We do know the good news at 5 00 tonight evacuation orders are set to be lifted, but here you can see atd the Evacuation Center in calistoga there are a lot fewer people here at the tent city. Yesterday 300. Many who are still here say they have lost everything and have nowhere else to go. The tears start to flow. Not every day just between errands like walking her dog any time she pauses to think and feel reality hits all over again. She and her family lost everything in the valley fire. Sometimes i think its not true. But sometimes i realize were going to have to start again. Reporter the calistoga Evacuation Center has been home ever since. Today, a sort of somber day as the Boosters Club serves breakfast for the very last time. While many have been able to return home to places like middletown, gonzalez and others have nowhere to sleep. She says her husband is dealing with the Insurance Claim today. And until theres real movement, shes trapped with no place to go. Now just waiting to see what is going to happen next. Reporter jen is with the boys and girls club of calistoga, which is opening its after School Program doors to every kid monday through friday from 3 00 to 6 00 at night. Its to give relief, but not just to the parents. It helps the kids. Theyre in so much stress right now. And it just gives them a time to get out and be a kid. Reporter james took last week off to volunteer as a cook, but hes back at work today. So james is here to fill in. I have plenty of friends that are over there, i know some lost their home, some fortunate to still have it. And those need it. It feels really good to have people that lost their home or still have it but theyre away from it have a good feeling inside. Reporter and its people like these who remind those like gonzalez there is hope, especially as strangers rebuild their lives next to one another as friends. You know that you dont have nothing. But you have a lot of friends. Thats when you see you have a lot of people that appreciate you. You help us a lot. Were not going to forget you. Never. Youll be in our hearts. Reporter some of these will be shifting as red cross is trying to relocate a lot of these services here to the Evacuation Center that is now growing in middletown at the twin pine ka see casino there. Thats to help people with the transition back to rebuilding. Part of rebuilding is getting kids back to school, middletown is hoping to return at earliest by thursday. Live in calistoga, stephanie chuang, nbc bay area news. Stephanie, thanks. As the wildfire continues to burn on, spare the air day has been issued for today. According to the air district smoke and wildfires around the state are contributing to the air pollution. Today marks the ninth such alert so far this year. Well, the heat certainly not helping firefighters battling those flames. Lets check in with meteorologist kari hall to see when well get a break. Today is the last day well have to deal with these sizzling temperatures at least for the next couple of days. And, yes, that last spare the air alert issued today where the air quality approaches unhealthy in the east bay and also the south bay with some moderate levels in the east bay and peninsula. And the wildfire forecast our temperatures will be up to 98 degrees today. These are the kind of temperatures we had over the weekend. And the humidity drops down to 18 as we go into this afternoon. But as we go towards the morning more humidity moving in, some low clouds, our temperatures coming down and humidity goes back up to 96 . With highs over the next few days in the mid80s. And weve been watching the smoke and the wind direction at all levels of the atmosphere. Well have more of an onshore flow pushing some of that smoke over towards the east as we head through the rest of the day. So unhealthy air quality for the next several hours. Look what happened in court. [ inaudible ] plead not guilty deny all allegations reporter Defense Attorneys entered a not guilty plea for 15yearold Adrian Gonzalez. Hes accused of murdering and sexually assaulting 8yearold maddy middleton. In july her body was found in the trash bin at the apartment complex where they lived. Gonzalez has been charged as an adult and he is facing life in prison. This morning his lawyers say the incident was a loss of two kids from the community. And believe gonzalez should have whats called a fitness hearing. Thats where a judge would decide if gonzalez should be treated as an adult. The d. A. Says thats no longer an option at this point. Outside the court family and friends gathered to honor maddys life. Her father says hes forgiven gonzalez and hopes others will be able to do the same. I just want people to remember she was about love. And she would want me to love also. She wouldnt want me to hate. And i think she would want me to have some peace with this. Reporter maddys family says they want the community to remember her smile and energy instead of focusing on her tragic death. Gonzalez will be back in court october 29th. Classes are canceled at a new south Bay Charter School after the arrest of a teachers aide who is now charged with molesting an 8yearold student there. Now there are questions about why spark Charter School did not have background checks on all staff as required by law before they opened their doors. Nbc bay areas chuck copolla is live. 160 students have nowhere to go to school. Reporter right now they are home. Theyre not on campus. We dont know exactly where they are, but for now they are certainly not in school. Were waiting right now for the county superintendent to speak with us