Front of Robert Sanders Elementary School off to the right side of the screen. The car kept going until it crashed into that home right there, that suv which you can see is smushed into the garage. The car is underneath the blue tarp on Mount Pleasant road. We spoke with a young man who lives in that house who appeared to be shaken up over what happened. He showed us video that he had just shot after the crash. It shows the driver unresponsive in the front seat. His head slumped backwards with what appears to be blood pouring out of his mouth. There is broken glass on the road leading up to the driveway which seems to indicate that someone shot the man through his car window while he was driving. Police would only confirm to us they found the man with at least one gunshot wound. What is already the third homicide for the city of san jose this year, a city coming off the year 2016 which was the deadly est year since 1991. Its very important, more so now than ever, that the Police Department and our Community Band together to try and come up with solutions on how we can go ahead and address some of the issues of violence in our communities. And once we do that, then hopefully we can see those decreases start to happen. Reporter the only suspect information that we have is that at least one witness heard a car speeding off after the shooting. Detectives with the san jose Police Department will be checking to see if any home Surveillance Systems captured the crime. We did hear from the Mount Pleasant School District who tells us this did not impact school. That classes were in session, and on time. Reporting live here in san jose, bob redell, nbc bay area news. All right, bob, thank you. Santa Clara City Police say they arrested a man accused of trying to break into homes. Police say they got a call about a man trying to break into homes near Mission Cemetery overnight. He tried to run when they spotted him. An officer did fire a shot during the arrest. It is not clear why at this point, but nobody was hit. That suspect has not been identified either. A north bay Fitness Community is in shock this morning after one of their fellow gym goers died of menning iet is and now there is concern other people may have been exposed though the gym has been disinfected. Nbc bay area travis is live in lark spur where that person trained. Pete, do we know what the risk is to the other folks who workout there . Reporter good morning to you, chris. We spoke to a Public Health officer with the marin county Public Health department and the way he broke it down, he said that the likelihood of someone actually catching menning iets here in lark spur is low. Youd have to be around the person for several hours and be in close contact. This doctor through the marin county Public Health department did not elaborate on exactly how this person may have caught menning iet is. They did explain to us it is infection of the lining of the brain and some of the symptoms include stiff neck, fever, chills, nausea and those are just a few of the symptoms to name a few. The county was notified on tuesday about the case and as i mentioned according to the doctor, hes saying youd have to be around the person for a long period of time. And also be in close proximity. I had him elaborate what he meant by close proximity and exactly how close would that be. Close contact is usually defined as several hours of very close contact. Thats one of the reasons why we often see just one case without seeing subsequent transmission. And one of the reasons why we focus on household contacts as being at the highest risk. Reporter now, the county did notify more than 200 people to see a doctor for treatment if they do have these symptom. Doctor also mentioned there is a vaccine thats available to protect yourself from menning iet is. So far there have been no more reported cases at this time. The forecast for the weekend is pictureperfect. Here is a live look at downtown san jose. Blue skies there in the distance, not a cloud in the sky. Lets turn to meteorologist kari hall. We have seen patchy fog. I can see that in the shot right behind you. As we get a look outside in san jose, you do see a beautiful sky and really soaking in that sunshine and some dryer weather. Heres a look at Half Moon Bay toward tiller point. You see the seas are also much more calm than weve had recently. And looking at guerneville, still recovering from all of that heavy rain, looking at the Russian River, and we will see those water levels starting to recede. It is now 49 degrees in oakland and in San Francisco. In santa rose a 46 degrees, very clear and chilly conditions. This is the kind of weather well see throughout the weekend, but those temperatures getting a little bit w5rarmer. Well have a weekend forecast and a couple events coming up at 4 11. Thank you much. It may be days, carry, before people are allowed to use tap water in hollister. Potential contamination from this weeks storm. San benito services are testing the water to make sure it is not contaminated with raw sewage or pesticides. Some residents say they had no choice but to use the water. You know, i cant say when i wash the clothes because were washing some pads right now. The water is here so were drinking it. Well, right now customers are advised the water may not be safe for any purpose, including bathing or laundry, even if its boiled first because of the potential pesticides. So far that warning