You will notice the list goes on and on. Multiple cities picking up over two inches of rain in three days. Theres stormranger fired up this evening. We have showers to the south and north, as well. We are not just done with the rain, even though the radar is quiet right now. We have another round that will push through. Isolated showers overnight through midnight until 4 00. The rain has been pummelling the Santa Cruz Mountains for most of the night, peggy. For those People Living in the area that was burned out by the low ma fire they have more to contend with than just the threat of mudslides. This is one reason the National Weather service issued a Flash Flood Watch tonight in the Santa Cruz Mountains. Water rushing down from the hills, ravaged by the low ma fire. Some roads and ranches are. Reporter flooded. Im just making sure my yard is draining properly. So its not going under my house. Reporter rock slides sent small boulder and other debris on to roads. We drive fourwheel drives for a reason so we can make it through some spaces. Yeah, landslides, huge, huge deal. Gusts manier than 40 miles an hour toppled trees. But the big question mark is how the rains will impact more than 4,000 acres left barren by the low ma fire. Without the safety net of trees and brush, mudslides are a threat. Scott and his kids are worried about their neighbors who returned to their homes after the loma fire forced them to flee. It would be terrible if they got floods as well right after it. In San Francisco tonight, the man accused of shooting a Police Officer has died. We first broke the story on our twitter feed this afternoon. The suspect believed to be shown in this photo still has not been identified by police. He died today at sf general where he was being treated for critical injuries after fridays shooting. Police say the suspect opened fire on officers without warning. The officers were responding to a call about a man acting erratical erratically. Police cornered him and he suffered injuries before police took him in to custody. Sources say the officer shot in the head is officer kevin downs. This is a photo of him from the website of his nonprofit that he helped to create. Officer downs is partially paralyzed on one side after the surgery, the surgery to remove bullet fragments from his brain. A woman killed by a driver and sheriffs are asking for help in finding the person responsible. It happened last night near collins. The woman was in the cross walk when she was struck. They releaseded surveillance photos and are searching for a pickup truck with a camper shell or bed liner. A followup on a triple shooting that we told you about last night. The Sonoma County Sheriffs Department said one man was killed in the shooting and two other victims are alive. They are currently being treated. Despite posts on social media, no arrests have been made in the shooting so far. Investigators do say they have solid leads that they are working on. This happened along 116 south of 8 15 at night. Major step ward in the sierra lamar case expected tomorrow. Jury selection beginning on monday for the man accused of killing lamar. Prosecutors say that Garcia Torres killed the 15yearold morgan hill girl in 2012. Garcia torres was arrested after lamars dna was found in his car. He faces the Death Penalty if convicted. Turning to decision 2016 new poll numbers show that Hillary Clinton has a Comfortable Lead over donald trump. The numbers come as there are new signs of the split between what trump is saying and what those close to him say he means. And he argues the Voting System is corrupt. I can tell you we have a very active investigation going on right now. A number of streets are blocked off. I want scott to zoom in where you can see the evidence markers. At 8 50 tonight, two Police Officers were inside of a starbuck on lincoln road west. They are saying the officers saw a black male adult open a door and point an assaultstyle weapon in their direction. And that he appeared to be attempting to manipulate the gun as if it wasnt working. The two officers, they are saying, drew their weapons to protect themselves. They say the suspect ran through the parking lot, westbound on magazine street. The officers ran after him and engaged him in the intersection. As they say, he continued to manipulate this weapon and they are saying he presented himself as a lethal threat. The suspect, were told, was struck three times by gun fire before falling. That he was taken in to custody and they are saying he was also found to be carrying another loaded handgun and also wearing body armor at the time. He was transported to a local hospital and i think, as you said at the beginning, is being treated for lifethreatening injuries. No one at the scene here is speaking with us. Were told they are all deeply involved in the investigation. I can tell you ive seen members of the Sheriffs Department, also the pd here helping out while police are investigating. He showed the weapon again and pointed it at the police in a threatening manner. The man went in to the starbucks where the officers were and had an automatic rifle that