Reporter you may remember bryan stow was brutally beaten while attending the San Francisco giants opening day at Dodger Stadium in 2011. Thats before stow worked as an emt here at municipal stadium. The giants are calling this day a homecoming of sorts for the comeback kid. Its a story of comeback and the giants come back a lot to win World Championships and they love their fans. Bryan has been a great fan of the giants for his whole life. And to just see what hes come through. And to be able just to give him Something Back like this. A little excitement. Right now firefighters are looking for a cause for a three alarm fire that ruined the morning breakfast rush at a longtime south bay restaurant. It started at jimmys. About 8 30 and quickly grew. Nbc bay area news scott budman joins us with the latest. Reporter good morning laura and sam. This place is called jimmys. Its a popular spot for diners in san jose on snell and capitol expressway. Its a great place to go for an early breakfast or a lightnight meal. It was during breakfast this morning that fire broke out and everybody inside had to be evacuated. We want to show you cell phone video that was taken by a neighbor. Fire broke out just after 8 00 this morning. Several san jose fire trucks and crews responded because of damage to the roof. Fire crews tell us there is a fear that it might actually collapse. The fire was actually put out fairly quickly. Everyone was able to get out safely but the place is gutted. Lots of smoke damage and roof damage. We talked to several local diners who say today was really a bad way to start the morning. I came here all the time as a child with my parents. And i brought my own kids here. So its sad. It was very unexpected. Reporter as you can see over my shoulder the roof is still very much damaged. They say there is actually structural damage inside so a lot of what you see behind me thats charred is going to have to come down and be replaced. We dont yet have any idea when jimmys will reopen. Its been around for decades. Local residents might remember that it was cindys before it changed over in the late 80s. Everyone got out okay. Some of the diners who were inside are shaken up though. Thanks a lot. San jose man is under arrest this morning accused of driving drunk and causing a deadly crash. The crash happened late last night on north cathol avenue. Five people were in the car. Two of them died. The three others including the driver, were taken to the hospital with nonlife threatening injuries. Officers say they found alcohol inside the car. They arrested 24yearold christian clemmen for vehicular manslaughter and drunk driving. This morning a deadly blaze in san jose at a residence near the 280101 interchange under investigation and being treated as a crime scene. A man took this cell phone video of the fire fully engaged. Firefighters say when they got there fire and smoke was pouring out of the house. A man out front told them he was able to escape but someone else was still trapped inside. Firefighters found a body in the back bedroom. Neighbors say that victim is not the man who owns the house. No word yet, though on who he is. New details about a growing chorus of bay area catholics pushing to have franciscos archbishop removed. More than 100 catholics asked the pope to intervene. Bob, you talked to a spokesperson for the group. Reporter yes. Some of the more than 100 men and women who signed this fullpage letter asking pope francis to remove San Francisco archbishop Salvatore Cordileone just spoke at a News Conference in this building behind me here in the financial district to respond to comments made by the archdiocese and to explain why they took out this fullpage ad and what they admit was an unprecedented move. More than 100 local catholics, some leaders in the community signed this letter asking pope francis to remove the archbishop because they believe the archbishop fosters and im quoting here as atmosphere of division and intolerance. Their main gripe is the morality clause that the archbishop has forced upon teachers and staff at the four San Francisco schools. The letter calls it mean spirited that it could not only violate the personal beliefs of those employees but state law as well. The cignatures to the letter wanted to respond to the archdiocese assertion yesterday that they do not speak for the Catholic Community. This is not a group of fringe lunatics lunatics. These are the absolute bedrock of our Catholic Community. And i should say that those are not all the signatures but we had to leave room for the ad. So our hope is that the pope recognizes both from our messages and this that we are serious, that we are looking to him for help. Reporter the archdiocese released this statement yesterday before the letter was released calling the letter a misrepresentation of catholic teaching. Again, saying the signers do not represent the Catholic Community of San Francisco and saying that the archdiocese has already addressed all the issues raised in this ad. A man severely beaten outside of his apartment complex. After several months of Investigation Police say they are at a dead end. It happened in mid september near winchester and payne avenue in san jose. Peggy cathcart tells us her son had just finished watching a game and walked into a nearby store but never came back. The next morning he was found beaten and unconscious on the sidewalk. He cannot remember what happened that night. He suffered brain damage and lost vision in his left eye. Court documents obtained by nbc affiliate kvoa show michal rapiejko was the subject of a lawsuit while serving with the nypd in 2005. The defense team for officer rapiejko and the city of new york denied the allegations. The case settled in 2008 when the city of new york agreed to pay the man 20,000. In a warning letter to the company, the fda writes that these bars must have one gram or less of saturated fat in order to even put the word healthy on the label. The fda says four flavors of kind bars have levels that are too high between 2. 5 and 5 grams of saturated fat. Its actually kind of shocking to me that it has so much saturated fat. Reporter what else has around 3 grams of saturated fat . One fast food hamburger or a twix bar tore two eggs. Kind says nuts are causing the higher fat levels adding there is an overwhelming body of Scientific Evidence supporting that nuts are wholesome and nutritious. Dr. David katz has collaborated with kind an research and says the bars are healthy. If kind bars cannot be called healthy because of their fat content it implies almonds cannot be called healthy because of their fat content because those are the sources of fat in the kind bars that are causing the controversy.
