District is very quiet. Thats because so many streets are shut down around battery and california. That suv, the one that was carjacked sitting there on its side after a rollover accident happened here this morning and officers had to open fire on that carjacking suspect. They say he just wouldnt put down the gun in a chase, as you said, that started in the east bay in richmond this morning with a woman who owned that whitest ka laid, carjacked on her way to work this morning. Police say the man then alone in the car, went on to the Golden Gate Bridge with several Law Enforcement agencies trying to catch up, each picking up in their own jurisdictions. Here in San Francisco, police say they lost sight of the car, then suddenly got reports of an accident and shots fired here. As were being told by the victim and witnesses, when they went to the aid, Good Samaritans went to the aid of the suspect, who was stuck in the windshield part of the car, he fired upon the Good Samaritans. One of the Good Samaritans was stuck with some sort of a shrapnel or fragment in his chest. Hell be fine, although shaken. Reporter the police think he was trying to get out of the windshield at the time. They came on scene and say they requested less than lethal weapons at first, tried to get him to surrender, but they say that he turned the gun on officers and then what happened is that several officers opened fire on that man. He was pronounced dead here at the scene. I just spoke briefly with San Francisco police and asked them how much longer this area might be impacted while they do their investigation and they said at least another hour. Not much information on that suspect. We only know that he is a male, but the streets, including california, from front to battery and pine, all shut down, so if you are in the area, this is certainly something you would want to avoid. And the second storm since just last week, as you can see, the rain blanketed parts of the bay area, including in downtown san jose from that image right there. It was enough to cause problems on our freeways and our streets during a very busy commute. Whats really great about these totals, one of the places we dont traditionally pick up rainfall, south bay, where were getting the highest total this morning. Los gatos, inch of rain from one system. Threequarters for half moon bay, sunnyvale, half inch, same for San Francisco. Right here in beautiful san jose, we picked up a half of an inch of rain, which is impressive from one storm system. I want to show you another time lapse, because this really tells the story. This is overlooking the Santa Clara Valley and you can see right now the clouds are starting to clear all that rain is racing off towards the king fire. They are going to get some heavy periods where the fire is burning. Well show you that coming up. Also i want to talk about whats to come next and thats lightning firing off just offshore. Do we have the potential for seeing thunderstorms in the bay area . The answer is, yes. Well let you know what that means for the rest of the day and its going to be cold tonight. We are northbound 101 in san jose, sam, the conditions much better, especially since were postcommute, but we did speak earlier with a chp sergeant, says he was unfortunately not surprised by the number of accidents this morning throughout the bay area. This being the first significant rain in months, it seems many drivers forgot about the law of hydrodynamics and failed to slow down. On the sunol grade alone, two big rigs jackknifed, chp tells us the driver was going too fast when the tree shredder he was pulling caused his rig to jackknife. The driver denied to us he was speeding. Further north in oakland, two more big rig crashes in two different locations shut down parts of 880. Investigators say a tanker got stuck in about four inches of water, leaked about 25 gallons of fuel. The chp issued an alert so they could clean it up. Its been a mess. People driving too fast, roads are wet. First rain of the season. Its been slipping and sliding all over the place. Reporter what do you tell people . Slow down, take your time and try to get to work safe. Reporter this mornings rain turned off the lights on Fuller Avenue in willow glen neighborhood, you can see the problem, the water caused a transformer to blow and catch fire. San jose firefighters ask People Living in the seven homes connected to that transformer to stay inside as a precaution in case there was a power surge that could reach the house and start a fire. And then kind of a firework, and then thats when the transformer blew. My mom was freaking out it was going to land on our house, the pole, and then she didnt really care about her car, because its old. Reporter pg e was able to shut off the power, we got the sense it was going to take several hours to restore power and here we are back live heading northbound 101 past Great America parkway, where the roads, still moisture, but the conditions are much better and i have to say im sad to see the rain go away, because we desperately need it. This as we learn about the folks still dealing with Power Outages this morning. Pg e reporting on its twitter page there are currently 10,000 customers without power. We just got word from pg e that in san jose right now that number has been trimmed to 1,400. Its from roughly 150 different outages. As we said, were trying to find out what the latest information is. As soon as we have the figures, well bring you the updates. What started as a report of a possible gas leak quickly turned into