A Placer County sheriffs deputy shot and killed the suspect. The woman he was allegedly holding hostage was unharmed. This is impacting highway 9 even now between squaw valley and all pine. Back here in the bay area, an Armed Robbery that caused sunnyvale to issue a advisory last night did lead to the arrest of two is expects, a possible third suspect is still on the loose. The driver had another idea and led officers on a chase down highway 13, ultimately crashing there at broadway and terrace and rolling down an embankment. The man and woman tried to get away this time on foot and that triggered a search that snarled traffic through the evening commute. Officers found those suspects hiding under the deck of a nearby home and they say they found a gun inside that stolen suv. A parents pain made worse by the fact that there is a very important question left unanswered. This is a parent asking for justice after a peninsula woman was killed by a hit and run driver. They are demanding justice. 29yearold carly flynn died last december after being hit in san bruno while crossing the street. She was legally crossing the street when a white suv hit her and the driver months later has yet to be found. Its just a great person, great person. We miss her. Were here today to seek justice for carly. She deserves it. Thats what we want. Well, flynns parents say their daughters organs were donate and had her legacy will live on. Three people are now in custody tied to a string of south bay purse snatchings. These are the suspects now facing charges investigators linked them to at least nine Shopping Center spurs snatchings over the last three months. In most cases they targeted asian women by driving up to them in parking lots. Some of those victims were even punched. Each suspect now faces several felony charges. Continuing coverage now in the murder trial of torres, the man accused of killing sierra lamar takes a break today. Yesterday three of lamars friends testified in court. Questions centered around whether lamar was capable of running away. Also the defense crossexamined an investigator who testified that evidence found where sierra was last seen was processed at the scene rather than a crime lab. The defense is trying to claim the evidence is tainted. The defense definitely brought its agame when it came to cross examining the main crime scene investigator in the case. What theyre trying to do is show that the collection of the evidence was flawed at the outset, so when the defense experts testify as to the dna issues, theyre going to say its not reliable because the way the evidence was collected. The defense is also suggesting that sierra lamars dna evidence found in the suspects car was also jeopardized. 15yearold lamar disappeared in 2012. Her body to this day has not been found. Some good news out of the sier a. The snow pack is at 173 of average. State officials made the trek through the snow yesterday for a monthly sierra snow pack survey. Runoff from the snow pack provides water to about a third of california, and this is the highest level since 1995 for this time of year. State Officials Say governor jerry brown will wait until closer to the end of the rain and snow season to decide whether to lift that Emergency Declaration addressing the fiveyear drought. They close some of the passes so it makes it hard to get tire chains. All that stuff doesnt work when the road is closed, right . Heres a live look outside downtown san jose, temperatures have warmed up into the lower 60s and were getting a mix of sun and clouds and a look at emory ville getting busy out there as weve seen the weather kind of drying up here within the past couple of hours. And looking at downtown San Francisco, the clouds still overhead, but we havent seen any rain. As far as those heavy downpours kind of taking a break, but still seeing some spotty light showers in the north bay. Also parts of the east bay seeing some light rain. So, theyll be surprised if you catch a few sprinkles. Weve had quite a bit of rain and were going to take a look at some of those rainfall totals that have been quite impressive just since midnight. In some parts of the north bay weve had rainfall totals close to an inch, in some spots like guerneville had over an inch of rain. And napa also seeing quite a bit of some of the downpours there. Looking at San Francisco in cole valley, about a tenth of an inch of rain, while some spots had closer to half an inch of rain, moving down the peninsula 3 10 of an inch was pretty average, closer to half an inch as you go towards half moon bay. For the south bay, anywhere from 4 10 in morgan hill to just over a tenth of an inch in san jose. Of course, not measuring as much there. Then you go over to the east bay where the average amount is closer to a half an inch, but there were some spots that got over an inch of rain in la have a et. So, looking now at san jose, the temperature trend through the rest of the day will keep it above average and then rising into the upper 50s and low 60s. This was the first storm system moving in now as that winds down, still some lingering showers behind that. The second storm system is set to arrive on sunday afternoon. And with that another round of some heavy downpours just briefly with some gusty winds. About 150 people dressed in all black Wearing Masks are being a qued of taking over those demonstrations and vandalizing businesses in berkeley. Police are blaming socalled black block protesters. They gave them that name for how they dressed. University administrators and many students are denouncing the groups action saying they are not part of the cal community, but one of the protest organizers, yvette, who was put on administrative leave from her teaching job, was put on leave after she punched a man during a knee owe nazi counter protest. She is applauding this decision. We are united in the many diverse and different ways that people express their determination