Situation. Right now this whole area is cordoned off. But if you look up into the hill there, thats part of the park. You can see there are some officers conducting the investigation into this officer involved shooting. San Francisco Police say around 7 00 this evening, people walking in the park called to report a man with a gun. Police responded and according to a spokesperson, they encountered the suspect and thats when the shooting happened. Were not absolutely sure what occurred up here, but it does appear that he drew that weapon and officers responded. And shot him. He is dead at the scene. Reporter police say they were able to recover a gun at the scene. Right now, again, a very active investigation. Homicide detectives are here along with representatives from the San Francisco District Attorneys Office and the office of citizen complaints. The officers involved in the shooting will be placed on administrative leave, which is standard protocol. We are told next week the chief will hold a Community Meeting to address the shooting and any concerns residents may have. Live in San Francisco, kimberly terry, nbc bay area news. The District Attorney said today that no charges will be filed against the suspect, michael montgomery. Prosecutors didnt have enough evidence nor could they reject his claim that he acted in selfdefense. Were going to show you a picture of the victim, jonathan denver. He was wearing dodgers gear when he got into a fight with montgomery last september after a giants dodgers game. Police say the brothers were bigger and heavier. At one point montgomery used his knife. It is simply horrific. A case of child abuse so disturbing. It was discovered inside a selinas home. Thee children found starving and abused. Tonight, they are safe but hardly free from the torment. Inflicted police say by these two women. Both in jail tonight. Not the kind of situation you expect for three Young Children to be living in. Reporter the sheriff said it was the worst case of abuse hes seen in 30 years of law enforcement. And it happened in this home in selinas. Deputies say they got a tip about neglect and went to check it out. What they found was three malnourished and mistreated chirp. Conditions were squalid. There was little food, the whole entire house was a mess. Reporter the boys, 5 and 3 years old. With an 8yearold girl, bone skinny and starving. Theyre all malnourished. It was a devastating scene for the three children. Reporter but the sheriff says the girl got the worst of the abuse, at times forced to live in a closet, chained by her feet and neck to keep her from getting food. The 8yearold was from time to time chained to the wall and denied food. She was extremely emaciated. Shes been described as someone who looked like she had been in a concentration camp. Reporter the two mothers are charged with child abuse. One of the women is the biological mother of the youngest boy. The other two adopted. The sheriffs say the wounds for all three run much deeper. The toll on the child is extremely deep and its a rough road that, together as a community, as public sector, we do our best to help that child overcome. Both women pleaded not guilty to those charges and they were back in court on march 26. It sounded like a train wreck. A hit and run that rattled a san jose neighborhood. Tonight, officers arrested the man two tried to flee the scene. According to police, one car slammed into another around 7 30 this evening just west of spartan stadium. Neighbors say they saw smoke from one of the cars. The two girls suffered cuts and bruises from the crash. The driver faces hit and run charges. 9,000 people evacuated from several schools in the state of montana today. But the bomb threat came from the east bay. Tonight, a teenager from dublin is in some legal trouble. Cheryl hurd is in dublin. What happened here . Reporter well, that investigation started in helena, montana and ended up here in dublin, california. And these investigators have quite a story to tell of a 14yearold boy that is now in big trouble for allegedly making three bomb threats to helena public schools. Someone may think this is a joke. We dont. Reporter lewis and Clark County Sheriff sending a verbal message to who called in bomb threats to their public schools. Well find you and well prosecute you. Reporter according to these documents, police did find a suspect. Not in their backyard but here in dublin. According to the affidavit, three calls were made this week. The first call went to a high school at 8 36 monday morning. The school dispatcher told police the caller said, bomb in gym. Capital high. 100 valley drive. Please come quick. Police there did a search and found nothing. Two days later, there was another call, around the same time at an Elementary School. The caller said, hi, i just left two backpacks with c4 at the Elementary School and im about to blow them up. Whos laughing now . There was a brief evacuation. But this time the dispatcher was able to capture a phone number. That phone number led police and the fbi back to magic jack, a Computer Generated telephone service. But today the caller made another threat, saying bombs were in all helena public schools. 