is precautionary only because no contamination has actually been discovered. Lets go to the mountains. If youre headed up to the sierra, expect plenty of powder. Last week, city of truckee has declared a state of local emergency, but Officials Say that shouldnt stop you from coming up and playing in the snow. I dont want to do that this weekend. A tower of power concert is canceled because two members of the popular bay area band were hit by an amtrak train last night. It happened in Jack London Square just a block from yoshi where the band was supposed to play a few hours later. A witness told us the train almost hit her, too. That woman told nbc bay area the men were in a crosswalk and that the train came up on them without any warning or crossing signal. There was no warning. There was no lights. There was no sound. This all happened after the impact. Our drummer david and basist marc were hit and last night the tower of power band manager said one of them did have to go into surgery. The good news, though, is that both men were conscious at the scene and both are expected to survive. A midair mystery may be solved. Alaska Airlines Says dee isising fluid may be the thing that sickened several flight attendants on a flight from seattle to san jose. This happened last night. Flight attendants noticed a strange white powder that may have been residue from the deicing fluid. They inspected the plane after it landed. Passengers we talked to say it was tense a few minutes when the pilot came over the intercom mid flight. There was an announcement and they were kind of like, oh, dont panic, but there might be some antifreeze like in the air. They just were going to bring on paramedics to come see and check it out and see if everything was okay. Those paramedics went on board and checked on three flight crew members who were ill. One was taken to the hospital. The plane has been taken out of service. The lisa is up for lefty odools. We could learn where the restaurant will open its doors. The restaurant wasnt able to secure a new longterm lease so the restaurant will serve its last meal in union square on february 3rd. The restaurant was supposed to hold a News Conference earlier this morning to share its plans for moving forward, but that News Conference was pushed to monday. The restaurant is named after former San Francisco pitcher and manager Francis Lefty odool. It is a favorite watering hole which many people say will be missed. Well, this is a San Francisco treasure. Any time you possibly could lose a San Francisco treasure, you feel a great loss. Lefty odools is not known as a bar and watering hole. It hosts christmas drive and honoring survivors of the 1906 earthquake. Up next at 11 00, what would you smell, rotten egg permeated much of the bay area last month. A muddy mess on old river road. Heres what the same area looked like just the day before. People forced to navigate the road with boats. The Russian River is expected to continue dropping several feet today. It is going to be sunny then dry this weekend. I can hardly wait. I cant wait. Oh, my goodness, it has been such a long week. And i just want to take in that sunshine. Here is what we are seeing right now from the top San Bruno Mountain looking toward San Francisco. Beautiful day, and we need this break, a chance to dry out after several days of rain in a row. Now as we head into the weekend, looking pretty good. Maybe you want to head to the beach. I think that will be in my plans. Heres a view of point raise where we see all the sunshine and some calmer waves as well. And heres a view of gilroy. Maybe you plan to go to gilroy gardens. It will be nice and sunny, but very chilly during those morning hours. And then as we go into the day, seeing those temperatures reaching into the upper 50s, maybe even a few spots hitting the low 60s, so looking a little bit closer at the south bay. San jose 57 degrees, parts of the east bay reaching 56 degrees and oakland a high of 55 degrees. In the peninsula reaching 54, belmont in the Mission District up to 54 degrees. And the north bay, 59 degrees today in napa. And even warmer as we head through the day tomorrow. So, yeah, all that rain that we had has now moved into parts of so cal. Theyre dealing with that now. Were also dealing with this cluster of clouds extending over the pacific. This may bring in a slight chance of some rain heading into early sunday morning. And also an increase in cloud cover, but until then were just going to see some dry weather. We see a couple of sploches there as we look ahead. And next week between tuesday and wednesday there will be another round of rain moving in and this one looks to be pretty heavy as well. Some of the initial runs computer model showing we may have several waves of this rain moving in, kienld of like what we just had to deal with from the past several days with some heavy rain as we go into the end of next week. And this is a look at the next seven days, the estimated rain, it shows the potential of over an inch and a half of rain with that next system moving in. Pour toll a road near wood side will be closed today and tomorrow to allow utility crews to replace electrical wires and poles that were damaged by the storm. Local traffic will still be allowed through while those repairs are being made. Our new at 11 00, the search for a missing Malaysia Airlines flight, that mh 370, will officially come to an end next week. That is when