have been following and i think its silly. on the spur of the moment i went to walgreens and made up a sign. >> reporter: two people were arrested, they were protest laid leader who had mega phones and their faces covered with makes. the masks were taken off as they were arrested. they are charged with interfering with bart operations, that is because the protesting was inside the pay area. no word on any protest planned for next monday night. live in san francisco, ken wayne. >> hurricane irene is come and gone and now people along the east coast are left to deal with the damage. the storm killed at least 40 people across 11 states, millions are without power and officials say with all the downed trees and flooding it is going to take time to restore power. in new jersey anhaphia duty military trucks had trouble getting through the flood waters and in vermont more than 250 streets are under water. the president declared a disaster and promised that help is coming. >> i will make sure that fema and other agencies are doing all in their power to help people on the ground. >> reporter: some numbers put all the damage at about $7 billion and the president is warning it could take weeks even months to recover. that flooding in vermont took no notice of history, a covered bridge that stood for 140 years, watch this, gave way to the rushing waters of the williams river in rockingham. a photographer caught the final moments. one man said he never thought he would see the water get that high. others cried as they watched the old bridge get swept away. vermont lost two and killed inside a station during an attack in 1971. tonight a plaque on the flag pole was dedicated in his honor. those who knew him called him a goodman and a great police officer. >> his main show where it got the pipe and that's been a big problem. >> a judge in san francisco today heard arguments for and against unsealing videotapes of last year's proposition 8 trial. outside the court a same sex couple held up a sign urging the judge to release the tapes for public viewing. attorneys for the backers of proposition 8 argue they were never meant for public release and doing so could put witnesses who testified during the trial in danger. you may recall the trial overturned proposition 8. gay rights groups say releasing the tapes will let the public sea the weakness of the legal east bay carjacking led to a police shooting. police say four men car jacked a jag about 11:30 this morning. officers saw the car and gave chase. the jag crashed. one of the carjackers fired shots at officers who returned fire. nobody was hit. the alleged gunman and a second suspect were arrested. police searched door to door. the men got away. we are getting a clearer picture of a horrible crime witnessed by a 1-year-old. the killing of his father. we spoke to the widow and learned why two men targeted her husband. >> reporter: a crowd gathered to honor jose, the 39-year-old husband and four of two young boys shot in broad daylight in front of his 1-year-old son >> i can't believe this happened. >> reporter: as far as his widow and neice described how he could only watch from the karasch two men shot his father after he refused to hand over the $300 he had just cashed. >> -- through his pockets to take what he had. they were still laughing about it. >> reporter: a witness who didn't want to be identified said he heard the man screaming, a gun shot and then two young men rush past him. >> i just let them go because they had a gun. >> reporter: witnesses say he then staggered a few steps around this corner before collapsing where this memorial is growing. he later died. >> >> we hope we catch whoever did this. >> reporter: police conducted what they call high profile enforcement tactics to help identity suspects and are offering a 15,000-dollar reward for information leading to arrest. >> why would this happen? he was just trying to leave, he was just -- trying to care for >> the accused gunman in a drive by that killed a 3-year- old is getting more time to enter a plea. he made a brief appearance. he was supposed to enter a plea today in the death of the little boy but he was granted a two week delay. the alleged driver in the shooting, is being held at the county jail. is he scheduled to be in court tomorrow. a new effort underway tonight to try to end the death penalty. today mothers of victims joined hands with many follower supporters of the death penalty in sacramento. they are now launching a petition drive to try to put an initiative on the ballot next november. they say a study found the state spends $184 million more each year on death penalty cases compared to what it would cost if they had life sentences. >> it doesn't work. it's flawed because the process is become so expensive. >> reporter: if approved it would earmark a hundred million dollars over three years to agencies across the state. >> a bill aimed at slowing california -- the california governor's ability to grant clemency passed the house today. it's in response to the former governor reducing the senate of a political ally's son hours before leaving office. if signed a california governor would have to give at least ten days notice to allow a challenge to the decision. >> and one state its being called the worst flooding in 100 years. a live report on the challenges is now here in massachusetts where a man stepped outside of his home, didn't see a wire action a live wire down from the storm, he was electrocuted. if you are dealing death, people you know flooding or power outage in rhode island hurricane and tropical storm irene has left her mark in so