That attack happened earlier today in the Bay View District as her family members and strapgers watched in horror. Nbc bay area is live at st. Francis hospital where the victim is being treated for serious burns. Monte, her family hoping that she will pull through. Reporter kris, thats right. The victim is here at the burn unit. Family members tell me that she remains in Critical Condition tonight. In the meantime, police have identified her boyfriend as the prime suspect. And he is still at large. I just want to know why he did it. She didnt deserve it. Reporter family members and other witnesses watched in har reporter this after as the man identified as 22yearold Dexter Oliver threw a famable liquid on to his girlfriend and then set her on fire. Pieces of the womans burned clothing were still laying in the street when her sister shs precious craig, described to us what led to the attack. She said that he had to get out, that it was over. And she left the laundromat. Ten minutes later, she was burned. Reporter family members say they had been date for six months and had a rocky relationship. Today were told they were arcing as they returned from the laundromat down the street and were near the victims house when lamar told oliver the relationship was over. Oliver allegedly returned to the house to get some gasoline. He let her know he was going to burn her. Reporter engulfed in flames, lamar ran almost a block toward her home screaming. Later at the hospital craig says the burns on her sisters face and chest were so severe she didnt initially recognize her. They argued and stuff a lot of times but i didnt think it would go this far because couples are going to do that. Heres another look at the suspect Dexter Oliver who police say attempted murder charges. He is 510, 155 pounds and he has a hair cut with a lightning bolt on one side of his head and fish designs on the other. If you spot him, call San Francisco police. I talked to the family not long ago and they say lamars condition is critical. She is unconscious. But she is also attempting to move. So that at least makes them hopeful. All northbound lanes were shut down near the high street exit just until about 10 00 tonight. Police say the driver hit the Center Divide around 8 00. Then the man got out of his car and ran across several lanes of traffic. He was struck by several vehicles and killed. A safety expert says that if you are in an accident drive off the highway if you can. If you cannot, stay in your car and turn it off. Officers say resist the urge to get out and get help to avoid dangerous and potentially fatal conditions that could affect your safety. It was a race against the clock as a dive team in a south bay searched cold and murky waters for a woman whose car crashed this afternoon. It was on the expressway in san jose. Reporter kris, emergency crews were out here for three hours today. Once the woman was taken out of the water divers went back in to make sure there were no other victims. San jose fire say they got it at 2 00 this afternoon. Lost control and plowed through fence and ended up submerged in a water. Its possible the driver was trying to make it off of the highway 85 on ramp but missed the sharp turn. When firefighters arrived one of them without proper dive equip m went right into the water to try to save the driver. They did jump in, swam out about 20 yards. Went down about eight feet into basically zero visibility water. Said he was able to locate the vehicle however he could not make entry or see anything. Had to get out of the pond. Reporter the cold temperature made it impossible to do much until the Santa Clara County sheriffs dive team arrived. Kudos to the dive team to get out here so quickly and at least give the occupant of the vehicle a chance. Reporter Emergency Responders were hoping there was still a chance to save the woman, who by then had been under water for 42 minutes. Paramedics performed cpr on the way to the hospital where she died. Authorities say no one else was found inside the car but divers went back in to look around the vehicle just to make sure. There were no other victims. Police are not releasing the identity of the driver and say right now they are still investigating the cause of the crash. Oakland police say they have located gloria g. Theyre not saying where they found her or what led them to her. Her husband reported her missing on friday when she didnt show up for work. He said he suspected foul play. San jose police are searching for the first homicide is speth in 2013. They were called to the 1900 block of tripoli avenue this morning just after 8 00. They found a body in front of the house. Police say the unidentified man was shot in the head. An ambulance arrived, paramedics then pronounced the victim dead on the scene. Now we have witnesses, witnesses meaning people who were in the house that may have possibly heard something. They are now being talked to by some of our homicide i imagine vest gators. Police say the victim was in his 30s and wasnt related to the people who live inside that house. They dont have a motive for the shooting. There were 46 homicides in san jose last year. More than any year since the 1990s. And on the Peninsula Police are investigating the shooting of 16yearold girl. The tooen was shot saturday night in millbrae across the street from cappuccino high