Again, it was on behalf of two stanford professors as well as other owners of volkswagen diesel vehicle owners. The two stanford professors and case being handled by well known local attorney who just did an exclusive interview with us just after filing the lawsuit. Now, as we reported after months of denials volkswagen admitted to the epa it installed socalled defeat devices into millions of its diesel run vehicles. The device allowed antipollution controls to operate at maximum efficiency only during an emissions test. So vehicles passed emissions test but released up to 35 times the amount of allowable pollution when on the road. Again, the bay area connection besides the impact on consumers, the lawsuit raises suspicions that the Volkswagen Electronics Research Laboratory in belmont played a big role in the companys study of emission problems years ago. So we right now have a very strong suspicion that data that holds the keys as to how far back volkswagen knew that these vehicles werent meeting epa standards may lie right in the heart of belmont. Reporter now, the lawsuit and others are expected to trigger a landslide of similar lawsuits and possibly criminal legal action as well as more investigations into whats happening inside the volkswagen Belmont Research facility. Now, again, volkswagen has apologized but it is not expected to slow down the consumer backlash or slow down the lawsuits. And we will also be updating the story on nbcbayarea. The congress in turmoil as House Speaker john boehner heads for the door. He announced this morning hes resigning as speaker of the house at the end of october. Steve, were just hearing from boehner for the First Time Since the news broke. And it seems like it was a rather tearful address. Reporter it was. Well, hes tearful a lot. He was tearful yesterday with the pope. He kind of implied that being with the pope kind of moved up the schedule of what he said already were his plans. Its looking back at the many struggles of boehner. This is a nobrainer. But for it to be actually happening and so soon said former speaker bay area democrat nancy pelosi feels like an earthquake. But to boehner today clearly feels like relief. A wonderful day. Reporter House Speaker john boehner confirmed to colleagues this morning that hes leaving. Quitting the top position in congress and resigning the house seat hes held in ohio for 13 terms. The House Speaker looked emotional yesterday with pope francis. Boehner is catholic. Getting the pope to the capitol was a kind of crowning achievement. But now its clear boehners tears came from a deeper place. In 2013 boehner agonized over the government shutdowns that embarrassed him and congress and turned voters against republicans. Next wednesday because of the fight over funding planned parenthood another shutdown looms. Shutting down government is drastic. Reporter now boehner since hes leaving can break with a poisonous partisan tradition and allow a vote to keep government going knowing that most in his party might vote against it. The odds of a shutdown are now much less likely. And why is that . Attorney general Loretta Lynch is in the bay area talking about trying to improve Community Policing. Ms. Lynch is going to hold a forum in richmond to discuss how to strengthen trust between the police and community. Its part of a National Tour designed to police around the country are under greater scrutiny because of shootings involving unarmed suspects. San jose police are not saying much about an officer involved shooting that sent one person to the hospital. And it all started with a call for police to do a welfare check. An officer approached the person on monterey road just north of south lake drive about 6 30 yesterday evening. That interaction ended with the officer firing his weapon and shooting the person at least one time. Police say they will release more details after the preliminary investigation is finished. Department policy calls for that officer to be on administrative leave for at least four days. This is the ninth time San Jose Police officers have shot someone this year. In five o of those incidents the shooting was deadly. School officially back in session for spark charter school, but still a lot of people are feeling concerned about how its handled a crisis. The Sunnyvale School has now been validated by the santa clara countys office of education after it was closed earlier this week following a Sexual Misconduct investigation that revealed a failure of background checks and fingerprinting. A teacher was arrested on suspicion of having child pornography and molesting an 8yearold student. The School Canceled classes in order to complete those proper background checks. The school had not done them before the semester started. We have reached out to the administration of spark charter school. We have not heard back in any form other than an email. Sam. Okay, kris. And it looks like a Beautiful Day out there. Stephanie, certainly a lot of people like to go out there and take pictures. Are they going to have to pay for it . Reporter thats right, kris. There are crowds here. The lawmakers here pushing this couldnt have picked a better time to get the message across. The fog was here but it has cleared and you can see the beautiful Golden Gate Bridge here crystal clear. There are now tolls right now for people who want to walk across or bike across the