The 30yearold man, the nephew of the homeowner here threatened family and friends yesterday with a weapon and allegedly he did it again today with a 14inch kitchen knife all before 7 00 this morning and that is why the district here decided to shut down school for the day. We did get some video of the property just in the last half hour when they opened the road again and you can see why. Lakeside Elementary School is right next to where the standoff happened and there is a main house and it housed different member of the same family. The suspect crashed his car on to the property and was holding a knife and a whole gas can in the middle of the property andee seven or eight members of the family. After the Crisis Intervention Team deputies would shoot him with rubber bullets and arrest him. The Sheriffs Office says there was no other choice because the suspect threatened to light the ground on fire threatening the lives of everyone there. There were propane gas tanks right in the middle of it, so we really had no choice, but to move in quickly and subdue him because if we didnt do that then the consequence could have been it would have been devastating. Reporter other deputies were able to put out the fire and she heard men shouting very early in the morning and heard the sirens from patrol cars and she was thankful the district decided to keep the kids home for the day and not take any chances. Up here, everyone kind of walks and roams and walks around and theres very few fences and we enjoy the freedom up here and as a mom, thats not really comforting. We are outside the hall of justice where the hearing went interest recess within the past five minutes and today is the first of what is expected to be three days of preliminary hearings. This is the time when the prosecution presents part of its case to convince the judge that there is probable cause to hold the three defendants on to trial. The three departments being rafael rodriguez, Matthew Farris and Jeffrey Lubin who were sitting behind their respective attorneys. Also in court the sister of michael tyree, the inmate of who those three deputies are accused of murdering on august 26th and tyree was in jail for a minor drug charge, and it was over an hour with the prosecutor questioning the sheriff sergeant in charge of investigating tyrees death and asking questions about the layout of the sixth floor of the main jail where tyree was being held in custody and thats where he died from Blunt Force Trauma according to the coroners office. The assistant d. A. Showed pictures of the floor and specifically asked which areas of the floor were covered by cameras and which werent. And what kind of contact is allowed and made during the hourly welfare checks of inmates. The three deputies are also accused of assaulting a second inmate, that inmate along with other inmates on that floor are expected to testify during these hearings about what they heard and saw on august 26th. Edmond pedraza shot and killed aguilar. Aguilar leaves behind a 7yearold son. Denato perez helped pedraza hide her body. He is also expected to be in court. Yesterday dozens of people came out for a car wash in the neighborhood of san jose to raise money for aguilars funeral costs. Her funeral will be held tonight. Police in san jose are searching for the driver invo e involved in a chaotic Early Morning crash. That driver of the red suv ran a signal early this morning and when police tried to pull the driver over that driver took off and then crashed into a home on park avenue not far from meridian. This is all in the downtown area. The suv damaged the front of the home and took out a gas line, but no one was hurt. The gas line is repaired. The driver ran away and police are still looking for him. Twoors were arrested after robbing a liquor store with a gun and a third suspect ran off. It happened on california street in mountain view. The suspects led officers on a chase through city streets in menlo park before one jumped out of an suv near alma and willow road. Police caught and arrested the other two. In san jose, the unexpected death of a toddler is under investigation. Someone called 911 to report that a 2yearold little girl was want breathing. We analyzed years of data and discovered research that reports californias sentence enhancements have not worked as once promised to reduce Violent Crime. Some critics of the Current System in california say sentence enhancements work in the reverse, serving as an injustice. I started carrying a gun around 16 years old, right . I shot and killed daniel reyes in a gang dispute. 50 years for a gun. 15 to life. I xhicommitted a gangrelate murder. And 49 years. If you want to witness the impact that californias sentence enhancement system has on those convicted on those of Violent Crime look no further than antoine. Were all shaped by our environments. He was just 18 years old when he got into an argument with his stepfather. He saw his stepfather go for what he thought was a gun and antoine pulled his gun first and shot. I committed the act of killing my stepfather after he a abused my mother and little brother. A jury found antoine guilty of manslaughter and the judge sentenced him to seven years in prison and 17 years later, antoine still sits in san quentin. Shooting through a screen door allowed me to have my seven years enhanced to 32 years to life. Thats right. All because a screen door separated antoine from his stepfather, a prosecutor added an enhancement of shooting into an occupied dwelling, much more than his original sevenyear manslaughter sentence. We cant grow to a point of success when were being crippled by our environment. Hes one of thousands of inmates serving extraordinarily long sentences because of sentencing enhancements. Even though ive taken a life, i dont believe it was fair. Reporter while theres no specific data on people like antoine. 