Here at San Jose City hall. You have mayoral candidate dave cortese, whos a santa clara supervisor, has the backing of the police union. You can see him here casting his vote this morning. Hes going up against sam liccardo, a San Jose City councilman, who has the support of mayor chuck reed. What separates the two most is where they stand on measure b. Liccardo supported the law to cut pensions for Police Officers and other City Employees in order to trim the budget deficit. As a result, there is now bad blood between the rank and file Police Officers and the mayor and parts of the city council. Cortese is painting himself as the mayor who can mend those relations and help rebuild the department. In recent years, hundreds of officers have been let go in a costcutting measure leading to lower morale and an uptick in crime. Cortese promises to hire 140 officers to restore some of the departments original strength. The neighborhood that were standing in right now is the neighborhood that used to be the safest in the city of san jose and last month had 95 residential breakins. People are overwhelmingly concerned with that. Weve lost 400 Police Officers in the last five years. People want their Police Officers back and i think that message has been getting across to them and i think thats why were getting a lot of support. We recognize that we cant continue to spend as we did in the days when dave cortese was on the council and offering sixfigure pensions to employees who are retiring in their 50s. We need to be able to spend smarter and if were going to build this Police Department back, it means we have to have the money to pay them to work, not to pay them to retire. Reporter liccardo did help the current mayor reed craft a plan to hire back 400 officers over a fouryear time period, starting in 2013. Both men this morning confident in their get out the vote effort and felt certain that they each would win. Polls have shown it is a close race with cortese maintaining a slight lead over liccardo. Reporting live, bob redell, nbc bay area news. All right, thanks, bob. Well, also in the south bay, the district 17 congressional race between congressman mike honda and relative newcomer ro khanna. District 17 stretches from parts of cupertino through parts of san jose, milpitas, and fremont. Bay area voters in two cities may be the first anywhere to pass taxes for sodas. If that idea sounds familiar, thats because its been tried 30 other times before in other cities and each time it has failed. Nannette miranda is live in San Francisco. One of the cities diving into that bubbly soda tax waters. Good morning. Reporter good morning, scott and kris. Berkley is the other city. Getting voters, as you mentioned, to approach a soda tax, is not easy. 30 measures across the country have failed. I imagine this could get close and it could go either way. After all, San Francisco and berkley are both pretty liberal cities, so voters are more open to implementing policies that change behavior. Supporters are hoping passage of the soda tax in at least one city will breathe life into the movement. The citys proposition e would levy a twocent tax for every ounce of sugar sweetened beverage. Thats about 24 cents for a typical soda. All of this in the hopes of fighting obesity, diabetes, and other Health Complications associated with sugary drinks. The soda industry opposes the tax and has pumped 11 million into both campaigns this election season. The bulk of it in San Francisco, trying to convince voters that government should not be making decisions for them. It also doesnt want other cities to get the same idea. Supporters who couldnt even cobble together a million dollars, says its definitely an uphill battle. Its been a long fight. Were up against a multibillion dollar industry, a multinational industry, that has poured almost 10 million against us, so its been a title wave of corporate money, but weve been waging a gross Roots Campaign and well fight until the end. Taxing Peoples Grocery items is not a great way to go ability it. We dont believe a tax like this, which has a disproportionate impact on lower income individuals is the right way to go about peoples lifestyle choices. Reporter supporters of berkley measure d are making their last push by phone. It will be easier to pass in that city because only a simple majority is needed. The money collected can be spent in anything. In San Francisco, a twothirds vote is needed because the money is ear marked for nutritional and exercise programs. Supporters say consumption of soda is down 10 and thats what supporters here are hoping if a soda tax can pass. Live in San Francisco, nannette miranda, nbc bay area news. Certainly, the entire nation is watching this. Thanks, nannette. In oakland, the mayor seat is up for grabs. There are 15 candidates on the ballot. What makes the race tricky is oakland uses rankchoice voting, meaning voters select their first, second and third choices on the ballot. It also means there are lots of different ways to win, even if you are not the favorite candidate. The person who gets fewer first place votes may be mayor if he or she has enough second or third place votes. Thats how mayor jean quan was elected four years ago. Five candidates are in a tight race at the top. Right now its anyones guess who will win. Legislation getting its first real test in california by societiers just south of the bay area. Fracking involves pumping water underground to release gas and oil. San bernardino will decide on measure j that will ban fracking. The oil industry, spending about 7 million to try to defeat those bans. The Investigative Unit will look out for any election day voting trouble. In other news on this election day, police are telling drivers to avoid a busy intersection in the east bay, because they are investigating a deadly crash there. It was around 5 00 this morning when an suv hit and killed a pedestrian. This is near the boulevard. Police are not identifying the victim at this time, but they do tell us that the driver is cooperating with the investigation. Officers expect to be at that scene for at least another hour, maybe two. And in san jose, investigators are trying to figure