I emailed them to the casting. Turns out he sent them nowhere, just across the hall to his own half sister. The same woman i auditioned for. We wanted to talk to her so we went back to the casting office to find her. That day, actors aid was Holding Auditions for a red lobster commercial. I had to tell these aspiring actors some bad news. What if i were to tell you we talked to red lobster and theres no commercial being made for that company . I knew it. She wasnt there, but she agreed to an on camera interview the next day. When we met, she didnt recognize me from my audition. I sat there. Yeah. Across from you. From me . From you. I asked her why instead of holding real auditions, they were being sold head shots . Hes no longer with the company. She told us she recently fired her half brother. She insists her Company Provides a legitimate service. The people who wait here for hou hours dont seem to know most of her lisings can be found elsewhere for free. It sounds like a scam for a commercial isnt being shot. A gray day. The car radio crackled at about 1 15 in the afternoon. A call had come in. She was supposed to leave and pick up my son at day care and she hasnt picked up her cell phone. It was a routine matter, or so it seemed. He met his partner at one hawthorn lane. I said, excuse me, are you ms. ElizaBeth Lochtefeld. She said no and pointed toward it is cottage. I moved around to the bay window and i looked in at which time i saw someone laying on the ground. He was looking at a crime scene. I told my partner we had somebody down inside. He kicked down the door and a body was on the floor, a woman stabbed to death. He had never seen anything like it and was hit by a wave of fierce emotions. From shock, to awe, then the Police Training kicked. With weapons drawn, we proceed to clear the house. It was all clear, but horrifying. There are signs of a struggle. Blood in a bedroom and in the living room by the body. The officer radioed in. I made the comments, just get here. It was his first homicide, but if he was a stranger to homicide, so was nantucket. There hasnt been a murder on the island for two decades. It doesnt happen here. It cant happen here. Thats the way it was until that day. Her name was elizaBeth Lochtefeld, but everyone called her beth. She was an unlikely victim. She was 44 years old. The successful businessman from new york who sold her company for profit and moved to nantucket. Beths brother, tom lochtefeld. I would be with her. He always felt like a little brother to me. I cant tell you how close we were. Tom went to private school and then columbia university. He landed a job as a broker at barney. He seemed to have it all with charm to spare. She called me on some corner of manhattan. I have to say thank you. Were having so much fun. Tom was smitten too from day one. He said shes an amazing gal. They started seeing each other regularly. Beth at 44 was eager for marriage and a family. Very soon there was talk of rings. Although beths brother says it was mainly tom doing the talking. Its my understanding that first day he said im going to marry you and she was like, yeah right. Beth may have hesitated as she learned more about her new man. He told her he had had drinking problems. Toms drinking hardly seemed like a deal breaker. I knew he had a drinking problem. She said i stood back and watched him and he was walking in circles smoking a pack and was just a mess. Beth wanted to introduce tom to her friends on the west coast. By then the two had been dated for six weeks, but the relationship was fraying. Beth was beginning to see a troubling side ining side of th. He would start drinking and get really ugly. You need to decide between alcohol and me. He would apologize and say, you know, i choose you and i want you. I dont want the alcohol. That week, beth invited her brother to meet her boyfriend. Perhaps she wanted his take on tom. First impression when you see him walk in. He had longish blond hair combed back and a double breasted blue blazer on. Very pompous, very i dont know. He seemed fake to me. That night over dinner, beths brother kept asking tom toolan what he did for a living. He couldnt really tell me what he did. Oh, im an investor. What do you invest in . He couldnt really give me an answer. Beths brother said toolan was drinking at dinner, but not in excess. Beth said she had seen him drunk and angry, but she never had seen her new boyfriend like this. He put her into a headlock and was walking down the street saying, i want to beat your head in. She went back to the apartment to get out of there. I wonder if i shouldnt have left that stuff behind and left another that toolan had been aggressive with one other woman. She says toolan tried to grope her. When they reached her street, she didnt wait around. I ran across the street. Beth lochtefeld was in a frightening situation with the same man. Instead of grabbing her stuff from toolans apartment that night, beth stayed. Beth told her things went from bad to terrible. Then he got very violent with her that night. He sexually assaulted her. And i think that beth was probably sort of in a state of its a confusing thing when it is somebody that youre supposedly close to that violates you. She was probably in a state of shock. Why she didnt leave that next day, im not exactly sure. By friday, october 22, duodays after the dinner with her brother, beth decided to leave new york. Friends and family say it was clear that she intended to call it quits with toolan. She left a message with her brother saying she was coming to spend the night. Tom toolan was not going to let beth go. He would not leave her. He followed her. She said i was standing there in front of this painting and it was incredibly dark and this painting reminds me of tom toolan. Thats the moment tom toolan picked to propose to her. He chose the most public place possible, the metropolitan museum of art. She didnt feel safe enough to say no. She said to him, i need more time. She was like, so upset because she sahe said its now never. She said . It has to be