Demolition has begun at an apartment at the center of a renters dispute. They are tearing down the reserve apartment complex in san jose. You may remember, hundreds of tenants took their fight to city hall when the owner evicted them in order to build luxury apartments. The city is now working on providing compensation for some of the tenants who were evicted. California is stepping up the sanctuary city fight with the white house. The state and San Francisco announced a lawsuit against the administration and the justice department. President Trumps Administration threatened to freeze funding for local Law Enforcement in sanctuary cities that would put 28 million in federal grants for california at risk. Californias attorney general says the state will not stand by and just do nothing. Now the federal government is using the threat of its power and its size to bully local jurisdictions to do what they want and, fortunately, youve got the city of San Francisco. I think there will be other jurisdictions i just saw in chicago and now the state of california they are going to say no. They would be required to give federal agents full access to local jails and also 48 hours of notification when they plan to release inmates in order to unlock that money. The marine layer is thinning out at the mendocino cost. Still cloudy in San Francisco but, hold on, there will be sunshine with the temperatures right now at 64 degrees and the sunol camera now all dark well, it was there just a while ago. Were seeing some clearing for those inland areas. As we look outside in san jose and the sevenday forecast is at the bottom of the screen showing warmer temperatures on the way. Highs in the 70s for willow glen when the normal High Temperature is 82 degrees. As we go into the evening, the winds will pick up and already by sunset well be feeling temperatures in the mid60s and they will continue to see those temperatures dipping into the evening. Reporter we first introduced you to a family in napa that had to move 500 miles to get help and the lack of critical home care is impacting more families. The state isnt convinced that theres a problem. Its leaving parents on their own, searching for answers and accountability. The video is hard to watch. 15yearold Kaitlyn Heflin in the middle of a seizure. Her mom liz has been by her daughters side alone through it all. I just want to be her mom, yeah. Reporter you just want to be her mom . Just to be a mom. Yeah. That would be awesome. I just need some help. Reporter help managing kaitlyns seizures, administering her medication and looking her up to feeding tubes. The family is supposed to be getting 16 hours of nursing care every day. Have nurses been able to fill those 16 hours a day . Reporter not at all. For three years, zero hours of care. Reporter for more than three years, they have yet to find a Nursing Agency that can help. Has this reached a crisis level . Absolutely. Reporter as we reported last year, the state has an obligation to make sure that kids enrolled in medical, like kaitlyn, get the service they need. Some say the state he is ignoring the problem. The state didnt even keep track of when agencies refused care or couldnt staff hours. The department of health care services, which oversees the system, tells us its now collecting this data but the state still says there is not a systemic or geographic access to care problem. From the stories weve heard, it does seem to affirm that children are not getting the medical services that theyve already been determined to need. Reporter william is an attorney with disability rights california. Following our investigation, the Group Launched its own statewide investigation and asked to talk with struggling families. The organization got a big response. We heard from over 100 families. Thats something very significant in the system and one, again, worth taking a closer look and a deeper dive. Reporter liz has spent countless hours on her own calling nursing agencies. The state gave her this list of available providers last year. She contacted more than 40. This one does not accept medical. Reporter only one said it could help her daughter and its located in l. A. What do you think is really going on here . I think this has been overlooked for so long that nobody has an answer. Im not asking for something luxurious or for money. Im not suing anybody. Im asking for care for kaitlyn thats covered, that shes supposed to have. Reporter so whats the solution . Some say increasing the medical rate could entice more nurses to do this type of work. Its not about rates at all, others say. Its about the states obligation to make sure really sick kids get the help they need. The number of Home Health Providers has remained steady. Still no reason why someone shot five people during a vigil in the south bay, say police. It happened around 10 30 sunday night in san jose at vista glenn drive by hill view park. Police say the crowd was gathered for a vigil for victims of a car crash and thats when someone drove by and hit three men and two women. A San Jose Police spokesperson says investigators are not ready to release details about the suspects. Two people charged with robbing and killing a San Francisco photographer will be back in court on friday. Yesterday, the duo pleaded not guilty. Authorities accused a woman and man of shooting 71yearold edward at twin peaks last month. They allegedly stole his camera during the shooting. His sister criticized the decision to release him five days before that shooting. Based on the facts and the facts are very clear, he was a felon arrested with guns and he should not have been allowed on the streets of San Francisco. The pair will be back in court on friday. And a man is in jail for a street fight in novato thats being treated as a hate crime that occurred sunday morning. Two men were seen arguing and then they got into a fight. The suspect allegedly accused a hispanic of stealing from his car. According to the police, he spit in that mans face, called him racial slurs during the fight. B. A. R. T. Is trying to decide what to do about its small police staff. They are currently 50 officers short. A meeting got under way about an hour ago. They increased the officers at trains and stations after recent highprofile assaults