out what caused this deadly crash on the expressway, hillsdale avenue. The driver hit a curb and the car flipped over. The driver was thrown from the car and pronounced dead at the scene. This is the citys 38th traffic fatality of this year. Kris, were learning new details about a crash involving the Ride Share Service lyft. The victim is from san jose, 24yearold Shane Holland and his friend left a Halloween Party saturday morning near sacramento and the lyft car they were in spun out of control, crashed into a tree, and that killed holland. Hollands father says his son will be missed by a lot of people. All the friends that have sent me condolences on facebook and they say he was great, some of them had problems and he helped talk them through them or worked with them on their problems. They really felt grateful to him for being a good friend. Shanes friend and the lyft driver suffered moderate injuries. Its the first time a lyft passenger has died in an accident. Firefighters had to work quickly to put out flames at a construction site in pleasanton. This started around 2 00 this morning, though crews were able to knock it down with just a few minutes and no one was hurt. Several homes were being built at the construction site and two of them are destroyed. Investigators are now looking into the cause of that fire. Police say the man whose body was discovered near a busy bay area street recently was indeed murdered. The gruesome discovery closed third avenue near gateway boulevard and willow street. Police say the victim was 24 year old fernando gerra and he had been shot. Investigators now looking for a motive and suspect. A man accused of groping two young girls in separate east bay stores expected to appear before a judge today. Police last month arrested Christopher German a few days after those incidents. Surveillance video placed him at the scene of each attack. The cases happened within moments of each other, one inside a san leandro walmart, the other inside a target store. In each case, the girls parents were nearby. German faces two felony counts of lewd acts with a child. Investigators in the east bay are trying to figure out who gave a child a bag of meth on halloween. The 8 year old had been trick or treating in the promenade area of hercules on friday night. People who live there say it was crowded with families. Police say the parents found a bag with white powder in the childs candy bag yesterday. Had been checking his childs halloween candy after initially putting it up away in the cabinet on halloween night, and while checking the candy, he found the baggy and suspected it to be Illegal Drugs and wanted to report that he had found that. The powder tested positive for a tenth of a gram of methamphetamine. That is a felony amount. Police say this is a good reminder to sort through your childrens halloween candy one more time. Scary. The council will vote on an initiative submitted by supporters of medical marijuana to repeal many of the regulations the city put in place back in july. Those restrictions forced dozens of pot shops to close over the summer. The proposed initiative to do away with some of the new distance requirements from schools, day cares, and community centers. The council can now either adopt the initiative as it is or submit the issue to voters. Also on the san jose agenda, the council will vote on a proposal to extend talks for a new stadium for the oakland as. That proposal would extend the talks for up to seven years. Thats why they now live in the shadows, the entire family, five people plus one infant, staying in this one small room here in the bay area. And this family is not alone. According to the u. S. Border patrol, more than 68,000 families have been apprehended crossing the southwest border with mexico so far this fiscal year, compared to about 15,000 families last year. An increase of 361 . That corresponds to a spike in gangs, violence, and lawlessness in honduras, guatemala, and el salvador. I ended up doing several, you know, thousand hearings. Reporter tom haines served both as an assistant u. S. Attorney prosecuting immigration and as an immigration defense attorney before retiring as a Border Patrol attorney this past july. The immigration policies in the United States tries to accommodate two inconsistent ideas. One is, you know, we are a country that provides refuge for people who are suffering persecution. The immigration laws all designed to protect the homeland. Reporter the numbers of people fleeing Central America have become so large theres no room in port or holding facilities. So after picking the refugees up along the border, federal agents rerelease them back in the u. S. If the immigrants have relatives already living here that can pay for a bus ticket. In exchange, these refugees agree to report to local immigration authorities once they get to their relatives hometown. The president is very committed to taking executive action to fix our broken immigration system. Reporter while admitting the Current System is broken, jeh johnson insists the numbers of these refugees peaked back in june and have now declined to levels last seen in january 2013. The bottom line of all this is, in recent years, the total number of those who attempt to cross our southwest border has declined dramatically. Reporter even sew, the sheer number of these refugees created a crisis, overwhelming local resources. In the last six months thayer been thousands of individuals. Reporter serving as director of operations at Catholic Community services in tucson, arizona, one town particularly hard hit by the number of refugees being dropped off at the bus station. They are leaving in most cases truly desperate situations, and they are making the kind of choices that i might make in their situation. I only see the people who make it. Reporter the demand for resources grew so intense that Catholic Community services hired gayland hunt, an americorps worker whose job is to house, feed, and care for people at the bus station. As many as 40 refugees a day. Many of them were dehydrated, hungry, clothes were torn and dirty. Reporter over the course of several days, the Investigative Unit documented family after