to stop fascism, stand up against racism. And we knew that what needed to be done had to be done. She says that the vandalism is a small price to pay and that the university is responsible. The school is now reevaluating its tactics to handle what theyre calling an unprecedented protest. And you talk about the violence and the vandalism and all the fighting that we saw on wednesday, kris, were getting a new look now at the destruction left behind after wednesdays protests. Many Truck Drivers are describing their vehicles as traveling time bombs. We start today preview this yesterday. We investigate new allegations that a device designed to cut pollution could be causing big riggs to burst into flames, putting Public Safety at risk. Senior Investigative Reporter vicky nguyen has more on what shes uncovered. Reporter we share the roads with these trucks every day, but now the drivers tell us there is a hidden danger on their trucks that could spark a fire on a highway you drive. It tells you regeneral required. Reporter Keith Daniels knows trucks. 39 years driving trucks, a little over 5 million miles. Reporter miles spent crisscrossing california roadways, hauling everything from solid waste to soda pop. Its a good occupation. Paid my kid way through college. Reporter he could only watch as his beloved truck burned. I timed it, 8 minutes that truck was burned to the frame. So, thats all it took. Reporter you could have been inside that truck. I could have been sitting there when it caught on fire. I do feel fortunate that i was out of it, didnt get burned. Trying to save the truck. You know, its your truck. Its something to me that could be preventible. Reporter keiths son runs the company. Youre talking about a crime scene. Reporter jason like many other truckers we spoke with believe the fire was caused by a diesel particulate filter. California started requiring the device for all Diesel Engine vehicles in 2007. Roughly a million trucks in this state are equipped with one, and those trucks travel the tri. The filters trap 97 of the pollution capturing small particles from the exhaust before they get into the air. Keith says his truck fire ignited while the filter was undergoing a cleaning process called regeneration. Burning all that captured soot into a fine ash. The cause of the fire is undetermined, but insurance investigators suspect it started somewhere in the exhaust treatment system. The report notes the Company Investigated several similar fires, but pinpointing the cause is difficult because, quote, the exhaust gets so hot that evidence is consumed. The filters are expensive. They are dangerous. And they dont work. Reporter bud caldwell owns a petroleum and rg trucking company. He formed the alliance for california business to challenge the states rules requiring filters. The group points to a series of filter failures, including two recalls for filters linked to three fires, including a 5,000 acre fire in washington that destroyed 29 homes. These were not ready for primetime when they were put forward. Reporter caldwells group and the Daniels Family are suing the state, asking forest institution for drivers with damaged trucks and an independent review of the filters safety. Diesel particulate filters do not cause fires. Reporter todd sacks work at the California Air resources board. You say there is no link between the filters and fires. But in your report here you investigated 13 fires, you found three fires were linked to dtf filters and you issued two recalls. Is that true . That is true that we issued two recalls. Reporter sacks acknowledges some of the initial filters put on the market were linked to fires. Others to expensive repairs, but hes confident newer trucks with filters work safely. They investigated three dozen fires since 2009. We have looked at the fire issue extensively and we dont see any evidence between the filters that are on road today and fires. Reporter while the research hasnt found a connection between fires and newer filters, agency data reveals a high failure rate for the dpf made from 2017 to 2011. Those faulty parts are still used on trucks today. Why hasnt cash come down stronger and addressed these issues sooner because these parts are failing at such a high wait . Partly if relates to the design of the regulation itself. There are a number of hoops we have to jump through, things we have to prove in order to be able to force the manufacturers to take action. In this case were essentially not able to do so. Reporter and what happens to the truckers and the businesses and these folks in between while all thats happening . Well, like i said, these trucks are safe to drive. If they have problems with the trucks theyre going to need to repair them. Reporter as for Keith Daniels, the lifelong trucker says he hopes this issue will be resolved and soon so other drivers wont have the same close call he did. You think you can go out and do your job and come home safely. Reporter the alliance for california business first sued the state unsuccessfully in 2015, but they say the new lawsuit contains new fires, including keiths. The group claims the city is delaying the release of them. It says the documents could help explain how the city missed chances to close the building that investigators said was dangerous. 