Thats on the order of the federal judge whos been asked to dismiss that lawsuit. The des moines utility says it cost a record oneandahalf Million Dollars last year to run the equipment that keeps tap water below the federally mandated limit for nitrates. It blames the drainage districts for not preventing the nitrates from entering the Raccoon River in the first place. The federal judge says there are a number of questions about state law that could impact the federal case.