3 8 of an inch gave me a life sentence. Using what data is available, 40,000 inmates currently serving time under the three strikes sentencing enhancement law alone. As part of our investigation, we were granted rare access by san quentin to talk to dozens of inmates currently serving time under sentencing enhance ams. I was given 20 to life for that. Inmates like rasan thomas who is serving 18 years for shooting and killing two people in a drug deal gone wrong. I cant say i deserve less than the time they gave me and my thing is for economics because this law makes sense. Without the sentencing enhancement hed be eligible for parole soon. It makes it almost impossible to make a parole board and you have to have live past life expectancy. Or demon lewis and he got 15 years for axe temped murder after he shot a man in the leg and he got 94 years or six times the original sentence for six separate gun enhancements tied to the same time and the same gun. The time was more than you would get for the crime itself. Here we are in california where we are stuck in the mud. The professor with the university of Mcgeorge School of law has studied this for years and it all adds up to injustice. We all suffer with this elaborate criminal Justice System that just piles on these excessive, obscenely excessive sentences. And the numbers show sentences in california for Violent Crimes increase 63 between 1990 and 2009 and patella says that should change. Were spending an enormous amount of money and other states have, for years been releasing older felons. Enough is enough. California state senator Lonnie Hancock agrees. Back in the end of the 1980s we have three state prisons in california and we have 33 state prisons and our population has about doubled, but our prison population has grown by over 400 . Hancock chairs the Senate Public Safety Committee overseeing prisons and she wants to see less attention and resources spent on punishment and more on rehabilitation and drug and commental counselling. How did we get this way . Anything that comes up, the lobbyists form and too often the sheriffs, the d. A. S and Police Chiefs come up and oppose. Advocates of sentencing reform say the Current System gives prosecutors too much power because the prosecutor can stack enhancements on to criminal charges often having them plead out rather than risk enhancements following a trial. What we did in the 80s and 90s in locking people up. I dont care what anybody else says, i believe we did the right thing. Steve wagstaff is the Vice President of the california district attorneys association. He says the system is working as designed. Is reform needed . Do we have too many enhancements and is there inconsistency . I dont think so. I think each county works within its own way and we have conferences when we talk about youth and application and there are differences and i speak with d. A. S who decide to apply things probably harsher than i do. You are surfing the web and out of nowhere, this scary warning pops up saying your system has been infected, its been hijacked and your private and Financial Data is at risk and the only way to fix it call the number on the screen. It looks legit. Like it came from your own computer, but its actually a fake. Its really a popup ad. I just opened the door and just let somebody into my computer. It just happened to natalie while she was online. Shepanicked called the number. They told me they were a Reputable Company and they told me they worked with apple and microsoft and. Please tell me you did not do that. I know i should not have. You let them in. I did it, jeff. I know. Once inside they scammed her hard drive telling her she has a virus, but good news, for 400 theyll fix it. It was sort of like the light bulb went off because i knew at that point what they were offering wasnt true. Security experts say these popup ads are misleading and dangerous. It looks like a warning, but its not real and theres just a picture telling you theres something wrong with your computer. Well try this for ourselves and well call one of the companies that sent the popup warnings and went to the store and brought a brand new macbook air laptop and its right out of the box and we brought our computer and if they tell us over the phone there is a virus this, and it means theyre trying to rip us off and theyre trying to put their own malware on. Well call them up. I saw a pop up that said to call this number about a computer virus. Can you help me . I can help you. The technician immediately asked to tap into my computer and once hes in, we watch him poke around my laptop in realtime. Thats him doing all of that and within seconds, he has bad news. Its a virus and maybe someone is trying to access a video. Thats right. Not only is there a virus on my computer, somebody is trying to hack in. Im going to clean up this machine and make this computer a brand new computer. But remember, this computer is brand new, and then comes the sales pitch. What does this cost me to get fixed . If you go for the oneyear contract it will cost you 199. 90. Our chopper is above the scene and has been for quite some time just before 9 30 this morning. Police found a 14yearold boy with a gun shot wound to his chest on ohio avenue in richmond. Thats near lovonya Dejean Middle School. Medics tried to save that boy, but he died moments later. Witnesses sea they saw someone running from the scene. We presume that that was the gunman. Officers are now searching for that suspect along the Richmond Greenway trail near bart tracks. Because of the search, trains in the area are now running late.
