people to file nearly 800 fraudulent tax returns. or abol robleto. another registered sex offender. he teamed with his wife and i.r.s. employee, to file false tax returns in theirs and other inmates names, claiming more than $18,000 in refunds that were not due. >> it got fairly big. >> the tax man doesn't know the half of it. according to 2009 data sent by state corrections departments to the i.r.s., 3700 fake income tax returns caught coming out of prison. congress is schedule today begin holding hearings where they will discuss this issue on april 10th. but this isn't the first time congress has tried to tackle inmates stealing your tax dollars. they had hearings on this back in 2005 where the i.r.s. pledged to do better. >> but now, instead of doing better, the problem is worse, much, much worse. >> we're talking billions of dollars being requested by prisoners. >> it's not acceptable. i mean, an honest, hard-working american taxpayer should not be able to have his or her burden increased by someone cheating the system. gaming the system. and that's what's occurring. >> nine years ago, the inspector general's office found the i.r.s. caught 18,000 fake returns where inmates claimed $68.1 million. today, the i.r.s. found 276,000 fake returns from prison inmates around the country, asking for nearly $2 billion in money that were not due. >> even still, a lot is getting through? >> oh, yes, we're still talking hundreds of millions of dollars. >> free money going to inmates doing time. >> exactly. >> i.r.s. officials both in california and here in washington, d.c., have consistently refused to go on camera and answer questions about this issue. but in a statement given to nbc bay area, the i.r.s. says it takes this fraud very seriously. the statement reads in part, quote when accurate prisoner data is available, the i.r.s. is very fast at stopping refunds. there are still significant challenges in getting complete and consistent data from the multiple jurisdictions involved. >> and as soon as you shut down one scheme, another scheme develops. >> jackie rearden knows all about this scheme. she's a retired special investigative agent for the i.r.s. >> you have the i.r.s. wanting to process returns and get refunds out as quickly as possible. and then on the other side of the house, you want to make sure you stop all of the fraudulent schemes. and that takes time and resources that the i.r.s. doesn't necessarily have. >> we've certainly been aware with many people in recent years that there is a problem. >> spokesman jeffrey halison says california's department of corrections wants to do everything it can to stop the kind of fraud. ultimately, it is just a state agency. this is a federal crime and the i.r.s.'s problem. >> what is california doing to try to stop this problem? >> we work with the i.r.s. we share inmate information with them, as required. and we're working on an agreement, a more formal agreement with the i.r.s. >> like i said, it's still going on right now within the prison system. >> dewayne has gone straight. he's out of prison now living clean in up state south carolina. he says he won't go back to scamming the i.r.s. but he also says this scam goes on behind bars without him. >> just recently was released from the federal prison system and guys was getting ready before i got out preparing to file fraudulent taxes. >> now, there have been improvements in fighting this scam over the years. the i.r.s. has made some progress. even so, the inspector jenl tells me that much, much more could be done. he says the i.r.s. needs to devote more resources and technology to fighting this crime. and he says congress needs to change the rules to help the i.r.s. and state prison systems better with the latest on the investigation. cheryl, heavy hearts tonight. >> it is, indeed, all over this neighborhood. but the victim within this intersection on tuesday, just before noon, when someone opened fire. his foot landed on the accelerator and he ended up in this ravine. oakland police tell me tonight that they are working overtime looking for a suspect. >> reporter: flowers trickling in from strangers who live in this oakland hills neighborhood. this man, very upset, telling me off camera that this killing is a low blow to the area. san jose paramedic quin boyer was pronounced dead at highland hospital just before 4:00 this afternoon. >> it's shocking. it's tragic. you know, we're all kind of going through a very tough time right now. >> reporter: police say boyer was leaving his father's home tuesday morning when he stopped at this intersection of keller and hansom drive about noon, detectives say a gunman, in another car, shot him at close range. boyer hit the gas pedal propelling his blue honda civic into a nearby ravine. >> quin was a great paramedic. he was loved by everybody here at the company. >> brian hubble says boyer worked for the santa clara ambulance company for five years. >> we're trained to deal with situations every single day. this is what we do. when it happens to one of us, one of our brothers that go through something like this, it's just emotionally taxing. >> police say they don't know if this was an attempted carjacking or robbery or possible road rage. d day diann amc donald. >> there's another kind of world out there where people get angry very easily where there's a lot of injustice. and there's a lot of suffering and a lot of homicide. and it really needs to stop. >> all police tell me they know tonight is that someone saul thanks, cheryl, for the update. a follow up now at the chevron refinery that could mean relief for california drivers. california spent the week going through dozens of items. the refinery