A peninsula restaurant that thought it would have to close tomorrow has been given a new lease on life. Mikes diner bar has been in palo altos midtown for three decades. But a day late rent payment put their business in jeopardy. And thanks to Community Support and a new deal, it staying open. Reporter this restaurant has been a fixture for 29 years but this summer the owner found his future and the restaurants up in the air. Mikes diner bar was supposed to say goodbye to palo alto for good on monday. This all started in july when the owner said he paid rent one day late, which spiralled into the eviction notice he got from the county. It was kind of going back and forth. At one point i was just ready to say forget it. Reporter last month he said he was three days late on rent last year so he signed an agreement with the landlord saying he wouldnt be late again. He said he was late delivering his july rent check because he was at the hospital with his daughter. The Community Rallied around him with more than 1,400 people signing a petition to keep the restaurant and local leaders, including the mayor, throwing their support behind mikes. Id been in the business for many years. Reporter still, mike said he was preparing to pack up the restaurant. At the 11th hours we were able to strike a deal and something that we can both live with so were very excited to get the word out that were staying. Reporter the Property Owner confirmed to us an agreement was reached to avoid eviction. If we were to lose mikes, it would have been devastating to the customers, to the other merchants of midtown. Reporter mikes friends and customers are breathing a sigh of relief. They say it important to the neighborhood to have this walkable gathering spot. Were just absolutely delighted that hes going to stay. Reporter he is grateful for the Community Support and he says hes now automated his rent payments so he wont miss another one. In palo alto, nbc bay area news. This train ride will be closing out a major chapter of our history. Reporter bart is moving forward into a new era. They closed out their last scheduled ride for legacy trains. Starting tomorrow riders will only see fleets of the future trains. And starting tomorrow morning, riders will see changes during your next trip, including shorter wait times. Its part of a plan for a postpandemic community and ridership. They say no rider will wait more than 20 minutes for a scheduled train. And there will be improved weekend and evening services. Service on the yellow line will also be increased, which is the busiest weekday line. They are aimed at increasing ridership. Right now service at every 30 minutes will change to 20 minutes. Reporter bart says its legacy trains might be seen on occasion but that would typically be for events. Tonight the highprofile race to replace retiring senator dianne feinstein, governor newsome told chuck todd he would make an interim appointment. You would not appoint anybody on who has filed for this race. It would be completely unfair to democrats who worked their tail off. The election is only months away. We hope we never have to make this decision but i abide by what i said very publicly on a consistent basis, yes. That decision to appoint a black woman but she is trailing behind in polls behind adam schiff and katie porter. Congresswoman lee said in part, i am troubled by the governors remarks. The idea that a black woman should be appointed only as a caretaker to simply check off boxes insults countless black women across this country who have carried the Democratic Party to victory election after election. And kristenwelker will be the new moderate are oo. And the Sheriffs Department hosted a day of remembrance. Religious and Emergency Service leaders spoke. The focus was on the hundreds of First Responders killed when they ran to help the victims. And a memorial for flight 93. Among those on board, two graduates who are now considered heros. Reporter for this town, september 11th is especially painful because they lost two High School Graduates during the terrorist attacks. You can see this memorial honors them. Extraordinary acts on behalf of ordinary people. They came to remember those lost on a day few can forget. More than 150 people gathered to reflect on the deadliest terror attacks on u. S. Overseas rescue efforts continue for people who may be trapped under rubble from the deadly earthquake in morocco. The death toll as climbed to more than 2,100 and another 2,400 people were injured, including americans. The 6. 8 magnitude quake was moroccos deadliest in more than six decades. They are sifting through heavy debris trying to find survivors. Doctors without borders said it is prepared to respond to the earthquake. Experts say the first 72 hours after a disaster like this are critical. Its been more than 48 hours since the quake hit. So today may be the best chance to find survivors. Police say a man waved a pick ax just before 9 00 tonight. The man took off before officers arrived. Police are trying to track down that man. Police need your help finding this man. They say gabriel andress ruiz is connected to two attempted burglaries. They say he tried to enter a home on big ben drive and while police were searching for him, another homeowner reported someone broke a window trying to get into that home. Police say security foot and confirmed it was the same man. Andress ruiz was wearing orange flipflops given to inmates. Police say he was recently released from jail. It is business as usual in the south bay after crews fixed a water main break overnight. Businesses were forced to close as the water was shut off. Water was restored early this morning. Reporter this is something where both Public Safety and public many are at stalk. On your phone bill you pay a 30 cent 911 surcharge. It doesnt seem like much but with every california phone user paying 30 cents per line every month it all adds up to nearly 200 million last year alone. We found as this money continues to balloon, the agency in charge of managing it is falling behind. 