apparently jammed upon second inspection here. The suspect had a second gun that was loaded that he brought in with him. This is under investigation. But once again the person who did walk in to the starbucks with a gun and apparently aimed it at the officers has been shot and injured here by Police Officers. We are following the story and bringing you the latest details. The suspect has lifethreatening injuries. No officers were injured. The other big story today. We are talking about the weather. We dont have any rain across the east bay. Pretty much done with that. The peninsula is starting to dry out as well. We have a few showers across the Santa Cruz Mountains over the loma fire burn zone. This is pretty much the last batch of rain. Deadly Police Shooting in santa cruz to tell you about. Officers say the man killed attacked them with a rake. This started as a disturbance 3 30 this morning. Someone called 911 to report a man banging on the door of their home and yelling the suspect wanted to kill the people inside. Police say the man attacked officers with a metal rake even after a taser was used on the suspect. Theres a new twist in an unusual fight involving money, unpaid taxes and tons of marijuana. A san jose marijuana shop refused to pay business tax for years now. It is now ready to strike a deal. Lawmakers may not be willing to take the money. This is crazy. This centers around why the shop decided not to pay taxes in the first place. According to the federal government, possessing and selling marijuana even for medical purposes is illegal. At the same time, 26 states have laws on the books that allow the medicinal use of marijuana, including here in california. That confusion has led to this bitter fight in san jose. Over 1 million hang in the balance. David armstrong proudly grows all of this marijuana. He runs medimart, a pot shop in san jose. The past four years he openly refused to pay the citys 10 business tax which is required of all marijuana shops. He owes 1. 3 million. Why is he stalling . He believes paying taxes could land him in prison. I wasnt going to pay a tax that breaks state and federal law and be looking at ten years to life. Thats the offer we made to the city. Armstrong and his legal team believe paying the tax would mean they are admitting to selling marijuana, which is illegal under federal law. So medimart sent this offer to the city of san jose. It is willing to pay the 1. 3 million with a catch. The deal says the money will not be labelled as a tax, but instead a contribution. The citys right to randomly inspect the shop would have to end. Do you see any problems with the offer . I think there are concerns. Richard doyle is the city for san jose. You dont want to send the message you dont have to play by the rules. One way or the other we will try to get the money. Doyle said the courts sided with san jose. The pot shop appeal to the California Supreme Court but a decision hasnt come down. To say there isnt continuing resources and everything spent by the city to continue to fight this is that a consideration . It always is. You dont see it as a matter of if they have to pay but when. There is always risk buff i think we have the upper hand. Reporter david ball is a law professor at Santa Clara University and specializes in marijuana regulations and policies. There theres going to have to be a day of reckoning because right now we are speaking out of both sides of our mouth. The state is saying it is okay for people to use and the federal government is saying it is not okay for people to use and no attempt to reconcile the two. The professor believes it doesnt pass the smell test. As long as they admit they are enabling other people to possess marijuana it exposes them to criminal liability. So in your opinion, not paying the tax doesnt leave them more protected. If anything it does the opposite. The only way they can protect themselves from federal prosecution is by not engaging in any possession of marijuana at any point. So in choosing not to pay the tax, they are just left more vulnerable because now they are breaking local laws. Thats right. Lawyers for the pot shop disagree. His attorney believes san jose is playing a dangerous game of semantics. Our position is the tax were worded differently, for Different Reasons theres no problem. The word is the sales and business is in there. It is a matter of characterization and a matter of what it is for. Regardless, san jose believes it is owed more money because of penalties and interest accrued the city council will likely decide by the end 0 the month whether to accept the deal or fight him in court. If you are asking me to break the law, state and federal law, simply so you can collect a tax on a sale or a transaction of a controlled substance, we simply cant do it that way. While federal law bans the use of marijuana, the federal government did issue a set of guidelines that say prosecuting someone isnt likely if they are following local laws and regulations. In fact, of the 16 pot shops in Good Standing in san jose the city says numpb of them have faced prosecution from the feds for paying taxes.
