Theyre said to process all the possible evidence collected just this morning. Witnesses around st. Lukes hospital in the mission caught gunfire on their cell phones, a tense scene unfolding around 4 15 yesterday afternoon. When we dent down that south stair, man was shooting a gun, he was actually shooting. Like a duck hunting shotgun. Reporter San Francisco police say he suddenly pointed a rifle down toward the hospital and at officers who acted quickly. Right in front. Suspect down. Suspect is not moving at this time. Unsure if hes been hit. Reporter three officers shot. One round fell marked here in front of the construction site by crime scene investigators. Overnight Police Officers watched the front entrance making sure anyone kept from entering the crime scene. Investigators did a final sweep of the building. They took pictures of the yellow tarp used to cover the suspects body on the lift where he had been standing. The officers worked carefully collecting all potential evidence bringing out at least three bags full of items to process, hoping to get dna, fingerprints and anything else to move the investigation forward. But San Francisco police chief greg sur says is that lopez garcia used a handgun to rob this sporting store in san bruno within the hour to steal a shotgun and shells. The description of the suspect and firearm matches in both cases. A pistol and shotgun found in lopez garcia according to police. Thanks to our security and the Police Department their reaction was swift. And our patients and our staff and all the contract workers here at the hospital were safe and secure throughout the incident. Reporter the hospital spokesman saying pretty much by 10 00 last night everything was back to normal. It does have counselors on site to help Staff Members if they need that help. Now, police have already cleared this scene, but construction workers have not returned this morning. Police saying there will be no more updates until a town hall meeting although they have not set a date nor a time for that just yet. Live here in San Francisco, stephanie chuang, nbc bay area news. All right, thank you very much, steph. Well, the area where that happened certainly a busy part of the city. And when people heard that commotion as you saw they grabbed their phones and hit record. Several witnesses catching those gunshots on camera. Another man says he saw dozens of construction workers running as fast as they could away from the building. The construction workers on the top of the building was shield so they wouldnt get hit. I thought follow the cops, stupidly. As soon as i turned the corner here i heard a single gunshot, so i stopped. Cops kept going. Again, nobody on the ground hurt. Well continue to cover this story. A legal dispute among neighbors over a child with autism is back in south bay courtroom. Nbc bay areas bob redell is in san jose. And, bob, neighbors were afraid of this child. They said he represented a threat to the neighborhood. Reporter scott and kris, you might recall two sunnyvale couples are suing the parents of an 11yearold boy with autism because of an alleged of alleged violent behavior towards their own children. This morning today moments ago the plaintiffs arrived in front of a superior court judge here in san jose while the defense telephoned in to let her know how mediation talks have been going. And she isnt pleased with what she heard. Turns out both sides have not met since they were ordered into mediation last september. The plaintiffs say that they have repeatedly suggested dates to meet with the defendant but receive no cooperation. Now the defendant has hired a new attorney in that time who claims that they havent had time to review the material and set up time for mediation. The judge admonished both sides for not being, quote, solution oriented, not doing their best to avoid litigation. Now, in their lawsuit the two sunnyvale couples claim the parents of the 11yearold boy with autism did not stop their sons allege ed violent and aggressive behavior towards others in the neighborhood. They say the boy slapped and kicked their children. And in one instance claimed he bit an adult. They are trying to make the case that the parents inaction is a nuisance and that they deserve monetary damages as a result. Now, the family of the boy has since moved out of the neighborhood, but they still own the home, which is why the plaintiffs have not dropped the case. And last week the boys father appeared on abc news and said he hopes that a judge dismisses the case so he and his family can move back into their home in sunnyvale. Now, within the past 20 minutes one of the plaintiffs told me he believes the defense is trying to bash them in the press, use the press to force them to drop the lawsuit. A man accused of killing an east bay ice cream vendor is expected to appear in court today. Police say jovan lopez shot and killed the driver of an Ice Cream Truck early last month. It happened in an east oakland neighborhood. Police made that arrest tuesday night. Investigators believe there may be a link between two driveby shootings on interstate 880, the latest happening tuesday night in pinole. The chp says gunman opened fire on a car killing the male driver and injuring his female passenger. Authorities say the shooter and the victims knew each other. Police are investigating this shooting if its connected to a different shooting last monday on i80 in san pablo. The man says or police say a man was in his car, shot multiple times. Hes going to be okay, Police Believe the targets in those shootings were not random. In jail after a bizarre showdown with san jose police. Police say nathan wong seen here confronted them early