911 calls going to busy signals. Unbelievable. Reporter others just ringing and ringing. Translator i called the police so they could help me but they didnt answer. Ringing, ringing, nobody answer. Reporter frustration with out of control crime, one man rammed his tow truck into an suv to save a woman from an armed robbery. No one should have to live in fear in america. Reporter californias standard is to answer emergency calls within 15 seconds in order to receive state 911 funding but oaklands average answering time is nearly a minute long, the second worst in the state. Last year oakland had more than 50,000 abandoned 911 calls, meaning people called but hung up before an answer. That number doubled from the year before. Extortions, vandalism, prostitution, drugs. Reporter we first spoke with alan about oaklands crime and 911 calling system crisis. Driving through east oakland, he says he has since closed his auto shop. I had a staff that got carjacked right in front of the shop. We didnt even make a 911 call. Reporter why . Because we know whats going to happen. Youre going to be on hold. Reporter civil juries hold the city responsible for the Communication Systems downfall. Although state and federal agencies cant take enforcement action, they are supposed to monitor 911 centers. The states manual says its a mandate, which isnt being carried out, we found. In its regular performance report to the California Office of Emergency Services, oakland said it received 1,200 911 this past february and then zero calls in march and then nearly 27,000 in may, adding to the citys confusing numbers to the state, this recent civil grand jury report says oakland received over a million 911 calls last year. But to cal oes, the city reported just a quarter of that. That is concerning we need timely, accurate data. Reporter brian is the spokesperson. As part of our role for the government is to monitor whats happening across the state. Reporter whats at stake . Everything. Knowing whats happening in the field, in the public and to your loved ones on the street. Reporter what are they doing to enforce proper reporting . We have some ability to push and pull as a service function, but ultimately thats going to come down to locals. Its their responsibility to provide timely, accurate data and serve the public. Reporter then whats the point of a mandate or a standard if time and time again it is not met or enforced . There is followup thats needed, it sounds like, to make sure folks get the support they need. Reporter over the past decade californians paid over 1 billion into 911 systems through taxes and that surcharge on our monthly phone bills. Since the government made updating 911 a priority, fees have skyrocketed. They are supposed to make sure the money is distributed fairly and make sure it isnt wasted. We found they have reporting issues of its own. In its recent 911 fee report to the federal communications commission, they said they conduct a fiscal and operational review of all 911 call centers in california, on average about every other year. But we found thats not the case pap cording to this cal oes report last month, its only completed 22 reviews this year, two all of last year and zero in 2021. This is out of roughly 440 Emergency Call Centers statewide. For weeks we tried following up about its gap and reviews but the agency never got back to us. A spoke person said the fcc does not oversee how 911 call centers are regulated under state law. They cannot compel jurisdictions to provide all was in requested. As for oakland, for more than two months and after more than a dozen emails and calls to all of these oakland officials, none of them agreed to sit down with the Investigative Unit and talk about the citys 911 problems. They cited a formal civil grand jury response process they say they need to poll. But when thousands of 911 callers impacted by this problem every month, our raj mathai raised the interview. Obviously 911 callers are unacceptable and my administration will be tackling this inherited issue with urgency. This is not anything new. Ive been sitting here for at least eight minutes. I cant imagine that nobody has called you guys. We have the call. 911s been backed up. I do apologize for the delay. Theyre making the city like its a joke. Thats how i feel. Outside of individual jurisdictions, there is no state or federal regulation of 911 centers. They are locally enforced and as a result operationally fragmented while every year the state both collects and determines how much we way pay into the system with our phone bills every month. No one from the city of oakland agreed to sit down with the investigative mentioned, the mayor brought it up during a Community Safety meeting this weekend. Yes, we need to do better with our 911 responses. So stay tuned tomorrow or actually monday, i will be announcing something in regards to how we approach that to solve the actual call rate so that when youre calling 911 you dont get a busy signal. I called 911 and got a busy signal and that was me calling as the mayor, too. Thats a problem where youre on the phone for two minutes, thee minutes, thats a problem. We see that and were going to address that. Our unit has been following the 911 system since july. Well update you tomorrow if and when the Mayors Office does make an announcement on dealing with the 911 problem. And if you have a story for our Investigative Unit, call. Tens of thousands came out to Mountain View this city for the huge art and wine festival. Artists, craft makers, performers, food vendors. This marks the festivals 54th year. They had some pretty good weather this weekend and thats going to continue for tomorrow but then a little bit cooler as we head through the middle of the week. So lets talk about some minor changes ahead oaf the next few days. Were winding