never. Toolan pursued her. He was screaming, im going to go get drunk with my friends. He hopped in the cab with her and they ended up back at his apartment. Beth called her brother. In retrospect he says, she sounded terrified. Her words were measured. She was talking very slowly and enunciating very clearly. She kept saying, im here with tom in the city and were trying to work things out. And i didnt even think to ask her are you okay or cough twice if youre in trouble or Something Like that. He had no idea his sister was in danger. I was sort of tired. I didnt want to deal with the breaking up making up kind of thing. Later from family and friends, he would learn the horrifying details of beths ordeal that night. It is my understanding he was holding her at gunpoint. He has no proof of that or other details of what went on that night, but he has pieced together stories from various accounts. He held her captive. She tried to get away. He was either drunk or tired. He ended up laying on her legs and going to sleep. To prevent her from leaving. Yeah. I understand she didnt even want to use the elevator because she was afraid the ding might wake him up. Yeah. It was around 4 00 a. M. When beth managed to escape from the apartment. Where was she going to go . Laguardia to get back to nantucket, her home. At 8 00 a. M. , beth called her brother. It would be the last time the two spoke. She mentioned she had broke up with him and he call ee eed 0 times since then. Did that raise any alarm bells . No, since she had just broken up with him. Tragedy was too short two days away. She called her friend leslie the morning she got back. She did say he has a gun and im afraid he might use it. Im not going to stay here tonight. Im going to go stay at my brothers house. Beth stopped by the Nantucket Police department to ask about filing a restraining order. For her to get to the point of stopping at the police department, that tells you all you need to know about what was going on inside of her. Yeah. I think she had very wellfounded fears, especially after the incident in new york where he held her captive. Beth did not file the paper work. She spent the night and the next at her brother peters home. She had fear that something would happen to her. On monday, october 25th, beth returned to her cottage in the morning, collected tom toolans clothes, parcelled them up, and returned them to him. She came in the yard and we were talking in the driveway. She was going to work on her computer. We were going to meet again around 1 00. Beth went inside the cottage to work. Thats the last i saw of beth. Barbara continueed to garden. A short time later, she was filling a wheel barrel when she heard a voice behind per. The voice said is anyone there in that house . It was a man. The man dressed in a hat and long overcoat was inquiring about Beth Lochtefelds cottage. I said i dont know. Something about him bothered her. I knew beth has been seeing someone and she more or less told me i think its over. I guess this is the boyfriend thats come back. He moved toward the cottage front door. She was uneasy. It was an intuition. Barbara says she called beths brother peter but couldnt reach him. She called beths parents, but couldnt reach them either. Beths car did not move. Then she noticed the shades in beths bedroom windows has been drawn. I had a bad feeling. Had a bad feeling. She called peter lochtefeld again and this time she reached him. I told him there was someone in the yard and i said, i think its beths boyfriend. He said barbara, lock your door. Dont come out. Call the police. It was then the Nantucket Police arrived at the cottage and made the discovery. Beth lochtefelds body on the living room floor. It was just weeks after she thought she found the love of her life and dreamed of a new beginning. For the lochtefeld family, life would never be the same. What did you lose on that day . I would have to say i lost probably my best friend and my confidant aside from my wife. She was my closest sibling in terms of i worked with her in her business, helped her run her business for three years. We always had a lot in common. We had the city in common. We had just we always got along really well. Leslie costello got a call that same day. When you heard the news, how was it told to you . He killed her. And i remember just being in shock. I didnt see it coming. I didnt know it was coming. I was it was shocking. You knew exactly who the he was. Oh, yeah. I did. Bernadette, the friend who played match maker, got the news from her husband. At first, she couldnt take it in. There was this big buzz going around that this woman in her 40s boyfriend flew in from new york and killed her. Im screaming, what . Tom toolan was arrested hours within the murder with bottles of beer and vodka with him. The Rhode Island State Police videotaped his arrest and recorded his voice in the cruiser. Toolan was held without bail and arraigned a month later. Bernadette could barely contain herself. It was the reality hitting me, sitting there, that this happened. This really happened. He walked in and it was like they were bringing in king congrekong, like a monster. I felt like it was my fault and shes gone. Toolan was charged with firstdegree murder and assault and battery with a dangerous weapon. He pleaded not guilty. In june 2007 while tourists wandered through old nantucket town, tom toolan went on trial for the murder of Beth Lochtefeld in a courthouse in the center of town. He pleaded not guilty. The defendant was as smartly turned out as ever. Looking like the successful executive he always wanted to be. The defense would argue that toolans polished exterior was nothing more than a facade. They would argue he shouldnt go to prison for killing beth. Toolans attorney began by hinting at the turmoil that lurked within tom toolan. He looked good. Certainly someone that doesnt look crazy to me. The master of the universe act was just that, an act. Tom toolan was plagued by drug addiction too. His drink of choice would be a fifth of vodka a day. When beth broke up