Gonzalez accused of killing 8yearold Madison Middleton at their santa cruz apartment complex in july then throwing her body in the dumpster. Supporter of little girls family held photos outside the courthouse today. We want to make sure that shes represented here as well as as well as the person that took her life. And so we want to make sure that people see her face and remain aware to keep an eye on their children. Gonzalezs Attorney Says theyre still sorting through the evidence theyll present in court. The teen is charged as an adult. If found guilty on all charges he would face life in prison. Also in court this morning, the three drifters accused of two brutal bay area killings, they were supposed to enter a plea in court. But the judge postponed their arraignment for the third time. Theyll be back in court in three weeks. The trio is accused of killing a hiker in marin county and a canadian backpacker in San Francisco earlier this month. The woman shot by Emeryville Police say theyll take the Police Department to court over that killing. The family says its planning to file a federal lawsuit and will reveal details about that lawsuit later today. Emeryville police confronted henderson in february after reports of a carjacking at a nearby home depot. Witnesses claim henderson pointed a gun at officers leading them to open fire. Her family does not believe that account and are demanding the release of Surveillance Video that may have captured that confrontation. New at 11 00, San Francisco is trying to pioneer the way in the fight against hiv aids. This morning the mayor and other city leaders announced a new plan and a lot more money dedicated to the problem. San francisco was ground zero for the epidemic. Many people here today saying no one back in the 80s would believe this would be the city to lead the fight against hiv aids. Thats what city leaders say is exactly happening here. A new campaign called getting to zero. So mayor ed lee along with supervisors scott weaner and david compost announced alongside executives from mack aids fund a donation of half a Million Dollars to the campaign in addition to 1. 2 million in new funding for the campaign in general. Keep in mind this is also on top of what the supervisors have already committed. Roughly 54 million to hiv aids and prevention as well as care for the next fiscal year. We heard this morning from a transwoman diagnosed with hiv in 88. Aids in 95. Jo hannah brown says she lost everything, her job, apartment, will to live. But after getting help from San Francisco she can see the real change in the near future for all those impacted by the epidemic. Its very real. I remember in the 1980s people would have gone but today here we are living healthy, so im living a very healthy life. So get to zero is something i can see. Weve just kind of been drifting downward. And we think now is the time that we can actually get down to zero because of great improvements in treatment and prevention. If we can bring those together and sinner jazz, then we think we can get to zero. Reporter and as for where San Francisco stands now the department of Public Health reports nearly 16,000 People Living with hiv that was by the end of 2013, 92 of them male. There was a record low of 302 new hiv diagnoses last year compared to 2,500 at the peak of the epidemic in 1992. The question is when is San Francisco getting to zero . The shortterm answer to that for the response is theyre trying to cut it down 90 in hiv infections and death by the year 2020. Just a few hours ago the chp identified five People Killed in a weekend crash in the sierra foothills. Four of them were from the bay area. All five people in the suv were from the bay area. 54yearold grace yu from san jose. 69yearold myung yang from cupertino, mikyong hong from gilroy and one from hayward died in the crash. Jung su yang survived the crash. The cause of the crash is still under investigation. San joses police chief will retire from san jose to become the chief in tracy. You may have some high breaker waves coming in. And wave heights have been anywhere from about 9 to 10 feet, but it could get a little bit higher. Period of swell about 14 to 16 seconds so you should never swim alone if youre heading to the beach today. Temperatures are still pretty cool. May have a lot of people going out there. Once again the wind forecast continuing to pick up. And look at all the microclimates. Its 61 degrees in the north bay. San francisco 64 degrees in the south bay 62 degrees. As we get a closer look at the south bay those temperatures in the upper 60s in willow glenn and over towards santa teresa at 64 degrees and san martin it is 69 degrees. The east bay at 60 degrees. We will feel some warmer temperatures as we go through the rest of the day. A closer look also at the peninsula. We have temperatures that are in the mid60s in San Francisco at 68 degrees in