And on friday state attorney Marlin Mosley six officers charged for the death of freddie gray. Sparking a National Conversation on crime. We begin in baltimore with abcs jim avila. Good morning, jim. Reporter the protests and marches continue here. Some large in size. Mostly peaceful. The real trouble coming mostly at night at curfew time overnight a curfew still in effect. More protests and baltimores Police Commissioner saying hell wait for the investigation to proceed. Now we have the confidence that the truth will come out and the truth will overcome for all. Reporter all of it sparked when baltimore stunned itself and the nation. Its youngest chief prosecutor in the country announced that she wants to put six of her Police Officers in prison for killing a poor black man. To the people of baltimore and demonstrators across america i heard your call for no justice, no peace. The city that went from riots on monday to celebrations by friday this is what democracy looks like. Reporter is patting itself on the back for standing up to what many see as an epidemic of Police Brutality. What is marching going to do . Marching got us to this point. Reporter the six officers, three white and three black accused of loading freddie gray cuffed and shackled face down into a police van leading to his death following an illegal arrest are free on bail and will appear in court on may 27th. Their Police Union Says they did no wrong and accused the states attorney of a political prosecution designed to quell the unrest rather than seek justice. We are disappointed in the rush to judgment given the fact the investigation has not been concluded. Reporter the union wants a special prosecutors appointed but she says shes from a police family. Both parents were on the force and she told me her office will not give up the case. My job as a prosecutor is to follow and uphold the law and that means equally applying justice to those with or without a badge. Reporter another protest scheduled for this afternoon. Baltimore authorities are reluctant to lift the curfew until theyre sure the city is safe and secure. Until then, the National Guard will remain on post and the state of emergency remains in effect. George . Jim, thanks. Our next guest has been marching in baltimore streets all week long. Congressman Elijah Cummings on thursday night. His west baltimore district, ground zero from this crisis. He joins us from city hall. Thank you so much for joining us this morning. What is the result of this week . I think we did pretty good. It was a very unfortunate incident with freddie gray, a young man who had died a very tragic death but as far as baltimore is concerned, i thought initially we had a lot of problems on monday, but i think overall its been a lot of peaceful protests and thats a good thing. As you know, those six officers are fighting the charges. We saw the head of the police union call it a rush to judgment. Are you confident these charges are going to lead to convictions and will we see new unrest if we dont . I feel very comfortable with regard to what ms. Mosley has done. She is a veteran prosecutor. Shes a young lady who has spent a lot of time addressing these kinds of issues and she is her integrity is impeccable without a doubt and i think she made the best decision she could. She looked at all the evidence and did what she had to do. What has to happen . You said members of Congress Said theyre worried their city is next. What can you do to prevent that . Well, one of the things we have got to do is we have got to invest in our cities and our children. A lot of young people feel that they have been disconnected and we have to have what i call a inclusion revolution. And address issues such as joblessness and training for young people. And we also have to look at our Police Department very carefully. We need to have an up and down look at it. And address it and be honest and address it in an effective way. A lot of us were struck by the cover of Time Magazine this week. It showed the city of baltimore striking out america 1968 and 2015. A lot of people say baltimore never recovered from the riots in 1968. What is it going to take to recover this time . Its going to take all of us, everybody from the president , the governor, all of us, the legislators and were going to have the Business Community and foundations. George, i can tell you people are already rallying trying to address these problems. And then again, were going to have to go back and make sure that we listen to our children. I feel their pain. Just the other day a young man told me he said, mr. Cummings i feel like im in my coffin trying to claw out of it. Thats not the way we want our children to feel. Boy, that is for sure. Thank you. The death of freddie gray, the latest example of what president obama called americas slow rolling crisis in the way police engage africanamericans. Pierre thomas went on the beat with police to examine whats happening now and what needs to change. Reporter the searing images, ferguson. A 12yearold boy shot and killed by police in cleveland. Eric goners death. I cant breathe and that Fatal Police Shooting of walter scott in South Carolina. And now baltimore. Ah a steady stream of events stoking a growing national movement. An intense debate about race and policing. With each case the intensity grows and the unsettling truth is that a toxic cocktail of factors that led to an arrest in baltimore exists in cities across the country. No racist police. High unemployment, high poverty and crime and mistrust between minorities and the police that serve them. All it takes is one controversial encounter between a Police Officer and africanamerican male to spark a firestorm of emotion and accusations. I think were seeing