yesterday morning wearing a military get up and carrying an assault rifle. Officers showed up at his town home after a neighbor reported wong was trying to get into their third floor window. When Police Showed up at wongs door they say wong lifted that driefl in their direction and an officer fired but missed. Wong later surrendered peacefully without anyone getting hurt. Three men who forced their way into a familys hercules home are on the run this morning. This happened around 7 00 tuesday night on partridge drive near interstate 80. Police say the suspects knocked on the door, told the resident they had the wrong address but then forced their way in. They were reportedly wearing ski masks. People who live in the home say they grabbed sharp objects to try to scare those suspects off. The men got away without taking anything. Students are organizing another march today in response to a racially charged incident last week at Berkeley High school. One week ago more than 1,500 students marched to the cal campus to protest a racist message that was posted on a Berkeley HighSchool Library computer. A 15yearold student who admitted to posting the message and now faces expulsion. Students today are organizing a solidarity march which is supposed to start in the next hour. Happening today, a new Housing Project will be the focus of a meeting in the east bay. In the spotlight are five acres of land along tice valley boulevard in walnut creek along 680. Some people are saying not in my backyard. The project would demolish a nearby vacant nursery and community center. Neighbors say theyre concerned the new development would bring more traffic and potential flooding. The city will review those projects Environmental Impact tonight. A Palo Alto City Council committee is recommending ecigarette smoking be banned in all areas where tobacco smoking is already illegal. The full City Council Must approve this. Well, theres no doubt that the u. S. Is an attractive place to invest in real estate. The National Association of realtors tells us that International Buyers spent over 28 billion on u. S. Properties last year. But in cities like palo alto neighbors are starting to notice those Investment Properties sitting vacant. And its affecting the neighborhood. This isnt your average plane ride. This plane is actually the latest real estate tool helping home hunters buy properties from the sky. We opened up a subsidiary in china. And we have two fulltime employees stationed over there. Reporter michael rep ka of daily owned realty in palo alto spends thousands on marketing videos that help International Buyers take virtual and aerial tours through peninsula properties. So they can bid on and buy homes without ever seeing them in person. The company was recently named the Number One Real Estate Team in the country by real trends ink and a good portion of their 500 million in sales in 2014 can be attributed to International Buyers. Hes secretary treasurer of his Homeowner Association and says theyre concerned that International Buyers are creating ghost homes, buying properties as a way to park money in the u. S. Where real estate is more stable. But never actually moving into the house. Somebody in asia is not going to be concerned about whats happening in our neighborhood. Reporter according to a California Association of realtors 2014 survey, 36 of all International Buyers were from china. 75 of International Buyers said they bought for investment or tax purposes or because they had Family Living in the u. S. And 66 of International Buyers paid all cash. Some locals say they cant compete with that and are getting pushed out. Repka says the company does hear from frustrated buyers. Sometimes we get some nasty racist notes mailed to us anonymously. Whenever youre successful in any area, people have a different point of view, but ultimately you just have to continue moving forward. Reporter while morrison understands and is even sympathetic to International Buyers who want stable u. S. Properties, he says empty ghost houses can damage neighborhoods. What are they doing to us . What are they doing to our neighborhoods . What if i have a ghost house here . Reporter and what about sellers who say they only want to sell their home to a local buyer, a family, someone who will live in the house and contribute to the community . Repka, who only represents sellers, says those conditions are a deal breaker. I dont mean to pass judgment, but personally if i run into that situation, i would decline the listing. But ultimately we need to open up the area to everyone who wants to come here. Now, according to the National Association of realtors of the homes purchased by International Buyers in 2014 only 39 said they were buying the home as their primary residence. Back to you. Thank you, peggy. Violent beatings behind bars and a former gang member now says correctional deputies at the main Santa Clara County beat him and left him with permanent damage. Hes coming forward as the Sheriffs Department investigates the different beating death of another inmate allegedly at the hands of three deputies. Nbc bay areas jean ellie talked with the inmate and his lawyer. Reporter former gang member ruben garcia says when he was in the main Santa Clara County jail in july, two correctional deputies beat him. Threw me down. As i was going down i hit the corner of the steel bed, the bunk bed, on my face. I dont know if that actually caused my broken jaw. Reporter these are pictures of garcia more than a month after the alleged beating when he was treated for a jaw fracture. Garcia says he didnt report the incident because he was afraid. Quite frankly i just didnt want to get beat up again. Reporter