While the rain is not here, weve got a lot of wind. Lets check in with a meteorologist who knows best. Good morning. Good morning. Weve been seeing those clouds, oven seen them taking a dip. They look upside down like cotton balls. Amazing cloud formations this morning. Weve also had gusty winds, mt. Diablo up to 57 miles per hour, los gatos 47, ocean beach 42 miles an hour. Weve also had winds at the benicia bridge at 36. Some of those bridges really catching those winds rushing in from the south and Moffett Field up to 33 as well. This is well ahead of that system. When you think about the temperatures we had yesterday in the 80s, today will be in the low to mid60s. A major shift in our weather as we are starting now to only see some light showers moving into the north bay. Weve had a lot of clouds and we will start to see a squall line developing as we go into this evening. Heres 4 00. We start to see the heavy downpours, the possibility of some very strong storms moving into the north bay. Moving through San Francisco by 6 00 or 7 00 and moving into the east bay with the potential of damaging winds, hail and lightning. Ill detail that, what to expect. A 12yearold student on a bike has been hit by a car right near dublin high school. Stephanie chuang is live where the crash happened this morning. Youre telling us that the driver is cooperating with police and even talking to you . Reporter yeah. He was very shaken up, the 72yearold man had just dropped off his granddaughter, a senior here at dublin high school, when this happened. He said this is not intentional, i did not see him. When he gets to this driveway he only has one direction to focus on, its oneway traffic. Its clear, he accelerates, turns right kind of like what this suv is doing and thats when he felt something. Thats when the crash happened. He had driven about 50 feet before stopping. The 12yearold was on his bike riding from the other direction. This happened before school started. First responders used airbags to lift the car off the boy. A helicopter landed and took the boy to Childrens Hospital. Both First Responders and the driver himself say the boy was conscious and talking after the accident. I turned right and thats when i felt something. And you said two ladies were walking. And they told me to stop, stop. What did you see when you got out of the car . I jumped out of the car and moved to the back and i saw the kid underneath my car. What was he, was he talking . His hand was moving. I was talking to one of the fire guys on scene and they were saying hes very fortunate that he wasnt burned boy some of the exhaust system that was directly underneath the vehicle. So the boy and bike were caught underneath the car but the tires hadnt crushed the boy, which is great news. Dublin police are focusing their investigation on the car and bike. Police say the driver seems to have followed the law. A bad situation with the boy riding his bicycle on the wrong side of the road. The boy is still at Childrens Hospital but the parents are not releasing his exact condition. This is not too far from Wells Middle School which is where we believe the 12yearold was riding his bike to so this area was packed with a lot of people for that school as well as dublin high school. The district is Offering Counseling to those around here and saw what happened. The poor student and that poor man as well. Apple taking a stand for its users in a debate pinning privacy against National Security. They are rejecting a court order to develop unlock tools for an iphone. The phone was used by one of the gunmen in san bernardino. Bob redell is in cupertino and tim cook very defiant saying he will fight the court order. Reporter yes, kris and scott. Apple ceo tim cook writes that the Software Technology needed to unlock that iphone that the government wants his company to create is too dangerous to create. It could allow anyone to unlock any iphone. Tim cook spelled out, wrote out his argument in a letter that was posted just after midnight onto the apple website. He writes that the company will fight a magistrates order to unlock the iphone of syed farook, one of the terrorists in san bernardino. Investigators want to see what he was commutinicating in the weeks leading up to the attack. The government wants them to develop a back door for the iphone, the equivalent of a master key that could unlock and bypass security not on just that phone but millions of other iphones as well. We spoke with a lawyer who fights for Digital Privacy rights on behalf of the Electronic Frontier foundation and he calls this request by the federal government unprecedented and dangerous. Even if apple is able to keep that back door secure, the legal precedent that this order would set if its upheld would compromise the security of all apple devices. If this order is approved, that would allow a court to outlaw this is more than a slippery slope. This order, if upheld, would be the end of secure encryption in the u. S. Reporter the Electronic Frontier foundation or eff says the fbi can still retrieve the meta data off of farooks phone, being who he called or texted and for how long, they just cant access the content of those communications without apples help. The eff plans to file a friend of the court brief on apples behalf. Apple says that it doesnt sympathize with terrorists, that it did provide whatever data they did have on farooks phone and offered Technical Advice to the fbi. There is support for what the government is requesting of apple. For example, coming from william bratton, the Police Commissioner of new york city, which was attacked on september 11th of 2001. He wrote, quote, no device, no car and no apartment should be beyond the reach of a Court Ordered search warrant. As the threats from isil become more divergent and complex, we cannot give those seeking to harm us additional tools to keep their activity