Immigration court. Coming up after nbc bay area news at 11 00 access hollywood lives followed by days of our lives at 1 00 p. M. In court. You get an attorney. Even if you can t afford one. Kris 2t welcome back. When you Face Criminal Charges in court you get an attorney even if you cant afford one. That doesnt hey employ for folks who end up in Immigration Court which can make a huge difference. Senior Investigative Reporter Stephen Stock has the numbers and a story of one u. S. Veteran set to be deported until a lawyer got involved. We obtained Immigration Court data that shows someone who has a lawyer in court is five times more likely to have the case ruled in their favor than someone who does not have an attorney. Earlier this year we first told you that the government can deport any noncitizen, even honorably discharged u. S. Veterans, for committing some crime. That policy came into play here in court in San Francisco involving the case of of a navy veteran separateded from his family for four years. Joaquin sotelo served on a Navy Battleship during Operation Enduring freedom, but this is the battle of his life. I want to make my family proud. Reporter sotelo is waiting to reunite with his children, a family he hasnt seen for years because of the legal nightmare he got caught up in after being honorably discharged from the country. Once you serve the country you assume this country is going to look out for you, and the system, it has failed. When he was 19, sotel ho met with a navy are you kreuter who assured him he would become a u. S. Citizen for signing up. He was promising a lot of stuff. Reporter his sister refers. Money for school, traveling, training in the navy, and citizenship. Reporter after 9 11sotelo went to serve of in the persian gulf. There were mines in the water, doubtful whether you were going to come home at night. Reporter at the time sotelo thought he became a citizen when president george w. Bush encouraged all noncitizens to become a citizen. You filled out the paperwork and they said you were a citizen. Reporter they typed in some things and said that you were already a citizen. Thats what it said on my record. Reporter you believed you were a citizen. I still believe i am. Reporter but he wasnt and under u. S. Law he faced deportation back to mexico after he was convicted and served time for drug possession and domestic abuse. We separate veterans from their families, thats what were doing. Reporter our investigation found more than 300 other veterans who served honorably and have already been deported for getting into trouble after their military service. Vet served prison time for aggravated felonies that can include minor crimes like drug possession, petty theft and failure to show up in court. He could have been order deported that day. Reporter an immigration attorney intervened in the case days before the navy veteran was scheduled to be deported without ever seeing his children. Immigration law is incredibly complex. The system is set up really to fail people who dont have attorneys. Reporter thats how instead of finding himself in a country that he barely remembers. How are you . Good. Joaquin sotelo reunited with his children, children whom he hadnt seen during four years of legal back and forth and even though the possibility that he could still be deported hangs over him constantly. Every step i take depends on deportation. Like a cancer thats hunting me. According to the transactional record action clearinghouse, 90 of those seeking asylum without an attorney were denied. Its extremely difficult to do it without an experienced immigration lawyer. Reporter an Immigration Court judge who has served since the 1980s spoke to us with the Union President with the National Association of Immigration Judges. The law ties the hands of Immigration Judges in many situations. If they served honorably in the military, that would obviously be a very strong discretionary factor. Reporter but you dont have that factor in almost all cases . If its an aggravated felony we dont. Reporter is this fair . I dont think so. I think this is a poster child for why the immigration system is so broken, the fact that his service to the country Means Nothing in Immigration Court. Reporter while grateful that he found legal help where so many others have not, Joaquin Sotelo knows under current policy he could still be separated from the family he now holds so dear. Im a United States veteran. Reporter which is why he speaks out hoping for change in washington. We all deserve a second opportunity, and we all deserve to get our process of immigration done on road to citizenship. Why not . Thats what america is all about. After our first series of stories ran several congressman, including the east bay representative, induced a law that would allow u. S. Veterans who have been deported to return here to the u. S. We asked the chief counsel with the department of Homeland Security to talk with us about this, but we never heard back. With the Investigative Unit, im Stephen Stock, now, back now.