9,000 students and staff were evacuated, and classes were canceled. But police had already connected the dots back to a 14yearold Dublin High School student, through that Computer Generated phone number. He was arrested on campus today. The case is still under investigation. There may be some connections here in helena that this 14yearold juvenile in california has. Reporter now, the affidavit went on to say that that 14yearold confessed to the crime. He also said that he collaborated with a 16yearold student in helena, montana. But no word on if that 16yearold was taken into custody. But the 14yearold here is now in the custody of his parents. Reporting live in dublin cheryl hurd, nbc bay area news. A huge settlement for this violent response from oakland police, the city agreeing to pay this iraq war veteran 4. 5 million. Officers fired a bean bag bullet at him during this occupy protest. His Attorney Says it fractured his skull, leaving him in permanent brain damage. Part of my brain is dead, but im i you know, its hard. It was a hard recovery process. He says in the wake of that protest, opd has changed its crowd control policies and retrained all officers. More details on that settlement. The city will pay 1. 8 million and the citys insurance carrier will pay the rest. It is the largest payout linked to the occupy movement. Along with a few other settlements, it adds up to more than 6. 3 million from those occupy related lawsuits. Today marks five years since the darkest day in oakland history for police department, a day a wanted parolee shot and killed four officers. The four died on march 21, 2009. Today, fellow officers gathered to mark the somber anniversary and to honor them. The man responsible for killing the officers was ultimately killed during a gun battle with police. Request denied for a disgraced former San Francisco supervisor. He will serve one year in county jail for lying that he lived in San Francisco when running for office. Ju already served nearly five years in a federal prison for other charges, extortion and bribery. He was released earlier this year. Today, his lawyers asked a judge to give him credit for the time served in federal prison but the judge rejected the request. A san mateo neighborhood is claiming victory after closing a seven eleven. It was later revealed that the city mistakenly approved a permit. New at 11 00, the ntsb says video shows a seattle news helicopter began rotating during takeoff before it plugged to the ground. Video from three security cameras show the chopper rotating counterclockwise before pitching forward and falling. On wednesday, this fire in Mountain View ripped through a pair of homes. Firefighters rushed to the scene, but so did crews from nearby palo alto. This was the first big test for a brand new computer dispatch system, linking Energy Communications for Mountain View, palo alto and los alto. The Fire Departments are able to track the apparatus available. The new system went online this week after five years of planning. Its uniting the three Cities Energy dispatch centers under one virtual roof. If we have insurance dents that are on our boarders, we can immediately access that, look at them, choose to respond on them. When emergencies pop up, dispatchers plug them, gps Mapping Software will determine which units are closest, even if from another city. You know right away you can dispatch that system, its going to get there much faster. First responders will always tell you seconds count in any emergency. A high fog here in the Santa Clara Valley and wind speeds are calm. In San Francisco, you can notice that fog really beginning to thicken up right now. Winds out of the west at 12 miles per hour. So lets take you into the winds. Theyre on shore, theyre going to stay on shore throughout tomorrow. Thats the reason we dont have any major beach weather for saturday and sunday. You can see again that cooler wind direction out of the west. So as far as tomorrow morning goes, thickest right up against the coastline for the cloud cover, right up into the napa valley. Then by the afternoon, we to expect some sunshine, even some clearing right now. The computer models are picking up at the immediate coastline, but we are not by any means going to see a warm Beach Weekend like we had last weekend with temperatures in the 70s. Its going way down. Tomorrow, low 60s. By sunday, we may see it go up to about 64. Thats just about it. If you want the heat, you want the sunshine, no doubt the spot to be is san jose. 74 degrees tomorrow. Saratoga may also get up to 75. You can see across the peninsula, well be under that on shore flow. Down towards palo alto, well push up to 73 and sunny skies by the afternoon. But if youre going to San Francisco, take that jacket as temperatures are not going to budge and stay in the 60s all day for tomorrow. Up into napa and sonoma counties, 75 in napa. 73 in santa rosa. For the east bay, 69 in oakland. Walnut creek should hit 74. And danville at 74. By all accounts tomorrow, inland looks awesome on saturday. And well see a repeat performance sunday. A whirl wind of air swept tumble weeds, dust and debris into this controlled fire, sending firefighters running. Thankfully no one was hurt, but that is incredible video to see that.
