Next, investigators will try to identify the victim. The father accused of killing his own 5yearold son and severely injuring the boys mother is now in jail. Darrylone shuemake has been on the run for several days and turned himself in yesterday after he caused this deadly fire. Poured gasoline on the female victim and lit her on fire and then the gasoline had spilled into the room and thats what ignited the house on fire. The boys mother is still in critical condition. Officers say shuemake was despondent and made comments about suicide. The menlo park Fire District says the faa has authorized its firefighters to use unmanned drones and the district is one of only a handful in the nation to receive that distinction. The department can use drones below air space of 400 feet. You may have seen this yesterday when firefighters sent a drone up during the santa clara strip mall fire. Vo a fight between a palo alto Mobile Home Park owner and the city head to court tomorrow. Reporter the accused, her stepfather. When he found me, he was touching me, on top of my clothes. From then on, like this happened every day. Reporter michelle says she was molested too many times to count. Why go on with life . Like, what did i do to deserve all of this . For seven years i hid all of this. Reporter scared that her abuser would carry out his threat to hurt her mother and deport her family. But at 14, michelle says she could no longer keep his secret. Translator i felt i was going to die, her mom said. I believed her right away. They went to San Jose Police where michelle says detectives interviewed her for hours and then listened to phone messages her stepfather left begging her mother not to report him. Please, i beg you, dont call them. Forgive me. Forgive me. Ill die in jail. Ill die in there. Inside, they will get me and kill me. Reporter that was july 2014. 11 months later, San Jose Police filed their case with the santa clara countys district attorney. The d. A. Asked for an additional interview. They submitted the case in august, 13 months after michelles initial report. I dont know why they took so long. Reporter michelle says she finally contacted the Investigative Unit after reporting her stepfather tried to confront her in person. I even went down to the Police Station the day he was stopped me after school, tried to get me to talk to him. Think didnt do anything. Reporter in late march, we called the santa clara d. A. To ask about michelles case. Two days later, the d. A. Issued an arrest warrant. The stepfather pled not guilty. It was human error. Reporter terry harmon is in charge of the team prosecuting sex crimes. A tremendous apology is owed to the victim. I apologize to her. Reporter harmon says San Jose Police reminded her office about the case in february. Seven months after it was submitted. It was either misplaced or misfiled or lost. Reporter when San Jose Police followed up with your office in february, you realized you didnt have the file. Why didnt you expedite that and then make the arrest sometime in that month . I dont know that i have an answer to that. Reporter and then as far as the arrest you made right after we called, are you saying that was a coincidence . I cant speak to that. Reporter the Investigative Unit reviewed records for the past three years of child molestation cases submitted to the district attorney. We found, on average, the d. A. Filed charges within a month of receiving a case. But at least 19 cases took anywhere from six months to more than three years before the d. A. Took action. How confident are you that there are no other cases that have been mishandled or lost . Im confident in the quality of the people that work in this office. I dont think we dropped the ball on this case. Reporter this lieutenant is charge of the case at the pd and personally reviewed the case. The detectives gave a very good interview on everybody involved and the case is a good case. Reporter and you dont think it took too long . No. Reporter so we tried to find out, on average, how long it takes san jose pd and every other police unit to investigate molestation. Most agencies keep track of that information. San jose does not. Why doesnt sjpd track how long it takes to investigate cases . We dont track the time because the time is really not a priority for us. I mean, we do a thorough investigation. Yes, im a little disappointed that it took that long. Reporter this is the training manager for bay area women against rape. I think its about having their voice heard. I think if molestation happens when they are young, children dont really have a voice. For michelle, its given back her power after trust in her stepfather, the police and Justice System took it away. As soon as i spoke about this, i felt relieved. I know there are girls and people that have been through this. I want them to know that you are not alone and you can speak up any day. You have a voice. Michelle is seeking counseling with the support of her family. Construction is taking place and its causing congestion near the tracks. The mother may have been caught in heavy traffic. A Fairfield CountyHigh School Student brought a gun and staff found it hidden under a trash bin in a restroom yesterday. The 14yearold student was found with a bullet on his person. The student says the gun magazine with two bullets in someone elses bag. The gun apparently belongs to a relative. Depending on who you ask, sfo is either air tight or something less than air tight when it comes to airport perimeter breaches. The airport insists that they had no breaches but the Associated Press found three such breaches last year. Sfo did not provide the Associated Press with further details but none of the cases should be considered a security breach. A separate investigation last year reported sfo had more perimeter breaches than any other airport in the u. S. San francisco schools will receive more than 3 million over a lawsuit claiming unsafe buses were used to transport students. The First Student bus company will pay up that money.
