New details about a troubling attack at an east bay school. A transgendered teen was cornered in a bathroom and sexually assaulted. Another transgendered teen at the same school was bullied a few months ago. We are live with the latest on this case. The victim is a 15yearold female who identifies as male and because of the new law that went into effect here in california on january 1st that student can choose whatever restroom they would like. And because of what happened in that restroom, the School Board Members will hold a special meeting to address what they call a troubling attack. A boys bathroom is now a crime scene with fingerprint dust just as fresh on the tiles as the outrage from the school board president. Were horrified by what happened. Its terrible that any student on this campus would be subjected to that kind of conduct. Reporter a 15yearold student who identifies as male was cornered in this handicapped stall this morning, the door locked as three male students physically and sexually assaulted that transgendered teen. It is being made a hate crime. Reporter and one of the first case of violence since the law went into effect. And i dont know why people do this. Let the kid live his life. He is the same as everybody else. If she wants to go into the boys bathroom its not our say in what they can or can want do. Reporter there are no arrests yet. And there are no security cameras outside like other district schools. We have to say there are consequences for this behavior. You will be expelled. You will be punished and ask you are punished to the full extent of the law. You cant assault students on campus. Reporter the victim was not able to identify the attackers. But the police are hoping that teenagers will do what teenagers do and that is talk and someone will figure out who was responsible and come forward. Live tonight, chase cain, nbc bay area news. This is the same school that is under scrutiny for how it handled a fight between a transgendered student and three girls. Joules was bullied for weeks and asked for help. Gutierrez threw the first punch in the fight and charged her. 200,000 people signed a petition demanding that the charges be dropped. And the teenager agreed to take part in a School Everyone thi program. If she completes the program the charges could be dropped. There is an increase in patrols at Santa Clara University after two armed robberies over the weekend. Nbc bay area eastery mcsweeney has more. Reporter the first attack happened at 1 00 on saturday morning. El camino real is just on the other side tonight police have stepped up patrols following two weekend robberies. The first happened at 1 00 saturday morning at this Campus Parking lot. Ironically next to an emergency button for people to push if they are in trouble. The student was robbed of their cell phone and wallet. I dropped off my friend on campus and returned around 12 50. Reporter the Second Attack was a few minutes away. Two students and a visiting friend were stopped and robbed and one was assaulted. One of the students was knocked to the ground and struck in the face. Reporter police say the robbers were the same in both of the crimes. I try to keep things in perspective and keep a good attitude about it. If you dwell on the bad things you will make yourself crazy. People have a false sense of safety in santa clara. Is it a gorgeous campus. People feel safe here but its there are safety issues. Reporter both of the students we saw in that piece say they will change their behavior as a result of the robberies. They will be more aware of their surroundings and walk with someone else, exactly what University Officials and police want them to do. Live in santa clara, terry mcsweeney. A san jose man is angry with police after his business was broken into twice in the same morning. Video shows a burglar ransack his store, leaving and coming back 90 minutes later. The Alarm Company called police but they didnt come. Officers say an overwhelming majority of alarm calls are false. At home in bed with my family. You know, i expect the police to help protect the business in our community that keeps everything going. Burglaries and threats have been on the rise in san jose for months now. The city council will talk about butting a referendum to allocate 10 of city funds to the police department. A teenage house party spirals out of control. Drinking, loud music and violence. When a neighbor asked the group to quiet down one of the teens attacked him. He was left with a bloody face and a brain injury. The family is turning to social media to find out who did this. Reporter thats right. Specifically, facebook where one of the postings has been reshared more than 1200 times. Michael is in the icu here in santa cruz. The family says he is talk and alert. But on saturday night he barely survived a horrible beating. He almost murdered. My husband. Reporter michael was minutes from dying. 