school. It is a rare instance of gun violence in a relatively quiet area. The girl is in stable condition. Police dont know what pro veked that shooting and so far have not made any arrests. Restaurant and bar owners near the shark tank are breathing a sigh of relief tonight. The nhl lockout is finally over and that means hockey is returning to san jose. A deal was reached just in the nick of time because we were just weeks away from the whole season being scrapped. You lose trust in teachers and you just dont know who to trust. Reporter Police Identified their daughter as one of the five children sexually assaulted at school by teacher craig chandler. The alleged abuse came to light after another parent called police. A jury convicted the schools principal last month of failing report the allegations of abuse to police. But we uncovered a federal law was also violated by the School District. One thats supposed to be enforced by the department of education. Its called title ix. The law require the schools to have policies in place and a trained title ix coordinator to handle abuse complaints. The coordinators Contact Information must be made public. We found at the time of the allegations, the School District wasnt following this law. Do you believe that some of the children would not be victims right now if the School District had simply followed the law . Without a doubt. Reporter they are bay area attorneys, separately representing alleged victims and several cases against evergreen and chandler. We showed them what we unkoefred. Had they paid attention to that which they are obligated to do, we wouldnt be sitting here talking to you today. Reporter the principal said she reported the alleged abuse to the district. Namely the Human Resources director carol schmidt. And was told to handle it on her own. Schmidt then testified she had not received any training on how to handle child sexual abuse in 17 years. But according to the district, schmidt is the title ix coordinator. In this instance, the information was conveyed to a title ix coordinator and the appropriate action was not taken. Far from it. Reporter a title ix coordinator with no training and no knowledge of how to process these serious allegations. Plus, her Contact Information wasnt published online. That is, until we told them about the requirements. The website is now updated to include Contact Information for a title ix coordinator. I think its a colossal failure of evergreen not to conduct an investigation when it had complaints in its hands involving young children. Reporter she is with equal rights advocates. She has also filed a we quest for information from evergreen asking for proof its following title ix. She is still wait for answers and so are we. For the past two months the district has dodged our questions. We met up with superintendent kathy gomez outside her office. Weve been trying to get in contact with you for more than a month now. I think i directed you to our attorney. And he has not answered any of our questions. Im sure he will. Again, we have not had any of our questions answered. Why cant you answer simple questions about what your policy is and whether or not anyone has been trained on polity ix . He will answer those questions for you. Do you not know those answers . For educators to stick their head in the sand about sexual abuse of minors and the application of title ix is a real problem. James holmes shown here in a Previous Court appearance is charge with killing 12 people and injuring 7 others after he opened fire on a theater in colorado last summer. Tomorrow prosecutors expect to publicly disclose evidence against him for the first time. The judge will then determine whether to send the case to trial. Holmes faces the Death Penalty for murder and attempted murder. The battle that is brewing over the debt ceiling could be bigger even than the fiscal cliff showdown. Republicans want to link raising the limit to cut the medicare, medicaid, and other government benefit program. We would need to raise the debt ceiling but if we dont raise it without a plan to get out of debt all of us should be fired. There are still deductions, credits, special treatments under the tax code which ought to be looked at very carefully. Democrats say the tweets to the tax code could save some money but president obama says he is willing to consider spending cuts separately. However, he says he wont bargain over the governments borrowing authority. President obama did sign into law a 9. 7 billion bill to pay for Flood Insurance claims from victims of Hurricane Sandy. The law increases fee whats borrowing authority. The agency previously warned that it would run out of money without the extra funding from congress. The white house said more than 100,000 flood claim payments from sandy would be delayed without the additional money. Congress has promised a vote on a comprehensive sandy aid package on january 15th. And back here in the bay area. High tide just before qu this morning close to seven feet. P if youre on the coast or on the inner base, places around mill valley for sure you will have to watch out for that wednesday morning as we can see localized flooding there from unusually high tides. Thats going to bring cooling temperatures, a chance for showers and lowering snow levels by thursday. Could be as low as 2 to 3,000 feet.