bridge. So these local lawmakers are urging Governor Brown to sign a bill and keep it that way. Supported by walking and cycling groups, Assembly Members authored ab40 that would ban sidewalk tolls until 2021 that goes for actually any stateowned bridge. It passed state legislature though it took more time in the senate where questions of fiscal impact came up. The golden gate highway and transportation Board Members voted almost a year ago voted to study the issue of imposing a sidewalk toll. It was a close vote that could have gone into effect in just a few years or could go into effect. Its part of a bigger plan to study Revenue Streams because the district is facing a fiveyear operating deficit of 33 million. But people we spoke with today urged it is very important to keep the experience at the golden gate free. I would think a coin donation maybe would be okay. Maybe it would make me think twice whether i should walk it or take a picture from afar. Right now with sb 350 passing and Climate Change we think its the wrong time for start charging people for doing the right thing which is to walk and bike. Reporter now, the Golden Gate Bridge spokesperson did say it is deferring to elected officials that the rough projected revenue estimate from the sidewalk toll really amounted to just 2 million so wasnt a Silver Bullet by any means. The district is looking into other options that would bring in more money, hybrid electric bus, time saving measure in payroll and more Parking Charges at ferry lots. But the Assembly Members say they really have to get this through. I asked how he felt the governor would sit on this he said he doesnt want to get ahead of himself but has great indications the governor will sign this. Scott budman, nbc bay area news. While many people argue whether or not there is a link between cell phones and cancer, a new study shows we should handle our devices carefully. A Consumer Reports article tells users to keep their phones away from their heads and their body and that would limit exposure to radio frequency waves admitted by phones. It also suggests using a speakerphone and texts whenever possible. A local Public Health expert says taking such precautions is beneficial for your health. Were risking a variety of cancers, other forms of other tumors, nonmalignant tumors, which we have evidence for in the head and neck. Although the article says evidence raises concerns over health impacts, it doesnt exactly make that cancer connection. And look at the temperature spread across the bay area. In sunol it is 84 degrees under all of that sunshine. And ive seen the temperature even at ocean beach starting to go up as the fog rolls away just slowly but still some low visibility there. As we get a live look now at emeryville we see bright sunshine, a gorgeous shot there. And well have all of this sun heating those temperatures up. So as we go to the east bay taking a closer look in pleasanton its 84 degrees. Walnut creek also 84. Orrin da at 87 and oakland at 77 degrees. And we do have the 80s out there now. While its 69 in san francisco, the north bay at 75 degrees and 74 in the south bay and peninsula. As we go into the next hour or so our winds very light coming in from the north and northwest. And well continue to pick up as we go through the day. Just slightly. And our temperatures as we go hour by hour in san jose well be at 1 00 at 83 degrees. And 87 degrees we will briefly hit that 90 degree mark in san jose and then feeling it coming back down once the wind kicks in and more clouds roll across san jose and dropping back into the mid60s through tonight. So look at all the microclimate, still very warm out there. So pretty toasty start to the weekend in foster city. 82 degrees. Mission district today will be at 80 degrees and 94 in napa. Its part of the nationwide shift in the way we pay and protect credit information. As nbc bay areas mark barger explains, it could cost you. Reporter new credit and debit cards have some added bling. A microchip that uses emv technology. What that does is generate a new unique code every time the card is used. Reporter in the past thieves could make physical copies of the traditional magnetic strip cards, the new chips make that much more difficult. They cant create a counterfeit card, which is twothirds of the fraud we see in the system. Reporter if a thief tried to use the chips unique transaction code. It would be worthless like using an expired pass code. Reporter but these cards require a learning curve at the checkout line. Consumers will have to learn how to forget to swipe and dip. Reporter that means inserting the end of the card for several seconds. Takes up to ten seconds longer to process than the old swipe method. Its a major change for businesses too. On october 1st merchants not card issuers will be responsible for fraudulent transactions if they dont upgrade their payment terminals. These new instore terminals can be very expensive to handle these chip cards. Reporter up to 1,000 per devi device, which can add up quickly especially for small businesses. Some experts say the risk of increased liability combined with slower checkout lines could fuel more use of mobile payment methods. The fate of the Hayward School superintendent is unclear this morning after very heated altercation. Two members of the hayward board of trustees filed Police Reports after they say the