secret, unquote. Scott, youve been covering this issue for years and you were saying even before steve jobs died, this was the way that this was going to play out. It really was, and it was tim cook who took over after steve jobs who really telegraphed it. I think we have video of him, yes, at stanford. This would be last february. The president of the United States created a cyber team, Cyber Security and Consumer Protection summit at stanford, and tim cook spoke right in front of the president and said we are not going to allow back doors in our products. We are going to keep encryption and any time the Government Asks us for this, we are going to come on the side of encryption and users. So that was him at least theoretically saying what would happen in the future. Now were seeing the actual activity. And tim cook, while he is very careful in that letter, says listen, were all americans, were patriots, we hate terrorism, we hate what happened, we need to do this for constitutional reasons. Hes really betting his career on this. It will be interesting to see what other ceos get behind him, google, oracle, hp, or are they going to remain silent. You know, its interesting because people will say take the easy step, the easy leap and say why would he protect terrorists. Just open it this one time. But its really about protecting everybody. Its a much broader its drilling one hole into the dam and say were just going to drill that one hole, what possible damage can it do . Well, thats not the way dams of built. And correct me if im wrong, but there was a lot of information that they were able to get even without that back door this phone belonged to the county, which actually set up the encryption. It wasnt farook. It wasnt even his phone, it was the countys phone that they gave him. They dont think theres anything on there because he didnt destroy this phone, he destroyed all of his other phones because thats immaterial in the argument should you be allowed to open it up. It happened while sitting in their car on pablo street. Right now police do not believe the shooting was random, but they dont know much about the gunman, including how he got away. We will certainly look and see if there is any type of gang ties to this. Those are some of the things investigators will try to look at and answer, just to see whether our victims or suspects may be related to that. Two of the victims are in serious condition, the other is expected to be okay. Happening today, the man charged with shooting and killing an east Bay Police Officer is expected to make his first court appearance. Robert vega is accused of killing officer gus vegas during a domestic dispute at the Richmond Police officers home in vallejo last week. Officer veg ags was the grandfather of the suspects son. Vegas was a 15year veteran of the police force and will be honored friday morning at a public memorial in richmond. Its expected to be tense tonight at the Police Commission meeting at San Francisco city hall. The focus will once again be on a new protocol for how police handle confrontations with suspects. The commission will give an update on the new use of force policy. The city continues to be under the microscope following the death of mario woods. He was the stabbing suspect shot and killed by police in december after repeatedly refusing to drop a knife. At last weeks meeting, the public anger and frustration was very visible, as chief sur once again asked for permission to arm his officers with stun guns. America would have used it if iran had refused to shut down its program or if israel had attacked iran. By conducting a cyber war it was hoped we could stay out of a shooting war. The times says the plan will be revealed in an upcoming documentary called zero days but its reporters verified all the facts of the film independently. Meanwhile a newly declassified report says the National Security agency might not be as powerful as we first thought. More than likely it will help valentine with his Recovery Efforts and will not be dough tatd to kanye west. A brief fight is now part of a much larger conversation on privacy because video is viral. Sonoma High School Leaders say this happened last week. In the video a girl from creek side high is punching and kicking a boy from Sonoma Valley high. The two schools share a campus. The video ended up on facebook and has been seen millions of times and that has parents upset. They believe High School Fights should remain a private matter. I think the parents of the children should definitely be involved. But as far as everyone else, once again, i think its just blown out of proportion. The incident is bringing up issues about privacy in the digital age. The School District asked facebook to remove that video but facebook refused. The district also notified parents about what happened, reiterating that School Safety remains the top priority. And a followup now. As expected danville leaders will ban shortterm recommendations like airbnb. They voted 41 to ban all shortterm rentals of less than 30 days. A string of complaints over the past year forced leaders to take action. Most people at last nights meeting supported the ban but opponents argue it will infringe upon the private Property Rights of the owner. Now it looks like santa clara leaders are going to appoint a replacement mayor as soon as today rather than wait for voters to elect one. Now the city needs someone to serve the last two years of his term. Last Night City Council members voted to hold an emergency meeting tonight to appointing a replacement. Not bad for the crabs but bad for the people who eat them. The task force is looking for a few options for commercial crab fishing including opening each region one by one as the conditions improve. Recreational crab fishing was reopened last week. Weve been looking in this picture window behind us and the clouds that have moved in, some of them, kari, are