crews are expected to finish scouring a 46,000 square mile area where experts thought the plane went down. Last month investigators recommended extending the search area after admitting that they were probably already looking in the wrong place. Malaysias transport minister said the search would end unless there was a credible crew suggesting it should be extended. Mh 370 disappeared in march of 2014 with 239 people on board. It was headed to beijing. Air quality experts are now focusing on an east bay refinery as a possible source of a foul odor that was smelled across the bay area last month. That rotten egg smell permeated parts of richmond and San Francisco over two days at the end of december. The bay area air Quality Management district believes it may have come from flaring at richmond chevron refinery. Investigators have ruled out an oil spill or a fuel spill. Developers and managers of the sinking Millennium Tower in San Francisco have until today to layout a plan for dealing with that problem. And it is a story that our Investigative Team has been following very closely. The city of San Francisco wants to know specifics about the extent of tilting and sinking. The buildings total weight and other critical information. The city says once it gets those answers, then it can start to plan the next steps. An attorney who also lives in the building filed suit against the developer. Its time to stop requesting and time to order the partners to come up with a plan. The hearing comes as a 58story building which opened in 2009 sunk as much as 16 inches and leans very slightly to the northwest. City leaders say they are also getting conflicting information about how the towers sinking foundation would handle an earthquake. State Fire Fighters could get hefty raises. It comes as california faces widespread vacancies. Fire fighters are slated for raises as high as 13. 8 this year. Details of proposed fourYear Contracts were released this week. Top raises will go to paramedics where there is a high turnover rate. The department of forestry and Fire Protection employees will also get sizeable raises. Study show state Fire Fighters receive onethird less in pay and benefits than local city Fire Fighters. A lifesaving alternative, people with potentially deadly allergic reactions now have an option other than that pricey epipen. Drugstore cvs is now selling a rival generic version of Mylans Epipen at 1 6 of the price. This comes after the treatment was grilled before congress because of its soring cost to consumers. Epipen sells for about 600 for a twopack. Cvss generic will be 110 for a twopack. Checking your friday markets this morning, the nasdaq hit another intraday high today. 25 points higher to 5573, the dow down 31. Pandora will layoff to cut costs. More people are signing up for the Music Streaming Service than expected. Wall street tends to like layoffs. Shares of pandora are up more than 15 since that news broke. Apple may start producing its own original tv shows and movies. The wall street journal reports that apple is in talks with hollywood producers trying to buy the rights for scripted television programs. Sources close to apple say the new programming would be available to apple music subscribers and could help offset the slow sales of iphones and i pads. The Company Hopes to start offering new shows and movies by the end of this year. Coming up next, its usually the other way around the now the fbi is under investigation. The Justice Departments independent watch dog has opened an investigation into Public Disclosures by comey and others about Hillary Clintons email server during the campaign. This is as we are learning new information about what comey told donald trump on the day that he was briefed about russian hacking into the u. S. Election. Nbcs Kristen Welker has the story. Reporter this morning new details about that briefing donald trump had last week on russian attempts to meddle in the u. S. Election, a senior u. S. Official tells nbc news fbi director james comey took mr. Trump aside and spoke with him one on one about the existence of unverified allegations about trumps ties and activities in russia. And director comey under another microscope this morning, the Justice Department Inspector General looking at key decisions and disclosures by the fbi while reviewing Hillary Clintons email server. This morning bipartisan support for the move. I do think there should be a probe. There are a lot of anomalies that happened. Several things that raised eyebrows. Reporter clinton aids saying the damage is done. My first reaction was im not surprised, but, you know, we cant put the genie back in the bottle. Reporter under review comey statement in july taking sharp aim at clinton and her aids for handling of emails. They were extremely careless of handling sensitive highly classified information. Reporter just 11 days before the election saying he was taking a look at new emails found later revealed on the laptop of former congressman anthony weiner. Nothing significant was discovered. Comey on capitol hill thursday not answering questions, but in a statement saying, everyone will benefit from thoughtful evaluation and transparency regarding this matter. Meanwhile, also on capitol hill, mr. Trumps pick for cia director congressman mike president obama pay or for his confirmation hearing. He seemed to break with mr. Trump, expressing full confidence in u. S. Intelligence