forest hill. And Mission District it is 67. Once again we will have those high waves out there, temperatures reaching into the 70s and 80s and breezy wind but a lot of sunshine that will stay with us as we go into the next couple of days. And as temperatures warm High Pressure here its moving in and pushing away that low pressure that we had yesterday that brought the scattered showers. And when you have High Pressure and low pressure close together, we have the air moving very quickly giving us some gusty winds. Into the weekend its going to knock back those Cool Temperatures as another cold front moves in. We can either have some snow showers for the sierra. Well keep you up to date on that. As far as how much rain we could see in the bay area between sunday and monday, the possibility of at least a few hundredths of an inch, maybe a tenth of an inch for the north bay. So it is looking good after halloween some dry weather. We will have a chance for some rain sunday and cooler temperatures, but it will be warming up the next couple of days. That man says he stabbed his girlfriend, but was initially turned away at the jail. Nbc bay areas Chuck Coppola has the response from the sheriffs department. Reporter monday morning 28yearold Hugo Ernesto Castro walked into the main jail with a note, that he knew of a dead body. He was told to go to san jose police. He did, where officers detained him while field officers went to this condominium complex in san jose and found the body of a woman castro had dated. Police then arrested and questioned castro who they say confessed to killing her. But it has added one more incident for a Blue Ribbon Commission alerted already to scrutinize jail personnel. The first thing you do is you call someone who has the authority to ask that person questions, sit them down in an interview room, talk about it, identify the location so that if the victim were still alive that person could perhaps be saved. Reporter sheriff lori smith issued a statement saying castro wanted to turn himself in, but later in the same statement says at no time did mr. Castro say he was responsible for the dead body or had any involvement in the crime. But with three deputies accused of murdering jail inmate Michael Tyree two months ago, this incident adds to questions about deputy training. This is yet Something Else that this commission is definitely going to be looking into. Reporter sheriff smiths statement added that if the initial findings are true, then the custody deputy failed to meet the expectations of the department. Chuck coppola, nbc bay area news. Two cases so far in san leandro near a royal high school, nbc bay area cheryl herd spoke with the daughter of one of the victims of robbery. A guy with a gun and mask and black and gray came up to him with a gun. Reporter shocked and shaken by what happened to her father outside their san leandro home monday morning. My dad grabbed the guys wrist and tried to take the gun from him, but then he saw two or three other people running up in masks and guns too. Reporter her father just dropped her daughter off at school, his wife and two other daughters were in the house when he got home. He went out here. Came back out to close it and lock it and they were already here. Reporter the masked men forced her dad into the backyard. His wife saw all the commotion and dialed 911. As soon as they saw her all they said was the lady has the phone, shes calling the police, hurry up. Reporter with her father on the ground, the robbers got away with his wallet. A similar robbery happened on october 8th in the same washingt Washington Manor neighborhood. This time it was a home invags and the gunman got away with personal items. In both cases coincidentally the victims in the cases are asian males that are 59 years old and had just driven their children to Arroyo High School and then returned home and at which time approached by three to four masked men. Reporter on october 8th the suspects took off in a dark colored nissan rogue captured on surveillance camera. On monday neighbors told they saw a dark colored car lurking in the neighborhood. Police dont think its a coincidence. Cheryl herd, nbc bay area news. Well, it is sentencing day for a former student at a prestigious New Hampshire prep school convicted of sexually assaulting a younger classmate. The case really drew National Attention because the suspect and his accuser went to one of the most elite boarding schools in the country. Heres nbcs stephanie gosk. Reporter just hours from now owen will learn whether hes going to jail. Guilty or not guilty . Guilty. Reporter convicted of Sexual Assault misdemeanors and endangering the welfare of a child and one felony charge of luring a minor from his computer. The accuser 15yearold classmate alleged the sex was not consensual. Were concealing her identity. I was raped. I was violated in so many ways. Reporter