in Santa Clara County. Thats the agency that approved spark Charter School to open. First of its kind in sunnyvale, but its only one of 23 Charter Schools in the county that this county board of education oversees. And at issue is why did the school open before background checks of its personnel were completed . This morning spark Charter School was closed. None of its 160 k through 6 students, teachers or staff seen on the campus. It will stay closed until fingerprint results of its personnel have led to completed background checks as required by county education officials who authorized its charter allowing the school to open. This comes after jonathan chow, a lunchtime monitor and teachers aide, was charged with sexually assaulting an 8yearold girl in school. Police arrested chow at the school last week. Chow is also charged with possessing child pornography. The school was to have completed background checks before opening. The schools principal says the state Justice Department didnt assign the school a corresponding Identification Number to do so until three days after chow was arrested. Tonight at 6 30 School Board Members at spark school are scheduled to meet. This was a scheduled meeting, but an additional item has been added in closed session. An agenda item to talk about potential litigation. Weve just been advised that mr. Gu gu guntry will be live in a few minutes. Several people shaken up after cars were struck overnight in San Francisco. California Highway Patrol says it happened to two different cars while they were driving on highway 280 near mariposa street. Both drivers called saying they were shot at. Once chp investigated more they said it wasnt gunshot most likely a rock or bottle. One car hit was a cab of people just arriving to San Francisco. We just got off straight out the airport and got here and first thing happened. Welcome to San Francisco. Now city and county leaders are faced with trying to keep the oakland as and raiders in town. Showdown over coal in oakland and City Council HearingPublic Comments over the possible shipment of coal through the city. Protesters plan to rally outside that meeting. The city council is considering allowing coal to come to the old Oakland Army Base for export. Right now palo alto has three workers for every residence. Supporters hope a limit on offices would help make more room for housing. Apple on damage control. This morning apple says its removing a number of apps from its app store because of hackers. Apple reps say the hackers duped some developers of chinese apps into using Fake Software to develop those apps. The bad software then would collect and steal a users private data. Cyber security firms say theres no evidence any personal data has been stolen. So far no word from apple. But what you should do if you find one of those apps are infected. Lets listen in. The board does not oversee the daily operations or the hiring or supervision of employees at spark charter. We work under the presumption that the Charter SchoolBoard Management will comply with provisions of their charter and with all legal requirements for opening and operating a school. We come in as the county Office Behind them as part of a second step in the process in our annual review of each of our 23 Charter Schools. After learning of the arrest of one of the part time employees i immediately responded by sending my Charter Schools director to the school. Spark staff could not confirm they followed procedures required by law and contained in their charter regarding background checks and tv clearances for their employees. As a result of these violations i requested in very strong terms on friday that they close the school at the end of the school day and remain closed until they come into compliance with the terms of the charter and the laws of the state of california. If they do not do so quickly, their charter is subject to being immediately revoked under california education code. Weve notified School Districts in the county so they can be prepared to enroll these children on short notice if necessary. Ill be happy to answer some questions. Yes, sir. You may not oversee the daily operations of the school, but why didnt you know the school had not completed the background checks before opening its doors . Your agency is the one that authorizes charters. We authorize them, but their own board is responsible for monitoring compliance with the terms of their charter. We dont step in there once we authorize a Charter School, theyre independent of us. We have very little authority over the Charter Schools. Their board is supposed to verify that. Their superintendent and their board are directly responsible for that verification. Who independently oversees it . [ inaudible ] no, the board is not them. Just as our board oversees this office, their board oversees their school and is responsible for the administration of that school. We come in after the fact. Throughout the year we monitor all 23 Charter Schools and go in and do records checks and make sure theyre in compliance with the terms of the charter. But we dont do that at all 23 Charter Schools before school starts. This is a process that happens throughout the year. [ inaudible question ] who is liable if theres potential litigation. Im not aware of any potential litigation so i dont know what theyre talking about. We dont go into that meeting because were not members of that board. So im not privy to whats on their agenda tonight or what their conversation has been around potential litigation. Im not aware of any potential litigation. This is one in 23 in the county