with him, reddington told the court that toolan snapped. The evidence will show that Thomas Toolan was suffering from a mental disease or defect at the time of this incident. He was well within the Legal Definition of insane. Who better to tell the defendant about his problems than the defendants mother. She cited the sorry facts of her sons life. Was it apparent to you that he had an alcohol problem . Yes, when he was 16, 17. Battle with drugs. He got some prescriptions from the internet. She told the court that she and her husband tried to straighten him out sending him to rehab several times beginning in 1999. Did you at some point receive a phone call from your son . Yes. She described a conversation with her son two days before the murder. She was inconsolable over the breakup with beth. He said, shes gone. Shes gone. Shes taken all her stuff. She just he said i was asleep and she just left. The next day, sunday, the toolans went to manhattan to see their son. He was in terrible shape. His whole body exuded the smell of alcohol. The defense believed that established toolans state in the days before the murder. Now for the day itself. When toolan was picked up in rhode island, he has been drinking. Sobriety test put him at twice the legal limit. The. 30 where does that fit in . The next level of confusion and the stupor phase. Add how much did drugs play tom toolans life . He would take whatever drugs he would get his hands on . Such as. Paxil, zoe loft. Final the defense was ready for its knockout punch. A neuropsychologist. My opinion is that he has profound frontal executive dysfunction. He testified years of Substance Abuse brought about that mental defect. Because of it, toolan could not control his impulses, so the defense said he could not be held responsible for the murder. Its like the perfect storm. You have all of these swirling together inside this mans head. The prosecutors job was to blow that argument away, to argue that tom toolan knew exactly what he was doing when he murdered Beth Lochtefeld, that he was so enraged by the breakup that planned and carried out a cold calculated killing. I will present to you a timeline. As evidence of premeditation, security guards stopped toolan from boarding a plane to nantucket because he was carrying a teninch knife. When asked about the knife, he offered a series of stories. He said he forgot it was in there. He was having lunch with his sister in nantucket and she wanted him to bring a knife. The prosecutors presented evidence that toolan boarded another plane this time without a knife, but after landing, he went shopping for a knife. The prosecutor called witnesses who would testify that toolan didnt seem drunk. Thats what the clerk who sold him the knives testify. I would say he was sober. And the rental car agent at the nantucket airport. Was he intoxicated to you at that time . No. The prosecutor played a surveillance tape from the airport in massachusetts. Toolan flew into the airport after the murder arriving at about 1 15. Jurors could see him renting a car, walking out to get it, and driving away in a gray chevy impala. Youre able to see how hes walking. Hes not falling or stumbling. There was audio of toolan in the back of the cruiser after he was arrested in rhode island. You want to tell me whats going on . The prosecutor argued toolan was coherent. He was capable of thinking clearly and of distinguishing right from wrong despite the alcohol. And the prosecution also had a forens forens forensic psychiatrist whom they thought would deliver their own knockout punch. On that date, he did not have a mental disease or defect. So the prosecutor told the jury, tom toolan was criminally responsible when he stabbed Beth Lochtefeld to death. The testimony took nine days in all. As the summer arrived on nantucket, the surf and sea beguiling visitors, the stores be beckoning shoppers, the jury in toolans murder trial got the case. For the lochtefeld family going through it a second time was deeply disappointing and worrying. All of a sudden, she wasnt convicted of killing my sister anymore and he was, as far as i was concerned. For tom toolan, it was an incredible second chance. This time the defendant looked thinner than he had in the first trial and this time a new defense attorney argued the case. This is a why case. Robert opened with an admission that the First Defense team never made explicitly, that toolan did kill Beth Lochtefeld. What the jury had to decide was why. Its a difficult issue to look into somebodys mind and figure out what was going on in that mind. Was he a common control or was he not . Thats the issue. It was the insanity defense all over again dressed up a little differently. The real question is anyone willing to let somebody whos done something this horrific quote unquote, off the hook. The problem with their drug abuse, alcohol abuse, and underlying mental issues. In 52 days, 52 days from the time elizaBeth Lochtefeld met Thomas Toolan until he stabbed her 22 time ps. The prosecutor said tom toolan knew exactly what he was doing the day he killed Beth Lochtefeld. This time the trial was considerably shorter. Is he not guilty or is he guilty of murder . The jury has found him guilty. Guilty of what please . Firstdegree murder. Guilty again on all counts. Beths sister kathy read a statement in court. This verdict cannot bring beth back, but it does bring a measure of justice. For tom lochtefeld, it was satisfying even though the first conviction was the one that mattered. On that day we took a walk to beths grave site after the conviction and i just remember feeling that was a beautiful june day and it felt like, wow, this is finally im finally not upset to be here anymore. It was good again. For those who were close to Beth Lochtefeld, there is a real sense of closure this time. The trial behind him, beths father is back to work at nantucket. In his studio is the book he and beth worked on together. He illustrated her words and dedicated the book to beth and her dreams. The dreams she lived and those that died too soon with her.
