Members told the rules Committee Time to act is now to replenish a disturbing number in the police force. They say its they suggested making some tweaks to the Pension Reform Initiative that voters approved all to keep the proverbial police ship from sinking. There are usually 50 or 60 cadet who make it into the academy, but after a rigorous screening process, only 29 remain standing for the Upcoming Academy in may. If that is the case and thats accurate, its just even more cause to take some action swiftly. Reporter they have voted to put measure b on the ballot, the Pension Initiative and now he thinks some measures are a mistake and wants to tweak it to keep more cops from leaving, like this cop who was climbing the ranks as an undercover drug cop to work the midnight ship in redwood city. He left san jose because of measure b. People want to feel secure in their line of work, that they will be taken care of, and thats the bottom line. Reporter mayor and police chief have won possible solution to lure more recruits by shortening the time they have to wait before they get hired. I think we need to go to three academies per year. We can do that, and then we would run academies around 30 in size. But he says thats not going to keep cops from leaving or even coming here at all. What happens to the Council Member and the proposal, the committee suggested it go over to closed session at a future council meeting. The mayor tells me theres actually 31 cadets in the new academy, not 29. Two are holdovers from two previous academies. And ill tell you who the mayor is blaming for the rising crime. To our developing story in chile, video of people fleeing a pharmacy as bottles and jars are falling off shelves during that powerful 8. 2 quake that struck last night. What is perhaps most remarkable is that the death toll right now is just six people. The toll on property, a different story though. Fishing boats along the coastline were tossed out of the water. Some of them overturned and damaged beyond repair. Soldiers helped some of the hundreds of thousands of people who were force to evacuate because of the threat of a tsunami. Even the Hawaiian Islands were watching for waves that never materialized. At their highest the waves off the shore of chile were only about six feet high. The chilean president declared many areas disaster zones promising troops and aid. The rim of fire which runs along chiles coastline is responsible for the overwhelming majority of the worlds seismic and volcanic activity. This earthquake occurred in an area of plate convergence where one plate slips underneath another. A similar earthquake to what weve seen in japan and sumatra in the last few years. The mayor criticizing pg es response to the new criminal charges against the utility. This stems from the deadly pipeline explosion in 2010. This video is a krim reminder of what happened. Pg e was indicted just yesterday on 12 federal criminal counts. The feds claim that all of the counts violate the natural gas Pipeline Safety act. Some of the violations include failure to maintain, repair and leak. Records for its Gas Transmission pipeline. San brunos mayor says pg e responded by calling the deadly explosion an accident. Thats something that he says makes him angry. They keep calling this an accident and they keep talking about what they have done and what they are going to do in the future. This was not an accident. This could have been prevented, and because of pg e and the lack of oversight by our own Public Utilities commission, eight people lost their lives. Well never see them again. They all perished. Its not an accident. Its south korea that i feel they could have prevented by preparing the lines and just taking care of peoples safety. Still very emotional for the residents of san bruno. Police tracked down the cabbie and put him under arrest. They say he had the motel key to the victims room and meth on his person when arrested. Should Public Schools stock eni pens in the Senate EducationCommittee Approved the bill in sacramento after several parents testified to its effectiveness. One father says his sons life was saved by an alert school nurse.