has been operating at about 60% since last august. california officials say if they're assured safety standards are met, chevron could operate at full capacity in days and that means gas prices could go down. >> off-duty and on vacation in hawaii. but a panol police officer sprang into action to help a tsa agent under attack. his heroism was caught on camera. in the left corner of your screen, you see a woman attacking a security officer. and then you see corporal justin rogers who is in a security line with his family, he saw what was happening and jumped in to help. he quickly identified himself as an officer and a tsa agent handed him cuffs to restrain the woman. here's the video. you'll see him coming in from the right side of your screen. authorities say she's one of several homeless people who are often at the airport. >> it's kind of like any other public place. people are allowed to be here. unless they're kmiting a crime or doing something to bother someone, they're allowed to be here like anyone else. >> deputies arrested the woman. she was taken to a local mental hospital for evaluation. the tsa officer told her bosses that she was a little swollen and sor erksz, but gilroy. neighbors rush to help the victim seconds after the shooting last night. nbc bay area is live in gilroy where he spoke to those neighbors. >> reporter: we're learning tonight one of the men is a father of twin boys, one of the men who was shot yesterday or last night. and the girl who police say they are following up on a number of leads as they look for those responsible for this shooting. >> it sounded, like, about more than five gunshots. >> the sound of gunfire caused irma to run out of her home on chestnut street in gilroy. three doors down, she saw a crowd gathering on the front lawn and two of them on the ground. one of them was her friend, stevie. >> so i went down on my knees and i got both of his hands and i said stevie, hang in there, please hang in there. look at my eyes and don't look away. >> within minutes, the police and paramedics arrived. while irma held stevie, he told her about these guy who is followed her from a nearby market. >> he responded to me and told me he just came back from the market. he was buying milk for his twins, he has twin boys. >> one man died and the other is in critical condition. but investigators are not saying which man died. the shooting happened in a neighborhood full of children. >> it's devastating. my daughter doesn't want her out. but i said you know what, we can't live in fear. we have to live comfortably in our neighborhood. >> irma says stevie just got out of jail a month of go and was trying to get their life back on track for his wife and their 18-month-old twin sons. >> i just think that it's unbelievable that somebody could be so cruel and know that there's no reason for it. there's absolutely no reason for it. >> reporter: police have not released the names of the two victims. if you know anything, please call gilroy, p.d. >> george, thank you. they say pilot error. a state commission wants to revoke his license. they're pointing the fger at the bar pilot of that tanker that sideswiped the bay bridge. his attorney sees it differently. >> the law says that he has to act in a reasonable way. as a skilled pilot. and we believe the evidence will show that he did that. >> this is the pilot, guy kleess. he was piloting the reymar back in january. that's the tanker that struck the pylon of the western side. the commissioners voted unanimously to revoke kleess' license. a state law judge will make the final decision. >> sexist or complimentary. president obama is taking heat tonight for something he did during a fundraiser. he called the state attorney general the president and harris have a solid friendship. reed is confident president obama's remarks don't overshadow her reputation. >> that this is an intelligent woman. she is a lawyer. she is a successful talking. first lady my shelt obama mistakingly called herself a single mother. she was discussing her empbts to proo mote healthy eating when she said believe me, as a busy single mother or, i shouldn't say single, as a busy mother, you know, when you've got the husband that's the president, he's busy, but he's there. >> the president is back after his brief visit to the bay area. this morning, a nice image. he was about to board marine one but was able to catch that breathtaking site of the golden gate. >> breaking the rain for president obama to do a little sightseeing, i see. actually, we had the rain today and there was more severe reports to the north. >> yeah, that's right. just to the south of reading and also red bluff. in fact, one of these near red bluff was actually caught on camera. i'll have that picture in a minute. this happens between 6:50 and 7:00 tonight. the good news, no injuries and no damage. so let's get a look at the first photo coming in. you can clearly see the funnel starting to drop out of the cloud. definitely some upper level dynamics. some twisting in the atmosphere. but watch the evolution of these pictures. as the second one starts to come in here, it's more this rope-like figure which leaves me to believe this is likely a cold-air funnel. a little bit weaker than a tornado, but it could still be classified as an ef0 or some sunshine. even a little bit warmer in the south bay, the wind will start to pick up as well as the latest weather system starts to clear out. also, 70 in gilroy and 67 in palo alto. if you're outside, that sun starts to breakthrough the clouds. that's 69 along the creek. it will feel like the low 70s. 64 for you and plenty of 50s at the coastline. speaking of san francisco, yes, it is the
