When it comes to disciplining kids at school, you might think the severity of thieir actions wou when it comes to just kids at school, you might think the severity of their actions would be the only factor in deciding their punishment. But our investigators unit found the color of your childs skin and whether or not your child has a disability may increase the chance that a police is brought in to deal with the child at school. This impacts hundreds of thousands of students across the bay area. And how schools work to keep their kids safe widely. Some students contract with the police department, Police Officers on karchlus, the practice began in the 50s and started growing in the 80s and 90s to weed out drugs, violence and weapons. But opponents say officers are now being brought to the classroom for far less, blurring the lines between childish misbehavior and criminal activity. 15yearold Adrian Crosby seems happiest with his feathered friends in the backyard. Next up, it is worms. Follow me, chickenes. Hes a visual learner. So a few years ago when his teacher assigned him a project to research animals, his parents brought him these chickens. He looks and sounds like your typical teenager, he struggles socially. His mother says he has trouble grasping certain concepts. The ability to understand rules, regulations, expectations, social behavior, especially in the case of adrian as it is with many other autist autistics, they do not understand that. Two years ago, adrian was at a school, brett hart middle which he write adrx on the sidewalks. The letters measured just 6 inches tall, but the school believed they were big enough reason to involve campus police. Adrian was arrested at 13. I thought maybe someone would look at it and say, oh, look, a legend, oh, look, a legend. This is so cool. A legend was at this school. You thought leaving your initials would give you a legacy . Yes. I thought i i did something awesome, but then they called me into the office and said, hey, you did something wrong. I think we have to call the cops on you now. How did you react . Fear to my toes to my brain. Fear. And were you crying . I was i was bawling. They said if you wont sign this citation, were bringing handcuffs in. He wasnt hand cuff ed, but he was given this jewel knife cry tagdz. The crime is vandalism. Adrians mom recorded this video the day her son was arrested. The School Resource officer is with San Jose Police. That department wouldnt provide anyone to talk with us on camera, but did confirm the arrest. For me, it was like the end of the world because your child is your baby. To find out how often schools call police on their students, we collected data from 20. Thats some of the Largest School districts in the bay area, home to over 370,000 students. Our investigation found those schools send more than 1800 students to police during the 2013, 2014 school year. While children with disabilities made up 10 of the population, they totaled 27 of all students referred to Law Enforcement. Black children represented 9 of the population. But 16 of all the students referred to Police Budgets have been squeezed in california. This attorney believes those rates were made worse after budget cuts left california students with fewer counselors. So educators relied on School Resource officers to discipline students. Police tend to approach conflict by arresting people rather than having a more supportive approach to keep kids in school and out of trouble. So an incident that could have landed a student in the Principals Office could, in some districts, very well equate to criminal charges against the student. Thats correct. The worst Case Scenario is the charges refer to the District Attorney and the child ends up charge ed with a crime. Hopefully it will be dismissed. This lou Law Foundation provides legal advocacy for children and teens. Many of those clients were referred to police while at school. Some of the cases that we hear about are as young as first grade. In some cases, 6 yeefrlds are Getting Police called on them. Thats correct. Theyre doing things that children would do. They may be talking back to the teacher, they may be, you know, hitting or kicking. Don bridges is with the National Association of School Resource officers and says Law Enforcement should be called only for major safety concerns. When we have officers in the school dealing with discipline issues, anyways when we have problems. He says stools that have police on campus should have a written agreement outlining the officers responsibility. 85 of the bay area districts we looked at have officers on campus. Our investigation found of those, only 35 of those have agreements with police to detail the officers. San jose unified does not have that kind of agreement. The superintendent, dr. Vincent matthews, wouldnt talk to us on camera about the districts policies or what happened to adrian. In a statement, a district spokesperson told us their School Resource officers complete a separate Training Program through the San Jose Police department that covers building relationships with kids, how to talk with students and how to serve as role models and mentors. But what the school calls a mentor Training Program laughs about 30 minutes pt the department of justice recommends 40 hours worth of training through the National Association of School Resource officers. Adrians parents made him clean up his signature. Much harder to erase was the impact. For me, a long time, adrian would not leave the house. Adrian still gets nervous going beyond his backyard. It made me feel fear. How do you think the school should have handled that situation . They should have called my mom. They should have just cleaned it up and we should have just cleaned it up and just get on with the school day. You think you could have learned your lesson without the police being there . Yes. Adrian had to nervously wait nearly four months before learning whether he would also face criminal charges. After finally get ago meeting with the juvenile probation officer, adrian and his family was told the case was closed and would not be given to the District Attorney. His arrest remains on his criminal record and could stay there even as an adult. There are so many questions related to this, especially how this can happen without the parent being present with the child. But i guess what i really want to know is how the Bay Area Schools compare in terms of how many times these citations or these referrals to Police Officers are made even when the parent isnt even present. There is a wide range. Certainly sdrikzs refer zero students to Law Enforcement officers, but another involved Police Nearly 1800 times in a Single School year. Tomorrow night, well look at the record of one Bay Area School district that sent kids to police at a rate that was actually higher than nearly every School District in the united states.