the trial shined a light on the elite st. Pauls prep school and revealed a ritual known as the senior salute where seniors asked out freshmen, sometimes for sex. He denied the charges. It wouldnt have been a good move to have sex with this girl. Reporter but now the 20yearold faces up to 11 years behind bars and have to register as a sex offender. On wednesday his lawyers filed a motion with family photos urging leniency. The harsh truth is that owen will be penalized every single day hereafter for what he did one night as an 18yearold high school student. The court was given 28 pages of testimonials on his behalf. Friends writing hes the model gentlemen, stunningly brilliant, a role model. From his father it would do no good to incarcerate owen. His mother pleading owen has already been hurt far beyond what anyone might ever know. But a spokeswoman for the victims family says the victim was harmed too. This was sexual violence. And it wasnt egregious case. And im hoping that the sentence actually reflects what we all heard in trial. And now to the Investigative Unit exclusive. They are some of the most vulnerab vulnerable, children removed from their parents and placed in foster homes. Tonight, a story about what happened to one little girl when the system failed her. We interviewed care givers and pieced together Police Records and court documents. We found a series of abuse reports that went nowhere. And that nearly led to the death of a 4yearold girl in foster care in Santa Clara County. I dont understand why this happened and why they let it go on over and over. And here im like practically screaming and yelling and telling everybody. Everybody i could think of. How does the county handle reports of abuse . What are your social workers trying to do . An unmanned military balloon loaded with top secret sophisticated equipment broke free and drifted 115 miles from maryland to pennsylvania. Fighter jets had to be scrambled. The balloons long tether caused destruction on the ground. The craft was impossible to control. As we hear from nbcs tom costello, very difficult to catch. A hovering hightech Surveillance System thats supposed to watch the skies along the eastern seaboard. This is part of a new military radar system thats supposed to detect cruise missiles, fast flying, low flying cruise missiles, probably from russian aircraft and drones. This military balloon called a jlens broke free from moorings in rain and high wind at a military base in aberdeen and then floated more than 150 miles to montour, pennsylvania. Passenger planes around the balloon while norad scrambled f16s to intercept it. Theyre working as fast as they can. Reporter for nearly four hours cable news and social media followed it soaring to 16,000 feet and then ascending and skipping across the pennsylvania countryside. About the size of two football fields the balloon dragged a heavy milelong cable hitting utility lines and knocking out power to nearly 28,000 people. Here we are no power after a blimp has knocked out all the power in bloomsberg. Reporter finally, the helium escaped and the balloon fell to the ground amid the horse and buggies in amish country. Quite a sight there. Women booked into Alameda County jails will no longer have to take mandatory pregnancy tests. The aclu settled a lawsuit against the Sheriffs Office challenging the pregnancy test requirement. Civil rights grouped sued last year on behalf of several women. One of them 69 years old who said the testing was humiliating and invasive. The tests will now be optional and only administered by medical staff. Sunday marks one year since britney minnards suicide death in oregon. Her husband still pushing to keep her dream alive. The flu vaccine could be less effective for Older Americans who take statins. Researchers focused on adults over the age of 65 for this study because of their risk for potential complications from the flu. And they found those taking cholesterol lowering drugs had a decreased immune response to the vaccination compared to those who were not taking any statins at all. Experts say more Research Needs to be done and those taking statins should continue to get flu shots. It would be overall less than optimal effectiveness in the elderly flu vaccine its still the best way to prevent a very significant infection. The winds coming in from the northwest at about 15 to 20 miles an hour. The winds continue to pick up and it was really windy yesterday. Once that cold front moves to the east were still feeling that right now. So if youre heading out to the beach and we are worried about the possibility of some rip currents, large breaker waves with those long period swells at about 14 to 16 seconds. And the swell heights at about 9 to 12 feet, weve had some gusty winds with us and as our temperatures are still very cool we are now in the 60s. Lets take a closer look at the east bay now.