down from that weekend where we had some beautiful weather over San Francisco and were seeing a lack of fog right now here at the bay bridge. Thats going to eventually roll back in in time for the morning commute but right now it is clearing out. We talked about those changes for bart in the morning. You may want to get out there a little early to see how things are going. Were starting out with temperatures in the upper 50s. Its going to be a mostly cloudy morning. As we go throughout the day, its going to clear out by about 11 or 12 00. And as we zoom into the south bay, we look at our highs for tomorrow afternoon reading 85 in coopertino and well need the air conditioning for a little while during the afternoon as you make your way inland and the east bay. About the same in oakland and in hayward, 75 degrees. Much of the inner bay is going to be pretty mild with parts of the peninsula in the low 70s, san mateo reaching 71 and 66 in daly city and back to the 60s and low 70s in San Francisco, the Mission District reaching 71 for mill valley. Expect a high of 77 degrees and in the 90s. The valleys are still pretty hot. Then we get ready for a transition to some slightly cooler temperatures and as that happens, well see those winds kicking up. As we go into tomorrow afternoon and the evening, 20, 30 mileanhour winds especially in San Francisco and along the coast. The areas in red may have some high winds and this time of year, any time we have some high winds, you do have to worry about that fire danger so were watching out for that. But its also coming along with some cooler temperatures that well see as a series of storm systems move across the pacific northwest. That will continue to give us an onshore wind flow and bring temperatures down. One more day of warm temperatures and then we see a bit of a break for spots like gilroy throughout much of the next week. Temperatures in the upper 80s on monday, just a little cooler on tuesday. But notice these temperatures arent changing all that much. Were mostly mid to upper 80s and then a slightly cooler weekend while San Francisco will be in the upper 60s and low 70s. New york is getting ready to honor the thousands killed and Emergency Responders are reflecting on their experiences. Two detectives are part of the nypd renowned Emergency Service unit. Both say they did not expect to survive. In fact several members of the unit never came home that day. It is a daily reminder of the dangers, the sacrifice that the job carries. 25,000 people were saved from that building that day, and they got to see their kids grow up. Have grandkids, whatever they did in life, they got to do that because of the efforts from everyone put forward that day. It was heroic with the cops, firemen, port authority, ems and regular civilians who worked in the building, they helped. The 9 11 Memorial Museum will be holding a ceremony at 8 40 in the morning. Meanwhile, a new york native is fighting to bring attention to those who died after the tragedy. Back on september 11, 2001, she was in fifth gade. Grade. Her dad responded to the attacks, survived but died from illnesses afterwards. Heres andrew sieve zif. Reporter Bridgets School day on september 11, 2001 was surreal. Kept getting pulled out of school, pulled out of school all day. The population was very blue collar. All these kids parents were likely here. Reporter bridgets dad billy, out Ladder Company 174 had responded to the 9 11 attacks j my mother picked me up. And she said, i asked her, whats going on. She told me, and shes like, daddys okay. So it was, like, this happened. Hes okay. Reporter a relieved little girl. But, as she went home from school, a realization something was not okay. There were papers flying all over the sky. We grabbing them out of sky and putting them in a bag. Reporter four years later a warning sign. 2005 when we see people getting really sick. Reporter and a decade after that, the aftershock. In 2016, december, he was diagnosed with Bladder Cancer and passed away the following june. Reporter bridget and their three brothers and mom devastated. If i didnt know at daughter of a First Responder whose parent got sick and died, nobody nose. Reporter bridget began traveling with advocates to expand health care for First Responders. Jon stewart credited with convincing congress. They did their jobs. 18 years later, do yours reporter bridget recording all of it for a documentary film called dust. Thousands of people have become ill or died from causes related to the attacks. Reporter her take away from the project, the experts should have known better. Doesnt really take Rocket Science to know how bad it was. When you hear the composition of what was in that dust. Benzene, chromium, jet fuel, pulverized concrete. All these things alone are carcinogens. Reporter educating others now her lifes mission, as the 22nd anniversary approaches. The new calculus, the impact of that day may reverberate for generations. A resident over here in battery park city, a newborn and was exposed, they have to have their life covered so they dont have to bear the burden of financial, medical expenses. As we go throughout the next several days, well see temperatures coming down a bit, but were not going to see anything really significant happening here except for a nice cool weekend ahead. Next weekend were talking about in spots like walnut creek, upper 70s for highs. Lets take it back to the tropics. Were keeping an eye on hurricane lee. It was moving so slowly as it moves farther to the north over the north of the caribbean, and staying out in the atlantic. This is expected to curve to the north and stay out over open water, but this will remain a major hurricane over the next few days. So were now at september so. 10. Its the peak of the season. And weve made it to margot. You may be wondering what happened to jova. That storm has weakened, fizzled out. But the moisture spread. It has pushed to the south.
