The suspect has not been caught. This happened at 9 00 in eastbound lanes. Officers say when they got there they found a man dead inside his car. Freeway shootings in the east bay have been an issue especially on highway 4. It has caused many drivers to be concerned. Its really sad. You know, that we live in a world where people would think thats okay to do. The victim has not been identified. Some east bay cities have installed security cameras on their freeways in response to the shootings. We are learning more about the victims killed in a double homicide in santa rosa this weekend. Police released the names of two people found dead in separate homes yesterday. Investigators believe the two killings are related but they are not saying how or why beyond obviously that the victims have the same last name. A deadly scene in a bar, gunfire rang out on lincoln road east at 1 00 this morning. One man died at the scene and the other was taken to the hospital. He is expected to be okay. A third man showed up at the hospital later saying he was hit during the shooting. So far no suspects have been identified. We investigate the Santa Clara County deputies violate their own policies and what prompted them to shoot and kill an 86yearold veteran in his own home. Reporter this was not the first time that deputies had gone to eugene craigs home in saratoga. They were familiar with the elderly couple living there. They had been there for two medical calls, two suspicious circumstances calls a vandalism and abandoned vehicle call. This time they went to craigs home for a wellness or welfare check but ended up shooting the retired homeowner inside. The Santa Clara County Sheriffs Office says that the deputies went to the home around dusk believing an elderly person inside had medical issues. The sheriffs news release says after calling out for 50 minutes deputies tried to force their way through the front door, could not and went through a side door. There they found eugene craig who displayed this. 38 caliber revolver prompting the deputy to shoot craig where the navy veteran stood in his own home. He gave him verbal commands to drop the firearm. Reporter these pictures show the doors forced open and the bullet hole in the side door frame leading into the home and another shot that missed, a bullet hole in the home where the wife was standing with her husband. If you are there to check on their welfare why do you kick two doors down . Reporter a retired Police Officer and now civil attorney was hired by eugene craigs 90yearold widow to look on what happened. From the information we had they turned a welfare check meaning is everybody okay into a deadly force situation. They went from window to window shining lights in. Reporter a family friend saw the deputies Milling Around the home with flashlights when he got there. He arrived 15 to 20 minutes before the shooting. Roberts went to the house at the request of another friend, jim marshal who got a call from eugene craig that night. Both say the 86yearold was hard of hearing and said that he thought someone was outside the house trying to break in. I could have got into the door and called him. I could have done anything but they couldnt let me do anything, just stay there and back out of the way. Reporter only later did it become apparent that craig mistook the deputies for burglars. He didnt call 911. He called his friends. Bam, bam, bam, i told them it was at least six shots if not seven. Reporter craig was hit by four bullets to the chest and pelvis and grazed once add in the two holes in the door frame and wall it adds up. He had a right to be safe in his house. The police cant come into the house and start shooting. Reporter the use of force entering buildings will only be used after alternative resources have been exhausted. Why they didnt have supervisors there or didnt try to negotiate or break a window and put a phone in the house, do something. Reporter a Sheriffs Department source told us neither a lieutenant or captain was called to the scene until after the shooting. The s. W. A. T. Team was not called nor a negotiator, no tear gas, intercom or loud speaker. That worries the source about the legal justification which would have led deputies to force their way into the home. There are things that allow us to violate a Fourth Amendment and go into a residence. Reporter Alameda County sheriffs sergeant is not talking about this case but in general about procedure for welfare checks. Those are things you balance. Its up to you as an officer to notify your supervisor and the most reasonable thing sometimes is just to walk away. Reporter the attorney agrees saying the law does not allow deputies to create their own exgent circumstances to break down doors. It didnt have to happen and shouldnt have happened and now i have a 90yearold woman who is alone. That is not a tragedy, that is horrific. But with the cool northwesterly winds you may not believe the thermometer. It is going to feel like low 50s for most of the day. From San Francisco to the north bay, highs in the mid50s for monday. The progression of the system, we should see less showers than were seeing right now and briefly midday some of the cool air aloft could trigger instability showers. Especially around the north bay.