many ways. water was frighteningly high. it was just -- >> reporter: rain swollen rivers flowing in to homes. >> you can see waves hitting windows. >> reporter: floodwaters wash away this covered bridge in vermont. residents are over run as the worst flooding in a century. >> cars and trucks that are floating down through. >> reporter: crews rushing in difficult conditions trying to restore power. irene knocked out lights to more than 7 million homes and businesses. >> whatever mother nature throws at us we are ready to go. >> reporter: this is a bird's eye view of the fooding in new jersey. pattern son and trenton the hardest hit. the governor of pennsylvania looking at the damage from the air. route 12 is sliced in five different lowations. the majority of the house is promising to send money . >> we said it's a priority and we will find other places to save so we can fund this kind of role that the government needs to play. >> reporter: while it may take some time to really know it's believed that damage from this storm could top seven billion dollars. >> thank you. to the south now irene first made landfall in north carolina. picture from the outer banks show clear evidence of the damage. it could be weeks before power is restored and the debris is cleaned up. the storm also washed up highway 12 to hatt era s, about 2,000 had decided not to evacuate and now have to rely on ferries. here irene's effects being felt at sfo where travelers have been stranded for days. many are having to come up with creative routes to get home. >> reporter: stuck at sfo some curled up on chairs in the terminal to get rest. a frustrating day. >> i stayed an extra day. everybody at work knows that i have to take a vacation damon because the flights were canceled sunday. >> just trying to get home. >> reporter: glenn and his familiar apply were supposed to be on a flight home to new jersey but never got off the ground. now he may have to get creative to get out of san francisco. >> the best they can do is get me out of here tomorrow to texas where i have to overnight and get on a flight to baltimore and then on my own. >> reporter: almost all the canceled flights were supposed to be going to the northeast. kelley and her son have spent the last three days trying to get home to new jersey after a san francisco vacation to watch tommy's favorite team. >> we are never going him. we will be here -- he is a giant's fan. >> reporter: their trips dragging on a lot longer because of irene and the extra nights at the hotel are starting to add up. >> the money is running out. >> reporter: there is no word on month canceled flights but many airlines are backed up. call ahead if are you traveling don't show up unless you know for sure your flight will take off. reporting from sfo. >> what remains of irene swept into canada causing more damage and possibly more deaths. montreal saw downed trees, and heavy rain. at the height of the storm a quarter of a million people lost power. two men are missing and feared dead. the storm system moved through very fast, through eastern provinces and conditions improved there quickly. it was six years ago that hurricane katrina made landfall in new orleans and today hundreds of people marched to the canal that failed and flooded the lower 9th ward . more than 1800 died and hurricane katrina turned out to be the costliest natural disaster in united states history. many homes and businesses that were wash away have been rebuilt. trying to land but didn't quite make it. he was taken to the hospital with a broken leg. two painters were outside at a time. they pulled him out of the plane but were hit by debris and had minor injuries. also in southern california adult film production has been shut down after an actor tested positive for hiv. the executive director of free speech coalition said the shut down is expected to when you get around our fringe inland valleys it's the upper 80's to mid80s, antioch, brent brentwood, the morning fog looks like this, a little bit more in here but you get the feel. it's real fracture and not a strong fog deck so it won't have the big impact it's had in the past. earlier burn off tomorrow i would suspect. temperatures just like they were today. very similar, maybe a degree cooler. after that temperatures start to go up. this week another week of changes but it starts off warm oval weekend, now its cooling down and then into -- wednesday and thursday, temperatures start to increase. back into the low 90s. again -- not one of these things, big change, it's this subtle change, highs to lows. in san jose tomorrow good air quality downtown. 80 degrees for daytime high downtown san jose, 80. not bad. 76napa. 80 vallejo. the temperatures about a degree or two cooler in someplaces than it was today. 85 in livermore. 74 castillo valley. in the heart of fire season we are dead smack in it, and it hasn't rained in a while. the temperatures have kept the fire danger at least much lower than we usually see so that's great news. 77 san mateo, 77 redwood, that's unusual. we usually even if it's not a bay area fire it's around lake tahoe, almost all this time of year a fire in california but we just don't have it with this weather. there is the weekend, it facebook. today a judge in buffalo declined to give him more time to produce thumb drives with evidence showing he helped create facebook. today's deadline passed without the data being turned over. leaders to consider putting up a fence. the pastor at the church said thieves took about 500 yards of many copper wire from outside the church. earlier this summer they made off with five outdoor