looking quite dark. Yeah, but thats a beautiful shot there and we will tin to see some clouds in and out of the bay area throughout the afternoon. Also some gusty winds that may top 50 miles per hour. Weve already seen that so far this morning. This afternoon a squall line will develop, a line of thunderstorms, and it will move from north to south and that is what we are expecting into the evening and the rain lingers, mainly some scattered showers as we go into tonight and the winds will start to calm down. Looking at those temperatures now, weve had such a mild start to the day, its 66 degrees in oakland and livermore. In concord its 68 degrees. Compare this to our temperatures that were quickly rising yesterday. We did make it into the low 80s for many spots. Now that we do have more cloud cover and some gusty winds, this cold front is approaching from the north. We have some scattered light showers starting to move into the north bay, but so far we havent seen much in the bway o measurable rain. I do think well see that this afternoon and into the evening. Starting to see some light spotty showers popping up in the north bay and heres that squall line i was talking about, doesnt develop until 4 00 this afternoon for the far north bay while the rest of the bay area is still mainly dry. It moves into San Francisco and into the east bay by 7 00 this evening. It may not make it into san jose until 8 00 or 9 00, and also for those spots farther south and east with heavy downpours, gusty winds and concern of small hail in some of those storms that are a little stronger. Still some lingering showers hit or miss and it will taper off during the night and staying still windy in some spots. Look at how much rain we could see, the potential of about 0. 4 of an inch in fremont. This will be a quick one andd , done. Temperatures today staying in the 60s, upper 60s for the south bay but these temperatures are closer to average and we are not looking at those 70s and 80s like we have to start out the week, so at least feeling much better out there as this cold front does approach. After this system moves through, we will have another one moving in on friday and it could bring in some scattered showers for the north bay most likely. The rest of the bay area just seeing some light rain and then another system approaching on sunday that kind of may fizzle out or bring in a chance of showers on monday morning. If youre going to the sierra, we do have a winter storm warning in effect. Up to 20 inches of snow above 7,000 feet. Rau robert handa shows us the changing strategy by san jose police. Reporter the burglary unit has been slashed to a handful of officers, each assigned to hundreds of cases. Standard Police Procedure kept any video or suspect pictures out of the public eye until there were no more leads, even if it took weeks or months. You have to remember when we put that information out, it could cause the suspect to do a few different things. They could flee the area, change their appearance or destroy evidence. Reporter but now they have a program to put images on the website and social media almost immediately. Investigators say they were startled by the public response. Tips have been pouring in on numerous cases. In fact six cases have already been identified from the last ten videos posted. Police say it is the main reason burglaries dropped 71 and as much as 75 in other problem neighborhoods. These individuals are committing multiple burglary, so by getting one of these subjects in custody, were in essence preventing dozens of burglaries from happening. Reporter and police hope the extra Community Involvement will encourage homeowners to upgrade security cameras and by doing so strengthen evidence. Very good quality video is what we need. In fact weve seen nearly a 30 increase in Video Evidence thats been submitted by the public to us. As robert reported, burglaries are down by about 71 . In the foothill district, 75 drop and the three combined eastside neighborhoods show a drop of more than half. One outlier, the Downtown District did see an uptick but police say that reflects specific crime sprees. The San Mateo College district is considering a change that would allow Campus Police to carry weapons. As Michelle Roberts shows us, students are divided on that issue. Were going to examine all the issues. Reporter chief rob dean oversees the Public Safety department for all three campuses in the San Mateo College system. The officers that report to him carry pepper spray and a baton but soon the board of trustees may vote to arm each officer with a gun. We want to look at all the available options and figure out whats best to make it safest. Reporter the college is in the process of studying how best to protect students against an emergency situation like an active shooter. The chief says it may come down to response times. If were in close proximity, we would be there sooner possibly than local law enforcement. Reporter he also says if the board approves the use of lethal force, each officer would need to undergo a psychological as assessment, a thorough background check and rigorous training. You need to train with it, be proesht at it, demonstrate that proficiency. Reporter before a decision is made the which i was asking for students to join the debate. With the increase in school shootings, to have our First Responders as prepared as possible makes me feel safe. Reporter while others want to keep weapons off campus completely. Seeing a weapon would kind of just make me feel really uncomfortable. Reporter Michelle Roberts, nbc bay area news. A stroll along the Golden Gate Bridge ended in a bizarre crime. Now we are hearing directly from the tourist hit by a blow dart. He was visiting San Francisco from mexico when he and another tourist were hit by those darts. Mark matthews shows us what the chp is doing to try to find the person who fired those