Chief williams says not only should it not have been shared around the world but because it was many children likely saw that video as well. Just about 50 minutes ago in san jose, facebook show Mark Zuckerberg address that had killing in cleveland and the killers posting of it on facebook. This is of laquifa carter, the widow of Stephen Carter and todays sentencing is about bringing closure for her as well as others after the two pled guilty in february to the 2015 murder of carter who they killed on a marin county hiking trail and a canadian tourist who was backpacking near golden kate bark. Lampley admitted to discharging a firearm in the murders and will be sentenced to 100 years in prison. The other will get 50 years in prison and the third suspect will be sentenced to is a years to life. I asked if todays sentencing will bring any type of closure. I dont know whether i will it because to me feeling what can compensate for an act like this had. I sort of even dont relate to the punishment, you know. I dont relate to vengeance because it doesnt bring him back. Now the pleas for the defendants mean they wont have the option of appealing the convictions, but as i told you that hearing is under way right now and the family is expected to take the stand to address the court during the formal sentencing. Police Just Announced the arrest of this man, john wiper. Police say he was crossing columbus avenue on march 26th when he struck that 86yearold woman. She is still recovering at a medical facility. A disturbing crime on a busy bay area trail is putting more officers on patrol. A jogger says a man tried to rape her while she was out on the sonoma overlook trail. Someone post at homemade warning at the head of the trail where investigators say the 24yearold victim fought off her attacker. She told them this he pulled her, hit her and tried to Sexual Assault her. Now hikers are saying that they are thinking twice about that popular trail. In other news, an eviction ordinance being discussed in the city of san jose now, and we know that several housing advocates have been holding a Hunger Strike. Reporter in a few hours San Jose City council here at city hall will consider a new ordinance that would limit the reasons landlords can evict tennants. Currently you can be evicted from your rental for no cause whatsoever. The issue is so important to some people, namely these protesters, that some of them say they have been on a Hunger Strike since friday to bring attention to this issue. According to city records there are 2,200 socalled nocause evictions in san jose between 2010 and 2016. The Silicon Valley renters right coalition which has organized this protest believes that number could be higher because some evictions go unreported. The proposed new ordinance which does have support on the city council would require that landlords have a just cause to evict. The proposal would also push landlords to be more attentive to tenant complaints. The California Association is against this ordinance saying san jose already has laws. Eddie ruiz was arrested back in november accused of killing david moagin last year who was an economics professor at Evergreen College and he was married with two young daughters. Ruiz will have a plea hearing this afternoon. Its a centurys old disaster that shaped the history of San Francisco. Well get to the anniversary of the great San Francisco earthquake and right now the berkeley mayor is weighing in on these violent protests that broke out in his city over the weekend. Berkeley Police Arrested 20 people and are still in the process of looking at video posted on social media. They are also being criticized for their handling of those protests and for not reacting more as they were escalating. Berkeleys mayor weighed in at a meeting last night and praised the Police Chiefs decision to not move more aggressively. That would have escalated the clashes between Trump Supporters and selfdescribed antifascists. The mayor says free speech can say but outside agitators have to go. Senior Investigative ReporterStephen Stock spent months digging into the circumstances that led to this shooting and he joins us now. What does the lawsuit claim . Reporter the Santa Clara CountySheriffs Office say deputies went to the 1200block of titus avenue around dusk september 12th last year believing an elderly person inside had medical issues. Sheriffs records show it was not the first time deputies had gone to the craig home. Since 2011 they had been there there before for a vandalism call, suspicious circumstances and medical calls and this time deputies went for a wellness or welfare check and after knocking on the door for 50 minutes with no response deputies forced their way into the house. These pictures obtained by nbc bay areas investigative units showed the results after deputies broke down two doors before they confronted 86yearold retired navy veteran eugene craig. Craig was standing with his wife behind him in the living room where this picture was taken. According to the sheriffs news relief after the shooting craig displayed this. 38caliber revolver prompting the sergeant to shoot him where he stood. The