a crime scene. Hazardous materials crews responded to reports of noxious or the r orders and found two bodies in an apartment last night in Mountain View off california street. Stephanie chuang is there live. Stephanie, police have not been able to determine it wasnt a gas leak. Good morning to you, kris. The latest is police were able to say this was not a gas line leak, so thats one development this morning, but now investigators have to figure out what the source of that very powerful odor was that kept this Apartment Building and the one next to it evacuated for 14 hours. Until 8 00 this morning. The two bodies were found in the back of this complex, no official i. D. Yet, though neighbors describe the people who lived in the apartment as a nice couple. Chemical odors were so strong, four officers had to be treated at the scene. Immediately police evacuated the building and the one next door. You have to evacuate, its hazardous. I was actually a little bit late getting out and when i did make it out, the Police Officer said you got to get out, this place could blow. Then i realized, wow, its pretty serious. I didnt know. Reporter overnight, into the Early Morning hours, hazmat crews were able to collect air samples, hoping to determine the origin of the overwhelming odor using meters to test toxin levels. Protecting them from what could be potentially deadly chemicals. They could have swabbed walls and things like that. As far as i know, beginning was checking air samples. Reporter not chemicals present, getting samples of those . That i cant speak to. Im sure they did later on with that. Reporter these neighbors say their thoughts are with those who may be getting the worst wakeup call this morning. Thats awful, yeah. Its disturbing, youre confused, youre sad for them. Reporter now, the situation right now is very fluid, a lot of questions, still police not saying whether there was foul play involved or if this was intentional, meaning suicides, although the Fire Department spokesman did say a 911 caller had characterized a message posted on the front door as a suicide note. A lot that investigators still have to work through, including what chemicals were involved in the first place. Live in Mountain View, stephanie chuang, nbc bay area news. Very strange story. Police have identified a father and son as the victims here. 61yearold keith lang and his 29yearold son brian were shot at their home. The sons girlfriend was also shot. She survived. Investigators right now are looking at security videos that may help them identify a suspect in this crime. Police hope they are one step closer to finding the man who robbed and kidnapped a walnut creek woman earlier this week. Take a look. This is the man police say forced a woman to drive him to a bank of america and forced her to drain her account on tuesday. They just released this picture yesterday. They know its not great, but they do hope someone will recognize him, though hes covered with a hat, gloves, and something over his face. After that man robbed that woman, he forced the woman to drive back to her neighborhood, where he jumped out and ran away. Police say the woman was shaken up, but not hurt. A High School Coach from south San Francisco under arrest this morning accused of taking advantage of a 15yearold student. Now police would like to know if there are more victims, as well. Officers say mark turner, a football coach and Security Officer at el camino high committed lewd acts against the girl two months ago. The investigation started after she complained about what was happening. Turner was arrested tuesday night. The alleged incident did not happen on campus or during school hours. Police believe matthew was the last person to see graham before she vanished after leaving a party on campus. At our nations capitol, eric holder is now officially stepping down. President obama is expected to make that announcement later today. Holder was the first black attorney general and has been in that position for six years now. Only chance for rain, at the very end of this area forecast, im going to show you our next opportunity. San jose, the big winner for the south bay valley, because typically we pick up. 2 of an inch in the month of september, so we already doubled our september average with one storm, so were looking good. Heavy rain is now clearing the bay area and this front is maintaining organization, which is what we were praying for. Watch this, a little thunderstorm activity, most of that activity is going to move onshore to the north of the bay area. But all of this rich moisture is headed right to the king fire and at this time were getting heavy down pours already and what im really watching for is this bulk of very heavy rainfall on the way to Pollock Pines as we head throughout about 11 41, it will be there. Make sure you stick with us and well help you figure out whether or not they were able to maintain with the containment they had and if the rain is going to help out. Its going to feel like fall tonight. The skies open up. Weve got cold air rushing in, so temps are going to be in the 40s, widespread, youll likely need to pull out the jacket if you have not yet done so this season. Lets take you back outside for a live look at clouds that have delivered so much rain and boy were so pleased about it. The storm system, though, now moving out. However, that doesnt mean the rains over for the entire bay area. The storm system is moving east now where hopefully it will help firefighters battling the massive king fire. More than 95,000 