Live from outside the courthouse in san jose and theres going to be a punishment but no jail time for collins. Thats what it looks like the judge is leaning towards. The court is in break right now. But in an effort to get leniency former county supervisor Santa Clara County supervisor apologized in open court for his actions in connection to the 2010 Campaign Mailer. And in open court, he admitted to the judge he failed to protect and serve his community by creating flyers that helped get his political ally elected to the San Jose City council. He painted the then candidate as a compnist sympathizer and she lost the election by 20 votes. He pleaded no contest to one felony count of false impersonation. The judge in his speech within the last few minutes said that other people in other cases with the same charges have been sentenced to community service, like picking up garbage off the freeway. Heulse said he should not be treated differently. It sounds like the judge was leaning towards no jail time. Prosecutors have been pushing for one year jail time saying he should give specifics on this criminal count, give specifics on how this Campaign Mailer was paid for and who else has helped him. So the judge also he has already served seven months in jail on a separate Corruption Case and by pleaded no contest the county saved 50,000 for going with no trial, and without putting him in jail the county would also save 10,000. So definitely sounds like the judge will be leaning towards community service, but at that point, court is in recess until 11 10, so we have to wait a few more minutes to see exactly what the sentence is. In about 90 minutes, well find out what kind of punishment awaits San Francisco Police Officers for allegedly sending racist and homophobic Text Messages. Stephanie chuang is live in San Francisco. The police chief is announcing the results of the departments investigation. The question now, are any of these officers going to lose their jobs . Good morning kris and sam. Thats ultimately up to the Police Commission but the San Francisco police chief is holding a press conference at the hall of justice 12 30 this afternoon. Were expecting to hear a lot more details about what was said and what went on. I talked to jeff adachi this morning. He said at a hearing yesterday, the board of supervisors meeting, the chief said he would send out letters to suspend the officers and recommend firing him if it proves they were behind the Text Messages. It was stemming from a federal investigation when basically they found out that Police Sergeant was behind some of these Text Messages. He was eventually sentenced in february to three years and five months behind bars for fraud and conspiracy. Here are some of the texts found on his private cell phone. Quote, all ns must fing hang and in response to do you celebrate kwaunlsa akwanzaa at your school, he said yeah we celebrate whiteness. Well learn more about who said what and perhaps more about ten additional officers who may be implicated on what is now known at text gate. These texts theyre talking about burning crosses, lynching and killing children and theres repeated references to the nword white supremacy. You know this isnt just joking around. These are very very serious threats. And i think anyone who heard them would be terrified. And now were talking also about a Lasting Impact in terms of the cases involving these four officers at least the four already identified. Theres a lot of work to be done now because thousands or more cases may be tainted now. The District Attorney and i have agreed to go back ten years, so we expect there will be about 1,000 cases. Well have to bring back to court. And thats months if not years of work in cases that could get thrown out. One of the four officers linked to the racist and homophobic texts is seen in this 2009 video confronting a skateboarding threatening to break his arm if he resisted another officer has already resigned. As for how long this could take adachi is saying they have been criticized for taking up to years for making decisions on terminations, but with all this attention and with them saying they want a swift resolution it would be a matter of a couple to a few weeks. The police could bring this to the commission as early as next wednesday. By the way, i just got off the phone with tony brass, he represents one of the officers. He said that theres actually a law where if the department has known about something for over a year, it cannot fire an officer for that conduct. Of course, a complicated law, but he says he believes the department has known about the Text Messages for over a year. Well have to see how it all develops. A man is dead and police are looking for a gunman right now in hayward. They say 22yearold victim was found shot in the chest on jefferson street just off mission boulevard. This all happened around 9 45 last night. Emergency crews tried to save the man but he died on scene. At this point, police have not released any information about a suspect. A late night fire turned deadly in San Francisco. This happened just after 10 00 last night at a home on columbus avenue in the north beach neighborhood. Investigators say one man died in that fire. And there is still no word yet on the cause. Arson investigators have been called to the scene, but that is standard until the cause is pinpointed. This morning, a homeless man is in the hospital with a serious head injury and now police in San Francisco are looking for his attacker. This happened wednesday night in the tenderloin near larson and geary and its an assault caught on camera but its so brutal we wont show you the actual moment of the attack, but heres the Surveillance Video showing the attacker approaching the victim and hitting him with what appears to be a pipe. The homealize man was knocked unconscious and hes a familiar face around the neighborhood where people know him as robert. We talked with a friend who visited him in the hospital who happens to be a sfras police officer. We would take him to the shelter, get him food when he needed it. We would even buy shoes. Friends say robert is now conscious. Police hope someone recognizes the attacker in that video. If hes caught he could face attempted murder charges. A trail of destruction in San Francisco. This all started last night near alamo square when a driver rear ended another car. That driver then took off from the scene. Swerving into the bike lane and hitting three cyclists nearly killing one of them. Police say the driver then took off again, hitting a parked card hard enough to send the vehicle flying into a garage. Amazingly, nobody was hurt. Police are looking for the driver. She was in a black Jeep Cherokee license plate number 7 ahe 206. Another attack on a bay area taxi driver and drivers are on edge. Daly city police where looking for two men shown in the Surveillance Videos. The men reportedly paid the driver last weekend and then punched and robbed him as he was returning their change. Tens of thousands of dollars raised for the family of a fallen San Jose Police officer. People packed two san jose bars well into this morning, donating money to the family of officer mikan johnson. Were told Michael Johnsons father and other family members were present last night. The Almaden Valley location and the one in san jose promised 100 of the proceeds to johnsons family. When we get a better idea of how much money is raised we know they exceeded the goal of 25,000. Community members said they were just trying to help. I was more than happy to work dwrrb. All while the cockpit voice recorder reportedly captured the metallic bangs of the captain trying to get in and the screams of passengers. The second black box was recovered at the crash site thursday, found in a ravine and so badly burned the normally orange casing was black. Meanwhile, in dusseldorf german investigators revealed more details of what they were able to find on lubitzs personal computer. Between march 16th and march 23rd the week leading up to the crash, german prosecutors said he studied medical treatment, various ways and methods of committing suicide, and cockpit doors and their security measures. At the western edge of San Franciscos presidio. Probably 30 to 50. In a creek, a fishing expedition of sorts. Were trying to get about 1,000 before the end of the year. Presidio college combed the creek with nets sifting through the debris to find their prized catch. The threespined sickleback. Theyre the only native fish found in the lake and they were to come up from baker beach, and had gotten into Mountain Lake at one point in the past. You wont find sickleback on any menu but the colleges jonathan young, treats each one as if it were precious. Every individual fish we have to measure to get an idea of average sizes. I took a lot of macro photography so we can go through and sort of sex them for males and females. The destination is their onetime home near Mountain Lake, one of San Franciscos few freshwater lakes. The lake experiences a 50year decline following the construction of highway one in the 30s and the introduction of nonnative species. Bass and carp drove it to extinction in the lake. They used a toxic solution to wipe out the lakes nonnative fish. Get the fish in now. On thursday, for the first time in decades dump them in and theyll swim away. The sicklebacks were going home. Since the First Official wildlife introduction. We have a big pregnant female. Who wants to do the honors . Sickleback are the first native species returning to the lake theyll soon be joined by pacific horse frogs, western pond turtles and california muscles. Freshwater mussl requires this fish to complete its life cycle. The project is a bold experiment to try to undo more than 50 years of environmental damage. Sort of a new 21st century concept of restoring an urban eco system. People should not release unwanted pets in lakes. Any journey into the unknown starts with a fearless explorer.