deputies gave him several verbal commands to drop the fireball. Reporter we took this picture showing a bullet home into the door frame, a shot that missed and you can see another shot that apparently missed this this picture, a bullet hole in the wall behind where craigs 90yearold wife says she was standing with her husband. Reporter family friend saw the deputies Milling Around the house with flashlights when he got there. He estimates he arrived 15 to 20 minutes before the shooting. I could have got into the door. I could have called him and done anything, but they wouldnt let me do anything, just stay there. Stay back out of the way. Reporter the familys attorney on monday filed suit on behalf of the 90yearold widow. What was supposed to be a welfare check ironically turned into the worst Case Scenario where the checkers become the intruders. Reporter theres nine different charges including excessive due force and wrongful due process and wrongful death. Before doors get knocked down i hope if this policy, the way they conduct welfare checks, its not the way the next one is conducted. Is this acceptable the way they conducted this one . A Solano County high schoolteacher in trouble with the law for the second time this month, but this time shes accused of having sex with a 17yearold student. Rina lane of Benicia High School turned herself in on easter sunday. Earlier this month the english and special needs teacher was found with marijuana and stolen property in her car near campus. The teenager shes accused of having a relationship with admitted to stealing those items and putting them inside lanes car with her permission. It was then that detectives say they discovered that lane was having an inappropriate relationship with the teenager. A man arrested by San Jose State University police is now suing the university for excessive force. Police arrested that man two years ago for public drunkenness at a campus event and according to the mercury news he says when he didnt leave immediately officers slammed his face into the sidewalk knocking out several teeth. Paul says the school told him the only prerequisite for the course was a High School Diploma or a ged. Paul went to the high school back in the uk so he asked if he could use his bachelors degree and he says the school said yeah, you could. So he turned over his college transcripts. Paul was ending the emt course and said National University told him they needed his High School Transcripts after all, and it barred him from completing the course without them. We still see the clouds though hanging around, and we are not getting the rain falling from those clouds like we did just a little while ago. Heres a look outside in palo alto. A few breaks in those clouds. A little bit more sunshine. Were seeing some improvement here as we head towards the lunchtime hour, and as you get ready to head out. Were at 61 degrees in oakland. Its 63 degrees in napa and in san jose its 59 degrees so its starting to slowly warm up, and this is where were headed, up to 71 in East San Jose and milipitas up to 67 and los gatos up to 69 and also 69 in fremont and livermore at 67 and antioch at 67 degrees. 62 on the embarcadero and ingleside and for the north bay were up to 66 in santa rosa and novato 68 degrees, so were getting a little bit of a break here, storm system winding down and moving off towards the east, but there still may be just another leftover moisture to trigger a few isolated showers and maybe a few thunderstorms or two mainly across the south bay and other than that well see some clearing for the rest of the day, and this is our dry air in between, so then we watch this next storm system set to move in for tomorrow evening and into early thursday. Not a very strong system and this is the way it bans out as we go hour by hour. At 2 30 we see some sunshine around santa rosa and some peeks of sun in napa and theres still lingering showers in the peninsula, the east bay as well as south bay. Everyone wont see this rain and it will be a quick one and done. By 7 00 a lot of this activity is out of here as well see some clearing around sunset and early tomorrow morning and then for the afternoon the clouds start to roll back in late tomorrow night. The rain moves in to the north bay and continues on to the south very quickly by thursday morning as a lot of people are getting up and out. Well see a lot of the wet weather out of here. Hopefully this will help with the pollen. Seeing a moderate amount of tree and grass pollen and Everything Else is fairly low and it does improve the pollen count with some rain temporarily. If you want to escape this all together and head to the tahoe area. Squaw creek is looking good and its above freezing, and well have some additional light snow above 6,000 feet looking at another 2 to 3, maybe 5 inches of snow over the next couple of days. Looking at that forecast, the snow will be falling during the overnight hours on early thursday and then going to see some warmer temperatures on friday. Here were looking at also some clearing and warming temperatures for the weekend. Look at that. The inland areas are close to 80 degrees on sunday.