garcia admits he fought with an inmate the next night. And then he says he heard deputies beat Michael Tyree to death in august. I heard screaming for help. Reporter garcia says when a detective questioned him about the tyree case, he told investigators deputies beat him. In a statement the Sheriffs Department confirms that part of garcias story and goes onto say the detective informed his superiors and an investigation was initiated into mr. Garcias allegations. And that investigation is active and ongoing. He is going to need at least another surgery. Reporter attorney Robert Powell is filing a claim against Santa Clara County and two correctional deputies with the last names of dario and lee. Powell believes violence against inmates is routine inside the jail. Getting to that point where someone is beaten to death by not one, not two, but three officers, you dont get there overnight. So its been a long running problem. Reporter garcia says hes witnessed multiple beatings and wonders if he could have saved tyrees life. I felt guilty because if i would have reported what happened to me at the time, maybe michael would still be alive right now. Reporter nbc bay area news. And now to an Investigative Unit exclusive. Well, a samesex married couple in utah is now fighting to keep custody of their foster child after a Juvenile Court judge ordered that the baby be taken away within a week. This all happened during a routine hearing. The lesbian couple says the judge ordered the child be placed with a straight couple because it would be better for the childs well being. Utahs child and Family Services is now looking into whether that order can be challenged. And new video now from our nbc helicopter in new york, take a look. That man shining a light right at the chopper. And it happened as the crew was flying to a breaking news story in downtown brooklyn. Around the same time an nypd helicopter also hit by the laser. Both pilots tracked the suspects and with the pilots help police on the ground were able to take those two men in custody and it was caught on camera. One of the men was arrested. A popular seattle tourist attraction back open this morning. The great wheel was shut down for some time yesterday after it was hit by a rogue drone. Just before 5 00 yesterday police say a drone hit the arm of the iconic ferris wheel. It then fell crashing onto a picnic table below. And a park manager took a picture of that drone. Witnesses say the drone was trying to fly through the spokes. There you see it. Didnt make it. Fortunately nobody hurt. I cant figure out why somebody would fly a drone so close to other human beings. I dont get it. The video would be amazing, but boy that would be dangerous. Seattle police confiscated the drone. So i said i should start taking him around to meet other people. Make other people smile. Reporter petey has been coming to the pines rehab and Health Center for about five months now. As you can see he loves animal crackers, so denise keeps those on him so he stays with her in the hall. Down the halls he goes making stops along the way to say hello. Im very glad you brought him in. I love animals. Theyre very happy to see him because a lot of people that are here were raised with farm animals. I think the reaction is kind of unique because hes different, you know. Theres not too many other goats that come in to peoples rooms. Nor are there too many Nursing Homes with the opportunity to offer its residents this one of a kind relationship. We should get a goat. The today show has a dog, why cant we have a goat . It was cool to start, but now were starting to roll up those long sleeves. Our temperatures warm up its 57 degrees in San Francisco. But a closer look at parts of the east bay. 63 degrees in castro valley. Walnut creek 58 degrees. Orinda at 60. And also 60 in sunol. A look at the bigger picture, we are seeing more uniform temperatures. As we go hour by hour in san jose 61 degrees at 1 00, 2 00 youre driving and its feeling nice and comfortable, no need for the heater anymore. And mostly clear skies into tonight as we go into the evening our temperatures will be dropping back down into the 40s. We may once again see some of that patchy frost once again especially in the valleys. A look at all the microclimate 67 in san jose, san mateo 66. And 67 in Half Moon Bay while San Francisco sees some mid60s there. Upper 60s in parts of the north bay. And even hitting 71 degrees today in pittsburg. Dublin reaching 65 degrees. Our next weather system is moving into oregon right now producing some snow in the higher elevations. And a lot of heavy rain. As this continues to move closer to the bay area its going to lose some of its punch. But still bringing quite a bit of rain for the north bay starting out here look at the timeframe 3 00 sunday morning. And then moving into the south and parts of the east bay as well by 9 00 in the morning. So looks like it could be a wet sunday morning and then some snow starting to fall on the sierra. That continues for a few hours. Looking at the potential of some measurable snow once again. As far as rain our first runs of the computer models bring us anywhere from about a quarter inch possibly closer to half an inch. So well see how that plays out. And then as we take a look around lake tahoe we are seeing the possibility of up to 8 inches of snow. And then some possibly higher amounts for those higher elevations. A look at the weekend forecast, it will be dry and very comfortable to start out. Tomorrow and saturday highs in the upper 60s to lower 70s. And then it gets cooler on sunday with the clouds and the rain moving in. Were going to stay in the 50s in San Francisco throughout the day on sunday.