authorized by the county office of education. How do you know the others are in compliance . We monitor them throughout the year. At least once a year they get a visit from us where we do a records review. But we dont stand there watching what they do every day. Because once theyre authorized, they are independent agencies. Our only authority once they start going is we cant tell them what to do, how to operate. We check periodically to see if theyre in compliance with the terms of their charter. If theyre not, we have the only authority we have is to threaten to revoke their charter if they dont come into compliance. Operate for a full year before Live Press Conference youre listening to a Live Press Conference. And that voice in the background is our own robert handa asking very tough questions of the schools superintendent. And, kris, i think a lot of people who send their children to Charter Schools or thought about sending their children to Charter Schools are a bit astounded to hear him say we have very little authority and that it is the county itself that there isnt something higher above the board of parents that is watching out to make sure that everybody is where theyre supposed to be and that theyre licensed to be there. Right, the county office of education contends it is the school board that is responsible for holding them to what their charter says. However, theyre run by state law. By law they have to have those background checks and fingerprints. The question that i have this morning is why they were able to open before they had all of that in place. The county office of education says it wasnt their responsibility to check. So in theory they could have gone a whole year before that review uncovered that. And 160 some kids are not going to school today. We are going to have a lot more about this very, very important story today at 5 00 and 6 00. And if something develops even today right now well get back to it. In the meantime lets check your forecast with kari. Evacuation orders lifted as crews put out the flames from the valley fire. The emotional journey many evacuees are making as they discover whether or not their home is still standing. Well, the flames are nearly out. Evacuation orders finally being lifted after the valley fire. Now residents starting to return home hoping that they have some home to return to. That must be nerve racking. Nbc bay area shows two families returning to whats left of their neighborhood. Reporter the drive into Hidden Valley lake is still familiar. Just want to get home. Yeah, we want to get home. Thank you. Lived here 31 years. Reporter but what lies ahead is what makes it all different. Hey, whats up man . Good, how are you . Good, thanks. Were good to go . All right. Reporter hes one of the hundreds of valley fire evacuees who will see their home for the first time. Everything is fully in tact. Unbelievable. Utility workers still fixing power lines in these areas. Homes burned to the ground. Some we heard some of the looting so we locked up. Reporter still standing. Cats been locked in all week. Yeah. I was up to about 2 00, 3 00 in the morning just laying in our hotel room in fort bragg wondering where do you start. Reporter for the evacuees heading home and seeing that welcome back sign, theyre telling me its a sigh of relief. But for some of their neighbors this neverending nightmare continues. Theres homes and plots of land behind that and those are gone too. So now, you know, its just going to be a constant reminder for a while. Reporter this family lives up the road. They run a drilling business in the backyard, the fire burning their equipment, their sons first car and their neighbors home. Thats their house. The fear is there that it might happen soon again. Reporter much like the stories weve heard all week, they plan to turn this negative into a positive. Its really hard. Nobody lake county has a bad rep. And all i can say is that as a neighborhood and a community, were a family. The valley fire is now the fourth most destructive wildfire in california state history. The worst wildfire ever in california in terms of numbers of structures damaged and destroyed was the Oakland Hills fire back in 91. Destroyed 2,900 homes but killed 25 people. Another deadly fire is burning just south of the bay area in Monterey County. We are learning that there has been a death in that tassajarra fire, the wildfire that started saturday near the town of jamesburg. This morning its burned more than 1,000 acres and destroyed ten homes. The Monterey CountySheriffs Department says they found a body at the spot where they think that fire started. And it appears the death may have been a suicide. How the fire started though is still being investigated. This morning the people whove been evacuated are waiting anxiously to see if their homes are okay. Deputies will escort them later today. The fire by the way is 30 contained. And lets not forget about the butte fire in amador and calaveras counties. Until just very recently this was the biggest in california. Everyone is being allowed back into their homes. All evacuation orders have been lifted. The cleanup going to take a while. The wildfire destroyed more than 500 homes, burned through nearly 71,000 acres. Firefighters do have more work to do, but containment now 72 . The search continues this morning for a person suspected of an Armed Robbery at an east bay gas station. Officers in concord say the suspect used a handgun to rob the grand gasoline store on contra costa boulevard. This happened about 4 00 in the afternoon. Cashier told police the gunman got