Bart police chief of police gave us more details about the search that resulted in one b. A. R. T. Officer fatally shooting one of his colleagues, officer thomas smith, seen in a new photo here just released this morning. We learned that its possible that some or all of the shooting was caught on video as at least two of the officers were wearing lapel cameras as is required by the department. The question is whether or not those cameras were rolling. Rainee tells us there were eight members of Law Enforcement searching the apartment in dublin. There were five plains clothed detective all looking for a stolen laptop related to a crime committed on b. A. R. T. Property. They knew the person on probation wasnt at home at the time, but they were not sure if someone else was there. Thats why they wore bulletproof vests. Thats why they went in with their guns drawn. The door was unlocked. Thats when they made their entrance. Sometime during all of that one officer shot at smith killing him. This morning chief rainey tells us he will not name that officer until some time next week. We want to give him a chance to grieve because of everything thats happened. I visited with him last night. Hes extremely upset. Obviously. And we want to give him a chance and his family to come to grips with whats going on and whats happening. Governor brown offered condolence condolences last night issuing a statement that said in part, sergeant smiths family, friends and colleagues are in our thoughts as we honor his service during this painful time. T. s police chief looked visibly shaken up when he addressed the media this morning. He said his department is grieving and they really need time to process this. He said personally and professionally tom smith will be missed as was mentioned earlier. He is the first officer killed in the line of duty in the departments history. Now this morning officers from san jose including chief larry escovel came to offer condolences in oakland where where officers are in mourning. Smith was a 42yearold veteran whose wife also worked for the b. A. R. T. Police department. They have a 6yearold daughter. His two brothers are also in law enfo enforcement, one works are for the Alameda County sheriffs department. Smith, a sergeant, was shot and killed accidentally by a fellow officer yesterday in an incident thats really stunned the department and the Law Enforcement community. Here is how the chief described him. A great guy. Cando attitude. Very, very supportive of his personnel. Just a really, really happy guy. A family man. I got the opportunity to meet his mom last night. His two brothers are also in Law Enforcement locally. Just couldnt meet a nicer guy. Police in the moments before the shooting. The b. A. R. T. Police department had enacted reforms in the wake of the controversial the shooting of an unarmed passenger oscar grant in 2009 on a b. A. R. T. Platform. And last month an independent auditor praised the Police Departments progress in improving its officer accountability and training. Attorney john burress represented oscar grants family. Hes been monitoring reforms made in the department. He believes procedures will once again be the focus of the current investigation. And i know that b. A. R. T. Police officers go to academy. So i would expect the training was proper. That would mean somewhere else there was a breakdown. Oakland police, meanwhile, investigating two tedly shootings involving chp officers that happened within a couple blocks of each other. The latest happened around 9 00 last night on went worth avenue near bancroft where two uniformed officers pulled over an suv. One of the passengers jumped out of the vehicle, started running away armed with with a handgun. A police dog chased him down. Both officers fired their guns. They hit the suspect. He was killed. The police k9 was also hit but is expected to be okay. Police are still looking for the driver of the vehicle they pulled over. This is the second deadly shooting involving a chp officer in less than 24 hours. Last nights shooting happened to be less than a half mile away from the one yesterday morning. Just before 3 00 a. M. Police shot and killed a robbery suspect after a car chase. Officers say 19yearold Antonio Mestas was oakland had a loaded gun when he ran from police. A candlelight vigil will be held tonight exactly three months after a santa rosa teen was shot and killed by a Sonoma County sheriffs deputy. Marchers will be gathering at the dmv at 5 30 tonight. Theyll march to a makeshift memorial set up for 13yearold andy lopez about a mile away. On october 22, lopez was shot and killed by a deputy who mistook the replica rifle that lopez was carrying for a real gun. A task force is still investigating that death. Well, new at 11 00, Governor Brown delivered a dual message in his annual state of the state address. He says california is resurging. Its well under way but the state continues to face threats from economic and environmental uncertainty. Topping the list of those unknowns is the severe drought gripping the nations most populous state forcing water cutbacks among farms and cities. Governor brown says the drought should serve as a stark warning of things to come. Right now its imperative that we do Everything Possible to mitigate the effects of the grout. Now to a followup a gun store will be allowed to operate at least for one more year. The town Council Agreed to give templar sports a oneyear permit but imposed financial penalties. Templar sports opened in 2012. At the time city rules said the store only had to apply for approval once. The store got that approval. Last year the town council changed the rules requiring all gun stores in los gatos to be every year. Poor marks when it comes to safety. The Insurance Institute for Highway Safety tested 11 models, the only one that got an acce acceptable rating was the cheffy spark. The rest were marginal or poor. I can tell you right now these swells are big. Were expecting 50 foot he is in hawaii. And ive heard ive been reading a lot about this. Ive heard some surfers out there. This is the surf you only see a handful of opportunities to get out there and ride onceinalifetime. So im going to tell you right now in your lifetime you will only get a couple opportunities for big waves like this. And temperatures today perfect for the beach. Were still getting offshore flow on the east end of the bay area. Onshore flow in San Francisco means youre going to hold on to the mid60s. So finally seeing the micro climate separation at least for today with a moderate onshore flow. As we head through tonight, High Pressure takes control yet again. That means our winds will shift right back offshore and that creates dangerous fire conditions. We are expecting the gusts to reach 35 to 45 Miles Per Hour through the east bay hills.