family arriving at this bus station in tucson. Young mothers and their children, even a father and a young daughter traveling alone. We talked with many of them, all of them feared for their lives. They rolled the dice to come here. Reporter we also rode the bus with several of these immigrants, headed to places like atlanta, los angeles, new jersey, even eureka in northern california. If you stay there, you will be killed. Thats why. Reporter sophia and her family also rode the bus. For three long days, just to get here to the bay area. Were here because were saving our lives. Reporter now sophia and her mother make the trip to San Francisco to report in to immigration authorities once every two weeks, honoring the agreement they made in order to get that bus ticket to the bay area. They may be scared, but they admit they feel safer here than back home, if not entirely secure, because for them, a judge issuing a deportation order back to honduras would be issuing them a death sentence. As we mentioned, these arent the only people who live in the shadows among us. Weve talked to dozens of people directly involved in this immigration and refugee crisis. San franciscos prop e is twice that, but the biggest difference is San Franciscos measure needs twothirds approval, while in berkley as long as the majority of voters say yes, the tax passes. Even progressive San Francisco, about one in three tax measures get the twothirds vote. Its difficult to get that bar. Its going to change how the city and state and country looks at it. Its not the governments face to decide for us as consumers on what is best for us to be putting into our bodies. If either measure passes, it would be the first soda tax in the country. Soda makers have spent more than 11 million trying to defeat each of those two proposals. And heres some of the other races that voters will be deciding on today. In the south bay, all eyes are on district 17, the congressional race between mike honda and ro khanna. Now, recent polls indicate khanna has closed most, if not all, of the ground on the seventerm congressman. Voters in san jose will be deciding a new mayor, Current Council member sam liccardo is in a runoff off dave cortese. Each is offering a distinct plan to add more Police Officers despite recent pension reforms. Statewide it appears jerry brown will remain governor. Polls show he has a decisive lead over challenger neil cash car ree. Some of the larger state measures include proposition 1, a 7. 5 billion water storage bond endorsed by the governor. Another high profile measure is proposition 46, looking to hold doctors and physicians more accountable through Drug Screening and higher malpractice limits. Through the weekend, storm system tracks closer and closer to the bay area, temperatures will fall, but were not expecting any real rainfall until we hit tuesday. I want to show you what the models are hinting at, because it looks like, yet again, we are going to hit that sub tropical moisture tap, and for us, thats the difference between maybe a trace amount of rain, nothing that you can even measure, and potentially a half inch to inch of rain. The great news is, everything leads me to believe that that tap will maintain. So were looking at rain chances starting late next tuesday, lasting through wednesday, all the way through friday of next week. We need the rain. Its looking good. Yeah, it is one of the biggest issues on the ballot today. And Governor Brown is aggressively campaigning for prop 1, promising that it will protect california from future droughts. In todays reality check, sam brock looks at the claim and how much it could cost you, the taxpayer, if it passes. Good evening. If youre a californian with a television set, youve undoubtedly seen ads stumping for props 1 and 2, which by the way, are not even related, except they appear in the same ad. Prop 2 saves money for a rainy day, but prop 1 is the attention grabber because it addresses the drought. We break it all down. With the worst drought on record, weve seen devastation across california. Heres the quick primer on prop 1, the water bond thats more or less flooding your air waves, courtesy of Governor Brown. First the facts, if voters approve the measure, it authorizes more than 7 billion in new bonds for water projects, but Hoover Research fellow carson bruno, a Public Finance expert, says prop 1 is not immediately putting voters on the hook for 7 billion, the sum will be broken up in chunks over many years. Thats an important distinction to make. This is not as if were saying on november 5th the state treasurer is going to sell 7. 5 billion worth of bonds. There will be a significant lag time, most likely. Reporter as a taxpayer, heres what youll actually owe, according to the nonpartisan legislative analysts office, about 360 million a year for 40 years to pay off the debt. Divide that by californias 16 million taxpayers and that comes out to 22. 50 a person per year, taken out of the states general fund. And the reality is that figure represents about onethird of 1 of californias current general fund budget. Its also true the bond money will largely go to projects such as dams, reservoirs, and water recycling that will take years, if not decades, to complete. Because prop one saves water to protect us during times of drought. Reporter so the measure might safe us from future droughts, but probably not this one. Still, director of uc daviss center for water shed Sciences Says theres enough packed into prop 1 to be impactful in the shortterm, too, provided we dont continue relying on water bonds to solve our crisis. I think its a shot in the arm financially for some of the Safe Drinking Water and ecosystem and Flood Control storm water aspects of the system. We sort of need this one, but i hope we dont see a lot more of them, because i think it distracts people from longerterm solutions. Dr. Lund says weve gotten into a bad habit here in california of relying on state bonds to address water issues. He says more needs to be done on the local level. Still as an immediate solution, prop 1 remains very popular. In the latest golden state poll, it was the only ballot measure to have a majority support, 52 .