a paradigm shift. Its going to take a long time for us to rebuild from the distrust thats going on right now. People are thinking thats what we do right away, reach for our guns and start shooting when thats not the fact at all. The citizens are focusing on the negative which is a very, very small minority. Every day theres millions of encounters between police and citizens that go well. We spent time with officers in washington, 40 miles from baltimore. They say some of the issues between minorities and police run deep. The Police Department is getting blamed through the historic lens through which black people view police in particular. And today because police are agrif in in neighborhoods, the mistrust builds. Theyre not seeing us as normal human beings and just like them but have a tough job to do. Right now Better Technology including expanded use of body cameras by police and improved training of Law Enforcement on use of force are keys to reducing encounters that end badly. On both sides we need to listen to each other. Get out of the car, interact with the citizens and let them interact with you. Pierre thomas joins us now. Hes here along with dan abrams, our legal analyst and the former new york city Police Commissioner. Dan, these six charges came a lot faster than people expected on friday. More often than not, these Police Brutality cases end in acquittals. Yeah i think theyre going to have some issues with some of the charges. You have to look at each officers actions separately. You cant say theres six officers, were going to review all together. For example, i think theres been some overreaching on the part of the prosecutor based on the facts as she laid them out. With regard to two of the officers. Charged with manslaughter why . Because they arrive later and dont do enough. Thats going to be a tough conviction for manslaughter. The Second Degree murder charge for the driver going to be tough. Let me stop you there. This is a pretty serious charge. The most serious charge, Second Degree depraved heart murder. What does that mean . It means we think hes more indifferent, took action and didnt care at all. Theres no sort of firm legal line where you cross from manslaughter. To depraved murder. Neither one requires specific intent. It says we think this one is so much worse. The reason she thinks its worse is because he had opportunity after opportunity with each stop to end this. Heres the one i dont understand. I dont understand false imprisonment for the two arresting officers. But manslaughter . I would argue i think that the initial officers if they falsely arrested, if they had no evidence, i think theres an argument that theyre more than someone on the scene later. Takes a look at him and doesnt take action. One of the officers not charged with manslaughter. Ray, these charges are more likely to stick if officers turn on each other. But thats rare. It is rare. Its unlikely. They see it as not necessarily in their advantage. Now maybe an argument can be made for one or two in this case. My sense is that its not going to happen. The case is perceived as being weak. I think youre not going to see that much cooperation. You think its weak across the board . I think thats the general view of the case. Certainly by the Law Enforcement people that ive spoken to. How about the general issue of these Police Departments and the need for reform . You were on just a few weeks ago after that South Carolina shootings. You turned around body cameras. What are Police Departments going to have to do to get the trust back . Theres a lot of soul searching by chiefs throughout the country. I believe the police are more professional educated, better trained and more diverse than ever. These events totally can turn that around. We made great progress in the last two decades. Really starting from scratch. In a lot of places. I also believe that cameras will make a big difference. They will help. Theyre going to help. Moving in that direction. I think will increase the trust and Comfort Level over time. You agree with that . Body cameras are being used by Police Departments. They know they have to show the public what theyre doing. Also think theres going to have to be more training in terms of when to use Excessive Force and i think the Police Departments are going to have to take a look in the mirror and say they have to purge rogue officers, that these incidents, when shown on tape, are having a huge impact in terms of perception of police. Theyre going to have to deal with that. Brand new attorney general on the case loretta lynch. Expecting anything new from them . Well, the Civil Rights Division is investigating this case too see what happened. Theres calls for an investigation of the entire baltimore Police Department. I think you will see the president continue to speak about this. The fundamental issue is the pain and poverty in these communities. One of the statistics that struck me most, between 2010 and 2013 nearly 900 murders. Some years half werent solved. You cannot continue to have People Living in that condition and expect anything other than what youre seeing. And 17 other shootings unrelated to the protests. Thank you all very much. Is it time for a National Response to these issues . Certainly think that Law Enforcement is a local issue. The question is can we weigh in for the National Level and provide resources. I think body cameras lead us in the right direction. I say that because according to at least one study in 90 drop in complaints against Police Officers and a 60 drop in the use of force. I think it helps the officer do their jobs better and keeps the officer safe and at the same time helps to keep the communities safe as well. I think a part of the National Opportunity