And while some may argue that a different standard should apply regarding the Senate's advice advice and consent responsibilities I believe the Constitution's provisions of fairness and due process apply here as well but he also. Said in this statement that he heard that the compelling from doctor testimony from Dr Ford was compelling and that he left the hearing with as much doubt as certainty yes so I think that statement really spoke to how Senator Flake obviously is that is torn on this nomination on on how to proceed and he is looking to split the difference a little bit here giving more time so that there is. So that Republicans can credibly say that we investigated this matter that we fully aired and looked at the story though that they heard from Dr Ford or from some of these other people the same time obviously being sensitive to Brett Kavanaugh as denial and his desire for this process to move forward and the president's desire for this process to move forward as quickly as possible and Judge cabin on in his testimony insisted that and basically that an f.b.i. Investigation wouldn't make a difference as far as a fact finding or. Additional testimony from anyone because of the letters that the witnesses the witnesses to the alleged assault of Dr Ford wrote to the committee saying that you know like. Mark judge saying I don't recall this or. So Judge Kavanaugh himself and the Republicans on the committee said. We don't need an f.b.i. Investigation because it won't it won't uncover anything new one affect the outcome certainly there are a number of questions Mark Judge of the other people who are at this party Dr Ford herself seem to raise the specter that her best friend the other woman who was at this party may not be participating in this sort of inquiry because of health concerns and so there are questions that she might be able to answer or new insight that an f.b.i. Investigation could bring to light she mentioned for instance when. When Brett Kavanaugh this friend was working at a neighborhood grocery store is helping her clarify her timeline somewhat and so you know this investigation could reveal more information that makes it more or less obvious what happened 36 years ago I mean I think what you've seen here is a real dichotomy and it was expressed by what Judge Kavanagh said in the hearing where he is sort of his Democrats of orchestrating a witch hunt against him that that's something that we've heard echoed by Republicans really actively and soul on the one side you've got somebody who says I didn't do this it was me. And you guys are trying to political hit job on the other hand obviously we heard extremely compelling testimony from Dr Ford who came forward told her story sat for questions for multiple hours and from the Senate there were no moments that cast any doubt on her testimony and so you have her and Democrats and some of these outside legal groups who are saying. What are some of the details from the lawsuit about this accusation so as you pointed out comments. From the complaint again these are allegations it sounded like you know Musk put this out there and even the company was caught flat footed and what the agency will need to prove in its case is that Musk was reckless in putting out that statement meaning that he basically should have known better that he didn't really have the funding secured or didn't have a reasonable basis to make such a statement I want to get back to something that you just said that this is a fairly quick can move considerably quick move for an agency that is a regulatory body that moves quite slowly and has been criticized as such so what is the sense of urgency here sort of peeled back that curtain and explain to us why they're moving so relatively quickly on this I think you know a couple things obviously the amount of attention this is is garnered. Is certainly you know not lost on the agency and secondly the amount of evidence needed to be gathered here is relatively confined you know is basically Ok What information did you have a conversations you have with the board you know was there any talk with investment bankers so it's a pretty limited type of limited amount of information they needed to to obtain to come to a conclusion to bring this to you know to bring this case what is the board saying about backing mosque Well you know the board has come out in support of of musk. You know you know we had just reported that they were close to a settlement but they in the company pulled out at the last. Minute so I think there is some concern from that side to basically you know even though they're not admitting that it was confident in the line and his integrity and his leadership of the company you know I think you know for a company gearing up to fight the f.c.c. That's the kind of statement that you know they're going to put out in support of the question now is you know now that these allegations are brought you know this is not going to be over any time soon you know litigation takes quite some time and you know that will weigh on the company you know the share price the board it remains to be seen if at a certain point they decide you know what this is not worth the overhang and then maybe they do they do find some sort of other settlement now let's talk about that for a 2nd because the move by the f.c.c. Certainly unnerved investors but didn't Musk's erratically behavior a nerve investors already Yeah and I think this is. You know kind of putting their you