Reporter the accident happened around 2 30 this morning on fremont boulevard. Friends of the victim came by and left candles and flowers on the meridian near the accident site. And Fremont Police tell me they are now investigating whether alcohol may have played a role in this fatal crash. Fremont police say a black toyota yaris was making a lefthand turn when it collided with a chevy malibu on fremont boulevard early this morning. Shay marcellino was killed in the crash. Anns Catholic Church. She was the funniest person ever. Reporter she was a senior, set to graduate next month. Friends say she was a talented flutist in the school band and was just coming home from her senior prom when she was killed. Shaneys 39yearold mother was driving the toyota. She suffered major injuries and remains hospitalized tonight. Police say two men in the other vehicle suffered minor injuries and were taken to a nearby hospital. Michael whalen lives nearby and saw the mangled car. He said hes seen several accidents here. This is a terrible intersection. I see accidents here multiple times a year. Cars left and right getting hit, you know, tboned. Reporter friends cant believe on this mothers day, a mom lost her daughter and they lost a treasured friend. I want her to be remembered that as a person that will always help someone and a person that will be there for you no matter what. California routinely puts doctors on probation for a whole list of patients, from sexuallily abusing patients to overprescribing drugs. We discovered that most physicians dont have to mention that to you, their patients. When it comes to investigating complaints about potentially dangerous doctors, the state has its own government watchdog, called the california medical board. But our past reporting revealed serious concerns about how california lets some doctors off the hook even when their errors might have hurt or even killed a patient. Tonight we investigate why the states medical board says youre better off not knowing when your doctor is caught making a deadly mistake. My sister was dead. Reporter the medical board receives more than 8,000 complaints each year. But even when investigators determine a doctor did something wrong, it usually takes more than 900 days after a compliant is filed for those physicians to face any kind of discipline. Nearly all of them continue to practice in the meantime. Could the california medical board be doing more to protect patients . Absolutely. Reporter senator jerry hill of san mateo chaired the hearing and is now proposing major reforms to boost patient preckedzs and increase transparency at the medical board. That includes a plan to require doctors to tell their patients if theyre on probation. That information already gets posted on the medical boards website, but its up to patients to find it. Of californias more than 110,000 doctors, 609 are on probation. Their offenses include deadly medical errors, drug use, and Sexual Assault against patients. Those doctors have a 30 historically, a 30 recidivism rate. Reporter a woman testified that her colleagues on the board, mostly physicians appointed by the governor, believe forcing every doctor to disclose their probation status would do more harm than good. They didnt want it to interfere with the patientphysician relationship that was happening. If doctors are worried their relationship with patients being be damaged, isnt the best solution then for doctors to avoid the actions that got them on probation to begin with, rather than keeping this secret from patients . Absolutely. And the part thats the most disturbing is that when a doctor goes on probation, they have to notify the hospital theyre affiliated with. They have to notify their insurance company. But they dont have to notify the most important part of the health care continuum, which is the patient. Good afternoon. Reporter just last month, the medical board softened its stance, saying it now supports doctors disclosing their probation status to patients, but only for certain violations. That means doctors could still keep some medical mistakes hidden. Even if those errors prove deadly. And the medical board continues to face criticism over how it disciplines doctors. The system was set up to fail. Reporter this investigator testified that what is supposed to be a team effort between the states medical board and attorney generals office, hasnt been at all. We had to investigate these matters and prosecute these matters being in two separate agencies. It has made it very difficult and very cumbersome. Reporter we exposed that breakdown last year, when we introduced you to mario and ludmia guzman. Mario says a misdiagnosis left him a multiple amputee. What are those feelings . Anger. The medical board recommended his doctor be disciplined. But the a. G. s office decided not to pursue the case. Citing insufficient evidence. I wonder, what more evidence do you need . The couple also testified at that recent hearing in sacramento. I spent months seeing my limbs fall off my body, and the doctor that harmed me has a spotless record. Reporter this summer, state lawmakers will decide how best to restructure the investigations process to ensure dangerous doctors are prosecuted. Are you worried the a. Caroline lowe recently passed the test to get her california private investigators license. Its in some ways just an official recognition of the kind of work shes already been doing for many years. Have a lot of experience doing these kind of things. Reporter after the gathering, he returned home to find the same fire crew waiting. Its different taking somebody up the stairs, you hope your back holds up. Took him up the stairs and went on their merry way like it was no big deal.