and robberies. A man reported three young men last night stole his cell phone in oakland. The suspects indicated that they were armed. The backlash continues this morning after the president s delayed denouncement of white supremacist hate groups. Meanwhile, a san jose woman is back in the bay area after she witnessed that violent rally in charlottesville firsthand. Marianne favro spoke with her about what she saw. Reporter this is what kristen and her husband encountered on saturday in charlottesville. Protesters carrying assault rifles. That was really shocking. It was just incredible to be walking next to people who had this artillery on. Reporter she saw rows of Police Officers in riot gear waiting to respond. Its like a molitov cocktail. One part hater and one part ammunition and guns. Reporter suddenly, the protest grew more intense. Thats when the tanks started coming down the street and the National Guard showed up. Reporter she was just a block away when a driver plowed into counterprotesters and killed 32yearold heather heyer. She saw another car attack in the parking garage she was in. This woman who was a white supremacist was trying to pull out and all of a sudden she just hits the gas and just starts tearing through this group. Reporter no one was seriously hurt in that attack. The unite the right protest denounced plans to remove a statue of robert e. Lee but kristen says there was much more going on. There was not any discussion of the statue. Tonights show Host Jimmy Fallon gave a heartfelt discussion about the tragedy in charlottesville. Even though the tonight show is not a political show, its my responsibility to stand up against intolerance and extremism. The president took two days to denounce White Supremacists is shameful and i think he finally spoke up because people stood up and said something. Fallon talks about his young daughters saying kids need leaders they can look up to. He said ignoring extremism is as bad as supporting it. On saturday, former president barack obama tweeted a Nelson Mandela quote in response to the violence. Ariana grande tweet after the Manchester Bombing was the first most popular tweet. Arnold schwarzenegger announced on facebook a 100,000 donation to a Los Angelesbased antihate group. That organization is a center named after the nazi hunter who schwarzenegger called his friend. The former governor says his donation is in response to violent clashes in virginia. Uc berkeley hired a social worker to assess the needs of the homeless in peoples park. The social worker started last month and is paid 92,000 a year. At least nine Violent Crimes were reported in the park last year and in june a homeless woman was charged with putting meth in a little boys mouth. The university owns the park and is thinking about simply Building Student housing there. Its no surprise, the Homeless Population in berkeley overall is on the rise. We looked at the numbers. In 2009, more than 300 sheltered Homeless People and 371 unsheltered. This data, according to daily cow. The sheltered number remains the same today. The number of Homeless People in all has doubled to 650. Pretty soon you might be able to drink alcohol at cal games. The sf gate reports that berkeleys Athletic Department is looking for ways to boost revenue. It lost about 22 million last year. Some ideas include selling alcohol at football and basketball games as well as selling the rights to memorial stadiums, cutting roster sizes and even tearing down a stadium in order to build new housing. Were going to be hitting 75 right at 2 00 and pretty much all day long you can enjoy comfortable weather as we look outside in santa rosa, you can see the sunshine there and also in morgan hill, looking at the Anderson Reservoir and the sevenday forecast is coming up at the bottom of the screen. The cool weather doesnt last all that long. Live right now in palo alto, we see the sunshine but it was cloudy throughout the morning and we keep the sunshine throughout the rest of the day. Now, normally were hitting 77 but our High Temperature at 2 00 will be at 74. And then it will be breezy, too. It will be comfortable with highs in the morgan hill up to 76 degrees today. The warmest day looks to be on friday, up to 90 degrees and then well start to see our temperatures coming back down early next week and a lot of people have their eye on monday because thats when the Solar Eclipse happens. It looks like for the inland areas it will be all clear. But we will still have those clouds in San Francisco. So you may want to move away from the coast if youre looking for ideal viewing conditions in the bay area for that Solar Eclipse. Jo ling kent has more on the story. Reporter this morning, after it went missing for 31 years, this priceless work of art is finally home. Closure for an injustice that happened 30 years ago. Reporter the painting, a masterpiece, was stolen from the university of Arizona Museum of art the day after thanksgiving in 1985. It was a classic heist. Police believe someone just cut the painting out of its frame, rolled it up and walked out the door. Brian seestone was the detective on the case three decades ago. There was very little evidence. Reporter there was no Surveillance Video of the theft but police came up with the sketches of two suspects. The trail eventually went cold. Whenever stolen art was found anywhere, seastone would ask is she there . And, unfortunately, it wasnt the case. Reporter fast forward 31 years to new mexico and antique owner picked up what he thought was a nice oil on canvas at an estate sale. He tossed it into his truck with other finds. Reporter it got thrown in on top last. Reporter the next day at the store, customers started asking, is that it . And then he did what most would do. He googled it. We blew up the computer on our computer screen and started comparing. It was an exact match. Reporter he thought hed keep the painting for himself. He liked it. So he paid 200. If i were buying it in the estate for resale, i probably would have paid 100 for it but since we were going to take it home, we pay more to make the offer a little bit better. Reporter its actual value, roughly 137 million. Today, its back at the University Museum safe and sound but what happened in between, still a mystery unsolved.