acres are already burned. At least 12 homes and other structures are already destroyed and some 12,000 homes are still threatened. Firefighters are making good headway and according to the latest update, the fire is now 43 contained. At the very least, hopefully it puts stoppage with the blaze burning out of control. Maybe another system in the works, as well, christina. What have you been tracking . Really good looking system on the way as we head throughout next week, but right now look at all the rainfall coming down right on top of the king fire. Pollock pines getting heavy down pours, a lot of people very thankful for this rain and they are going to get a good three to four hours of steadily rainfall in the area, so hopefully this will help firefighters knock that fire down. This is what you need to help out a situation like that, and right on cue, showers on the way, with some heavier bouts of rain on the way throughout the next hour or so. Here in the bay area, whole other scenario to talk about. We received much needed rainfall to the tune of an inch up in the north bay, over threequarters in the south bay, and even in san jose, a half inch of rain on the floor from one system is really, really great for us. We have a little bit more on the way for the rest of the day, even tracking some thunderstorms firing off just offshore, i think a lot of this activity is going to move to the north of the bay area. Still fair game for a thunderstorm or two throughout the day today. Well talk more about that and our next chance for rain in my next report. Its looking good. Obviously, were still on the drought, this is not a drought buster, but i do want to tell you guys, overall looks like the pattern is changing. More on that coming up. Reporter it once held about 8,000 acre feet of water but has now become the first reservoir to become dry, or as the Water District puts it, minimum dead pool. Theres a little water less, but not enough to release into streams to keep wildlife alive or recharge groundwater. I didnt expect it to be this dry. I thought water levels were low, but this is almost completely dry. Reporter the Water District is happy to see any rain, but mainly because they hope it spurs on more conservation since the latest figures show south bay users cutting back only 11 , far from local and state recommendations of 20 . Were getting now into the fall months, so your grass or plants dont need as much water as you think. Reporter the Water District board is providing another 3 million in conservation incentives. The board also wrapped up a series of special meetings on future projects, including new purification and recycling facilities. Supply that we get other than rain will be recycling, so weve tried everything to get the projects moving, weve accelerated it in every way possible. Were preparing now for next year, if it looks like this year, so chesbro is one of the local reservoirs that doesnt have any other source of supply but rainfall, and it hasnt rained. Reporter robert handa, nbc bay area news. And at 11 32 right now, we have breaking news. The Labor Coalition announced that ferry captains will hold a oneday strike tomorrow. This is because of a contract dispute between the Golden Gate Bridge district and labor unions. Tomorrows work stoppage will start at 4 30 in the morning and run all the way until 9 00 tomorrow night. That means more traffic on the roadways since ferry riders will have to drive or bike to and from work. And we should also mention that the strike is happening during tomorrows giants game. Perfect storm of bad events for tomorrow, no pun intended. San jose state is on damage control after a newly released internal audit that stems from a former Department Chair who got caught using University Funds for personal expenses. Nbc bay areas chief investigatorive reporter Tony Kovaleski has the result of the fourmonth audit. Our investigation started with whistleblowers calling for justice in the Justice Studies Department. Now inside this 47page audit, a failing grade for san jose states oversight of public money. I think that going to the media and also turning to the Student Activist made all the difference in the world. Reporter hes an associate professor in san jose States Justice studies department and one of the whistleblowers who contacted nbc bay area. I think what the audit shows us is that there was some institutional issues around how the university and campus deals with money. Reporter the 47page audit found weaknesses in fiscal, operational, and administrative controls at san jose state and the Justice Studies Department. Multiple offices seem to have been involved in not crossing their ts and dotting their is, which allowed someone like my former chair to game the system. Reporter in may, our investigation questions several spending decisions by former Justice Studies Department head mark correa and the universitys internal investigation that concluded there were no fiscal improprieties. This audit, essentially, confirmed everything we reported. Surprised . Im not surprised by the report, but i am certainly concerned about the number of issues that were identified. Reporter in fact, the audit found breakdowns that led to 18 specific recommendations for san jose state, specifically the audit said areas of concern include an unauthorized off campus bank account, administrative oversight, contracting practices, and questionable spending from campus and foundation accounts. Should the university be embarrassed by what this audit found . I dont think its a