15 centimeters. They caught it just before he would have died. Reporter how he ended up. The icu is sickening. On saturday night in the hills, a big party was going on across the street from the home. Dozens of cars blocked the road including their driveway. He was seeing that nothing was happening and cars werent moving. So he had a flashlight that he used as a strobe and said you need to leave and get out of here. Reporter at that point one of the young men from the party came from behind and struck michael in the head and threw him down an embankment. And the guy was on top of him just punching him. Reporter a blood vessel popped in his head. And some kid decided to just come at him from behind and beat him. And you know, thats just shameful. Its shame on him, really. Reporter after his stepdaughter posted on facebook about what happened, her friends responded with love and support. The love and compassion and support that people have been giving me and my family and step dad is unbelievable. Im overwhelmed with the good in people right now. Reporter the Sheriffs Department is investigating this. One deputy said that the beating is criminal and unacceptable. Live in santa cruz, nbc bay area news. Tonight a call for greater accountability. The issue is on Sexual Assault and retaliation in the u. S. Military and the California National guard. This follows an nbc bay area investigation highlighting the alleged Sexual Assault and subsequent termination of a member of the guard. Now military women across the country are responding. Chief Investigative ReporterTony Kovaleski has the story. Reporter members of the National Guard in other states say that Jessica Brown is not alone. Military women saying they know what it is liked to be raped and forced to end their careers. We completely understand what shes gone through. Weve been there. Weve been pushed to the brink of death and its not her fault. You can heal from this. Reporter three experienced military women responding to our regards about Master SergeantJessica Brown. I just wanted to stop. Reporter that was back in 2012, brown described in front of our cameras, her memories of a retaliation following a Sexual Assault. Leadership has been told and they dont do anything about it. They throw it under the rug. Reporter the California National guard says it investigated the claims but the claims were never substantiated. The retaliation after reporting the Sexual Assault became so unbearable she tried to end her own life. Hours after that attempt, the guard confirmed it tried to serve her termination papers in the hospital. My heart was broken when i saw her story because i have been pushed to that point. I have ended up in the hospital with wanting to die. Reporter Jennifer Norris served in the air force and air National Guard and reported four separate Sexual Assaults that took place between 1996 and 1998. Norris says she reported those to her command but like jessica, she faced retaliation. My career was simply ended because i was getting help for the military sexual trauma. Reporter she sat with us. Army veteran kate webber says she was raped in 1993. Coast guard veteran says she was raped in 2006. They all say Jessica Browns story is far from unique. Every person we know that has reported Sexual Assault has been fired for being raped. The problem we have been seeing in the National Guard is the lack of the in the command. This bill has the problem of Sexual Assault. Sexual violence military sexual trauma has received a flurry of National Attention from members of congress. But federal legislation does not apply to state military departments. A lot of people just assume that because the National Guard is such a big part of the department of defense that they automatically have to adhere to the laws of the d. O. D. But they dont. They are a state entity. I think its important that the legislature be involved with this and we know how many of these cases are happening. Reporter lawmakers in iowa are addressing the issues. In january an iowa state senator introduced a bill to require the commanders to report Sexual Assaults outside the chain of command to civilian authorities. We want to have better reporting to Law Enforcement but also for the legislature to understand how many of these incidents are happening. Reporter the women of the military Rape Crisis Center say they hope other states pick up similar legislation. The whole system has to change. The whole entire National Guard. I would like to see, you know, california and other states following iowas steps. The current Sexual Assault reporting system has failed many very successful career women and there needs to be change. Reporter she is currently a member of a rescue wing at moffett field. She wanted to send a personal message to Master Sergeant brown. Jessica, your bravery to persist and remain determined and overcome is a model for all those out there even in the wings who are i feel like what i did was worth it then if it is getting out there. Reporter since our original report, the California National guard terminated master brown from her fulltime status and she is no longer a member of the reserve. What is your reaction of this move to make things for the military to be more accountable when it comes to Sexual Assault . I think its phenomenal. There is very little accountability. Seeing a Sexual Assault get processed in the civilian world, we need that kind of support in the military. Reporter the proposed iowa law require that Sexual Assaults receive an outside review. Jessica brown believes that would have made a difference in the gauntlet she experienced we did not receive a response from the California National guard to comment on the report.
