There was a form of altercation that happened there, there was a shot heard in the area at that time and a witness saw a female be drug away that had blood on her face. We are very concerned. Witnesses went to say that castro was seen carrying a gun. The fire in vallejo, this is a father accused of killing his 5yearold son and severely injuring his mother. He is now in jail. Poured gasoline on the female victim and lit her on fire and then the gasoline spilled in the room and that ignited the house on fire. The boys mother is still in critical condition. Like what did i do to deserve all this . And for seven years i hid all this. Reporter scared that her abuser would carry out her threat to hurt her mother and deport her family. If i would tell, we would have nowhere to go. Reporter at 14, michelle said she could no longer keep his secret. I felt i was going to die her mom said. I believed her right away. They went to San Jose Police where michelle said that detectives interviewed her for hours and then listened to phone messages she said that her stepfather left. Begging her mother not to report him. That was july 2014, 11 months later the police filed the case with the district attorney. The da wanted an additional interview and the police resubmitted the case in august, 13 months after the initial report. I dont know why they took so long. Reporter michelle finally contacted the Investigative Unit after reporting her stepfather tried to confront her in person. I even went down to the Police Station the day he saw me at the school. He tried to get me to talk to him. They didnt do anything. Reporter in late march, we called the santa clara da to ask about michelles case, two days later the da issued an arrest warrant and the stepfather plead not guilty. It was human error. Reporter this is the Senior District attorney in charge of the team prosecuting sex crimes in santa clara county. A tremendous apology is owed to the victim. I apologize to her. Reporter she was reminded about the case in february, seven months after it was submitted. It was either misplaced or misfiled or lost. When San Jose Police followed up with your office in february. You realized you didnt have the file, why didnt you expedite that and then make the arrest sometime in that month . I dont know that i have an answer for that. Reporter and as far as the arrest being made after we called, are you saying that was a coincidence . I cant speak to that. Reporter the Investigative Unit reviewed records for the past three years of child molestation cases submitted to the district attorney, we found on average the da files charges within a month but 19 cases took six months to three years before the da took action. How confident are you that there are no other cases that have been mishandled or lost in the system . Im confident in the quality of the people that work in this office. I dont think we dropped the ball on this case. Reporter lieutenant jason todd is in charge of the case. He personally reviewed the case after we raised questions about the 11month investigation. The detectives did a very good interview on everybody involved. And the case is a good case. Reporter and you dont think it took too long . No. Reporter so we tried to find out on average, how long it takes san jose pd and every other Police Agency in the county to investigate a report of molestation. Most agencies keep track of that information. San jose does not. Why doesnt sjpd track how long it takes to investigate the cases . We dont track the time because the time is really not a priority for us. I mean, we do an investigation. Its disappointing that it took that long. Reporter howard bloom is the training manager for bay area women against rain. How important is it for survivors to have the cases resolved and as quickly as possible . Its about having their voice heard, especially if the molestation happens when they are young, children dont have a voice. Reporter for michelle, reclaiming her voice has given her back some peower. Reporter michelle is seeking counciling with the support of her family, meanwhile, the District Attorneys Office is now reviewing 50 active Sexual Assault cases to make sure no others are languishing or lost like michelles.