matter of being embarrassed. I think its a matter of being enlightened as to what has occurred in the department and ensuring that we address those issues. Reporter following the conclusion of the audit, san jose states president issued this statement that included, you may share my deep disappointment at so many troubling breaches of trust, policy, and protocol. Is it your job to fix this culture . What im focusing on, what we are focusing on as a university, is moving forward and addressing the issues that were raised in this audit and thats what i intend to do. Its just sad that i had to turn to the students, as well as the media, in order to get the things that needed to be done, done. She said her home moved two feet. Next door, the homes that burned down that morning are now cleared. Some neighbors still have repairs to do, but she just got good news. I get to move in this saturday. Reporter shes ready to move out of her brother and sisterinlaws house, but is grateful for their help and help from others. I didnt think everything would come together so quickly, but everything came together so quickly, all the contractors and everybody, the insurance people. Reporter its a different story at napa self storage, a building with more than 200 Storage Units inside is off limits. Its red tagged and you can see why. The steel structure is a twisted, mangled, hazard. Its kind of crazy living right across the street from it knowing that our stuffs so close, but we cant get to it. Reporter chris metro is living out of a suitcase across the street. He and his girlfriend have a house full of belongings trapped inside a storage unit and some things cant be replaced. My girlfriend has some of her stuff from her grandma, you know, that she wants back, and, you know, a lot of sentimental stuff we have in there. Reporter the owner says several engineers told her the building must be demolished, but shes working to hire someone to dismantle it so hundreds of anxious renters can get their belongings. A South Carolina state trooper is charged with assault and battery this morning and fired from his job last friday. This all comes after he shot an unarmed man during a traffic stop. The incident was captured on dash cam video and we must warn you the video is graphic and may be disturbing to some viewers. Heres nbcs Kristen Dahlgren with the story. Reporter the video shows shaun gruber stopping jones september 4th near columbia, South Carolina. Jones was standing outside of his suv in a gas station parking lot when gruber asked for his drivers license. When jones turned to reach inside his vehicle, gruber began yelling at him to get out of the vehicle, then fired his weapon multiple times. Get out of the car get out of the car get on the ground get on the ground reporter jones is heard asking gruber why he shot him. I just got my license, you said to get my license put your hands behind your back. What did i do, sir . Are you hit . I think so. I cant feel my leg. I dont know what happened. Why did you shoot me . Well, you dove head first back into your car. Im sorry. You dove into your car. Your seat belt violation, sir. I just pulled it off there at the corner to pull in the gas station. Reporter Authorities Say jones, who was unarmed, was shot in the hip and treated at a hospital. He released a statement saying in part, my recovery is coming along well and i hope this situation can make a change, not just here at home in South Carolina, but coast to coast. Gruber was charged with assault and battery of a high and aggravated nature which could hold a sentence of up to 20 years in prison. He was fired on friday. The facts of this case are disturbing to me but i believe this case was an isolated incident. Mr. Gruber reacted to a perceived threat where there was none. He told a judge yesterday his client is not guilty and was justified in shooting jones, who was reaching for his license. Grubert posted bond last night and will be back in court next month. The woman beat up by a chp officer has reached a settlement with that department. The beating was caught on camera back in july, you might remember it shows officer Daniel Ambrose punching the woman by the side of a california freeway. The video quickly spread on the internet and on television. Her attorneys said they wanted to make sure they could have Financial Stability the rest of her life and andrew would not be an officer any longer. She was awarded 1. 5 million and officer andrew has agreed to resign. Wait until you see this, terrifying moments for a Southern California woman forced to escape to the roof of her house during a breakin. It happened early yesterday morning at a house in venice. Shes crouching under the overhang. Police say the woman was asleep when she heard someone break into her house, wasnt long before the burglar followed her out there. Officers eventually got the woman down and they were able to arrest the burglar. Everybody was safe, but looks menacing. Really scary. Story of the day, right now at 11 45 is, of course, the rain we are finally getting. So needed. So happy about it. And you know what, at this point, most of the rainfall is done. We are getting some thunderstorms offshore, and im going to show you that in just a moment, but still taking a live look here, mount hamilton, mostly cloudy conditions and as a result were going to see limited sunshine and Cool Temperatures for today, but here is the front. Right now at this point, we are fair game to see the sun come out throughout the next couple hours. All this is racing out of the area.