agencies and their assessment that russia hacked into emails during the 2016 race. This was an aggressive action taken by the Senior Leadership inside of russia. That was kristen reporting. President trump went on a tweet storm slamming leaks over russia having unverified information about him. He also attacked obamacare calling it unaffordable and vowing it will be replaced soon. The inauguration of donald trump is now officially one week away and today home land security secretary jay johnson will discuss security preparations ahead of that big event. Representatives from the fbi, from fema, and the d. C. National guard will come together to discuss their roles in the security plan. Were only at 50 degrees in palo alto, 49 degrees in oakland and San Francisco. And despite all of that sunshine, we are not seeing those temperatures warming up very much as we go through the day, making it to 55 in the peninsula, and the south bay 57 degrees. In the north bay up to 58 degrees and once again very nice. One of the events going on this weekend in San Francisco for both tomorrow and sunday, the walking tours for the Martin Luther king, jr. Holiday and it will be up to 53 degrees. We will have a chilly start to the day. There is a lot of events going on, but i know the main event will be people heading over to the sierra to check out that epic snow. Ill have more on that coming up at about 11 41. All right, thank you, kari. What a difference a week can make. These two maps are drought maps. Last weeks map is on the left. On the right, the one released just today. You can see all of Northern California is now out of the drought while the rest of the state is in better shape, though still in a drought. Nbc bay areas kirchner has more on why we are still not out of the woods yet. Reporter for days clara roth has watched her newly installed drought resistant lawn get soaked. I have been here watching the ground being more and more saturated with the storm. Reporter with all the punishing of rain and recent dumping of snow in the siary a, reservoir levels statewide are also over flowing. The amount of water that we receive and precipitation we received is 196 of average. Reporter even federal drought watchers today declare more than 40 of california including the bay area is no longer in a drought. Its a dangerous and premature assessment. Reporter but professor alex from the environmental and Earth Science department at saint marys says the drought is far from over. Here san analogy of what we have beneath the surface in the state of california. Reporter she says our groundwater levels are still dangerously low. Until we can replenish these which is going to take decades, were not going to have a healthy, robust water supply. Big, big difference. Reporter thats why claire roth says she will continue to pay the price to renovate her landscaping to conserve water. I havent added it up. I dont want to add it up. I just know its going to be worth it. In the long run, right. The long run picture. The drought emergency issued in 2014 will remain in place until Governor Brown lifts it, but of course all of this rain is a step in the right direction. Well, years of division appear to be at an end for san jose Police Department after a new tentative contract agreement. The city and the Police Officers union have agreed to a new 3 1 2 Year Contract including wage increases and an agreement to recruit and hire more officers. The city has seen its number of Police Officers drop dramatically over the past decade. A lot of that has been the product of a roll back in pay and benefits. Officers, though, still have to ratify this new deal. So, how quickly can things change . Thanks in part to backlash from social media, former San Francisco police chief gregg suhr is now out as a Security Consultant for the Golden State Warriors. We reported earlier this week that suhr would help the team with Security Issues including planning for next weeks groundbreaking at the site of the teams new San Francisco arena in mission bay. A activists expressed concern which involved several Police Shootings and a text message controversy. Suhr quit the department in may at the request of the mayor. Activists we spoke with say theyre happy with this decision. I thought it might have been a joke at first. I thought like a little practical joke or something. I was like i opened the link and read it, kind of just it was kind of it was disappointing, of course on both ends to understand that someone like suhr could still get employed in some authoritative position. Suhr says he doesnt want to be a distraction to the team and the decision is in everyones best interest. The family of a mentally ill man shot by San Francisco Police Officers is speaking out. They claim the police did not have to open fire even after that man attacked the officer. Nbc bay areas jean elle has more from San Francisco with the emotional exchange. Hes not an animal. Hes a person with a mental condition, and i dont think that he deserved to have been shot. Reporter the mother of 43yearold sean moore tells San Franciscos acting police chief officers didnt have to shoot her son. Moores family says hes bipolar and schizophrenic, but insists hes not violent. I know my brother would never attack the police. I know my brother. And i know the police would be agitating to him. Reporter Police Say Moore was agitated when two officers showed up at his home on capital avenue