superintendent lashed out during closed door meeting last week. Louis and William Mcgee say superintendent dobbs was shouting, cursing, even physically threatening during the meeting. The board discussed dobbss possible discipline or dismissal in a special meeting last night. But several people defended dobbs. What have i observed . Sarcasm, veiled threats and not so veiled threats. And just plain rudeness towards the superintendent. Hes here serving because of the children, the School District needed someone to challenge the status quo. It is not clear yet what the result of that private meeting was. Integration is exclusion, thats the message from special education advocates to School Administrators in oakland. Dozens of special ed students, parents and teachers held a News Conference ahead of last nights School Board Meeting in oakland. Theyre against the superintendents decision to move many students served by special programs into general education classes. They maintain that integration cuts off students from the extra help that they need. So we need to be building up the programs we have and make and strengthen them and making sure that the students really have a program that meets their needs available. Supporters say putting struggling students in general ed classes helps those students succeed by challenging them to reach their full potential. They also point out that only 7 of special ed students graduate ready for college in the current system. One of the biggest changes in schools in decades is already under way, but odds are you havent heard of it yet. Californias local control funding formula means more money and more decisions for local School Districts. But the question is, how is it working . Today were making salsa and were going to eat it with chips i guess. Reporter these young men are part of a latino men and boys program. Its like a small circle where everybody is like pretty much in trust. So its like a Family Circle pretty much. Reporter its a circle thats about to get bigger thanks to extra dollars flowing in from the city. We get targeted funding from the state in order to support our most needy students. Reporter for the first time oakland unified is investing newly available money 200,000 in the latino program. Thats the most important thing, that those young men that they graduate from high school. Reporter the money comes from a local control funding formula, a landmark law now being put into practice across california. This is an historic change, its the biggest change to our School Funding system in the last ho years. Reporter under lcff many funding decisions shift from sacramento to local School Districts. California is leading the country in terms of having a formula that provides more support for the students with the greatest need. Reporter this sticks with high needs kids get more money. The extra dollars are for english learners, foster youth and low income students. Equal treatment for children in unequal situations is not justice. Reporter at oakland unified where 80 of students are high needs, funding incrementally increases from 7,500 to almost 12,000 per student over the next five years. However, in more affluent San Ramon Valley unified where just 8 of kids are high needs, funding in 2021 tops out at a little more than 9,000. Our biggest concerns are more people dont know about it. Reporter hes right. Most voters have never heard of the funding law even though for the First Time Ever it requires Community Input on how that money is spent. In order to get this right because its more flexibility in how funds are spent at the local level, people have to get involved and hold districts accountable. Chopping up peppers. He says it wasnt until he got a bit older though he understood that geography meant a lot more than just maps and globes. Hed love for everyone else to understand that too. An eclipse is going to take place at the same time as a socalled supermoon. A supermoon is when the moon is closest to earth in its monthly orbit making it larger than usual. The Lunar Eclipse begins a little after 7 00 sunday night, so you wont have to stay up late if you want to see it. The same kind of thing will not happen again until 2033. Maybe not as windy as weve had in days passed. And going hour by hour in oakland at 1 00 its 80 degrees. Rising up into the mid80s for a couple of hours. Then as you head out for dinner its at 80 degrees and then a few clouds starting to mix back in. And this evening as the skies become partly to mostly cloudy we will have temperatures in the lower 60s later on tonight. So a look at all the microclimates, los gatos today 95 degrees. Still pretty hot palo alto 89 degrees. And financial district at 79 degrees. Santa rosa 93. And oakland 89 degrees. Pleasanton seeing a high of 97 degrees. There will be some changes after having to deal with these sizzling temperatures. Well have a series of cold fronts moving through. So the first one moves in on saturday. Unfortunately that front will be weakening as it passes. And were dropping temperatures just a few more degrees and heading into next week there will be another one. Both of them look pretty dry at this point. We dont have any chances of rain in the forecast even as that next one moves. It looks pretty robust at first and theb as it moves closer to the bay area that rain just dries up. So a dry weekend and turning a little bit cooler.