away with cash. Chp helicopter searched the area but they couldnt find the guy. The woman who jumped off the bay bridge and vanished for weeks is back in court today. She was arrested in oakland. The chp says she crashed a stolen car on the bridge last month then tried to get away by jumping off the bridge, roughly a sixstory fall. She survived, swam to shore, went back to the bridge and apparently hitched a ride home. Authorities say she was intoxicated and working as a prostitute that night. She now faces several charges. Well, theres a plan to maybe cut sales at levis stadium of alcohol following another brutal fan beating caught on video. The Santa Clara Stadium Authority will meet tomorrow to discuss safety concerns. City Council Members spearheading an effort to cut off alcohol after halftime. This comes after three men and a teenager were arrested in connection with a brutal assault of a vikings fan after monday nights game. And of course last year a bathroom brawl left one fan with a brain injury. Police say alcohol played a role in both cases. Women in california are one step closer in their fight to get equal pay for equal work. Governor jerry brown has indicated he will sign legislation granting women new rules to challenge gender based wage gap. The legislation places the burden on the employer to prove that a man with higher pay is based on factors other than gender. The fair pay act would guarantee freedom from retaliation and discrimination if employees ask what their coworkers earn. That legislation would take effect january 1st. Decision 2016. Ambassador to oman after their release. The hostages also included two saudis and a british national. Officials say in yemen that the six were detained earlier this year but they did not specify why. The u. S. Is vowing to help europe with what is being called the worst migrant crisis since world war ii. And this morning were learning how the government plans to do it. Secretary of state john kerry says the u. S. Will accept 85,000 refugees from around the world next year. That number will go up to 100,000 in 2017. It is a significant increase over the current annual cap of 70,000 people. Many though not all of the refugees will be from syria. Pope francis will travel to the u. S. Federal authorities are planning for one of the largest Security Operations in the history of the united states. Some 100 dogs destined to die in south korea have been rescued and sent to the bay area. The dogs were being raised by a meat farmer in korea. Thats where the Humane Society international stepped in. It bought the dogs and made the farmer agree to stop raising dogs and move them to farming instead. They were flown into San Francisco. This is absolutely a happy ending for all of them and for our community to be able to embrace these dogs and help them find a new life. The city celebrating the 100th anniversary of the classic building in all sorts of ways. Massive city hall is an impressive building. Reporter its impossible to imagine all the things a 100yearold building has witnessed. San franciscos majestic city hall has seen more than most. But in this long time temple of the peoples business, the work happening in this room is a first. To help celebrate the 100th anniversary of city hall, the City Arts Commission picked artist jeremy fish to mark the occasion in art. We invited him to come and think about what it would be like to do a series of 100 drawings for the 100th anniversary of city hall. This is physically just about the things that make this building remarkable. So jeremy is the First OfficialSan Francisco arts commissioned city hall artisan resident. Sizzling temperatures continue today. So we do still have a heat advisory for all of these areas shaded in orange. It does not include the coast and the inner bay, but the rest of the bay area. Yeah, its going to be really hot as we are seeing those temperatures warming up. Now its 89 degrees in livermore. Santa rosa 83 degrees. And San Francisco 75 degrees. And theres not much of a wind to help you out today. We will have a stronger onshore flow the next couple of days. And that will bring our temperatures back down. But in the meantime we have to deal with this. 98 degrees in gilroy. Burlingame 88 degrees. Financial district at 85 degrees. And there will be some cooler spots along the immediate coast. But then you head over towards fairfield and it will be up to 100 degrees today. Oakland 87. Pleasanton reaching 97 degrees. Theres not much in the way of fog right now, but we will start to see that redeveloping as we go into the evening. A very shallow layer of a marine layer into the evening. And into the start of the day tomorrow. So the morning clouds will be back. And also the cooler temperatures and a breezy wind. That will help bring our temperatures down. So were going to go from 85 degrees today to 68 degrees tomorrow for the high in San Francisco. So that will be a dramatic difference. And you can go back to opening up the windows and turning off the airconditioning. In the south bay today 95 degrees. Then up to 81 degrees tomorrow. Well have 70s and 80s the rest of the week. Also in the trivalley temperatures coming down significantly from 100 degrees today to the mid80s as we go into the rest of the week. And the morning temperatures will be in the upper 50s. So into the next several days our weather will be improving after having record setting temperatures over the weekend. We will also keep this dry weather too as we go into the next several days. The owner plans to donate 100 of the sales to fire victims, especially those in middleton.