darts. Reporter able medina says he was nearing the north end of the bridge when it happened. A needle from a blow gun hit him in the left leg just above the knee. Translator it didnt bleed. I guess because it was a direct hit, like an injection. Reporter medina says his leg is recovering but he is worried about what may have been on the dart. Translator right now what i feel is just slight pain. It did go into my body about two inches. Reporter the chp doesnt believe the dart is poisoned. It is running tests on the needle. They told medina it could be a couple of weeks before the results are in. He calls that frustrating. In the meantime, investigators are reviewing videotape from the bridges surveillance cameras, but the bridge manager admits they dont show much. This is literally a needle in a haystack. You know, really, really difficult to try to pick anything of significance out of the crowds. Reporter reaction from visitors to the bridge today is what youd expect. Well, thats bizarre. Its not regulated and there are no plans to regulate cryotherapy right now. Ryan weeks says he welcomes any oversight on the industry. I would ask that everybody has an open mind and that we actually study this and look at it as an applicable method for treating people in a different way. Chris said he literally picked everythings name out of a hat when he got her as a puppy. It turned out to be as perfect as it was random. Everything became just that to chris. I guess some people have religion and some people have, you know, their materialistic things, but for me it was the dog. During this tough times in the past, tempted down some dark roads, one thing chris said always kept him from going too far astray. Like no matter what, i had her. It was like this responsibility and i never let that go. You can imagine what it was like for chris to lose her. Two years later, it still hurts. This is like my favorite picture i have of her. But if time wouldnt heal the wound, perhaps kindness might ease the pain. Its why last month chris put this post on instagram, promising to send anyone a free tennis ball if they just promise to use it to play with their dog like chris wishes he could his. He started with 100 balls and low expectations. I figured i was going to be sitting in my room with about 80 or 90 tennis balls. But it didnt happen like that. Chris exhausted his initial supply practically overnight. And now has a waiting list hundreds of dogs long. People from around the country, even the world, sending in requests with notes of thanks and encouragement, and then sending back proof of chriss good deed. I feel great about it. Its a lesson all of us can learn from, really. If you ever feel like youve lost everything, just throw a little love out into the world and watch it brought right back to you. You can see the web shaking around and you can tell that it is windy out there and weve had a few breaks in the cloud but still much cooler than yesterday at this time. In san jose its 65 degrees, 66 in livermore and 68 in oakland. We do have a wind advisory that continues until 7 00 this evening. Winds may top 50 miles per hour. Weve already seen that, especially in the hills. Mt. Diablo we had a wind gust at 57 miles per hour. That could also cause some damaged trees and Power Outages so be prepared for that. As the sevenday forecast comes up at the bottom of the screen, well have some cooler temperatures over the next few days and slowly warming up. Weve only seen some light spotty showers so far in the bay area, but well start to see a squall line developing and move from north to south as depicted by our computer model. This is 1 00. We only see light rain for the north bay, maybe only hitting San Francisco and this will be a very heavy downpour where we see bright reds, even some shades of pink where there may be wind damage and lightning. It moves through ukiah and santa rosa by 7 00 or 8 00. This will be a quick mover. As it produces the heavy rain, it will drop a quarter to half an inch of rain. Then into palo alto by 8 00 this evening and it continues to move off towards the south and east while weakening. Well still be left with spotty light rain overnight and into the morning commute but that main squall line moving through will be of main concern. We may get up to threequarters of an inch in San Francisco and a little higher as you head to the north where the rain is falling a little longer. Temperaturewise we are really bringing it down from the way we started out this workweek. Even yesterday weve been setting some record high temperatures. Were looking at something a little bit closer to normal reaching into the low to mid60s. Heres the cold front moving in. Were seeing that rain rushing in out ahead of that and well see another system moving in by friday so that could bring us some additional light rain. Some of the heavier rain will be moving across the north bay. By sunday another system moving in. So it looks like we could see things getting a little more active over the next several days. Looking at northstar, actually its been raining there so i think it chased those skiers inside. Weve had some warm temperatures but then that rain will change over to snow as we go into tonight. Where we see those bright blues, thats heavy snow and it continues for at least the next 24 hours, also creating some dangerous travel conditions. All of these areas shaded in pink under a winter storm warning that starts at 7 00 this evening when it changes over to snow and the potential of up to 20 inches of snow in some spots. Heres a look at the model that shows that, where we may have maybe 22 inches of snow in spots like twin bridges and we need it because weve lost a lot of snow with this warm weather. It will be cooling down over the next few days, at least to start out the weekend, as our dry weather returns and then sunday is looking to 70 degrees. Sunshi well be right back.