for us to provide resources is there. I would be very careful for the federal level to start figuring out how to have local policing. So we just heard the congressman talk about inclusion revolution. More federal investment. Ready to sign up for that . I have been working for the last three years on the opportunity agenda. Focuses on the power of education. I was once that kid that were talking about drifting in the wrong direction, flunking out of high school. I found my way through the power of education and faith. I will tell you if we focus on first and foremost educational opportunities. If you look at the statistics surrounding Educational Achievement and the communities in most distress, what youll find is that high levels of High School Dropouts which leads to high levels of unemployment which leads to higher levels of hopelessness. There is a trend that can be broken at its foundation if we focus first on education and then second, on work skills. Second part of the opportunity that i had been proposing for the last three years is to focus on apprenticeship programs. Myself and cory booker from new jersey have created a bill on apprenticeship programs. Earn while you learn. We can provide open opportunity in communities by helping folks get a better education which may include School Choice and skills for the work force. Theres this growing middle skills need in the work force where you need more than a high school education, less than a College Degree and you can earn a very strong income providing resources and opportunities in middle skill opportunity area. You have seen bipartisan calls for criminal justice reform. More drug treatment. Hillary clinton called for the end of the era of mass incarceration this week. Can you sign on to that . I have been a part of the working group from bobby scott in the house, to cory booker. Lindsey graham and the senate. We have been working for the last several months on different proposals. Im engaged in studying the patterns of who we incarcerate and why and what we can do about it. Exactly whats happening with boxing when mayweather is not fighting. You have got a lot of quality fighters and boxers in the sport. Globally its doing well. In america thats an entirely different story. We gravitate to the knockout and to the heavyweight division. If youre middle weight you need to have a lot of knockout power. Thats where the excitement of the sport really elevates. It doesnt exist right now. But you got mexican fighters like alvarez and you look at welterweight division. The middleweight division. Whats wrong when you have more income and equalty and a stronger middle class, a higher minimum wage than we do and stronger on the environment than we do . We do a lot in our country which is good but we can learn from other countries. We have the highest rate of childhood poverty of any country on earth at the same time as were seeing a proliferation of millionaires and billionaires. I dont think thats what america is about. Youre the longest serving independent in congress. You said you would remain an independent but prepared to file as a democratic . In my heart i am an independent and have been for 30 years. Im seeking the Democratic Party nomination for president of the United States and obviously im going to follow all of the rules and regulations to get on the ballad as a democrat. If you lose will you support the democratic nominee . Yes. I have in the past. Not going to run as an independent. No. I have been clear about that. Which ideas . What are the biggest differences between you and Hillary Clinton . It has a lot to do with our records. I think at a time when we have seen trillions of dollars shift from the middle class to the top 1 10 of 1 we have got to say very frankly that the wealthiest people of this country and largest corporations are going to have to start paying their fair share of taxes. Profitable corporations cant stash their money in the Cayman Islands and avoid taxes. Thats my view. In terms of Climate Change i believe this is the great Global Environmental crisis of our time. I think we need bold leadership. I have been leading the effort against the keystone pipeline. In terms of trade, i believe the trade agreements we have had from way back, normal trade relations with china have been a disaster. I voted against them. Im helping to lead the effort against the partnership so that we do not continue to see shutdowns of factories in america and the loss of paying jobs. Hillary clinton hasnt taken a final stand on that. Thats my understanding. You told my colleague that you have concerns about the money raised by the clinton foundation. What are the concerns . Its not just the clinton foundation. Here are my concerns. It should be the concern of every american. And this is in a sense what my campaign is about. Can somebody who is not a billionaire who stands for working families actually win an election in which billionaire supporting hundreds of billions of dollars into the election . Its not just hillary. It is the coke brothers. Sheldon anderson. Youre lumping her in with them . What i am saying is that i get very frightened about the future of american democracy when this becomes a battle of billionaires. I believe we need a constitutional amendment. To your turn citizens united. On our first day that we were out, we asked people to get involved in our campaign, 100,000 people signed up. 35,000 made donations to berniesanders. Wildstein claims he engineered the lane closures with two others in christies circle. A powerful political appointee and deputy chief of staff, both have pleaded not guilty. David wildstein is a liar. Nowhere on fridays indictments is christie alleged to have known about the plot. Based on the evidence