Abc bay area confirmed smith is facing another lawsuit. This stems from a party that he hosted last summer at his san jose home. This new lawsuit reveals new details about al kbaglegations drugs and gang activity. Tony broke the story this week and has exclusive new information tonight. Ive been focussing on football. Reporter while aldon smith was answering questions about the first lawsuit, the second was filed in santa clara county. Like the first, smith and former 49er walker are named as the defendants. This time the accusations come from an attorney for aaron reyes. It says reyes is a friend of the plaintiff in the first lawsuit. Reyes says like a sporeless he received catastrophic and permanent injuries. Both lawsuits paint add similar picture of the events of june 29th and june 30th at smiths 8,000 square foot home in the East San Jose foothills. He accuses smith and walker of knowing gang members were at the party. It says during the course of the Party Defendants became aware there were gang members and persons armed with weapons at the premises. The lawsuit also claims smith had recently hosted similar parties at his home. It reads defendant smith has already established a pattern of having wild parties at his house. The legal document says the party was advertised widely including the internet. It says drugs were used in an open and notorious fashion at the party. Smith and walker charged patrons for drinks including serving an alcohol concoction they named as jungle juice. The lawsuit requests that the court determine the Amount Awarded to reyes. Just ahead in about 15 minutes, well hear from the 49ers and the raiders as they gear up for sundays nfl opener. Dave will join us for a special edition of xfinity sports sunday. A mother killed in a San Francisco park this afternoon and a city worker in a city vehicle ran her over in front of her baby. They screamed for the driver to stop but he took off. This unfolding at holly park. Jean elle has the latest from San Francisco and that driver is in jail tonight. Reporter jessica, that driver has been arrested on suspicion of felony hitandrun. People who live here are stunned by what happened in the park. There is a memorial of flowers growing in the very spot where police say a 35yearold San Francisco woman was here on the grass with her baby and dog when a rec and park driver drove on the grass and killed her. The park was killed with people and pets around 2 20 this afternoon. The park worker in a green pickup truck was driving on the path and turned onto the lawn and drove over the woman. Her baby and dog were not hurt. Witnesses say the driver kept driving away as people yelled at him to stop. Regular park goers say the tire tracks in the park are proof rec and park vehicles drive on the lawn often, and they always worried someone would get hurt. Its a tragedy. That is not paying attention. Being out of control doing what they want to do. San Francisco Police did catch up with the rec and park worker minutes after the woman was killed. Hes under arrest for leaving the scene of an accident. Hes cooperating with investigators and will be tested for drugs and alcohol. Rec and park is not identifying him but says hes been with the department for more than seven years. The victims husband has the baby and animal care and control has the dog until the family is ready to care for it and the investigation why and how this happened continues tonight. We have more details in the murder of a san jose mother and Elementary School employee. The body of Rana Figueroa was found. Police arrested the man but wont say who it was. Marianne has information how she may have died. Shes inspiring. Reporter Manuel Figueroa cant believe his mother is gone. She was found dead in her mini van. Her husband francisco was the first to find her. He says his wife neck had been slashed. San jose police say they have arrested a man in connection with the murder but police are not revealing his name, only that he was aquatinted with rana. Manuel says police have not told him who the suspect is, either. He says his mom was an inspiration. Herman f main focus in raisi was to go to school, and she would attend all the meetings and make sure me and my brother were on the right track toward our education. Reporter ranas husband of 23 years says she was a wonderful wife and devoted to their sons. For the past 1 two years she worked as a yard duty supervisor. The students love rana and miss her. Reporter grief counselors were on staff to help cope. Many expressed feelings by creating this sign. Manuel says his mom loved working with the students and cant imagine who would want to harm his kind and giving mother. Were trying to push through the hard times that were going through right now. Reporter police say the District Attorneys Office is now reviewing the case, and they do expect to release the suspects name at a later time. Reporting from san jose. Marianne favro. Mountain view plus are searching for a woman using a fake id to scam people out of money and may be wanted across the state, as well. Police released this picture of the suspect. Police say she was able to use a stolen credit card to get cash, then she went to a second back on san antonio road and left emptyhanded when a teller became suspicious and delayed the transaction. She may have use add fake id in southern california, as well. Tonight one is dead following a Home Invasion that turned into a shoot out. Police were called to a home on the 1500 block of lodi. Three suspects entered the home and shot a man. That man is expected to survive but managed to shoot back hitting two of the three intruders. One of those died. Police arrested the other two. The motive of this Home Invasion is under investigation. Were currently interviewing several witnesses and sifting through evidence. Several search warrants are being sought to understand the motives. This was not a random robbery, that home was targeted. Three weeks later, we have an answer, investigators say a hunter started the devastating rim fire burning in and around yosemite. They say the hunter, whose