36 people died in that fire. The Northern California aclu is jumping into the fight over President Trumps travel ban. It is coordinate ing with 50 other aclu offices demanding more information about that order which resulted in mass confusion at airports across the nation, including at sfo. The Northern California aclu office filed a freedom of information act request to see how officials are interpreting and executing President Trumps order. Federal judges will now hear the legal arguments on the ban later today. Were also seeing some of the showers moving through concord and over towards pittsburgh and clayton, and this is moving off to the east as well. Looking now at lake tahoe in truck, it is 39 degrees, not really that good news because we are seeing temperatures above freezing. So, some of this is coming down as rain. And that will be the case as we go through the weekend but the sierra snow pack is still looking good. We are at 173 of average for the central sierra, thats the statewide average as well. And this is the highest weve had in 22 years. The best amount of snow, the highest snow totals have been in the southern sierra. Were still looking at some more snow in the cast for the weekend, so, if youre planning to get there or if you can get there with some of those roads closed, bring the tire chains and may have to take some alternate routes. Were looking at the potential of at least another foot, possibly close to 2 feet of snow in some of those higher elevations. So, the second storm system moving in will give us a little bit of a break between saturday night and early sunday. Fans are pouring into the city, definitely to have a good time. Thats right. A lot of them will do that in the nfl fan zone which we find here in the bay area, an area called super bowl live. What the nfl says is they think record crowds already to tart this week, they expect that just to continue to grow throughout the week. There were people waiting in line before the sun came up today to try and get in and spend a little time in fan area. The gates are open now and finally officially Super Bowl Weekend this is here. The party has started in houston. Its amazing and i love it. Reporter hundreds of thousands of fans are already in the super city and the crowds are expected to grow as we get closer to game day. Well have over a Million People come through this event. Its a free Family Friendly fun event and the nfl experience is next door. You can go into that, too, if you want. Theyre having record numbers. Reporter the super bowl is a bucket list event for a lot of people here and theyre taking it all in. I was nervous the first game of the playoffs. I was jumping up and down, but after the last two games im confident. Reporter and taking a lot of merchandise home. Its great, yeah. We came in yesterday, long day traveling from boston. Today were just seeing the sights and taking advantage of picking up some more gear and get ourselves ready for the game. Reporter i georgia getting ready for the game as well. Myself and my dancers have been training for months. Reporter shell be float ed in from the roof joined by a special guest. We have some things plabd for this weekend. Reporter but she wont share exactly what well see during the halftime show. Its going to be a good time. Reporter or i guess you could say a super time. Now, look, lady gaga wont talk about what songs shes singing, she wont talk about how shes getting to the performance. Maybe repelling from the roof. Wont talk about her hair color. She did say she wants to make sure that everyone watching this halftime show has a good time, laughs, sings along, dances. She said, though, afterwards she wants people to the performance and the message its going to deliver. So, you got to think theres going to be something there. Usually there is when lady gaga performs. Should be a lot of fun and part of a great weekend. Kris, sam, back to you. We heard she was barred from mentioning the president by name. Is that true . Reporter well, weve heard the same thing. Again, she wouldnt talk about that. The league has refused to say anything about it. So, at this point we cant confirm that, though it seems to be the case. Shes usually pretty vocal about political issues. She didnt make any during press briefing which was yesterday. I think what well see is a message, it may not directly name the president , but youd have to think its going to be political in nature. Thats what lady gaga does. Thats what i would expect. This started as a south bay man hailed a cab to get from the Las Vegas Strip to the airport. By the end of that ride, one mans life had changed. Here is Garvin Thomas with todays bay area proud. Reporter regardless how it may seem in movies and on tv, not all las vegas dreams come true at night. And not all take place in a casino some jack pots are hit in the middle of the day. And one, well, one recently happened right in pedros cab. It was a gift from god. Reporter pedro has been driving a taxi in vegas for 18 years. Its helped him raise a family, he, but changes in the industry have made it harder and harder lately to make ends meet. Its tough. Its very tough. You got so many taxis now, its very hard to make a living. Reporter its why when pedro picked up a passenger at the cosmopolitan two weeks ago, he was about two months behind on his mortgage. A fact hed not normally share with a fare, but this one was different. He was very friendly and i could tell him all my problems. Reporter pedro, though, had no idea how different this ride would be. Im a Firm Believer of what you project out in the world is what you receive ten fold. Reporter first of all, his passenger, si plays for the san jose earthquakes. For pedro, originally from argentina and a soccer lover his entire life, that would have been enough to make this run to the airport memorable. But quincey was about to turn memorable into unforgettable. If there is a way that you can help someone, you need to find a way to do that. And i let him know, i said, i would like to help you get caught up on your mortgage. Reporter and so quincey cut him a personal check right on the spot. I wont lose my house. Im still in my house thanks to him. I very appreciate his generosity. Reporter quincey is an athlete who thinks a lot about life after sports. Hes working hard to be a success in business, to have enough money one day so he can help others make their dreams come true. Its the reason he was in vegas that week, attending a marketing convention. There are so many people with great ideas and such passion for what they love, you know.