currently available to us, were not going to charge anybody else in this scheme. Christie took that as total exoneration. Tweeting that make clear that what i have said from day one is true. I had no knowledge or involvement in the planning or execution of this act. Still the controversy has been a serious blow to christie once considered a leading president ial contender. The fiery christie first joked about the traffic mess. I worked the cones actually. Then admitted he was embarrassed by the alleged actions of his inner circle. I am stunned by the stupidity and i knew nothing about this. But Bridget Anne Kelly hinted there may be more to come. To suggest that i was the only person in the Governors Office who was aware of the George Washington bridge issue is ludicrous. Attorney is planning no further indictments. That governor christie knew about the crime. Do you accept that conclusion . Its hard to believe that the governor when his key appointees knew about this that he had no knowledge. Theres no evidence. You heard bridge kelly say that others in the Governors Office knew and David Wildstein say that the governor knew. So there are at least three different versions of the facts out there. The one where David Wildstein says the governor knew. Bridget kelly says folks in the Governors Office knew. Theres the report that has a different version and bill barone still claiming this is the traffic study. Yet the federal prosecutors looked at this for over a year. You have been investigating for over a year as well. Have you found any new evidence . Theres no direct evidence that the governor knew. But hes talking about this as if what happened on friday was a vindication that he had no involvement. Even in that press conference this does not implicate or exonerate him. It had absolutely no specific findings for him. The governor tweeted out he took action firing staff believed to be accountable. Isnt that what a governor is supposed to do . Absolutely. Hes supposed to fire the people accountable. We dont have all the answers yet. It is the new low in american politics is that at least i wasnt indicted. It seems to be a low standard because the governor appointed these people to high positions within his administration, one of them pled guilty and two indicted. Theres no direct evidence he knew about it. You say more to come from your committee. What more can you do that the u. S. Attorney didnt . We still have our legislative inquiry. Remember what the u. S. Attorney did was a criminal investigation to see if laws were broken and prosecution should follow. Thats not the role of the legislature. Our role is one of oversight and figuring out how to fix this problem. What do we need to do to reform the port authority. Its a huge agency. Most people dont appreciate its bigger than 26 states. Wastes a lot of money. This all came out of the port authority. We need to understand who gave the order to Bridget Kelly to do this so we can stop it from happening again. By the end of the week. Your take . I hope they come out better but its a city thats had a lot of trouble over the last few decades. Im struck by the contrast of new york. New york instituted broken windows policing. I think there were 2,300 murders in 1990 and 330 last year. Thats an amazing drop. New york is now safe. It was three times more dangerous 20 years ago. I think you need to have tough policing. Policeman should be held accountable when they do something wrong. But cannot abandon tough policing. And under governor omalley of baltimore. Crime went down a bit during his term. Lets hope someone like Marlin Mosley signals the future. No justice, no peace. Shes speaking to communities which has abusive discriminatory policing, communities of color been targeted and were seeing a history, a context, george. I think its about egregious policing. According to the aclu 109 people died in Police Custody since 2010. But its also about the need if its possible for a National Urban agenda. These communities are trapped in a prison of inequality of despair and joblessness. I think we have a transpartisan moment where people wont channel their inner nixon but channel new ideas of new kinds of police. It does seem we heard the senator tim scott. There seems to be some kind of consensus forming about reform of the criminal justice system. This has been building. Its across the board. When you have rand paul, Hillary Clinton, everybody on the same page, it seems to me if they think it is this much of a problem, we shouldnt wait until the president ial election to address it. If there is momentum, why dont they do it. This is where i think the rubber hits the road is what are the details . What kind of crimes are they going to allow people to walk away from . Is it gun possession. Gun possession has a lot to do with this. Is the left going to be okay with illegal gun possession, those crimes being reduced . Maybe so. Maybe thats appropriate. Theres a lot of agreement. Will they actually get something done . I believe so. I think criminal justice has got to be a big issue in the president ial campaign. I mean i was a governor and then congressman in the bill clinton on the years. The thing to do was tougher penalties on drug offenders, mandatory minimum sentences. Mass incarceration, build more prisons. That doesnt seem to have worked. I think what youre going to see is candidates talking about ways that we have not necessarily fewer prisons but job training. I think theres going to be more talk about income and equality. Thats going to be a big issue. Poverty. Inner city education. I think one of the big problems we have in the inner cities is these kids, these young kids need to get stronger schools and more education. We heard Bernie Sanders talking about