name has not been released, started an illegal campfire in the national forecast. No decision yet on whether charges will be filed. The fire is now 80 contained. Its burned more than 370 square miles, and its one of the largest wildfires in california history. So far, the cost of fighting this fire is 77 million. Pg and e announced the opening of a state of the art complex in san ramon to help prevent disasters like the one in san bruno three years ago. It will be a nerve center for the natural gas system. It is designed to give engineers information about the entire natural gas system. Pg and e says the center went online last week. The opening comes almost exactly three years after the pipe explosion in san bruno that killed eight and destroyed a neighborhood. The center cost 38 million to build and oversees 7,000 miles of pipelines. Nearly 250 people are assigned to work at the center on a 24 7 basis. The Grand Central station of the west and celebrate the the first concrete floor of what will be the transition of the Transit Center in San Francisco. House Democratic Leader Nancy Pelosi and ed lee were among the speakers praising the project. Construction of the Transit Center began three years ago. When its done, its set to house 11 transit systems including the future high speed rail that will connect eight bay area counties. Organizers say the project created 2400 construction jobs so far and more to come. There will be 27,000 permanent jobs attached to this Transit Center on going, sustained, and thats why this Transit District plan was so important. Now the project, which got 400 million from the federal stimulus package is said to create a neighborhood with offices, parks, shops and hopes of a surrounding center as welcome pleated in 2017. The departments quarter pointed compliance director said opd must start recruiting officers from other sacities. They are fully trained. They can be on the street tomorrow. We dont have to wait, you know, six, seven months up to a year, two years to train someone. Reporter noel agrees recruiting from other departments makes sense but claims thats part of the solution. He says compliance director Thomas Frasier must address why oakland officers arent staying on the job. So for tomorrow, i dont think the south bay will be extremely hot by any means. San jose still above the averages, 87 there, 86 in palalto. Its the east bay that will see more notable increases about four to five degrees warmer than what we had today that means a few 90s. 91 along the creek and 87 pleasing ton. The key difference as we head throughout fridays forecast is those of you at the coastline and across the bay starting to notice temperatures into the unfamiliar category into the 70s. 10 to 15 days a year when those temperatures are in the 70s so that will be super enjoyable. 73 in San Francisco and 73 berkeley and 80 oakland. Overall, some of the hottest weather will build in throughout saturday. But youll find temperatures will be close to record setting but most notably for a lot of us, the biggest thing this will mean is it will get to the Dangerous Levels as we head throughout saturday and also on sunday, will be near record setting heat in concord with 96 and napa 95 and Mountain View 93. As you look at the sevenday forecast. Youll find those temperatures stay hot for sunday and also on monday. Then gradually we begin to cool off as we head throughout next wednesday and thursday and looks like some moisture could get close by wednesday and thursday of next week, mainly se lly sie thunderstorms. The issue is not a concern with the man who will be affected most or the man in charge of protecting him. You can only line 11 people up so many ways, so, i mean, weve seen a lot of different looks. Any defensive player will say they will tackle our quarterback and running back. Thats their job. Thats doesnt surprise me a bit. They would say the same thing about aaron rogers. Harbaugh does not expect a clarification from the league before sundays game and until he does receive one, he will speak to the game referees before kick off to determine how they will interpret the rules. You have a target on your back. And he will get hit. The thing i say is why would you want to do that when your back up is colt mccoy . I wouldnt want to do it, lo. Im running. I love this offense because you can do so many things. You do that, reed, that line backer has to either come up and feel that safety, step down and that tight end, that little pop pass builds over the top. I like this offense. Dont change it. If its not fixed, dont break it. You want him to get hurt . Im calling the 20 seconds. They sacked kaepernick three times. How did they do it . With great coverage, relentless pass rush and went after him. You see here this is a classic its a coverage sack. There is nobody open and got him by the ankles and great play by jones. When you have a limited amount of receivers, you have to have someone that can create opportunities and pryor can do that get at him trouble with his feet, you got to go with pryor. You know, it will be a good test on the perimeter because they will challenge us in the running game and passing game. It will come down to just us making plays. That sounds difficult because not only can he scramble, a lot of quarterbacks can do that but throw the run across his body and thats how big plays happen during the broken plays and find a way to keep him centered in the middle of the field. So what it shows is hes going to be a guy thats expected to be one of the teams top play makers on the field, but it also says they are expecting him to be a leader on the field and off the field. So i think it is big from that standpoint. Scott a backup, a backups backup tradeed to green bay or picked up by green bay. He knows the 49ers system. How much can he help green bay know what the 49ers are going to do, and how much do the 49ers have to change stuff because one of the ex quarterbacks went . Yeah, i think this is a situation where scott is the offense but the Green Bay Packers know the 49ers offense and what they will try to do.