know sort of digging in that you know they're not you know they didn't have to file this this quickly right even if they filed it next week or 2 weeks from now it still would have been relatively fast so I think this shows the agency is taking you know is you know is it wants to highlight this case that they want to hold you know in their view. You know even a century you know C.E.O.'s to you know to that they need to follow you know proper securities laws what's next what should we be looking for is there is there or is there hearing scheduled on this you know there this is just been filed to how I believe they've just picked a judge usually in terms of like a hearing and that's you know a couple of weeks away you know we're obviously paying trying to pay attention to if this settlement was did fall apart you know obviously we're going to be looking to determine if that you know if those discussions have restarted or if that's changing mind or or how this plays out in the coming days and weeks and it's worth mentioning that the f.c.c. Is suing. Not tast explain the difference there and how that. It's not just semantics right you know it's a good point you know this is Moscow in his statements and capacity. You know we actually reported that the test the company test was also potentially involved in involved in allegations but that you know you know that could have be brought at a later time or maybe the f.c.c. Decides not to so I think the going after mosque you know they're going after his specific statements and not necessarily the culpability of anyone else at the company and remind us what else the f.c.c. Is looking into at Tesla. That's a good point as well we've reported that the agency had been looking at the company statements about Model 3 production way before this tweet that is a much more expansive investigation because they're looking at you know production statements you know was this Were you close to meeting these targets you know that's talking to a lot of folks talking to suppliers you know and that's looking at accounting numbers which is you know in a you know a bit squishier than just saying a funding secured tweak so that that's ongoing and also the Justice Department's criminal investigation into the street still still ongoing as well criminal investigation so. When they were retaliating steel tariffs earlier this year targeted bourbon why Tennessee why Mitch McConnell You know I didn't exactly sorry Kentucky the Mitch McConnell the the the Senate majority leader they also looked at Harley Davidson's and we saw you know all of the fallout that we had from that and the kind of battle between the president Harley Davidson when it started talking about relocating some of its Summers production so what we're seeing here is a trade war that's going to be fought on multiple levels and is not showing any signs of easing up well tell us about this announcement from the Chinese how does that card play out in all this. Well it's really fascinating because what do you what their reaction reacting to the Trump administration's raising of terrorists by saying Ok well you know you know unilaterally we're going to lower our tariffs on a whole series of products to the rest of the world and what's important here is that the people are going to benefit from this and we don't yet know the exact list of. Goods that they're talking about but it looks a lot like the rest of the world will benefit for this Meanwhile the u.s. Which has been targeted for retaliation and higher terrorists is is going to suffer so it's this is China turning to the rest of the world saying hey we're open for freer trade just not those guys over there in the u.s. You know that sort of leads to my what I guess I thought of as of his sort of way out of the box question which is if China is lowering its tariffs on the rest of the world isn't that a step in the direction that the administration says it wants trying to take in terms of lowering barriers in terms of opening its markets up to more trade Absolutely but what we've seen so far. In China has done this before earlier this year they announced that they were lowering tariffs on auto imports for example but as a result of the retaliation to the u.s. They then raised their tariffs on imports from the u.s. Of autos for a very specific reason so we're seeing this kind of there's this real gap emerging between the ability of European and other Asian companies and the access that they're going to be getting into into the Chinese market and the u.s. Market and we're seeing in b.m.w. This week said that its results are going to be hit by the trade war so why because it exports S.U.V.s from South Carolina to China what's the problem well China has slapped a 40 percent tariff on those S.U.V.s imports which means that other European s.u.v. Manufacturers who don't manufacture in the u.s. Are going to be able to have an advantage and and that means Audi v.w. And others are going to have an advantage in China. Meantime the president got Japan in in his sights for on the trade front what can we expect from that meeting so out of terraces is really the big issue in the bilateral relationship right now to remember the president earlier this year threatened to impose tariffs of up to 25 percent on imports of cars and car parts and Japan is a major exporter of cars and car parts to to to the United States and they're worried about that the president has also been trying to draw Japan into a bilateral trade agreement.