income and equality. How serious a threat is he . Well, you just introduced Bernie Sanders to millions of americans. If the main stream media gives Bernie Sanders a chance, he is a real deal. Hes a buying big deal. You dont think he can win . There are obstacles but his message is in sync with the moment were in. He wants to fulfill the promise of america. This is not a country that is going to be defined by billionaires but lift up ordinary americans and deal with staggering income and equality. The climate crisis. Give people good jobs, not being held to corporate to find trade deals. Bernie sanders announced that he would consider running for president a year ago, lets give him a chance and the main stream media might distort others. But lets give bernie a chance. Popolous moment . I think it is. The answer is to lock up criminals. Bill clinton on the was right. Im disappointed to see Bill Richardson now abandoning his message. I think it is though a moment in the sense that middle class, working class americans would like to see policies that would help them more. The single best thing one could do for poor kids in baltimore or anywhere else is have more choice of schools. In new york there are terrific Charter Schools which bill de blasio is trying to shut down. Charter schools a competition. Break up the Teacher Union strength. I dont think so. Will any democratic run the way bill clinton on the did this year . Im doubtful. I think there has to be a balance and clearly i think we went to have on the mass incarceration i think the police have taken a bad rap. Its clear, we need more training of our police. More diversity in the police forces. We need like in baltimore they should have been more reactive. They should have moved faster. I think its a good debate. Im not abandoning bill clinton. I was just teasing you there. Its not even bill clinton. There are thoughtful republicans laying out alternatives. This is a moment for Real Solutions and not just calling for tough policing which we have seen blow up in cities. Epidemic after epidemic in these last months. Theres a balance. Also rethinking trade, not only crime. We talked to Bernie Sanders. President obama trying hard to get it passed. Hillary clinton not ready to declare where she stands. This is one of the biggest stories of the week. Even though some of my colleagues didnt agree with me because theres other bigger news. The debate about trade is fascinating. You hardly have any of the moderate democrats, sort of the 1990s, 2000s left. You have them rethinking their positions and you have president obama who has not had any deep relations with anybody in congress now having to struggle and is probably going to lose on the democratic side this trade fight. Im fascinated by it and i think Hillary Clinton you think its going to go down . I think theres a possibility that this trade bill does not get passed. I heard from a reliable Democratic Congress person that 84 of the house caucus is opposed to it. I remember the days on nafta. I was one of the very few that supported it when president clinton proposed it. It started building democrats and the majority will probably reject it. Trade authority will pass with republicans. You think republicans will come around . My worry is americas labor unions. They have been very useful, very good. My worry is that this is going to be another decline if a trade bill passes. I would like to see the house and senate put very strong labor worker rights, Environmental Standards in the trade agreement. But what bill is saying, you know, the trade unions and democrats arent against fair trade and globalization but the trade rules are being written by corporations and banks. It speaks to Bernie Sanders. He talks about the rigged rules that have been written for the few. We can do better. Before we go i want to talk about Chris Christie and the indictments on friday. He says still full speed ahead going back up to new hampshire. Any chance . He is going to town halls and trying to make his case. Some chance but not your typical republican race. The democrats are having the republican race. The republicans are having the democratic race with i think very well qualified governors, senators, former governors and so forth. I think thats christiess problem. There are plenty of people already in the field. Its not as if voters are looking around and saying we need Chris Christie. And this week alone, tomorrow youre going to have ben carson in the race. Carly is going Good Morning America and Mike Huckabee on wednesday. Let a thousand flowers bloom huh . I think the field is stronger than 2012 and had relief after you left politics and got to be on this side. Im having fun being an observer. I think theres a lot of substance and debates. Only three months away from the first republican primary debate. They got to make a move and at least have some sort of leadership position. Theyre going to need three or four tiers. Very interesting and had a chance to meet people. The governor has been out of that state and pretty good poll shows that bush, rand paul and rubio are leading in his own state. And walker is leading in iowa and new hampshire. Budget cuts and working people. Not popular. I was in the president ial race. I didnt last very long. I dont have a lot of expertise. I wouldnt count christie out. Its so early. Hes had a big blow with these indictments. I wouldnt i think huckabee, he controls a large vote of the religious right. I wouldnt discount him either. Obviously im not an expert. But i think walker, rubio have emerged. I still think in the end the republicans will see that their most viable candidate is jeb bush and Hillary Jeb Bush fight will be interesting and it could go either way. Thats my prediction.