january 6th responding to a call from a neighbor saying moore was banging on a wall, violating a restraining order. Police say body camera video shows officers repeatedly trying to talk to moore, but they he say moore kicked one officer in the face. His partner deployed pepper spray, and moments later an officer shot moore twice while trying to arrest him. And one officer struck mr. Moore with a baton in his lower it appeared to be in his lower leg. Mr. Moore then stood up, turned, he punched one officer in the face, knocking him off the stairs to the sidewalk. Mr. Moore then advanced at the second officer who fired his weapon. Reporter a neighbor who says moore has a history of causing disturbances says San Francisco needs more Mental Health services and officers need stun guns. We also need to equip our Police Officers with tasers. No. Sorry. That was jean elle reporting. Police arent releasing the body camera video because it is part of an active investigation. Moore is in the hospital recovering and hell face felony charges for assaulting those officers. Peninsula authorities credit an observant neighbor with helping to nab a home burglary suspect. Heres a man San Mateo Police rather deputies arrested. He is 19yearold roger pena. He is accused much burglarizing a home in san carlos. A neighbor saw two suspicious people leaving the home. Their vehicle description led to an arrest in east palo alto. Authorities in palo alto next door arrested two men in connection with a recent purse snatching at stanford shopping center. Investigators believe one of the two suspects was driving the get away car. In a pair of robberies over the past weekend in a mall parking lot. They are still trying to figure out how the other suspect is linked. The arrest followed an aborted robbery attempt after a victims mother screamed for help. A description of the vehicle led to that arrest. Police believe more suspects are still at large. A devastating fire in baltimore claimed the lives of six children early thursday morning. Today their mother and two siblings are recovering in the hospital thanks to one brave little girl. Nbcs Kerry Sanders has more on the tragic story from baltimore. Reporter heart break in baltimore this morning. After a raging infern owe ripped through the familys three story home. Nine children inside, nine children inside. Reporter tragically six children died in the fire. Officials say if it werent for the bravery of one of their siblings, the outcome could have been even worse. We have three children relocated in the backyard. Theyre safe. She did her job on earth and her job was to save a life. Reporter an 8yearold girl now hald as a hero after she managed to rescue two younger brothers as the flames intensified. My heart right now crumbles every time i talk about it. It keeps crumbling because i could try to do more. My daughter said dad, you couldnt do more because it was too much fire. It was just too much fire there. Reporter this morning investigators still dont know what caused the blame, but they believe it was accidental. May heart is breaking for them and i couldnt think of anything we could do in the neighborhood, but just pray for them. Reporter the city is now razing the home here. A home the father says did have a smoke detector. But apparently it wasnt loud enough or didnt work to warn the children to get out of the house. Kerry sanders, nbc news, baltimore. Apparently not everyone is on board yet with the proposed changes to bta bus service. Vta last week released plans to overhaul some lines and certain bus routes will be changed. Some others will run less frequently. The mercury news reports that people in palo alto are unhappy with those changes. They say that some of the lines being reduced are critical for students and for seniors, including the vtas 88 bus line. The vta has several hearings scheduled before the vote comes up in april. Santa rose a over toward napa right now. So, weve seen the rain moving away from us and were seeing it now pouring across parts of l. A. And san diego, farther off towards the east over towards las vegas. And then we also have a span of some clouds just to the north and west of us offshore. And that will move in later on this weekend, it may bring in some spotty showers sunday morning. Weve seen that looking at the future cast, but ittant show a lot of rain and nothing that will add to any more of the weather problems weve had from this week with the heavy rain. But then look towards next week, on wednesday it look pretty widespread with some rain moving in. It looks pretty wet, too, throughout the end of the week. So, some scattered showers, possibly some heavy downpours returning for the end of next week. So, enjoy this dry weather while it lasts. A lot of people making plans to head out for the bay and inland areas. It will start out at 50 degrees and by 1 00 up to 55 degrees, clear skies, and a nice cool day, a few clouds moving in late at night. And for the day on sunday, looking at much more of the same with those temperatures reaching into the mid 50s. If you are planning to head to the sierra, the northern and central parts well above average at 132 of average for the northern sierra, central sierra 163 , and the southern sierra is doing the best with 197 of average. As weve seen some beautiful scenery around the sierra, here is a look now at the forecast heading into the weekend. It will be clearing out for today and tomorrow.
