A. , while at the same time saying they are committed to making something work out here in oakland. For years, they wanted to get it out of the aging o. Co stadium. Part of the obstacle funding. The mayor of oakland said shes committed to keeping the team here but doesnt want to use public funds to build the stadium. One of her colleagues urged a regional approach to the problem. Oakland is not at the level that san diego is or l. A. Is in terms of population business growth, development. So the reality is we have cities that like dublin and pleasanton that have investors that would come to the table if we include them and invite them, and i think if i was in the mayors shoes, thats what i would do. The executive director of the Coliseum Authority pointed out there were other ways outside of public funds to entice the raids or any team to build a stadium namely giving them land helping them out with game day expenses and revenue sharing agreements. Yesterday, Sonoma County sheriffs agents served a search warrants at the home. Today, police may identify the man theyve arrested for killing a Security Guard in san jose. I should say men. Police arrested two men. Manny zuniga and a fellow Security Guard reacting to a robbery. Someone started shooting. Witnesses say new neega stepped into the line of fire. A man who stabbed a coworker at work is on the loose. The two were arguing about something work related when the suspect pulled out a knife and stabbed the man. The victim should be okay. Starting just after midnight saturday 12 01 a. M. Even from a 415 number youll have to dial 1415, and then the phone number, or youll get a recording saying your call cant be completed. Your current phone number and area code will not change nor will the price of a call covered area and other rates. People with the 415 area code we spoke with said theyre happy to have the 415, and as for the change in dialing habits no big deal because everyone is on a cell phone. Very strange. I dont really it doesnt bother me. Most people i tap a name or number in my phone. So i guess if i had a rotary phone, i guess i would have to unmemorize the 415, but its not going to be that big of a deal. This is called an overlay. You see the firefighters on the scene. This is all because of a possible hazmat situation. Calls for help came in at about 10 20 this morning. Okay so the long and the short of it is that it was confirmed that it was pepper spray incident. We did transport 11 oh, im sorry. That i do not know. Initially, they thought it may have been work that was being done on a refrigerator but after further investigation, they confirmed it was pepper spray. And is the restaurant right now closed . What do you do at this point . Well it dissipates and so we have cleared the building nothing is being picked up on the cgi monitors anymore. Tony is here with an undercover look inside the controversy of pot and taxes and tony were talking about a collision between government pot shops and the law. Scott and laura in san jose pot businesses required to hand over about 10 prs of their sales to the city. Another 8. 5 to the state. For years zyears, the two sides have battled over marijuana business taxes. A semantic power struggle leaving millions of unpaid dollars. Were not even close to closing down. Listen closely. Those prices include sale taxes, to the state and the city as well. Your hearing and seeing one side of this controversy through the lens of our hidden cameras. So you guys are on the up and up. Were good. Our investigation included visits to more than four dozen recently closed and currently operating pot shops in san jose. We pay all the taxes were supposed to be paying. You pay all the taxes youre supposed to be paying . Yes. Employees at san jose pot shops claim their employers are doing nothing wrong, paying all their taxes and not in any danger of getting shut down by the city. You guys pay the taxes . Yes. Okay. Im not going to come back and youre done because you didnt pay taxes . No. Was the information shared there accurate . No its incret. Theyre not paying taxes. This woman coordinates marijuana business for the city of san jose. Since 2011 san jose has collected more than 18 million in taxes for pot shops. But in response to requests from the Investigative Unit the city confirmed it has more than 2 million in unpaid marijuana taxes, penalties, and interest. 2 million is a lot of money because the city dropped the ball by not getting those dollars . I would say no. Its the citys goal to eventually pursue that unpaid tax amount. The citys list of noncompliant pot shops includes five active and operating locations. San jose medicinal group, norcalcare mehdi mart and the all american cannabis club. We can do better. San jose mayor samlocardo. Theres at least two million that hasnt been collected. Yeah. Thats a lot of money. Probably conservative. Probably more. Can the city do more . Should the city do more . Yes and yes. We can always do better. Are you worried youre going to be put out of business . No why would i be worried inim the only one who seems to understand the concept. Hes the ceo of medi marts in san jose. The city says his business is one of the worst offenders, owing nearly a half million in unpaid taxes and penalties. The only problem we have with the city is the marijuana business tax. Like i said it implicated the sale. Theres case laws and guys in federal prison right now because they paid a tax on cannabis it was considered a sale of a controlled substance, so theyre doing ten years in prison. Based on the conflict armstrong refuses to pay because he fears it will confirm his sale of an illegal drug. This is our indoor facility. Where we grow our medicine. He believes he doesnt owe the tax because hes running what he calls a closedloop collective. These are samples. Growing the pot and providing it to his members or coowners. He says theyre not customers and the money they pay is an equitable contribution and not a sale. Youre not paying taxes . No because we make everything ourselves. Are you paying taxes to the city right now . We are not. Dave owns the all american cannabis club. When it comes to taxes, do i pay the taxes . Its already included in the menu. Shes a little misinformed and thats a conversation i have to have back at the shop. The truth is they have never paid marijuana business tax to the city of san jose. City records show dave has been noncompliant for four years. More than a half Million Dollars in unpaid taxes and penalties. I want to pay sales tax, but by paying sales tax, im admitting im selling marijuana, which is violating the law. Hes referring to federal law, and the conflict with state laws. Hodges and other pot shop owners also point to this language at the top of san joses marijuana business tax return. It includes payment of the tax does not authorize unlawful business. Now, its the law to say you can sell marijuana, we would gladly pay sales tax, but the law doesnt say that. This is a semantics nightmare. It is. It just needs to be cleared up. Are you worried the city is going to come and lock your door snz. You know, its been a concern of mine ever since i started five years ago. Whats your message to these businesses . Pack up. Its time to move on. And pay up on your way out. I would say to the mayor he won by 2,000 votes, and theres a Large Population in the city of san jose who wants us here. And were going to stay here. Now, we reached out to the three other noncompliant pot shops, norcalcare says its paying its back taxes and should be off the list next month. The other two locations did not respond to our calls. Now, interesting point here mayorlocardo said he thinks the city should not be in the business of regulating marijuana. He said if it is a medicine, it belongs in a pharmacy and under the supervision of the fda. So really a lot of conflict here that still needs to be resolved. I see hodges points. If my taxes are violating city tax law, it doesnt seem to be a big penalty, or violated federal drug law, im take the city tax law. Theyre willing to pay taxes, just clear up this language. If you want to call the tax an administrative tax, a Law Enforcement tax, theyre on board. Theyll start writing the checks. If you call it a marijuana business tax, youre taxing for the sale of what is considered a controlled substance. Thats the nuance. Thats the semantic difference and thats why theyre not paying. So many governments involved quasilegal in some cases. Many layers. Yet theyre still operating. Exactly, and you heard, theyre not going anywhere. And i think when you hear what theyre saying, theyre hoping to last until next year when californias likely to vote on legalizing recreational marijuana. That changes the game field more completely, more like colorado more Like Washington and maybe bring more consistent foundation, because right now in california, city by city the regulations are different. When jamie was 11 years old, he was treated at oakland childrens for an aggressive form of cancer. He missed some of the sixth grade and all of seventh grade. But not only did jamie not fall behind in math. Just the opposite in fact. Jamie, now an applied mathematics major in college, says it was jerry who not only influenced his course of study but the direction of his life.
